Abstract

The study aims to identify and analysts the legal protections of diplomatic buildings of the United States are reviewed from the perspective of the Vienna Convention 1961 as well as the recipient state answer of Kabul Afghanistan in the case of suicide bombing near the U.S. embassy. The study uses a type of normative legal research through a conceptual approach, a statutory approach and a historical approach that is then analyzers by using primary, secondary, and tertiary legal substances. The results showed that the protection of the law against diplomatic buildings is governed in article 25 of the 1961 Vienna Convention describing the building of representatives and facilities therein can not be contested by the recipient State obliged to provide facilities to support the activities of representatives outside the country and the form of liability of the recipient of Afghanistan to the diplomatic buildings by replacing any damages for both physical damage and discomfort experienced by 1961 United , as well as deploying security officers to anticipate follow-up attacks by the Taliban against the environment of United States diplomatic buildings

Abstract

This study discusses to analyze, the implementation of research on children who oppose criminal acts of persecution carried out in the jurisdiction of the Buleleng Resort Police and the protection needed by investigators in the process of investigating children. This research uses empirical research, with descriptive research types, data and data sources are divided into primary data and secondary data consisting of primary legal materials, secondary materials and tertiary materials, then using data merging techniques with document study techniques, observation techniques, and interview technique, in the sample selection technique using non-probability sampling techniques, namely purposive sampling, the data of this study were processed and analyzed qualitatively presented in a descriptive qualitative manner. The location of the study was conducted at the Buleleng Police Station. The subjects of this study were the parties involved in the study involving deaths carried out by minors. The results showed that the investigation carried out in accordance with the juvenile justice system, the investigation continues to prioritize child protection. Related to what is broadcast by the investigator during the process of education which is well done which is carried out with the consent of the children but concerns issues that are classified as minors who have been known in advance from the time limit for conducting the investigation which is demanded quickly will lead to investigators in terms of looking for evidence, witnesses, questions and answers.

Abstract

This study aimed to determine and analyze law enforcement against extortion carried out bycommunityand to find out law enforcement efforts in tackling extortion in the Law Area of Buleleng Police Station. The type of this research was used is empirical legal research. This study usedqualitative descriptive with the location of this study carried out in several places namely in the Buleleng Police Station, the Buleleng District Attorney, Singaraja District Court, Buleleng Inspectorate and several shops in Buleleng. Data collection techniques were carried out using document studies, observations, and interviews. The results showed that (1) law enforcement apparatus in enforcing extortion cases carried out by community have been acted properly and decisively because law enforcers have the right to process and up to now there are no extortion in the community, (2) prevention efforts what has been done by law enforcement officers was in the form of preventive, Pre-emtive, and Represive actions

Abstract

This research aim to (1) know and analyze arrangement of opportunity principle in article 35 letter c Act of number 16/2004 about concerning the Prosecutor’s Republic of Indonesia, and (2) know and analyze what is the consideration of public interest as a basis for the basic application of opportunality by the Attorney General. The type of research used is normative legal research. The data is obtained from this research is secondary data, obtained through library research, and analyzed by qualitative juridicial method with the statue approach, conceptual approach, case approach, comparative approach, and historical approach. This research led to the showed that the (1) basic arrangements of opportunity principle are reflected in article 35 letter c Act of number 16/2004 about concerning the Prosecutor’s Republic of Indonesia, but doesn’t clearly determine the parametes of what is meant of public interest, (2) In formulation he public interest based on article explanation 35 letter c are too broad and there are no obvious parameters, so that many interpretations related to the phrase of public interest.

Abstract

An accident is an omission and negligence is a crime that is no criminal accountability, as set out in Article 310 of Law Number 22 Year 2009 regarding Traffic and Road Transportation. The issue when the accident committed by a child causing others died, how law enforcement against minors in the case accident resulting in loss of lives of others in the city of Singaraja. This study uses empirical legal research. Empirical legal research is a field research by relying on facts. Data were collected by interviews and by means of a literature study, methods of analysis with qualitative way to describe and interpret data based on the doctrine and legal norms relating to the subject of the obtain problem then arranged for the clarity of the issues discussed. Based on the research that writers get in law enforcement against children, generally from the data in the can since 2017 till 2019 there are 25 cases entered in the Police Buleleng, the solution is only at the stage of diversion in the police, because the child was 15 years old and is suspect as well as the penalties are less than 7 (seven) years, where the child has violated Article 310 paragraph (4) of Law Number 22 year 2009 regarding Traffic and Road Transportation.

