Abstract

This study aims to examine the transformation of blockchain technology within the Islamic financial system at Bank Syariah Indonesia, Makassar Branch, South Sulawesi (from the perspective of fiqh muamalat). The specific objectives of this research are: 1) To analyze the presence and application of blockchain technology in Indonesia's Islamic financial system. 2) To explore the perspective of Fiqh Muamalat regarding the feasibility of utilizing blockchain technology in the Islamic financial system. 3) To identify opportunities and challenges in implementing blockchain technology within the Islamic financial sector. This research employs a qualitative method with a descriptive approach. The findings indicate that: 1) Blockchain has the potential to enhance efficiency, transparency, and reliability in financial systems; however, its implementation in the Islamic sector is hindered by unclear regulations and the necessity to adhere to Sharia principles. 2) The perspective of fiqh muamalat at Bank Syariah Indonesia Makassar recognizes blockchain's potential to support Islamic finance, provided it is designed in compliance with Sharia values. 3) Blockchain technology offers opportunities such as increased transparency, efficiency, financial inclusion, and innovation in Islamic financial products, while its challenges include regulatory readiness, infrastructure development, resistance to change, and data security and privacy.

Abstract

The concept of minority fiqh (fiqh al-aqalliyyat) addresses the unique challenges faced by Muslim communities living as minorities in non-Muslim-majority societies. Tana Toraja, a region in Indonesia with a predominantly Christian population, presents a distinct sociocultural context where Muslims must navigate religious practices while adapting to local customs. This study aims to examine the application of minority fiqh in the daily lives of the Muslim minority in Tana Toraja and explore how Islamic law is contextualized within this pluralistic society. Using a qualitative case study approach, data were collected through in-depth interviews with religious leaders and community members, participatory observations, and document analysis. The findings reveal that the Muslim community in Tana Toraja adopts a flexible approach to religious practices, particularly in matters of interfaith marriage, religious celebrations, and social interactions, emphasizing principles of maslahah (public interest) and tolerance. This study contributes to the existing literature by providing empirical insights into the practical implementation of minority fiqh in a unique cultural setting. The research highlights the importance of an adaptive and contextualized approach to Islamic jurisprudence to ensure the preservation of religious identity while fostering social harmony. These findings offer valuable implications for policymakers, religious scholars, and minority Muslim communities worldwide in addressing the complexities of religious coexistence in diverse societies.

Abstract

This study aims to analyze the influence of the Fatwa of the Indonesian Ulema Council (MUI) of South Sulawesi No. 2 of 2022 on panai' money and its implications for Bugis marriage practices in Bangkala Village, Manggala District, Makassar City. The subject matter of this research focuses on how the implementation of the fatwa on the tradition of panai' money in Bugis society. This research uses a qualitative approach with a descriptive-analytical method. Data were collected through in-depth interviews with traditional leaders, scholars, and the community, participatory observation, and documentation of the fatwa text and related social practices. The results show that panai' money still has an important position in the traditional structure of the Makassar Bugis community and is seen as a form of respect and a symbol of the man's social responsibility towards the woman. Although the fatwa of MUI South Sulawesi states that panai' money is a custom whose law is permissible as long as it is not burdensome, its implementation in the community has not shown significant changes. The lack of socialization and education from religious institutions and related parties is a factor inhibiting the understanding and application of the contents of the fatwa as a whole. The implication of this finding is that the preservation of customary values must be accompanied by a proportional understanding of Sharia so that tradition does not become a barrier to marriage. Intensive cultural and educative approaches are needed so that this fatwa can be accepted and implemented by the community in accordance with moderate and contextual Islamic values.

Abstract

Bulukumba is one of the areas designated as the location of the zakat village program which has been running for four years. Therefore, the program needs to be evaluated to measure the effectiveness of the program. This evaluation uses the Logic Model. This study aims to evaluate the Baznas zakat village program in Kahayya Village, Bulukumba Regency using the Logic Model. This research uses mixed methods research. The purpose of this research is to evaluate the Input, Activity, Output, Outcome of Kampung Zakat program in Kahayya Village. The results showed that in the baznas zakat village program in Kahayya Village, various activities were carried out such as providing direct assistance to people in need, training and workshops to improve skills and knowledge, socialization and guidance in various fields such as education, health, economy, da'wah, and humanity. In addition, there are also ben˙cana response activities, procurement of facilities and infrastructure, and efforts to empower communities through various productive economic programs. Statistical test results show that there is a significant difference in the amount of mustahik income before and after the Kahayya Village zakat village program and there is a significant relationship between the length of time receiving assistance and the amount of zakat assistance with the amount of income after the zakat village program in Kahayya Village.

