Abstract

An important aspect related to the crime of terrorism is human rights. Terrorism is essentially the destruction of human values, national dignity, and religious norms. Therefore, it is mandatory to provide legal protection to victims of terrorism as stated in Undang Undang No. 15 Tahun 2003 because in reality, victims of crime have not received adequate protection. The problem is interesting to study, regarding the implementation of legal protection for victims of criminal acts and Orientation of Regulations that regulate the rights of victims of criminal acts of terrorism have sufficient needs to support the defense and security efforts of the state The method used is normative juridical emphasizing the study of library materials and the disclosure of the meaning of a positive legal norm. In the Indonesian context, various relative rehabilitation and reintegration programs have also established several institutional instruments and special anti-terrorism task forces. Value orientation, TNI involvement is based on the consideration that terrorism crimes that have occurred in Indonesia are serious crimes that endanger the state ideology.

Abstract

This journal writing discusses the role of the TNI as Indonesia's front guard and defense in facing the Free Papua Organization (OPM) which has occurred since pre-reformation, post-reformation, and even now based on the laws and regulations in force in Indonesia. Indonesia. This research method uses methods. This writing method uses a literature approach which takes as its basis the laws and regulations in force in Indonesia and uses a descriptive analysis method, namely by analyzing existing problems and the role of the Indonesian National Army as the main force of defense and national security. The role of the Indonesian National Army (TNI) as the front guard and defense of the country in facing other acts of terrorism from the Free Papua Organization (OPM) is emphasized in Law no. 34 of 2004 concerning the Indonesian National Army in chapter VI concerning the deployment and use of TNI forces. The TNI as a component of national defense and national defense is correct in implementing existing regulations in Indonesia. However, acts of terrorism that are still occurring today must be used as evaluation material to further refine military strategies in this case so that the OPM conflict can be resolved quickly.

Abstract

Law criminal responsibility adopted by the Indonesian criminal law and the environmental law are regulated in Law Number 32/ 2009 on Environmental Protection and Management is only a fault liability. The principle of fault liability based complicate law enforcement in the process of criminal evidence. Law Number 32/ 2009 on Environmental Protection and Management of the Environment has set a strict liability issue but nevertheless the strict liability only obligate to pay compensation in the event a civil lawsuit. Criminal law recognize the strict liability. Strict liability is defined as liability without fault is criminal liability without proof of fault further to the offender. In criminal cases involving corporate environment needs to be applied the principle of strict liability, so that the strict liability can be expanded application not only to the claim for damages in civil cases but can also be done in the legal protection of penal law. Is expected with the integration of law will be able to simplify the process of proving crime against violation of environment by the corporation. This research aims to determine the corporate criminal liability based on the principle of Strict Liability and its implication in the process of proving environmental criminal.

Abstract

The legal consequence of this decision was that the Constitutional Court granted the lawmakers a two-year period to amend the Job Creation Law, following a process that adheres to a clear, standardized, and established method for creating omnibus laws. The Constitutional Court's Decision No. 91/PUU-XVIII/2020 was subsequently followed by the government issuing Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation, which contains similar content to the Job Creation Law. This has sparked controversy within the public. Therefore, the issue that will be further examined in this research is how the creation of the Job Creation Government Regulation In lieu of Law complies with the Constitutional Court's Decision No. 91/PUU-XVIII/2020, which declared the law conditionally unconstitutional, and how the harmonization between the Job Creation Government Regulation In lieu of Law and the legal reasoning in the Constitutional Court's decision is achieved. The research method used in this study is a normative juridical approach, which emphasizes library research. This study is descriptive-analytical, with the research stages focusing on secondary data analysis. Data collection techniques include library research and field research through interviews with relevant parties. The results of the study show that the lawmakers did not comply with the Constitutional Court's Decision No. 91/PUU-XVIII/2020, as they did not amend the Job Creation Law as required by the decision. Instead, they chose to issue the Job Creation Government Regulation In lieu of Law. Regarding the harmonization between the Job Creation Government Regulation In lieu of Law and the legal reasoning in the Constitutional Court's Decision No. 91/PUU-XVIII/2020, a lack of harmonization between the two was found.

