Abstract

Kesetaraan gender merupakan isu yang sering menjadi topik bahasan ketenagakerjaan di Indonesia. Salah satu Isu yang paling banyak dibahas jika dikaitkan dengan perempuan adalah banyaknya perempuan yang bekerja. Penelitian ini bertujuan untuk mengetahui tentang eksistensi pekerja perempuan sebagai bentuk keseteraan gender dalam perspektif al-Qur'an. Jenis penelitian ini adalah jenis penelitian kepusatakaan yang mengambil data-data primer maupun sekunder yang bersumber dari data kepustakaan seperti buku-buku, jurnal penelitian terbaru maupun prosiding. Adapun pendekatan yang digunakan adalah pendekatan sosiologis dan hermeneutik. Setelah data terkumpul, kemudian dianalisis dengan menggunakan metode tematik (maudhu'iy). Hasil dari penelitian ini didapatkan bahwa: 1) Perbedaan gender sesungguhnya tidaklah menjadi masalah sepanjang tidak melahirkan ketidakadilan gender (gender inequalities), 2) Laki-laki dan perempuan mempunyai kesempatan dalam menuntut ilmu dan mengamalkan apa yang mereka ketahui, hal ini berarti selama perempuan mampu dalam melakukan sebuah pekerjaan, sekalipun pekerjaan tersebut umumnya dikerjakan oleh laki-laki maka hal tersebut bukanlah larangan dan menyalahi aturan. Kesimpulan dari penelitian ini adalah banyak sekali ayat-ayat yang dijadikan bahan rujukan ketika membahas tentang kesetaraan gender yang umumnya digugat oleh kaum feminis. Ayat-ayat tersebut banyak ditafsirkan yang sampai pada kesimpulan bahwa laki-laki dan perempuan memiliki strata yang sama. Sama-sama memiliki kesempatan dalam menuntut ilmu dan mengamalkan ilmu tersebut, demikian pula untuk pekerjaan yang dipilih oleh perempuan sekalipun pekerjaan tersebut bersifat maskulin yang umumnya dikerjakan oleh laki-laki maka hal tersebut wajar dan sah-sah saja dalam Islam. Adapun saran dari peneliti bagi para perempuan yang bekerja adalah tetap memperhatikan kodratnya sebagai wanita terlebih dahulu. Bagaimanapun, kodrat perempuan adalah mengandung, melahirkan, dan menyusui anak, sehingga sebaiknya para perempuan pekerja membuat skala prioritas dengan mengutamakan keluarga bagi yang telah berkeluarga.

Abstract

Abstrak Pokok permasalahan penelitian ini adalah Bagaimana Tinjauan Hukum Islam Terhadap Penerapan Akad Rahn pada Pegadaian Syariah di Kantor Pegadaian Syariah Cabang Gowa. Penelitian ini menggunakan jenis penelitian kualitatif lapangan, yaitu jenis penelitian yang menggambarkan secara kualitatif mengenai objek yang dibicarakan sesuai kenyataan yang terdapat dalam masyarakat. Penelitian ini, menggambarkan tentang analisi prinsip ekonomi islam terhadap operasional produk investasi emas pada Pegadaian Syariah. Hasil penelitian menunjukkan bahwa dalam Tinjauan Hukum Islam, Penerapan Akad Rahn dapat dikatakan tidak bertentangan dengan Hukum Islam. Berdasarkan analisis peneliti, akad Rahn di Pegadaian Syariah Cabang Hasanuddin tidak melanggar aturan dari hukum Islam dan syariat Islam itu sendiri. Semua kegiatan masih berada dalam koridor syariat Islam. Secara garis besar, Pegadaian Syariah Cabang Hasanuddin Gowa menawarkan dua kategori produk, yaitu gadai dan non-gadai. Pada produk gadai, hanya terdapat satu produk yang disebut Gadai Rahn, sedangkan pada produk non-gadai terdapat Ar-rum haji dan Amanah. Pada produk gadai Rahn, Pegadaian Syariah Cabang Hasanuddin Gowa hanya menawarkan satu jenis transaksi, yaitu gadai Rahn semata. Pegadaian Syariah, tidak ada penerapan bunga. Biaya-biaya yang dikenakan di Pegadaian Syariah meliputi biaya pemeliharaan barang (mu'nah), biaya penitipan, biaya pemeliharaan, biaya penjagaan, dan biaya penaksiran. Implikasi penelitian ini Proses penerapan akad Rahn sebaiknya difasilitasi dan tidak terlalu rumit. Penting bagi Pegadaian Syariah Cabang Hasanuddin Gowa untuk menjelaskan secara rinci akad yang diterapkan, agar tidak terjadi ketidakjelasan dan memudahkan masyarakat dalam memahami proses selanjutnya, hal tersebut di rumuskan menjadi karya ilmiah dengan judul “Tinjauan Hukum Islam Terhadap Penerapan Akad Rahn Pada Pegadaian Syariah Cabang Hasanuddin Gowa.   Kata Kunci: Rahn, Jaminan, Arrum Haji   Abstract The main problem of this research is how to review Islamic law on the implementation of the Rahn Contract in Sharia Pawnshops in the Gowa Branch of Sharia Pawnshops. This research uses a type of field qualitative research, which is a type of research that describes qualitatively the object being discussed according to the reality that exists in society. This study describes the analysis of Islamic economic principles on the operation of gold investment products at Islamic Pawnshops. The results of the study show that in a review of Islamic law, it can be said that the application of the Rahn contract does not conflict with Islamic law. Based on the researcher's analysis, the Rahn contract at the Hasanuddin Branch Sharia Pawnshop does not violate the rules of Islamic law and Islamic law itself. All activities are still within the corridors of Islamic law. Broadly speaking, the Hasanuddin Gowa branch of Sharia Pawnshops offers two product categories, namely pawning and non-pawning. For pawn products, there is only one product called Pawn Rahn, while for non-pawn products there are Ar-rum haji and Amanah. For Rahn's pawn products, Hasanuddin Gowa Branch Syariah Pawnshop only offers one type of transaction, namely Rahn's pawn alone. Sharia Pawnshops, no interest is applied. The fees charged at Pegadaian Syariah include goods maintenance costs (mu'nah), safekeeping fees, maintenance fees, guard fees, and appraisal fees. Implications of this research The process of implementing the Rahn contract should be facilitated and not too complicated. It is important for the Hasanuddin Gowa Branch Sharia Pawnshop to explain in detail the contracts that are applied, so that there is no ambiguity and make it easier for the public to understand the next process, this is formulated into a scientific work entitled "Review of Islamic Law on the Application of Rahn Contracts at Hasanuddin Gowa Branch Sharia Pawnshops .   Keywords: Rahn, Assurance, Arrum Haji.

