Abstract

Perwujudan demokrasi rakyat yaitu pemilihan Kepala Daerah dari tahun 2017 hingga tahun 2020 telah menampakkan berbagai permasalah yang dapat dianggap menurunkan kualitas perhelatan politik tersebut. Perdebatan terus terjadi mengenai calon kepala daerah, bahkan calon anggota DPR/DPRD yang pernah melakukan korupsi, dan rendahnya tingkat kepercayaan publik terhadap partai politik. Tampak terjadi korelasi korupsi dikarenakan kebutuhan dana kampanye terkait pilihan kepala daerah. Ruang lingkup korupsi calon kepala daerah perlu menjadi perhatian dari semua pihak agar maraknya korupsi dalam pelaksanaan Pilkada justru meningkat, dan merusak tujuan demokrasi sebagai sarana mewujudkan kesejahteraan rakyat. Disisi lain partai politik sebagai pintu pertama yang menjaring calon kepala daerah memiliki peran deteksi dini dalam menelusuri track record calon kepala daerah yang akan diusungnya. Rumusan masalah yang akan dikaji adalah bagaimana fenomena/ bayang-bayang korupsi dalam Pilkada Serentak 2024 bercermin dari Pilkada sebelumnya, perilaku politik ini sejenis pula dengan saat adanya pilihan legislatif. Metode yang digunakan adalah yuridis normatif, kemudian mengkaji data sekunder Pilkada serentak tahun 2020 diselenggarakan, sebagai pandangan terhadap potensi yang terjadi di Pilkada serentak 2024. Calon kepala daerah yang melakukan korupsi atau terkait tindak pidana korupsi tidak memiliki legitimasi untuk mencalonkan diri atau terpilih menjadi kepala daerah.

Abstract

Cases of sexual violence against children increase every year in Indonesia. Based on data from the Ministry of Women's Empowerment and Child Protection (Kempppa), the total number of children who were victims of sexual violence from 2019 to 2021 increased. From 2019 to 2020, cases of sexual violence against children increased to 6,980 cases, then from 2020 to 2021 there was another increase to 8,730 cases. This study aims to determine and analyze the imposition of prison sentences for perpetrators of sexual intercourse with children in Indonesia; about chemical castration for perpetrators of sexual violence against children in Indonesia; about children as victims of sexual violence against children. The research method used is normative juridical which is sourced from secondary data, the material legal analysis is qualitative. The results of the study found that the imposition of prison sentences for perpetrators of sexual intercourse with children is threatened with a minimum prison sentence of 5 (five) years to the death penalty (in certain cases), as well as how many additional chemical castration sentences meet the requirements as decisions that cannot be accepted by human reason. Sexual violence against children is a criminal act regulated in several Constitutions and other laws in Indonesia. The punishment of chemical castration is a decision that has become positive law, but several parties consider it inhumane, including the statement of Komnas HAM.

Abstract

In Indonesia, the limitation of power has been implemented in the constitution which regulates the term of office of the President and Vice President. The limitation of the President's term of office is an attempt to prevent the incumbent from continuing in power which is the reason for absolute power. There are no regulations that apply to DPR members. There is no provision which states that a candidate for members of the Legislative Body who has served as a member of the Legislative Body for 2 (two) terms cannot return to serve as President. The large number of board members who are caught in corruption cases has created a negative public perception. Indonesia adheres to the principle of democracy or people's sovereignty which guarantees citizen participation in the decision-making process within the state so that many laws and regulations that are implemented and enforced represent the realization of justice and legal certainty.

Abstract

With the development of trade in goods and services, trademarks play a crucial role in identifying products. Trademarks are graphical signs, including logos, names, words, letters, symbols, numbers, arrangements, and colors, used in the trade of goods or services. Given the increasing number of human needs, it is unsurprising that counterfeiting of trademarks by irresponsible individuals has become a concern, affecting both the utility and quality of the goods they sell. The purpose of this study is to analyze criminal acts related to the unauthorized use of other people's brands, focusing on case number 84/PID. B/2023.PN.Smg and case number 892/Pid. B/2020.PN. The benefit of this research is to contribute to the development of criminal law, particularly in the juridical analysis of trademark crime cases. The research method used in this study is qualitative descriptive, utilizing a theoretical approach to trademark studies, judges' considerations, and rulings in trademark abuse cases. The study revealed that in both rulings, the defendants were proven to have violated trademark rights by producing counterfeit trademarks, leading consumers to purchase these goods at the same price as genuine ones, but with inferior quality. The perpetrators gained personal benefits from the misuse of the trademarks.

