Abstract

Perkembangan teknologi informasi dan komunikasi telah mengubah cara manusia berinteraksi dan mengakses informasi. Namun, perkembangan ini juga menimbulkan tantangan baru dalam hal melindungi privasi individu. Penelitian ini bertujuan untuk menganalisis pengaruh perkembangan teknologi terhadap perlindungan privasi dalam hukum perdata. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan dan analisis isi untuk mengumpulkan data dan menganalisis argumen yang berkaitan dengan perlindungan privasi dalam hukum perdata. Beberapa aspek yang dibahas dalam penelitian ini meliputi definisi privasi, evolusi teknologi informasi dan komunikasi, perubahan hukum perdata terkait perlindungan privasi, dan tantangan yang dihadapi dalam mengadaptasi hukum perdata dengan perkembangan teknologi. Hasil penelitian menunjukkan bahwa perkembangan teknologi telah mengubah lanskap privasi dalam konteks hukum perdata. Munculnya internet, media sosial, dan perangkat mobile telah memperluas kemampuan individu untuk berbagi informasi secara luas, yang pada gilirannya meningkatkan risiko pelanggaran privasi. Di sisi lain, perkembangan teknologi juga memberikan peluang baru untuk melindungi privasi, seperti enkripsi data dan keamanan siber. Namun, penelitian ini juga mengidentifikasi beberapa tantangan dalam melindungi privasi dalam hukum perdata di era teknologi yang semakin maju. Beberapa tantangan utama meliputi kesenjangan antara perkembangan teknologi dan kebijakan hukum, masalah keamanan data, dan ketidakjelasan batas privasi dalam lingkungan digital.

Abstract

In Indonesia, there is currently no universal law of inheritance that applies to all citizens. This is because the inheritance system in Indonesia is divided into three, namely Islamic inheritance law, inheritance law based on the Book of Civil Law, and inheritance law based on local customs. In the context of Islamic inheritance law, the Religious Court plays a central role as a separate institution with full authority in resolving inheritance disputes for Muslim communities. This aligns with the teachings of the Prophet, emphasizing the importance of applying Islamic inheritance law to prevent disputes over inheritance. This study aims to analyze Islamic inheritance law from its concepts, legal sources, principles, order of heirs, obstacles in inheritance, and procedures for dividing inheritance according to Islamic law. The research method used is a library method involving relevant books and journals. The research results show that Islamic inheritance law covers who is entitled to inheritance, the size and reduction of inheritance portions, and the implementation of inheritance distribution. This is based on legal norms sourced from the Quran, Hadith, Ijma, and Ijtihad of Ulama, which must be followed by all society.

Abstract

This study explores the philosophy of wasiat wajibah (obligatory bequest) within the Islamic inheritance law system in Indonesia, by examining its philosophical, normative, and practical foundations in the context of national law. Wasiat wajibah is a legal institution that grants a mandatory inheritance share to heirs who are otherwise excluded from inheritance rights, such as grandchildren whose parent (the child of the deceased) has passed away before the testator. The purpose of this study is to examine the philosophical foundations of wasiat wajibah, its relevance to the Islamic principle of justice, and its integration into Indonesia's positive legal system. This research adopts a qualitative approach with a normative-philosophical method. Data were collected through literature review of both primary and secondary sources, including classical Islamic jurisprudence texts, Indonesian legal regulations (such as the Compilation of Islamic Law), and philosophical writings on Islamic legal thought. The data were analyzed interpretively and reflectively through textual and conceptual analysis. The findings indicate that wasiat wajibah is grounded in strong philosophical principles of justice, compassion, and protection of vulnerable groups. In the Indonesian context, this concept has been incorporated into the Compilation of Islamic Law, particularly in Article 209, as a form of legal adaptation to the complex and plural realities of modern society. However, its implementation still faces challenges due to differing scholarly opinions among Islamic schools of thought and limited awareness among legal practitioners. In conclusion, wasiat wajibah serves as a bridge between Islamic moral values and a responsive positive legal system. A philosophical approach to wasiat wajibah reinforces the urgency of reconstructing the Islamic inheritance system in Indonesia to be more just, adaptive, and contextually relevant.

Abstract

Waqf is a crucial institution in Islamic social practices utilised for community welfare since the era of Prophet Muhammad (peace be upon him). Initially, waqf primarily consisted of immovable assets, such as agricultural land, as Umar ibn Khattab's waqf demonstrated. In Islamic law, waqf has distinct legal characteristics that set it apart from zakat, infaq, sadaqah, and hibah, even though they share similarities in material nature. Over time, the scope and management of waqf have evolved, particularly in Islamic boarding schools (pesantren), which leverage waqf to foster economic independence for the Muslim community. This study explores waqf management within Persatuan Islam (Persis) pesantren in West Java, focusing on its regulatory framework, implementation, and distribution of benefits. The findings indicate that waqf management within Persis adheres to structured guidelines, as outlined in the Kaifiyat Kerja and Pedoman Jam'iyyah Persatuan Islam (2011). Waqf management in Persis pesantren is carried out independently, with pesantren acting as both managers (nadzir) and implementers. The distribution of waqf benefits is predominantly directed toward social and educational initiatives. However, efforts to expand its role in developing broader economic independence require further collaboration with economic actors to fully realise the potential of waqf in supporting the community's welfare.