Abstract

Ijtihad merupakan metode penting dalam kajian hukum Islam yang berfungsi sebagai proses analitis untuk menjawab permasalahan hukum kontemporer yang tidak tercakup dalam teks-teks Al-Qur’an dan Sunnah secara langsung. Kajian ini menekankan pentingnya ijtihad dalam konteks perkembangan sosial dan teknologi yang memunculkan isu-isu baru, seperti keadilan sosial dan hak asasi manusia. Ulama menggunakan pendekatan-pendekatan ijtihad, seperti ijtihad bayani, ta’lili, dan istishlahi, untuk menafsirkan dan menerapkan prinsip-prinsip hukum Islam secara relevan. Artikel ini menjelaskan pentingnya kompetensi seorang mujtahid dan metode yang digunakan dalam ijtihad untuk mencapai keputusan hukum yang adil dan bermakna. Kajian ini juga menggarisbawahi bahwa ijtihad bukan hanya sebagai alat untuk pemecahan masalah hukum, tetapi juga sebagai upaya menyelaraskan nilai-nilai Islam dengan dinamika sosial modern.

Abstract

This research discusses the issues of Qath’i and Dzhanni, exploring their essence and characteristics, as well as the problems and debates among scholars regarding these concepts. It also addresses the urgency and implications of these concepts on the extraction of legal rulings in both classical and contemporary Fiqh. This study employs a library research method, involving the analysis of various articles, journals, and books relevant to the research theme. Data collection in this research is carried out through documentation techniques, where the researcher seeks and analyzes data by studying documents written by other researchers on the topic. The discussion of Qath’i and Dzhanni is approached from two perspectives: Wurud (the arrival of the evidence) and Dalalah (the indication of the evidence). There are Qath’i al-Wurud and Dzhanni al-Wurud, as well as Qath’i al-Dalalah and Dzhanni al-Dalalah. These concepts are firmly grounded and well-established. Therefore, even if these concepts are challenged or criticized, they cannot be undermined or dismissed. Understanding and comprehending the concepts of Qath’i and Dzhanni is crucial, as they are integrated with how words indicate meanings or legal contents contained within them. This has significant implications for Fiqh as a product of ijtihad. The approach of classical Fiqh involves measuring evidence based on its numerical certainty, establishing clear meanings, and considering it to have no other possible meanings. Meanwhile, the approach of contemporary Fiqh focuses not on linguistic-semantic analysis, but on the substance of the Qur’anic verses or Hadiths.

Abstract

Qawaid ushuliyyah merupakan kaidah-kaidah dasar dalam ilmu ushul fiqh yang sangat penting dalam proses istinbath hukum, terutama dalam konteks hukum Islam yang terus berkembang. Dalam era modern ini, tantangan baru muncul seiring dengan perkembangan sosial, ekonomi, dan teknologi yang memerlukan pendekatan hukum yang adaptif. Oleh karena itu, pemahaman yang mendalam tentang qawaid ushuliyyah menjadi krusial bagi para mujtahid dan ahli hukum Islam untuk menghasilkan fatwa dan keputusan hukum yang relevan dan aplikatif qawaid ushuliyyah memberikan kerangka metodologis yang memungkinkan para ulama untuk menganalisis dan menafsirkan teks-teks Al-Qur'an dan Hadis. Dengan menggunakan kaidah ini, mereka dapat menemukan solusi terhadap masalah-masalah kontemporer yang tidak secara eksplisit diatur dalam nash. Misalnya, dalam kasus produk keuangan syariah atau isu-isu sosial lainnya, penerapan qawaid ushuliyyah membantu para ahli hukum untuk melakukan ijtihad dengan lebih efektif. Hal ini menunjukkan bahwa qawaid ushuliyyah tidak hanya berfungsi sebagai teori tetapi juga sebagai praktik yang memberikan kontribusi nyata terhadap pengembangan hukum Islam, Kedua, qawaid ushuliyyah juga berperan penting dalam meningkatkan kualitas fatwa yang dikeluarkan oleh lembaga-lembaga keagamaan seperti Majelis Ulama Indonesia (MUI) dan Nahdlatul Ulama (NU). Fatwa yang dihasilkan melalui penerapan kaidah ini menjadi lebih terstruktur dan berbasis pada metodologi yang jelas, sehingga lebih dapat diterima oleh masyarakat luas. Selain itu, keterlibatan ulama dalam forum-forum seperti Bahtsul Masail atau Majlis Tarjih menunjukkan pentingnya kolaborasi dalam pengembangan hukum Islam di era modern.