Abstract

This study aims to analyse the Qur'anic verses related to the rights and obligations of husband and wife, as well as explore ways to contextualise these verses in an effort to prevent domestic violence (KDRT) in the modern era. This research uses a qualitative approach with the type of library research. The data used is secondary data, which includes the Qur'an, Hadith, books, and articles relevant to the topic of discussion. The results of the analysis show that the Qur'an emphasises the principles of love (mawaddah wa rahmah), good treatment of spouses, equality in husband and wife relations, and responsibility as a family leader, which are the foundation for the creation of a harmonious household. These principles serve as a theological foundation in the prevention of domestic violence. A correct understanding of Qur'anic verses can be an effective solution to domestic violence, especially in highly religious societies such as Indonesia. This study recommends the education of Qur'anic values in premarital programmes, strengthening the role of religious institutions, and formulating policies based on Islamic principles as an effort to prevent domestic violence. This approach is expected to create harmonious families and a society free from violence in accordance with Qur'anic values.

Abstract

Local traditions as religious practices in Indonesian society experience dialectic and integration of Islamic teachings. Every ethnicity in Indonesia has socio-cultural mechanisms in dealing with calamities and disasters which are influenced by religion and customs. This then dialectic with the practice of Islamic law. The study seeks to examine songkabala, a tradition of mutual acceptance in the Makassarese society. These traditions are local values that contain Al-Qur’anic teachings. This is an empirical legal study employing an anthropological perspective on Islamic law. In-depth interviews and literature reviews focused on three districts inhabited by Makassarese, namely Maros, Gowa, and Takalar, were employed to collect data. The study indicates that songkabala is the spirit of Al-Qur’anic verses associated to human responses to calamity, including remembrance of Allah, gratitude, and ritualized prayer. Songkabala is a Makassarese folk tradition that contains Al-Qur’anic themes. The verses of the Al-Qur’an indicate that the command to pray and the remembrance of Allah are incorporated into the songkabala ritual. Consequently, there is no incompatibility between the songkabala tradition and the teachings of the Al-Qur’an.

Abstract

This study aims to identify the concept of work ethic in the Qur'an that is relevant to be applied in the Industry 5.0 era, which is marked by technological advances and changes in the paradigm of the world of work. Work ethic according to the Qur'an reflects the Islamic view of the importance of work as a form of worship to Allah SWT. This study uses a library research method, with data collection stages that include searching for references to analyzing related sources. Data sources were obtained through a literature review of books, journals, the internet, and other media. The results of the study show that work ethic in the Qur'an is reflected in the Word of Allah SWT, which teaches that every Muslim must have a work ethic in accordance with the instructions of the Qur'an, so that they can become professional, reliable individuals and provide benefits to society. This study provides a deeper understanding of the application of work ethic values ​​in the Qur'an to face challenges and changes in the modern world of work.

