Abstract

The development and maturation of a child includes various physical, cognitive, social, and emotional aspects that are influenced by social events that continue to occur and have an influence on increasing the child's thinking and behavior. If not given enough attention in the process of growth and development, children can commit deviant behavior that is not in accordance with the norms, such as the brawl carried out by 17 ABG in Bogor that violated the law. The existence of this concept raises the question of whether there is a relationship between legal awareness and the acts of brawls committed by the 17 children and whether strengthening cooperation between law enforcement agencies and schools can increase students' legal awareness. The purpose of this paper is to examine and analyze the relationship between legal awareness with brawls and steps to increase legal awareness in students. The method used is normative juridical by examining legislation, textbooks, and articles related to the legal issues raised. The results obtained are that there is a relationship between legal awareness and the acts of brawls committed, namely adolescents who lack awareness of the law tend to commit juvenile delinquency and cooperation between law enforcement agencies and schools can increase adolescent legal awareness through socialization to learn the laws that exist in everyday life.

Abstract

Theft is the most prevalent crime in society. It involves an individual unlawfully taking property, either in whole or in part, from someone else with the intent to own it illegally.  The crime of theft itself is recognized in law and is a type of crime against individual interests that harms other people and the surrounding community.  The Criminal Code (KUHP) strictly prohibits these crimes and emphasizes that violators will be subject to detailed and severe punishments.  This is manifested in the form of punishment or threats of punishment imposed.  In the Old Criminal Code (KUHP) and the New Criminal Code (KUHP) regarding the crime of theft, actually there has not been a very big change, where there are differences in the articles, but in this case the substance and interpretation are still unclear.  too different.  Then there are also added types of criminal acts of theft and also differences related to criminal threats for each type of theft act.  This journal studies further the differences between criminal acts of theft in the old Criminal Code (KUHP) and the new Criminal Code (KUHP).

Abstract

The corruption case involving Harvey Moeis, with state losses reaching 271 trillion rupiah, has brought sharp scrutiny to the integrity and professionalism of judges in Indonesia. The public's perception of a lenient verdict has triggered allegations of violations of the judicial code of ethics, potentially undermining public trust in the judiciary. This study aims to analyze in depth the alleged violations of the judicial code of ethics in this case, as well as its impact on public trust. The research method used is a case study with a qualitative approach, through the analysis of documents, news, and literature studies. The results of the study indicate indications of violations of the judicial code of ethics, reflected in the significant disparity between the prosecutor's demands and the judge's verdict. The implications of this case are extensive, not only damaging the image of the judiciary, but also threatening the rule of law and justice in Indonesia.

Abstract

This study examines the role of ethics and professionalism of the police as law enforcers in maintaining public trust, with a case study of ethical and legal violations committed by Ferdy Sambo. This case highlights the gap between public expectations of the integrity of the police and the reality of practices in the field, which has an impact on the crisis of public trust in the police institution. The study uses a descriptive qualitative method through literature studies and data analysis from various news sources and related literature. The findings show that violations of the code of ethics and abuse of power by officers, especially in the case of Ferdy Sambo, worsen the image and legitimacy of the police institution. The failure of the internal monitoring system and the weak implementation of sanctions for ethical violations are the main factors in the decline in public trust. This study emphasizes the importance of implementing the principles of integrity, justice, and responsibility as stipulated in Law No. 2 of 2002 and Regulation of the Chief of Police No. 14 of 2011. This study also provides strategic recommendations to strengthen the monitoring system and enforcement of the code of ethics in order to restore public trust. Thus, improving ethics and professionalism within the police force is key to restoring the legitimacy and public trust in the police institution in Indonesia.

Abstract

This case shows how three judges of the Surabaya District Court were involved in bribery practices in the case of Gregorius Ronald Tannur's release. This article examines the bribery case of Judge Ronald Tannur as a reflection of ethical and professional issues in the legal field in Indonesia. The focus of this research is on how the ethical violations and breaches of the legal profession's code of ethics in that case have undermined the integrity of the Indonesian judicial system. This violates the principles of judicial independence and integrity regulated in Law No. 48/2009 on Judicial Power. This research shows the systemic consequences of such violations, such as a decline in public trust in the judicial system, an increase in perceptions of injustice, and challenges to the advancement of democracy and the rule of law. In addition, this article offers solutions to prevent the issues. This includes improving the internal-external oversight system, implementing a meritocracy system for the appointment of judges, and incorporating continuous professional ethics education. The results of this study indicate that structural reforms in the Indonesian judicial system are crucial for restoring public trust and ensuring the integrity of law enforcement.

