Abstract

This study aims to; first, identify the problems and needs of the East Kalimantan Province in an effort to implement regional autonomy. Second, to formulate a regional autonomy policy model based on the fulfillment of regional and territorial needs in East Kalimantan Province. The research method used is sociological legal research (empirical juridical). Where the research location is at the East Kalimantan Provincial Government office and the East Kalimantan Provincial DPRD located in Samarinda city. The types and sources of data used are primary data and secondary data. The primary data collection techniques are interviews and public discussion forums or FGDs with related apparatus. Literature study to complement secondary data and data analysis in this study is classified as qualitative with deductive inference. The impact of the implementation of regional autonomy has an impact on the determination of regional policies in responding to all the problems that arise so that a regional autonomy implementation strategy is needed in accordance with the needs of the region and the conditions of the region. Regional autonomy must be in accordance with regional needs so that it has an impact on regional independence, community welfare, justice in terms of natural resource management, regional financial capacity and environmental damage, democracy and upholding human rights in accordance with the constitution and equity in terms of economy and infrastructure.

Abstract

Economic development will develop quickly if a green economic system is adopted. a green economic system that is oriented towards the relationship between ecosystem nature and the presence of human resource elements by prioritizing knowledge and technology. Changes in the economy from previously only about profit and welfare to a green economy that has environmental principles. Samarinda, as a supporting city for IKN, is one of the cities in East Kalimantan Province which is the center of attention for rice competitions. It cannot be denied that many immigrants who come do not bring the skills to become PMKS in Samarinda City. Referring to the principles of a green economy, namely prioritize quality, follow nature, waste can be recycled etc. The problem formulation of this research is regarding the legal arrangements for handling and handling empowerment people with social welfare problems in the form of policing in green spaces and what form of policy the Samarinda City Government takes in empowering people with social welfare problems through a green economy approach that prioritizes a livable city structure. The aim of this research is to find out legal regulations from an administrative and criminal perspective even civil law due to the relationship between the Samarinda City Government and the Community Incumbent Social Welfare Issues. Apart from that, to analyze the policy formulation of the Samarinda City government which prioritizes structuring room cities to reduce the risk of environmental damage. The conclusion of this research is that in terms of the legal structure it is adequate, where the Samarinda City Social Service is to assist in terms of empowerment while the Satpol-PP is tasked with carrying out handling. Substance the law is still there Not yet adequate, one of which is that the old regional regulations are still used and there are no guardians. Meanwhile, legal culture is also becoming Wrong Where is education for the community so that not giving money to PMKS and the lack of deterrent not giving money to PMKS and the lack of deterrent effect on those who have received training.

Abstract

Meaningful participation in lawmaking can be understood as important input or suggestions to ensure the validity and relevance of legal products. The idea of meaningful participation emphasizes the importance of the community's role in the law-making process, especially in the formation of ideal local regulations (Perda) to support the implementation of regional autonomy. This research aims to examine the application and implications of meaningful participation in the formation of ideal local regulations, using a juridical-normative approach through three approaches: 1) statutory approach, by examining relevant regulations; 2) conceptual approach, by examining the values contained in the underlying legal concepts. This research uses primary, secondary, and tertiary legal materials to produce an ideal local regulation model in the implementation of regional autonomy. The results show that meaningful community participation is a crucial element in creating local policies that are inclusive, transparent, and responsive to community needs. The process of local regulation formation must substantially involve the community, expand public participation mechanisms, and increase transparency and the role of the legislature. Thus, meaningful participation will strengthen the legal and social legitimacy of regulations, and support the creation of democratic and accountable regional autonomy. The formation of ideal local regulations not only ensures the achievement of effective and transparent governance, but also strengthens public trust in local governments. Public participation is not just a procedure, but must be understood as the core of democracy that emphasizes the right of the people to be heard, considered, and explained for the decisions taken.

Abstract

Cryptocurrency has emerged as a global innovation since the launch of Bitcoin in 2009, underpinned by blockchain technology that offers enhanced efficiency and transparency. Despite its potential, cryptocurrency presents complex legal challenges, particularly concerning its regulatory status. In Indonesia, cryptocurrency faces a dual regulatory framework: it is prohibited as a means of payment by Bank Indonesia pursuant to Law No. 7 of 2011 on Currency, yet simultaneously recognized as a tradable investment commodity by the Commodity Futures Trading Regulatory Agency (Bappebti). This study aims to analyze the implications of this duality for Indonesia’s national regulatory system. Using normative legal research and a statutory approach, the study reveals significant legal uncertainty arising from institutional regulatory inconsistencies. Such uncertainty may impede innovation and compromise consumer protection. Therefore, regulatory harmonization is essential to ensure legal certainty and adaptability, drawing on the theories of legal certainty and progressive law.