Abstract

Abstrak Tujuan Penelitian ini adalah untuk mengetahui Akad murabahah dan relevensinya dengan tafsir Al-qur’an Surah Al-Baqarah Ayat 275 Tentang Jual Beli, Karenanya begitu penting Allah membicarakan tentang jual beli dan kedudukannya. Analisa-analisa para mufassir sangat beragam. Kenyataan praktik di lapangan tentang jual beli dan riba tidak sepi dibicarakan sepanjang zaman dan relevansinya dengan akad murabahah. Metode yang digunakan dalam penelitian ini adalah pendekatan deskriptif kualitatif dengan studi tafsir teks-teks Al-Qur'an yang relevan, Sumber utama dalam kajian ini adalah kitab-kitab tafsir dengan tujuan hendak mengetahui jual beli menurut para mufasir. Hasil temuan ini adalah bahwa Allah menginginkan jual beli benar-benar halal, terhindar dari praktik riba, transaksi akad murabahah, dan penanggungan resiko sepihak sehingga di dalam praktik jual beli terbangun prinsip kutauhidan, kemanusiaan, keadilan dan kedamaian. Kata Kunci: Jual Beli, Murabahah, Al-Qur’an Abstract The purpose of this research is to find out the murabaha account and its relevance to the interpretation of the Qur'an Surah Al-Baqarah Verse 275 about buying and selling, therefore it is so important that Allah talks about buying and selling and its position. The analyses of the mufassirs are very diverse. The reality of the practice in the field about buying and selling and usury is not quiet discussed throughout the ages and its relevance to the murabaha contract. The method used in this research is a descriptive qualitative approach with a study of the interpretation of relevant Qur'anic texts. The main source in this study is the books of interpretation with the aim of knowing buying and selling according to the mufasirs. The result of this finding is that Allah wants buying and selling to be truly halal, avoiding usury practices, murabaha contract transactions, and unilateral risk bearing so that in the practice of buying and selling the principles of kutauhidan, humanity, justice and peace are built. Abstrak Berwisata adalah salah satu aktivitas manusia untuk yang dianjurkan agama islam sebagai penghilang rasa jenuh, menambah pengetahuan, dan bersenang-senang. Islam adalah. MUI telah mengeluarkan fatwa No. 108/DSN-MUI/x/2016 tentang Pedoman Penyelenggaraan Pariwisata Berdasarkan Prinsip Syariah, salah satu wisata syariah yang ada di Indonesia tepatnya di Kabupaten Wajo bernama Wisata Syariah Tellaga Biru Park. Tujuan dari penelitian ini untuk mengetahui Sistem Pelayanan dan Pengelolaan yang diterapkan Wisata Syariah Telaga Biru Park di Kabupaten Wajo, Untuk  dan mengetahui pendapat pengurus MUI tentang keberadaan Wisata Syariah Telaga Biru Park di Kabupaten Wajo, dan untuk mengetahui implementasi Fatwa MUI Nomor: 108/DSN-MUI/X/2016 tentang Pedoman Penyelenggaraan Pariwisata Syariah Berdasarkan Prinsip Syariah terhadap Wisata Syariah Telaga Biru Park di Kabupaten Wajo. Penelitian ini merupakan penelitian kualitatif atau penelitian lapangan (field research). Data yang dikumpulkan menggunakan metode pengumpulan data melalui observasi, wawancara dan dokumentasi. menunjukkan bahwa 1). Mekanisme pengelolaan dilakukan oleh pengurus pondok pesantren dan masyarakat sekitar, dan pelayanan wisata syariah telaga biru park dilaksanakan dengan baik dengan fasilitas yang memadai. 2). Praktik di wisata syariah telaga biru park belum sepenuhnya menerapkan Fatwa DSN DSNMUI No: 108/DSN-MUI/X/2016 tentang Pedoman Penyelenggaraan Pariwisata Berdasarkan Prinsip Syariah. Hal ini dapat dilihat dari belum ada fasilitas pembatas kolam pemisah kolam laki-laki dan perempuan yang tertutup sehingga lekukan tubuh yang disebabkan menempelnya pakaian pada tubuh saat berenang bisa terlihat oleh lawan jenis, dan masih ada pengunjung laki-laki yang suka kekolam perempuan saat pengawas kolam lengah begitu juga sebaliknya. 3). Pihak MUI Wajo tidak keberatan dan jutsru mengapresiasi wisata syariah telaga biru park selama tetap menjaga norma agama, namun belum ada peninjauan secara resmi dari lembaga MUI Wajo ke wisata syariah telaga biru park. MUI has issued fatwa no. 108/DSN-MUI/x/2016 concerning Guidelines for Organizing Tourism Based on Sharia Principles, one of the sharia tourism in Indonesia, precisely in Wajo Regency, is called Tellaga Biru Park Sharia Tourism. The purpose of this research is to find out the Service and Management System implemented by Telaga Biru Park Sharia Tourism in Wajo Regency, to find out the opinion of MUI administrators regarding the existence of Telaga Biru Park Sharia Tourism in Wajo Regency, and to find out the implementation of MUI Fatwa Number: 108/DSN- MUI/X/2016 concerning Guidelines for Implementing Sharia Tourism Based on Sharia Principles for Telaga Biru Park Sharia Tourism in Wajo Regency. This research is qualitative research or field research (field research). Data collected used data collection methods through observation, interviews and documentation. shows that 1). The management mechanism is carried out by the boarding school administrators and the surrounding community, and Telaga Biru Park sharia tourism services are carried out well with adequate facilities. 2). Practices in Telaga Biru Park sharia tourism have not fully implemented DSN MUI Fatwa No: 108/DSN-MUI/X/2016 concerning Guidelines for Organizing Tourism Based on Sharia Principles. This can be seen from the fact that there are no closed pool dividing facilities separating men's and women's pools so that the curves of the body caused by clothing sticking to the body when swimming can be seen by the opposite sex, and there are still male visitors who like to go into the women's pool when the pool supervisor careless and vice versa. 3). The Wajo MUI does not mind and actually appreciates the Telaga Biru Park sharia tourism as long as it maintains religious norms, however there has been no official review from the Wajo MUI institution regarding the Telaga Biru Park sharia tourism. Abstract