Abstract

Penelitian ini bertujuan untuk menganalisis, upaya perlawanan (Verzet) terhadap putusan verztekdalam perkara No.604/Pdt.G/2016/PN.Sgr di Pengadilan Negeri Singaraja Kelas 1B dan pelaksanaan putusan verztek dalam pembagian harta gono gini.Jenis penelitian yang digunakan yaitu penelitian hukum empiris.Penelitian ini menggunakan pendekatan deskriptif dengan analisis data kualitatif. Lokasi penelitian ini dilaksanakan di Pengadilan Negeri Singaraja Kelas IB. Teknik pengumpulan data dilakukan dengan cara observasi, wawancara, dan studi dokumen. Teknik penentuan sampel menggunakan purposive sampling.Hasil penelitian menunjukan bahwa dalam mengajukan sebuah upaya perlawanan (verzet).

Abstract

This research aims to know (1) the application of mediation in dispute resolution of Setra Karang Rupit Land at Singaraja Judiciary’s country class 1B (2) to find out the obstacles procedure of mediation dispute custom land in judiciary country class 1B. This research is using an empirical method. Sampling techniques using purposive sampling. The subject of this study was the chairman of the Judiciary’s country of Singaraja class 1B, Bendesa Adat Temukus village, and the object of the study is the role of mediation in dispute resolution of Setra Karang Rupit custom land. The techniques used in this study are document study techniques in Singaraja Judiciary’s country class 1B, interview techniques and observation techniques. The collected Data is analyzed in a qualitative description. The results of the study indicates . (1) In the application of mediation concerning on the dispute resolution Setra Karang Rupit custom land where the evidence of the plaintiff using certificates, testament and parent’s heritage, (2) concern on how about the obstacles in the implementation of the mediation in dispute resolution of Setra Karang Rupit custom land in Singaraja Judiciary’s country class 1B is the plaintiff itself didn’t attending the trial, the legal authority of the plaintiff are resigned during the trial, and the process of the trial itself the plaintiff is too long delayed the way of the trial, so that there’s any obstacles happened.

Abstract

Terrorism is not a new issue but is an increasingly important issue for ASEAN countries, including Indonesia. Indonesia's involvement in the fight against terrorism is not only to fulfill its obligations as part of the international community to jointly fight terrorism, but also to fulfill its national interests. Indonesia's foreign policy in handling this issue puts forward cooperation with other countries, especially in ASEAN. Where in this study aims to know more about Indonesia's role in combating terrorism in the Southeast Asian region and to better understand the obstacles faced by Indonesia in combating terrorism in the Southeast Asian region. To achieve these objectives, this study uses a type of normative research with descriptive qualitative research methods. The data collection technique was carried out using the library research technique. Where the data comes from books, articles, journals and other documents. The results of the research show that terrorism is a security problem and a cross-border problem so that cooperation between ASEAN countries is needed to eradicate terrorism in Southeast Asia through the ASEAN Convention on Counter Terrorism. Indonesia's role in eradicating terrorism by internal and external efforts carried out bilaterally and multilaterally. Given that terrorism is a transnational crime, in Indonesia's role in eradicating terrorism there are several obstacles and challenges. This challenge relates to the principles of consensus and non-intervention, domestic conflicts as well as differences in commitments and perceptions among ASEAN countries.

Abstract

Sexual violence against women and children is a form of action that violates human rights. As it is known, the human rights of women and children have been guaranteed and regulated in the 1945 Constitution of the Republic of Indonesia and the Law on Human Rights. Therefore, protection of the rights of women and children from violence should be respected, upheld and enhanced human dignity without discrimination, welfare and justice for women and children. Violence is any act against the law with or without using physical and psychological means that causes danger to one's life, body or causes the deprivation of one's freedom. The purpose of this paper is to provide legal protection to women and children who are victims of sexual violence in Bali Province. By using juridical-normative research methods based on primary, secondary, and tertiary legal materials such as laws and regulations, court decisions, legal theory, and can be in the form of opinions of scholars related to existing problems. Analyzed qualitatively with descriptive-prescriptive presentation. There it was later found that until now, especially in Bali, the existence of women and children victims of sexual violence has not received adequate services so that legal protection efforts are needed for victims of sexual violence in Bali Province. Thus, the law exists to provide protection for women and children who are victims of sexual violence.

Abstract

In an armed dispute, the protected persons include combatants and the civilian population. Combatants who have horse de combat status must be protected and respected in all circumstances. Combatants who fell into enemy hands gained the status of prisoners of war. Protection and rights as prisoners of war are regulated in Geneva Convention III of 1949. Meanwhile, civilians are entitled to protection as regulated in Geneva Convention IV of 1949. The legal protection given to children is more focused on the consequences of armed disputes that will affect or affect children. As part of the civilian population, children who do not participate in hostilities receive general protection without any adverse distinction based on ethnicity, nationality, religion, or political opinion, and are intended to alleviate the suffering caused by war