Abstract

Kejahatan secara umum dan kekerasan seksual merupakan penyimpangan moral manusia. Realitas kekerasan seksual terhadap anak di Indonesia merupakan permasalahan serius yang memerlukan perhatian dan tindakan kolektif. Data menunjukkan tingginya jumlah kasus, walaupun banyak kejadian yang tidak dilaporkan. Contohnya, kasus di Way Serdang Kabupaten Mesuji, di mana seorang ayah menyetubuhi anak kandungnya yang hamil, menggambarkan kompleksitas masalah ini. Penelitian  masuk dalam kategori yuridis normatif, yang meneliti bahan pustaka (data sekunder) atau penelitian hukum kepustakaan. Tujuan penelitian ini adalah untuk mengetahui kekerasan sesksual terhadap anak; dampak dan upaya perlindungan. Dampak kekerasan seksual terhadap anak mencakup konsekuensi psikologis, sosial, dan fisik yang mendalam, seperti PTSD, gangguan perilaku, dan stigma sosial. Upaya perlindungan dan pencegahan harus melibatkan pemerintah, lembaga perlindungan anak, dan masyarakat. Pendidikan, regulasi yang kuat, dan perubahan norma sosial menjadi kunci dalam menciptakan lingkungan aman bagi anak-anak. Deteksi dini, peran institusi perlindungan anak, dan upaya kolaboratif lintas sektor menjadi strategi penting dalam mengatasi tantangan kompleks pencegahan kekerasan seksual. Diperlukan pendidikan dan peningkatan kesadaran untuk mengubah persepsi masyarakat, serta investasi dalam sumber daya dan penelitian untuk mendukung upaya pencegahan yang efektif.

Abstract

The purpose of writing this article is to explain the judge's considerations in deciding the practice of sexual exploitation in the crime of child trafficking based on court decision number 29/Pid.sus/2019/PN.Tim and Decision Number 311/Pid.sus/ 2021/PN.Pol. This decision provides a clear picture of the continued practice of trafficking children for sexual exploitation in Indonesia. The practice of trafficking children for sexual exploitation occurs because the victims are still minors so their minds are not yet perfect in making decisions and following up on what they have experienced. This is what exploiters take advantage of. The facts revealed at trial are of course the basis for judges in examining and deciding exploitation cases. Writing this article uses a normative juridical approach with a descriptive type where the author will explain the legal basis relating to sexual exploitation and the judge's considerations in Decision Number 29/Pid.Sus/2019/PN. Team and Decision Number 311/Pid.Sus/2021/PN. Pol. In the results and discussion, it is known that the government has issued several regulations that can be used to provide repressive legal protection for children, including Law Number 35 of 2014 concerning Child Protection. Abstract

Pengabdian masyarakat ini dilakukan untuk mengetahui tahap persiapan dan pelaksanaan yang dilakukan oleh penasehat hukum dari BKBH Universitas Muhammadiyah Surakarta. Sebelum pendampingan persidangan, terdapat tahap persiapan yang didalamnya terdapat tahapan wawancara dengan klien, kemudian mempelajari aturan hukum yang berlaku, dan mengumpulkan bukti-bukti pendukung. Selain daripada itu terdapat tahap pelaksanaan pendampingan hukum dengan menganalisis strategi pembelaan dan terhadap klien yang ketergantungan mengupayakan putusan rehabilitasi dan meminimalisir terdakwa dari tuduhan sebagai pengedar narkotika. Proses dan tahapan pendampingan persidangan perkara penyalahgunaan narkotika di Pengadilan Negeri Boyolali melalui beberapa tahap yang dimulai dari pembacaan dakwaan sampai dengan putusan. Tahap persidangan menjadi penting dalam proses peradilan pidana, di mana semua bukti akan diperiksa secara terbuka untuk umum. Pengabdian masyarakat ini memberikan gambaran mengenai pendampingan hukum dalam perkara narkotika di Pengadilan Negeri Boyolali dan pentingnya peran penasehat hukum dalam memastikan hak-hak terdakwa terpenuhi selama proses persidangan.