This study aims to analyze and formulate applicable ihdad rights for career women within the framework of the Counter Legal Draft Compilation of Islamic Law. Counter Legal Draft KHI is a legal product of Islamic law reform in Indonesia. The material contained in the KHI is considered gender bias against women, so CLD-KHI was born which aims to revise the article on gender bias in the KHI. With one of the approaches used in formulating laws based on gender equality so that the role of women in society that has undergone significant evolution, including in terms of education, career, and active participation in economic life does not reduce women's rights. This research is classified as library research type, data is collected by reviewing and reviewing various books that have relevance to the subject matter, and then using primary and secondary data sources, with normative analysis research methods on various sources of Islamic law, legal documents, and related literature. This research also involves a comparative approach to compare the views of different schools of Islamic law regarding ihdad rights and their context in the lives of career women today. The results showed that it is necessary to reformulate ihdad rights in order to accommodate the aspirations and real conditions of career women. This reformulation should take into account just and balanced inheritance rights, without neglecting fundamental principles of Islamic law. In addition, it is also necessary to integrate social, economic, and cultural aspects in consideration of the formulation of new ihdad rights. This research contributes in the face of social change and the demands of gender equality in the context of Islamic law. It is hoped that the resulting ihdad rights formulation can provide guidance for legislators and legal practitioners in developing more inclusive and fair regulations for career women, while adhering to fundamental Islamic legal principles.

Abstract

This study aims to analyze how the urgency of implementing the green economy on the maintenance of the human soul (Hifz Nafs) perspektif al quran. This research is a qualitative study by conducting library research. The data in the study was obtained by conducting content analysis of sources that have relevance to the topic of research conducted. The results of the study indicate that the importance of implementing the green economy concept in the economy is First, in general, environmental damage that occurs comes from economic activities carried out by individuals in households and by industry. Second, environmental maintenance is part of maintaining human survival (hifz Nafs), and environmental damage is a threat to human survival. Third, the concept of green economy is in line with the goals of the Indonesian national economy as stated in the Constitution Article 33 paragraph 4. Fourth, in the Koran it is clearly stated that the purpose of humans being created was as caliphs who were responsible for making the earth prosperous, not vice versa.

Abstract

This study aims to find out how Q.S. al-Żāriyāt verse 19 describes the condition of poverty in the perspective of Islam, to find out what the relationship is between this verse and the principles of welfare in the perspective of thematic interpretation, and to find out how Islam's solution to poverty is reflected in Q.S. al-Żāriyāt verse 19. This research is a library research. The results of this study are that Q.S. al-Żāriyāt verse 19 describes poverty in Islam as a condition that not only involves material deficiencies, but is also related to social, moral, and spiritual aspects. In the thematic interpretation of Q.S. al-Żāriyāt verse 19, the principles of welfare in Islam contained in this verse emphasize the importance of attention to those who do not beg, and the fulfillment of the rights of the poor as part of a greater social responsibility. In Q.S. al-Żāriyāt verse 19, there is an emphasis on paying attention to two types of poverty, namely those who beg and those who do not beg. Islam emphasizes the obligation to provide assistance to both, by maintaining their honor and paying attention to their overall welfare and offering solutions to create equitable prosperity in society.