Abstract

Tindakan pemalsuan tentunya suatu tindakan yang merugikan masyarakat maupun negara. Pemalsuan uang dapat merusak stabilitas ekonomi dan kepercayaan masyarakat terhadap mata uang yang berlaku di Indonesia. Dalam hukum islam pemalsuan uang bisa dikategorikan sebagai tindakan penipuan yang mana perbuatan tersebut dilarang dalam islam. Pelaku tindak pidana pemalsuan uang dalam hukum islam dalam dikenai hukuman Ta`zir, yaitu hukuman yang ditetapkan oleh hakim berdasarkan pertimbangan kemaslahatan umum. Tindak pidana pemalsuan uang sudah beredar di berbagai wilayah, sehingga cepatnya peredaran uang palsu ini membat kestabilan ekonomi di Indonesia menurun. Berdasarkan fenomena tersebut, maka penelitian ini berfokus pada pertimbangan hukum hakim dalam putusan Nomor 71/Pid.B/2024/Pn.Kbm tentang tindak pidana pemalsuan uang, unsur-unsur tindak pidana pemalsuan uang dalam putusan Nomor 71/Pid.B/2024/Pn.Kbm menurut Hukum Pidana Islam dan efektivitas Hukum Pidana Islam degan putusan Nomor 71/Pid.B/2024/Pn.Kbm tentang tindak pidana pemalsuan uang. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode analisis deskriptif. Hasil dari penelitian ini adalah pertimbangan hakim dalam memberikan suatu putusan pidana kepada pelaku selalu berpedoman pada peraturan yang ada dan melihat dari unsur yang terpenuhi, dalam hukuman ta`zir yang diberikan oleh hakim sudah cukup efektif untuk memberikan pembelajaran kepada pelaku agar tidak mengulangi kesalahan yang sama lagi.

Abstract

The performance of the Hajj pilgrimage is one of the pillars of Islam that must be fulfilled by Muslims who possess the ability (istita'ah). Due to the overwhelming number of applicants and the restrictions on the number of pilgrims allowed to depart each year imposed by the Saudi Arabian government, the Ministry of Religious Affairs of the Republic of Indonesia has limited the departure of prospective Hajj pilgrims through a quota system and the allocation of waiting numbers known as "nomor porsi" (quota numbers). One consequence of this situation is that some prospective Hajj pilgrims who have registered and received their quota numbers may pass away before their departure. To address this issue, the Director General of Hajj and Umrah Implementation has issued Decree Number 130 of 2020, which allows for the transfer of quota numbers to one of the heirs of a deceased prospective Hajj pilgrim who did not have the opportunity to perform the pilgrimage. The findings of the study indicate that the Hajj quota of a deceased prospective pilgrim is part of their rights that fall into the category of inheritance. When such a right falls into this category, it can become an inheritance that must be divided among heirs who meet the requirements.

Abstract

One of Law enforcement efforts can be conducted through a non-litigation approach. In this, arbitration can be seen as a non-litigation legal effort and can be used to resolve Islamic economic civil cases. So far, arbitration law effort has been regulated in the Law Number 30 of 1999 and is widely used in the law enforcement practices. This study uses a normative-juridical method and a qualitative approach. The sources and techniques of data collection refers to the number of relevant literatures, and also analyzed deductively and inductively. The results of this study show that legal certainty of arbitration in the settlement of Islamic economic civil cases in the perspective of positive law in Indonesia that regulated in regulated in the Law Number 30 of 1999 has proven to be quite effective in resolving Islamic economic civil cases. The benefit of Islamic economic civil cases settlement through arbitration is the parties have the same position in the form of equality before the law, the process is easy, not expensive, and a win-win solution. Moreover, arbitration can also guarantee legal certainty and justice for the disputing parties.

Abstract

The cases of domestic violence in Indonesia tend to increase from time to time. Based on data released by the National Commission on Violence Against Women in 2020, the number of domestic violence complaints received was recorded at 4,371, an increase from 4,322 cases in the previous year. From the perspective of Islamic criminal law, domestic violence is classified as jarīmah takzīr (criminal acts where the legal provisions are left to the discretion of the authorities) whereas in positive law domestic violence is regulated in Law of the Republic of Indonesia Number 23 of 2004 concerning the Elimination of Domestic Violence. This research discusses domestic violence in Bandung and examines the methods for resolving cases at the Religious Courts and the Bandung Police. The aim is to find the characteristics and methods of resolving cases in the two institutions. This research is classified as field research using comparative methods. Data was obtained from the document available at the Bandung Religious Court and the Bandung City Police Station. This research finds that more domestic violence cases in Bandung City were resolved through criminal channels (police) rather than civil channels (Religious Courts). This research concludes that although both Islamic Law and Positive Law view domestic violence as a criminal act, there are differences in the methods of resolving them in the Religious Courts and Bandung Police. This is because the competence of each institution is different. The Religious Court only handles the civil side, while the Bandung Police handles the criminal side.

Abstract

This study examines the legal validity of mediation in marriage annulment cases conducted without the respondent’s presence, focusing on its conformity with the provisions of Supreme Court Regulation (PERMA) No. 1 of 2016 on Court-Annexed Mediation Procedures. Employing a normative juridical research method with statutory and conceptual approaches, the analysis draws upon primary legal sources, including PERMA No. 1 of 2016, Law No. 1 of 1974 on Marriage, and the Compilation of Islamic Law (KHI), as well as relevant religious court decisions. Secondary sources consist of scholarly books, legal literature, and journal articles addressing mediation in marriage annulment and divorce cases. The findings indicate that, although marriage annulment proceedings are exempt from mandatory mediation, some religious courts still conduct mediation as a peace-seeking effort. However, declaring mediation successful in the absence of the respondent contravenes the fundamental principle of active party participation, undermines legal certainty, and potentially diminishes the protection of the rights of absent parties. The study concludes that mediation in annulment cases without the respondent’s presence lacks strong legal validity under PERMA No. 1 of 2016, and may generate procedural injustice and uncertainty in religious court practice. It recommends stricter judicial adherence to mediation procedures, particularly regarding the mandatory presence requirement when mediation is undertaken, even in exempt cases.