Abstract

The unlawful detention case involving former Regent of Langkat, Terbit Rencana Perangin-angin, exemplifies a severe abuse of power leading to significant human rights violations. This article identifies various forms of this abuse and analyzes them from a human rights perspective, referencing national laws, such as Law No. 39 of 1999, and international instruments like the Convention Against Torture and ILO Convention No. 29 on forced labor. Using a qualitative approach and literature review, the study finds that the practices of unlawful detention, torture, and labor exploitation in the private prison constitute serious human rights violations, including potential human trafficking. This case highlights the inadequacies in oversight and accountability among local officials and underscores the urgent need for a comprehensive evaluation of Indonesia's human rights protection systems. The article recommends strengthening supervisory institutions, enforcing strict legal actions against offenders, and formulating policies to prevent similar abuses in the future.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi secara mendalam mengenai pelanggaran etika dalam ruang sidang dengan menyoroti kasus Firdaus Oiwobo sebagai studi kasus. Fokus utama penelitian ini adalah untuk memahami faktor-faktor yang menyebabkan terjadinya pelanggaran, dampaknya terhadap kepercayaan publik, serta langkah-langkah yang dapat diambil untuk memperkuat mekanisme pengawasan kode etik di lingkungan peradilan. Pendekatan yuridis dan analisis empiris akan digunakan untuk mengevaluasi efektivitas regulasi yang ada serta menawarkan rekomendasi kebijakan yang dapat meningkatkan kualitas penegakan kode etik profesi hukum. Penelitian ini menggunakan metode studi kasus normatif, yaitu metode yang menitikberatkan analisis pada norma hukum yang berlaku serta penerapannya dalam kasus konkret. Fokus penelitian ini adalah pelanggaran etika dalam ruang sidang yang terjadi pada kasus Firdaus Oiwobo serta bagaimana implikasinya terhadap sistem peradilan di Indonesia. Hasil kajian menunjukkan bahwa Kasus Firdaus Oiwobo menjadi contoh konkret bagaimana pelanggaran etika dapat berdampak serius terhadap karier seorang advokat serta kepercayaan publik terhadap profesi hukum.

Abstract

The Constitutional Court (MK) has a crucial role in upholding the supremacy of law and the constitution in Indonesia. However, the independence and integrity of MK judges are in the spotlight in MK Decision Number 90/PUU-XXI/2023 which changes the provisions on the age limit for presidential and vice presidential candidates. This decision has sparked controversy due to allegations of violations of the code of ethics by one of the MK judges who has a conflict of interest with the party benefiting from the decision. This study aims to analyze the effect of violations of the code of ethics by MK judges on the legitimacy and acceptance of MK decisions. The research method used is juridical-normative with a statutory regulatory approach and analysis of decisions and their impacts. The results of the study show that violations of the code of ethics can damage public trust in the MK and give rise to debate about the validity of the resulting decisions. In addition, non-compliance with the code of ethics has the potential to weaken the independence of the judiciary and create a bad precedent for the enforcement of constitutional law in the future. Therefore, a stricter oversight mechanism is needed for MK judges as well as strict enforcement of sanctions to ensure that the resulting decisions remain objective and based on the principle of justice.

Abstract

Our purpose in analyzing this case is aligned with the theme of "Violations of Law and Human Rights in Indonesia." This serves as the foundation for our selection of this case, with the aim that through discussion and awareness of legal and human rights violations, particularly within the scope of femicide in Indonesia, we can contribute to addressing this issue. As university students, we hope that cases of legal and human rights violations, including femicide, will decrease over time following the publication of this journal. Abstract

The bribery case involving Prosecutor Farizal represents the damaging impact of violations of professional ethics on the legitimacy of judicial institutions. The act is not only a violation of fundamental principles such as integrity and impartiality that should be upheld by every prosecutor, but also tarnishes the main values in Tri Krama Adhyaksa which are the moral foundation of the Indonesian Attorney General's Office. Farizal's involvement in corrupt practices also adds to the long list of cases of irregularities committed by law enforcement officers, thus deepening the crisis of public trust in the judicial mechanism in Indonesia. This study uses a normative legal method that relies on various written legal sources to answer the problems that have been formulated. The approach used in this study consists of a statutory regulatory approach and a case approach. Through the statutory regulatory approach, researchers examine relevant legal norms, especially those regulating the ethics of the prosecutor's profession and the form of legal accountability for violations committed by law enforcement officers. The results of the study show that the violation of professional ethics committed by Prosecutor Farizal in this bribery case reflects serious deviations that not only damage the integrity of the prosecutor's office, but also reduce public trust in the justice system. His actions, which involved accepting bribes to influence the legal process, are contrary to the basic principles of the Prosecutor's Code of Ethics and Code of Conduct, such as integrity, impartiality, and accountability.