Abstract

The Indonesian state has a firm and constitutional obligation to advance national culture as mandated in Article 32, paragraph (1) of the 1945 Constitution. This article guarantees the freedom of the community to preserve and develop cultural values. Indonesian culture, reflecting the noble values of the nation, must be embraced by all citizens to strengthen national identity, enhance dignity, and reinforce unity to achieve the nation's future goals. The preamble of the 1945 Constitution of the Republic of Indonesia outlines the national goals of protecting all Indonesians and their homeland, promoting general welfare, educating the nation's life, and participating in maintaining world order based on freedom, eternal peace, and social justice. The diversity of ethnic groups, customs, languages, local knowledge and technology, traditions, local wisdom, and arts are valuable cultural heritages that shape the nation's identity amid global development. According to various articles in the 1945 Constitution of the Republic of Indonesia, the country possesses extraordinary artistic and cultural wealth that must be protected. Local governments, as the forefront of governance, have an obligation to preserve culture to strengthen the nation's identity. Purworejo Regency, with its rich local traditions, has the responsibility to preserve regional cultural expressions through protection, development, utilization, coaching, and cultural supervision. Copyright protection of traditional art works is considered an economic asset and a national identity. The Purworejo Regional House of Representatives (DPRD) has taken the initiative to draft regional regulations to protect and preserve traditional cultural expressions, demonstrating the local government's commitment to safeguarding cultural heritage and promoting the development of local cultural wealth for the welfare of the community and regional advancement.

Abstract

More than one-third of adults have metabolic syndrome risk factors. The prevalence of metabolic syndrome rises with age, and it is associated with a significant risk of morbidity and mortality due cardiovascular disease. People frequently are unaware of the symptoms of metabolic syndrome and are unconcerned about leading a healthy lifestyle, eating an unbalanced diet, and being physically active in daily life. For the purpose of preventing metabolic syndrome, preventive interventions connected to metabolic syndrome should be proposed. Educators are rarely informed about metabolic syndrome. They are rarely educated on how to manage risk factors for metabolic syndrome. As a result, health education are carried out to promote understanding of metabolic syndrome prevention through adjustments in risk factors and lifestyle. The method applied is metabolic syndrome education. Pretest and posttest findings indicate increased knowledge. This activity had a total of 22 participants. The average pretest score was 81.2, and the average posttest score was 87.7. There was an increase of 8% in pretest to posttest scores. Although there was no significant improvement in knowledge, this activity yielded fairly acceptable results. This could be because the participants in this activity are educators with prior understanding of metabolic syndrome. It is believed that the activities would raise awareness of metabolic syndrome and help to prevent the formation of heart disease in the future.

Abstract

Penelitian ini mengkaji peran kognisi sosial dan risiko bias kognitif dalam proses penegakan hukum pidana di Indonesia dalam kerangka KUHP 2023 dan prinsip hak asasi manusia. Dengan pendekatan yuridis normatif yang diperkaya telaah literatur empiris psikologi forensik, studi ini menelaah bagaimana mekanisme seperti confirmation bias, tunnel vision, halo effect, serta heuristik penilaian memengaruhi penyidikan, pemeriksaan saksi, dan pengambilan keputusan hakim. Hasil analisis menunjukkan bahwa ruang interpretatif yang diberikan KUHP 2023, misalnya dalam penilaian motif, sikap batin, dan keadaan yang memberatkan atau meringankan, berpotensi mengalami distorsi ketika aparat penegak hukum tidak mengendalikan bias kognitif. Dampaknya tidak hanya mengurangi reliabilitas pembuktian tetapi juga berimplikasi pada pelanggaran hak asasi terdakwa, khususnya prinsip peradilan yang adil dan bebas dari diskriminasi. Untuk itu, artikel ini merekomendasikan serangkaian langkah mitigasi berbasis bukti: standardisasi prosedur identifikasi (doubleblind lineup dan pencatatan confidence statement), perekaman audiovisual penuh interogasi, pelatihan antibias untuk penyidik/ jaksa/ hakim, pembatasan teknik interogasi berisiko, serta protokol penulisan pertimbangan putusan yang menuntut evaluasi hipotesis alternatif. Implementasi rekomendasi ini diharapkan memperkuat integritas proses peradilan pidana dan perlindungan HAM di era KUHP 2023