Abstract

This study aims to describe and analyze the legal review of istiḥālah and ḍarūrah on the Indonesian Ulema Council Fatwa Number 14 of 2021 concerning the use of the AstraZeneca vaccine. A library study was conducted on some literature using a qualitative descriptive approach. The results showed that the limited supply of vaccines hindered the success of vaccination. Furthermore, the insufficient availability of the lawful and holy Covid-19 vaccine was also a problem encountered, hence the Fatwa Commission of the Indonesian Ulema Council (MUI) issued fatwa Number 14 of 2021. The Central MUI decision allowed the use of the AstraZeneca vaccine based on emergency conditions. They used the rules of istiḥālah and istiḥlāk narrowly and were not enforced because the Astrazeneca vaccine was not made from pork but used pork-derived ingredients. Furthermore, the fatwa was determined using the istinbāţ rules used as guidelines, which included three methods, namely, the bayānī, ta’līlī, and istilahsi. The adopted methodology in issuing this fatwa was the istişlaḥī method or maşlaḥah mursalah. Regarding the Astrazenecase vaccine, the final decision was the same and allowed. However, according to the Central MUI, the permissibility of the Astrazeneca vaccine was an emergency.

Abstract

The tradition of Saprahan is one of the local wisdoms of the Pontianak Malay community, rich in social, cultural, and spiritual values in community life. In the context of a diverse society and the potential for ethnic, religious, racial, and intergroup conflicts, this tradition has a strategic function as a means of conflict resolution based on custom that is in harmony with the principles of Islamic law. This study aims to analyze how the values of Saprahan are applied as a method of conflict resolution in the Pontianak Malay community and the extent to which these values reflect the principles of justice and peace in Islamic law. This study uses a qualitative approach with a case study method. Data was collected through in-depth interviews with traditional leaders, religious leaders, academics, and government officials, as well as documentation and participatory observation of Saprahan practices. Data analysis was conducted using reduction, categorization, and inductive reasoning techniques. The results of the study indicate that Saprahan not only serves as a traditional custom but also as an effective social institution for resolving conflicts without resorting to formal legal channels. The resolution process, which is based on deliberation, equality, and kinship, makes Saprahan a concrete manifestation of the principles of justice and peace in Islam. The harmony between local cultural values and Islamic law contributes significantly to maintaining social harmony and preventing conflict escalation in a multicultural society.

Abstract

The rapid development of information and communication technology has had a significant impact on society, particularly through the use of social media as the primary means of disseminating information. However, this convenience has also triggered serious problems related to the spread of fake news (hoaxes), which can cause public unrest and even have implications for social and legal stability. This study aims to analyze the enforcement of laws against the criminal act of spreading fake news through social media, examine the urgency of the Electronic Information and Transactions Law (EIT Law), and formulate alternatives for reformulating Article 28(1) of the EIT Law to make it clearer and more applicable. The method used is a normative legal approach with qualitative analysis, supported by case studies and observations of the implementation of the law by the Cyber Crime Unit of the West Kalimantan Regional Police, as well as an examination of the Joint Ministerial Decree of 2021. The results of the study indicate that law enforcement against hoaxes still faces challenges in terms of proving legal elements and the ambiguity of the wording of the norms in the ITE Law. Additionally, the urgency for regulatory updates is high, as the improper application of certain provisions in some cases has led to potential violations of the right to freedom of expression. Therefore, a reformulation of Article 28(1) is necessary, emphasizing objective terminological boundaries and the actual impact of false information. This reformulation is expected to provide legal clarity, enhance enforcement effectiveness, and ensure the protection of civil liberties in the digital age.