Abstract

AbstrakJurnal ini bertujuan untuk menganalisis dan membandingkan sistemketatanegaraan di Amerika Serikat dan Indonesia, serta mengkajiimplikasinya terhadap stabilitas politik nasional masing-masing negara. Kedua negara, meskipun memiliki latar belakang sejarah dan budaya yangberbeda, sama-sama menganut sistem pemerintahan presidensial. Namun, terdapat perbedaan signifikan dalam struktur kelembagaan, mekanismepemilu, serta hubungan antara lembaga-lembaga negara. Analisis komparatifini akan mengidentifikasi persamaan dan perbedaan mendasar dari keduasistem tersebut, dengan fokus pada prinsip-prinsip pemisahan kekuasaan, sistem check and balances, serta peran partai politik. Selain itu, jurnal ini jugaakan mengeksplorasi bagaimana perbedaan-perbedaan tersebut berdampakpada stabilitas politik di masing-masing negara. Studi ini menyimpulkanbahwa meskipun kedua negara memiliki sistem pemerintahan yang serupa, terdapat perbedaan yang signifikan dalam praktik politiknya. Perbedaantersebut memiliki implikasi yang kompleks terhadap stabilitas politik nasional. Melalui studi komparatif ini, diharapkan dapat memberikan kontribusi dalampemahaman yang lebih mendalam mengenai dinamika politik di kedua negara, serta memberikan masukan bagi upaya penguatan stabilitas politik diIndonesia. The two countries, even thoughthey have different historical and cultural backgrounds, both adhere to apresidential system of government. However, there are significant differencesin institutional structures, electoral mechanisms, and relationships betweenstate institutions. This comparative analysis will identify the basic similaritiesand differences between the two systems, focusing on the principles ofseparation of powers, the system of checks and balances, and the role ofpolitical parties. Apart from that, this journal will also explore how thesedifferences have an impact on political stability in each country. This studyconcludes that although the two countries have similar government systems, there are significant differences in political practices. These differences havecomplex implications for national political stability. Through this comparativestudy, it is hoped that it can contribute to a deeper understanding of politicaldynamics in the two countries, as well as provide input for efforts tostrengthen political stability in Indonesia. Abstract

This study investigates social conflict in Wadas Village from the perspective of Structuralist social conflict, focusing on interactions between the government and local communities in the context of andesite mining development plans. A qualitative approach with case studies was used to explore the dynamics of this conflict, collecting data from literature studies and involving in-depth interviews with various related parties. Research subjects include the Wadas Village community as a group directly affected and the government as the force that initiates and regulates the development process. This research reveals that these conflicts do not simply stem from individual or local disputes, but more deeply from structural inequalities in access to and control over resources and development decisions. The government, in its role as the highest structure, dominates the development process without adequately considering the interests and aspirations of local communities who are often marginalized. This creates significant tension between the bourgeois class who have greater economic and political access and the proletarian class who rely on local resources for their livelihood. The results of this research highlight the need for structural reforms in development policies that are more inclusive and equitable, as well as increasing community participation in decision making regarding natural resources. The implications of these findings can help in designing policies that are more responsive to local needs, reduce social tensions, and promote economically, socially, and environmentally sustainable development in the region.

Abstract

Penyalahgunaan antibiotik di Indonesia telah menjadi masalah yang serius, berkontribusi pada resistensi antibiotik yang mengancam efektivitas pengobatan dan meningkatkan beban sistem kesehatan. Penelitian ini bertujuan untuk mengidentifikasi faktor penyebab penyalahgunaan antibiotik, mengevaluasi efektivitas regulasi yang ada, mengidentifikasi tantangan dalam penegakan hukum, serta mengusulkan solusi untuk meningkatkan penerapan hukum dalam mengatasi masalah ini. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta pengumpulan data melalui studi kepustakaan dan wawancara semi-terstruktur. Hasil penelitian menunjukkan bahwa tantangan utama dalam penerapan hukum terkait penyalahgunaan antibiotik adalah kurangnya kesadaran masyarakat, pengawasan yang lemah, dan distribusi yang tidak terkontrol. Meskipun regulasi telah ada, implementasinya masih terbatas. Solusi yang diusulkan meliputi penguatan regulasi, penegakan hukum yang lebih tegas, serta peningkatan kerja sama antara pemerintah, sektor kesehatan, dan masyarakat. Penelitian ini menyimpulkan bahwa untuk menjaga keamanan kesehatan masyarakat, perlu ada upaya lebih dalam memperbaiki penerapan hukum guna mengurangi penyalahgunaan antibiotik dan mencegah resistensi antibiotik. Misuse of antibiotics in Indonesia has become a serious issue, contributing to antibiotic resistance, which threatens the effectiveness of treatments and increases the burden on the healthcare system. This study aims to identify the factors causing antibiotic misuse, evaluate the effectiveness of existing regulations, examine challenges in law enforcement, and propose solutions to improve the implementation of laws addressing this problem. The method used in this research is normative juridical research with a statutory and conceptual approach, including data collection through literature studies and semi-structured interviews. The results indicate that the main challenges in law enforcement related to antibiotic misuse are a lack of public awareness, weak supervision, and uncontrolled distribution. Although regulations are in place, their implementation remains limited. Proposed solutions include strengthening regulations, enforcing laws more strictly, and fostering greater cooperation between the government, health sector, and the public. This study concludes that to ensure public health is safeguarded, more efforts are needed to improve the enforcement of laws aimed at reducing antibiotic misuse and preventing antibiotic resistance.

