Abstract

This research analyzes food ordering contracts via online transportation applications from an Islamic economic perspective. It was found that there are various electronic contracts that influence society, including the perception that booking contracts can be considered haram or contain gharar, affecting beliefs and the online transportation ecosystem. This research methodology is descriptive qualitative with primary data sources from interviews and secondary sources from books and papers. Data collection techniques include observation, interviews and documentation. The research results show that in Go-Food services by PT Go-Jek there are ijarah, wakalah, sale and purchase and musyarakah contracts. Ijarah contracts occur in service transactions, wakalah contracts when consumers represent purchases, sale and purchase contracts when drivers buy food, and musyarakah contracts in collaboration between PT Go-Jek and drivers. In addition, analysis of OVO top-up transactions shows that it is compatible with the Sarf contract, although a small number of users still consider it a Qardh contract due to the lack of socialization regarding the type of contract in OVO transactions

Abstract

This study aims to analyze the institutional challenges and direction of reform within the Indonesian Waqf Board (BWI) in managing national waqf. Although Indonesia has enormous waqf potential, with over 414,000 hectares of waqf land and approximately 420,000 nazhirs (Islamic trustees), the reality is that only about 10% of these assets have been managed productively. This study uses a qualitative approach with library research through analysis of academic literature, policy documents, and official reports from related institutions. The results indicate that the main problems lie in weak coordination between the central and regional BWI, limited human resource capacity, a lack of transparency and accountability, and low literacy and public trust in waqf management institutions. Furthermore, the implementation of waqf regulations has not been optimal due to lengthy bureaucracy and the absence of regulations that adapt to contemporary waqf innovations such as digital waqf and stock waqf. Comparisons with Malaysia and Turkey demonstrate that the success of productive waqf management is largely determined by institutional professionalism, strong regulatory support, and the integration of public policy with technology and the Islamic financial sector. Therefore, BWI institutional reform needs to focus on professionalizing nazhir (managers), digitizing the national waqf management system, and developing fiscal policies that encourage productive waqf innovation. These reforms are expected to strengthen transparent, accountable, and globally competitive national waqf governance to achieve the welfare of the community in accordance with the principles of maqāṣid al-syarī‘ah (the main objectives of Islamic law)

Abstract

The Muslim population that has great potential in giving zakat is Indonesia. One of the functions of zakat is as a social fund that can be used to overcome social problems such as poverty that occurs in society. Of course, an appropriate formulation is needed to utilize zakat assets to overcome these social problems. Among the efforts is to build a paradigm that the use of zakat must be productive, educational, and economical so that in the end, zakat recipients (mustah}iq) will leave the mustahiq zone and will automatically enter the mandatory zakat zone (muzak). Productive zakat is giving zakat that can make recipients produce something continuously through the zakat assets they have received. This program can not only help underprivileged people. However, it can also enable people who have been economically deprived and have always been zakat recipients to change their position to become muzakki. This research describes productive zakat and its empowerment in Indonesia. Apart from that, we also found that productive zakat is very powerful in playing its role as one of the sharia financial instruments in Indonesia in empowering and alleviating poverty through the philanthropic institutions that support it.

Abstract

The increase in Hajj registrants in Indonesia has led to the need for efficient and transparent management of Hajj funds. State regulations and Sharia principles must be adhered to when using Wakalah contracts for efficient management of Hajj funds. The aim of this research is to clarify the legal framework surrounding the Wakalah contract so that its implementation is more effective and optimizes the management of Hajj funds both in the context of sharia and state law. This research uses a normative juridical method, namely data is analyzed and processed systematically, logically and critically, using a normative approach and based on regulations, doctrine, legal principles and other relevant supplementary materials. Based on these findings, data was analyzed and a strong legal framework and sharia principles can maximize benefits for Hajj pilgrims and encourage cost-effective management of funds. Collaboration between Islamic banking institutions and Hajj regulators can also help overcome existing challenges. This research offers a deeper understanding of the benefits of ownership, Wakalah principles, as well as relevant legal and Sharia aspects, thanks to its careful methodological approach. Its unique contribution lies in its focus on beneficial ownership, a comprehensive examination of legal and sharia considerations, and the development of a practical framework for improving Hajj financial management in Indonesia.