Abstract

The inti-plasma partnership scheme in the oil palm plantation sector aims to create a mutually beneficial relationship between large companies (nucleus) and smallholders (plasma). However, in practice, there are often inequalities that cause plasma farmers to lose control over their businesses. This research analyzes the violation of the partnership agreement between PT Hardaya Inti Plantations (PT HIP) and Koperasi Tani Plasma Amanah as decided in KPPU Decision No. 02/KPPU-K/2023. The focus of the analysis includes the forms of juridical, financial, and operational control that PT HIP exercised over the cooperative, as well as the legal implications based on Jeremy Bentham's theories of civil law, competition, and justice. The results show that PT HIP has abused its dominant position by fully controlling the partnership agreement, limiting cooperatives' access to decision-making, and implementing non-transparent financial practices. KPPU has imposed administrative sanctions in the form of an agreement addendum obligation, an independent audit, and a fine of Rp1,000,000,000.00. However, an evaluation of this decision indicates that the sanction has not fully provided substantive justice for plasma farmers, given the absence of a direct compensation mechanism. Therefore, there is a need to strengthen regulations and implement more effective monitoring and law enforcement mechanisms to ensure fairer and more sustainable partnership relationships in the oil palm plantation industry in Indonesia.

Abstract

Penelitian ini bertujuan menganalisis implikasi disrupsi sistem proporsional terbuka terhadap legitimasi rakyat, mengevaluasi kelemahan regulasi dan praktik politik elektoral, serta merumuskan arah reformasi hukum dan kelembagaan guna memperkuat representasi demokratis di Indonesia. Metode penelitian yang digunakan adalah pendekatan doctrinal yuridis normatif dengan fokus pada analisis norma hukum positif, teori hukum, dan prinsip-prinsip demokrasi dalam konteks sistem pemilihan umum. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, putusan pengadilan, dan literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa disrupsi terhadap sistem proporsional terbuka telah menimbulkan paradoks demokrasi, dimana keterbukaan partisipasi rakyat yang luas yang awalnya memiliki cita-cita dalam memberikan kesempatan legitimasi rakyat justru tergantikan oleh dominasi oligarki partai dan praktek politik transaksional. Realitas tersebut, melemahkan representasi substantif dan memperburuk keberadaan fragmentasi politik yang berdampak pada stagnasi konsolidasi demokrasi sesuai amanat konstitusi negara Indonesia, serta berkurangnya efektivitas pemerintahan dalam melaksanakan kewenangan secara transparan maupun berintegritas. Oleh karena itu, diperlukan reformasi progresif yang berkelanjutan dan menitikberatkan pada penguatan kelembagaan partai politik, transparansi pendanaan kampanye, serta rekonstruksi regulasi pemilu yang menegaskan kembali nilai-nilai keadilan representatif pada sistem proporsional terbuka. Reformasi tersebut, diharapkan mampu mengembalikan sistem proporsional terbuka pada esensinya, yakni menjamin kedaulatan rakyat melalui proses politik yang lebih akuntabel, inklusif, dan berintegritas tinggi, sehingga dapat memperkuat legitimasi demokrasi di Indonesia

Abstract

General Background Civil servants hold a central position in public administration, yet dishonourable discharge decisions must comply with legality, justice, and good governance principles. Specific Background This study examines the annulment of State Administrative Decisions concerning dishonourable dismissal of Civil Servants by the State Administrative Court in Decisions Number 45/G/2018/PTUN.SMD and 65/G/2019/PTUN.SMD. Knowledge Gap Previous studies have largely discussed the normative basis of civil servant dismissal, while limited attention has been given to legal protection, legal certainty, justice, and the nonretroactivity principle in annulled dismissal decisions. Aims The study aims to analyze the forms of legal protection for Civil Servants following the annulment of dishonourable dismissal decisions and to assess whether such annulment reflects legal certainty and justice within administrative law. Results The findings show that both dismissal decisions contained procedural and substantive defects because they were issued without careful consideration of the plaintiffs’ prior administrative status, including reinstatement, continued employment, salary recognition, and promotion. Novelty This study specifically links the annulment of dishonourable dismissal decisions with preventive and repressive legal protection, the General Principles of Good Governance, and the prohibition of retroactive administrative decisions. Implications The findings underline the need for clearer technical guidelines, careful administrative examination, and consistent personnel governance to prevent legally defective decisions and future employment disputes. Highlights: KTUN PTDH contained procedural and substantive defects in both examined cases. AAUPB requires careful, proportional, and consistent decision-making by personnel authorities. Prior reinstatement, continued employment, and promotion must be considered before PTDH issuance. Abstract