Abstract

Penelitian ini bertujuan untuk mengetahui seberapa layak akses kesehatan yang didapatkan oleh masyarakat kurang mampu di Indonesia sebagai bagian dari pemenuhan Hak Asasi Manusia bagi tiap warga negara. Metode yang digunakan dalam penelitian ini adalah pendekatan kualitatif dengan analisis deskriptif terhadap data sekunder yang diperoleh dari laporan kebijakan pemerintah, studi kasus, serta literatur yang relevan tentang sistem kesehatan di Indonesia. Hasil penelitian menunjukkan bahwa meskipun terdapat upaya peningkatan dalam sistem kesehatan melalui Jaminan Kesehatan Nasional (JKN), hambatan utama yang masih dihadapi oleh masyarakat miskin adalah biaya, aksesibilitas layanan di daerah terpencil, dan kurangnya penyuluhan kesehatan. Selain itu, masih terdapat ketimpangan dalam kualitas layanan kesehatan antara wilayah perkotaan dan pedesaan. Kesimpulan dari penelitian ini adalah bahwa untuk mewujudkan sistem kesehatan yang inklusif dan berkeadilan, dibutuhkan reformasi kebijakan yang lebih fokus pada perluasan cakupan JKN, pengembangan skema pembiayaan yang fleksibel, dan peningkatan kualitas infrastruktur kesehatan, terutama di daerah-daerah terpencil. Selain itu, pemberdayaan masyarakat melalui edukasi dan pendampingan juga sangat penting untuk memastikan akses yang merata bagi seluruh lapisan masyarakat, terutama mereka yang kurang mampu. This study aims to determine how feasible access to health is obtained by underprivileged communities in Indonesia as part of the fulfillment of human rights for each citizen. The method used in this research is a qualitative approach with descriptive analysis of secondary data obtained from government policy reports, case studies, and relevant literature on the health system in Indonesia. The results show that despite efforts to improve the health system through the National Health Insurance (JKN), the main obstacles still faced by the poor are cost, accessibility of services in remote areas, and lack of health counseling. In addition, there are still disparities in the quality of health services between urban and rural areas. The conclusion of this study is that to realize an inclusive and equitable health system, policy reforms are needed that focus more on expanding JKN coverage, developing flexible financing schemes, and improving the quality of health infrastructure, especially in remote areas. In addition, community empowerment through education and mentoring is also very important to ensure equitable access for all levels of society, especially those who are less well-off.

Abstract

Human Rights (HAM) are rights that are inherent from the time humans are born and cannot be separated from humans at all, as well as a legal concept as well as a characteristic of a legal state which aspires and states that humans have rights related to themselves as individuals, and also is a deep and complex issue. So that the state is fully obliged to respect the citizenship status of its citizens, and prevent violations of human rights. The research method applied in this paper is the normative juridical method, namely legal research carried out by studying library materials or secondary data as a basis for analysis. This research was carried out by exploring the laws and regulations in force in Indonesia and literature related to the problems discussed in this paper. In a democratic society, human rights are considered a fundamental principle, which must be safeguarded and protected by the government. Meanwhile, state administration is a system of state regulation and administration based on law. The two are certainly interconnected and bound. Human Rights (HAM) in Indonesia are a very complex issue where every human being is attached to basic rights that have been destined since birth. This right must be respected, respected and protected by the state. Of all the challenges and hopes mentioned, human rights protection in the context of state administration in Indonesia has a fundamental role.

Abstract

Sehubungan dengan berlangsungnya tahapan kontestasi Pemilu 2024 di Indonesia, saat ini tingkat kesadaran bela negara warga negara Indonesia mulai luntur sehingga muncul sikap fanatisme yang negatif maupun kelompok masyarakat yang terkotak – kotak. Munculnya fanatisme yang berlebihan dari rakyat Indonesia ini maka menimbulkan banyak konflik baru seperti maraknya berita hoax, politik adu domba, kampanye fiktif, kampanye hitam, pencemaran terhadap nama baik seseorang, ujaran kebencian, hingga politik SARA yang sangat mengganggu ketertiban masyarakat Indonesia. Oleh karena itu, penelitian ini akan membahas pola tingkah laku warga negara Indonesia untuk menghadapi Pemilu 2024, serta mengkaji apa saja upaya pemerintah Indonesia bersikap terhadap lunturnya semangat bela negara Indonesia dalam menghadapi Pemilu 2024. Metode penelitian yang digunakan penulis adalah metode yuridis normatif yakni dengan cara mengumpulkan berbagai data informasi dari data sekunder, seperti buku, produk hukum undang - undang, e-book, jurnal ilmiah, dan penelitian terdahulu. Dengan adanya berbagai upaya pemerintah Indonesia untuk meningkatkan serta menjaga semangat bela negara rakyat Indonesia dalam ikut pemilihan umum 2024, diharapkan Pemilu 2024 bisa menghasilkan pemimpin yang terpilih berperilaku integritas kebangsaan bela negara yang tinggi berdasarkan dengan kepuasan mayoritas pemilihnya.
