Abstract

Koperasi Simpan Pinjam (KSP) merupakan jenis koperasi yang memiliki fungsi intermediary yakni menghimpun dana dari masyarakat dan menyalurkannya kembali dalam bentuk pinjaman. KSP ini diatur dalam Undang-Undang No 25 tahun 1992 tentang Perkoperasian, Peraturan Pemerintah No 9 Tahun 1992 tentang Pelaksanaan Kegiatan Simpan Pinjam oleh Koperasi serta peraturan terkait lainnya. Pada realitasnya ditemukan berbagai kendala baik dari aspek regulasi maupun pengawasan sehingga KSP seringkali berujung pada gagal bayar yang menimbulkan kerugian terhadap anggota koperasi. Penelitian ini berfokus pada perlindungan hukum yang diberikan terhadap anggota koperasi yang mengalami gagal bayar oleh KSP. Tujuan penelitian ini adalah untuk menganalisis (1) aspek hukum dari KSP di Indonesia, (2) kepastian hukum terkait tanggung jawab koperasi terhadap simpanan anggota koperasi yang mengalami gagal bayar, (3) konsekuensi hukum akibat adanya gagal bayar dalam kasus KSP Sejahtera Bersama. Penelitian ini menggunakan penelitian hukum normatif yang bersifat deskriptif dengan peraturan perundang-undangan dan studi kasus. Sumber data terdiri dari bahan hukum primer, sekunder, dan non-hukum, serta dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa perlindungan hukum yang diberikan terhadap anggota koperasi yang mengalami gagal bayar tidak diatur secara spefik dalam peraturan perundang-undangan. Namun terdapat beberapa perlindungan hukum yang diberikan kepada anggota koperasi yang dirugikan akibat dari gagal bayar pada koperasi yakni perlindungan hukum secara preventif yang dilakukan dengan pengawasan terhadap kegiatan KSP oleh anggota koperasi melalui rapat anggota dan juga represif yang dilakukan dengan pengajuan gugatan ke pengadilan dan jalan terakhir yang dapat ditempuh oleh anggota koperasi bilamana koperasi sudah tidak mampu lagi mengembalikan simpanan semua anggotanya adalah dengan mengajukan permohonan pailit terhadap KSP. Disarankan bagi pemerintah untuk memperketat pengawasan dan perizinan terhadap usaha KSP serta pemerintah dalam hal ini dapat melakukan kolaborasi dengan KSP untuk dapat mengedukasi masyarakat dalam memilih produk dan jasa dalam KSP.

Abstract

The inactivity of cooperatives constitutes a significant legal issue, particularly in relation to the accountability of cooperative management. Although an inactive cooperative no longer conducts business activities, it legally remains a corporate entity as long as its dissolution has not been formally executed in accordance with statutory provisions. This condition creates legal uncertainty, as cooperatives are expected to continuously perform their economic and social functions. This study aims to analyze the legal implications of cooperative inactivity on the liability of cooperative managers and to examine the role of the Department of Trade and Cooperatives for Micro, Small, and Medium Enterprises (MSMEs) in Labuhanbatu Utara Regency in supervising and fostering inactive cooperatives. The research employs a normative juridical method supported by empirical data, obtained through document analysis and interviews, and analyzed qualitatively. The findings indicate that the inactive status of a cooperative does not eliminate the legal and civil liability of its management. Cooperative managers remain responsible for the management and administration of the cooperative as stipulated in Articles 31 and 34 of Law Number 25 of 1992 on Cooperatives, particularly when losses arise due to negligence or intentional misconduct. Furthermore, the Department of Trade and Cooperatives for MSMEs plays a strategic role through guidance, supervision, governance assistance, capacity building for managers, and periodic monitoring and evaluation. These efforts aim to encourage cooperative revitalization or, where necessary, lawful dissolution to ensure legal certainty, protect members and third parties, and promote sustainable cooperative development.

Abstract

This study examines the extent to which gubernatorial candidates in North Sumatra incorporate women’s rights and welfare into their policy agendas, with specific attention to marginalized women. Although the 1945 Constitution of the Republic of Indonesia mandates the state to safeguard the welfare of all citizens, many women in marginalized positions continue to experience limited access to education, healthcare, economic opportunities, and legal protection. Using a qualitative research design, this study draws on in-depth interviews with 12 marginalized women in Medan, including domestic workers, small-scale traders, women with disabilities, and housewives from economically disadvantaged households. The research explores women’s expectations regarding gubernatorial policies that could improve their access to welfare services, education, healthcare, and legal safeguards. The findings indicate that patriarchal social structures, unequal access to public services, and ongoing gender-based violence remain dominant challenges for marginalized women in North Sumatra. Despite gradual improvements in gender equality, substantial disparities persist. While the policy platform of the gubernatorial candidate pair Muhammad Bobby Afif Nasution and Surya identifies women’s empowerment as a strategic priority, the proposed initiatives lack clear operational frameworks. Conversely, the policy agenda of Edy Rahmayadi and Hasan Basri Sagala places limited emphasis on gender-related concerns. Marginalized women express a strong demand for policies that support skills development, access to micro-capital, and more effective legal protection, accompanied by transparent and accountable governance. This study highlights the need for more concrete and inclusive policy commitments to ensure that women’s empowerment becomes an integral component of regional development in North Sumatra.