This study aims to analyze law enforcement and supervision of corporate post-mining reclamation obligations as well as to find an effective model of law enforcement and supervision of corporations in post-mining reclamation implementation. The research method used is normative juridical research. The results of the study show that law enforcement for corporations that do not carry out post-mining reclamation starting from Administrative Law, Civil Law and Criminal Law as a form of legal consequences for not carrying out an obligation is a repressive effort on a problem, because sanctions are one of the legal consequences that coercive when an obligation that has been mandated by a regulation is not carried out. In relation to the implementation of post-mining land reclamation activities as part of the process of utilizing natural resources, the sanction that can be applied is the obligation to pay fines to community mining business actors if the post-mining land reclamation activities are not carried out as planned. Giving the obligation to pay fines to these business actors does not eliminate the obligation of smallholder mining businesses and local governments to restore post-mining environmental damage by providing the lack of funds needed by third parties. This aims to provide a deterrent effect to other smallholder mining business actors . Keywords: Reclamation, Monitoring, Environment.

Abstract

Filsafat hukum merupakan cabang ilmu yang mempelajari hakikat, tujuan, nilai, dan dasar keberlakuan hukum dalam kehidupan masyarakat. Filsafat hukum tidak hanya memandang hukum sebagai kumpulan peraturan yang bersifat mengikat, tetapi juga sebagai sarana untuk mewujudkan keadilan, kepastian hukum, dan kemanfaatan. Penulisan ini bertujuan untuk mengkaji perkembangan filsafat hukum, peranannya dalam pembentukan dan pengembangan sistem hukum, serta relevansinya dalam mewujudkan tujuan hukum pada sistem hukum modern. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan konseptual dan filosofis yang didasarkan pada studi kepustakaan terhadap berbagai literatur dan pemikiran para ahli hukum. Hasil kajian menunjukkan bahwa filsafat hukum telah berkembang sejak masa Yunani Kuno melalui pemikiran Socrates, Plato, dan Aristoteles yang menempatkan keadilan sebagai inti dari hukum. Perkembangan tersebut kemudian dilanjutkan oleh pemikir Romawi seperti Cicero yang memperkenalkan konsep hukum alam sebagai dasar universal bagi pembentukan hukum. Dalam pembentukan sistem hukum, filsafat hukum berperan sebagai landasan konseptual, normatif, dan etis yang memberikan arah bagi pembentukan peraturan perundang-undangan agar sesuai dengan nilai-nilai keadilan dan kebutuhan masyarakat. Selain itu, filsafat hukum berfungsi sebagai sarana evaluasi dan pembaruan hukum sehingga hukum mampu menyesuaikan diri dengan perkembangan sosial, ekonomi, politik, dan teknologi. Dalam konteks sistem hukum modern, filsafat hukum memiliki relevansi yang sangat penting karena mampu menjembatani hubungan antara keadilan, kepastian hukum, dan kemanfaatan. Ketiga tujuan hukum tersebut harus diwujudkan secara seimbang agar hukum tidak hanya memiliki kekuatan mengikat secara formal, tetapi juga memberikan perlindungan, ketertiban, dan kesejahteraan bagi masyarakat. Dengan demikian, filsafat hukum menjadi fondasi intelektual dan moral yang berperan penting dalam menciptakan sistem hukum yang adaptif, responsif, dan berorientasi pada tercapainya tujuan hukum yang ideal.

Abstract

Activity coal mining is one of the sectors who contributed towards national economic development, but in its implementation it often has an impact on the environment and society. is at in around region mining, including public customs. Wrong One regionWhich affected Pampang Cultural Village, Samarinda City, is an area of the Dayak Kenyah indigenous community and is located near the mining route of the coal transportation corridor. This study aims to analyze the forms of protection law against the indigenous people of Pampang Cultural Village based on applicable laws and regulations and analyzing the implementation of legal protection for indigenous people affected by activities mine corridor. Study This use method juridical empirical withapproach sociological Law. Data were obtained through interviews, field observations, and literature studies, which were then analyzed descriptively. qualitative. Results study show that in a way normative protection law to indigenous peoples has arrangedin Constitution Base Country Republic Indonesia Year 1945, Constitution Number 32 Years 2009 about Protection AndManagement Environment Life, as well as Constitution Number 3 Year 2020 about Mining Mineral And Coal. Form protectionlaw the includes protection Preventive measures include recognizing indigenous peoples' rights, access to information, and community participation, as well as repressive protection through complaint and dispute resolution mechanisms. However, the implementation of legal protection has not been optimal because communities still feel the impacts of corridor mining activities in the form of dust, increased heavy vehicle traffic, and disruptions to the environmental comfort and living spaces of indigenous communities. From a justice theory perspective, the legal protection provided has not been fully able to realize balance betweeninterest development economy And protection rights public customs. Therefore, it is necessary to strengthen government oversight, increase the participation of indigenous communities, and commit to company mining in carry out not quite enoughanswer social And environment use realizing effective and just legal protection.