Abstract

This research analyses the legal politics of Indonesia's immigration policy during and after the COVID-19 pandemic in the context of national economic recovery. By employing a normative juridical method with a conceptual and statutory approach, the study explores how legal instruments such as visa restrictions and movement control served as tools to protect national security and public health, while also impacting state revenue from the non-tax sector. The results show that post-pandemic immigration policy was strategically adapted to optimise economic functions, such as through the implementation of selective visa policies and innovations like the "Eazy Passport" service. These efforts contributed significantly to the recovery of tourism and the increase of non-tax state revenue (PNBP). The study concludes that immigration policy has effectively transformed from a regulatory mechanism into an economic stimulus instrument, and recommends that future immigration policy remain adaptive and balanced between economic benefit and national security.

Abstract

Penelitian ini meninjau konsepsi hukum SWF di Indonesia dan mengkomparasikannya dengan konsepsi hukum SWF di Norwegia dan Uni Emirat Arab untuk menemukan pembelajaran bagi SWF Indonesia. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan perbandingan. Hasil penelitian menunjukkan bahwa konsepsi hukum SWF Indonesia masih belum memiliki kerangka yang terstruktur. Variasi SWF Norwegia dan Uni Emirat Arab memiliki konstruksi hukum yang jelas dalam pembagian sumber pendanaan hingga strategi investasi yang dilakukan. Selain itu, kerangka hukum SWF Indonesia dalam lingkup strategi investasi masih terfokus pada investasi langsung, sementara SWF Norwegia dan Uni Emirat Arab memiliki fokus dalam diversifikasi aset dalam ekuitas global. Oleh karena itu, perlu rekonstruksi pembagian peran investasi antar SWF Indonesia agar memiliki kerangka yang terstruktur guna menjaga linearitas dengan tujuan pembentukannya dalam memberikan keuntungan makroekonomi.

Abstract

Legal aspects of creative economic development in digital economic development by conducting studies in Padangsidempuan City, is important to carry out with the following considerations: There are limitations in terms of legal regulations that both the central government and the regional government of Padangsidempuan City have in supporting the development of the creative economy in digital economic development, so that the implementation of digital economic development in the regions has not run optimally. This research analyzes the legal aspects of developing a digital-based creative economy, the role of local governments in supporting it based on positive laws in Indonesia, as well as the obstacles and the role of the Padangsidempuan City Government in overcoming them. Using a normative juridical method with primary, secondary, literature and field study data, the research concludes that integrated legal support, collaboration between the government and creative economy actors in strategic steps are key to the growth of the digital creative economy in Indonesia, while Padangsidempuan needs to overcome limitations in digital infrastructure, creative education, regulatory harmonization, and intellectual property rights protection. Therefore, it is necessary to develop a strategy for a collaborative model of academia, business and government, or what is called the Triple Helix.

Abstract

This study is motivated by the differing legal interpretations between the Commercial Court and the Supreme Court regarding the application of the principle of simple proof in cases involving a creditor’s petition to annul a settlement agreement where the creditor did not exercise their voting rights at the homologation meeting as addressed in Decision No. 49 K/Pdt.Sus-Pailit/2025. The research issues include the legal provisions on the annulment of a settlement agreement under the PKPU, the application of the principle of simple proof, and the judges’ reasoning in the decision. This study aims to analyze the applicable legal provisions, the application of the principle of simple proof, and the judges’ reasoning in the case. The research method used is a normative legal approach employing statutory analysis and case-based analysis through a literature review. The results indicate that a homologated settlement agreement is binding on all creditors, including those who did not exercise their right to vote. The right to file for annulment of the settlement remains possible if the debtor fails to fulfill the terms of the settlement in accordance with Article 170(1) of the UUK-PKPU. The application of the principle of simple proof should focus on the existence of two or more creditors and the existence of debts that have matured and are collectible, rather than on creditor participation in the homologation meeting. This study concludes that consistent application of the principle of simplified proof is necessary to ensure legal certainty and fair protection for all creditors.
