Abstract

The implementation of Islamic law in the Indonesian legal system is a complex issue involving the interaction between religious authorities, the state, and society. This research aims to analyze the dialectic between the theories of Receptio in Complexu (Islamic law applies automatically to Muslims) and Receptio a Contrario (Islamic law applies as long as it does not contradict custom) and its impact on the integration of Islamic law in the national legal framework. The research method used is library research with a theological-normative approach and contextual analysis, combining primary (legal texts, colonial documents) and secondary (journals, books) data. The results show that inconsistencies in the application of Islamic law, such as in the case of Bugis customary inheritance which contradicts the provisions of faraidh, reflect the tug-of-war between religious, customary and state authorities. The implications include legal uncertainty, regulatory dualism, and the potential for social disharmony. Islamic legal products such as the Compilation of Islamic Law (KHI) and MUI fatwas have been recognized, but their application remains influenced by the socio-cultural context. To create harmonious integration, a benefit-based approach (istislahi), regulatory harmonization, and the active role of Islamic organizations and community leaders are needed. This research provides academic and practical recommendations to strengthen an inclusive national legal system, and encourages further research on the integration model of Islamic law based on maqashid sharia and local wisdom within the framework of Pancasila.

Abstract

Perkembangan teknologi digital dan media sosial telah mengubah peran perempuan Muslim secara signifikan, baik dalam ranah domestik maupun publik. Fenomena ini menimbulkan isu baru mengenai keadilan gender dalam hukum Islam, terutama ketika perempuan memikul tanggung jawab ganda antara peran keluarga dan aktivitas sosial di ruang digital. Isu ini menjadi penting untuk dikaji karena pemaknaan tradisional terhadap hukum Islam sering kali menempatkan perempuan dalam batas domestik, sementara realitas modern menuntut partisipasi mereka dalam ruang publik secara lebih luas. Penelitian ini bertujuan untuk menganalisis konsep keadilan gender dalam hukum Islam dengan meninjau peran ganda perempuan di era media sosial. Fokus kajian diarahkan pada bagaimana prinsip-prinsip hukum Islam merespons keterlibatan perempuan di ruang publik digital tanpa mengabaikan tanggung jawab terhadap keluarga dan nilai-nilai moral Islam. Metodologi yang digunakan adalah pendekatan kualitatif deskriptif dengan metode studi pustaka. Penelitian ini memanfaatkan teori Keadilan Gender Islam dari Amina Wadud dan Double Movement Theory dari Fazlur Rahman sebagai kerangka analisis utama, dengan sumber data berupa literatur klasik, teks keislaman kontemporer, dan kajian akademik yang relevan dengan aktivitas perempuan di media digital. Hasil penelitian menunjukkan bahwa hukum Islam bersifat adaptif dan kontekstual terhadap perkembangan zaman. Prinsip al-‘adl (keadilan), al-musawah (persamaan), dan al-maslahah (kemaslahatan) menjadi dasar penerapan keadilan gender yang memungkinkan perempuan berperan aktif di ruang digital secara etis, produktif, dan tetap sejalan dengan nilai-nilai syariat.

Abstract

Perkembangan ekonomi syariah di Indonesia menyebabkan semakin banyaknya kasus sengketa akad mudharabah yang diajukan ke pengadilan agama. Sengketa ini umumnya terjadi antara para investor dan pengelola usaha akibat perbedaan dalam pengaturan pembagian keuntungan atau tanggung jawab atas kerugian. Dalam keadaan seperti ini, peran hakim sangat penting untuk memastikan keadilan dengan mengedepankan prinsip hukum Islam serta nilai-nilai moral. Tujuan penelitian ini adalah untuk menilai bagaimana para hakim menimbang aspek hukum, prinsip-prinsip syariah, dan nilai-nilai moral serta sosial dalam menyelesaikan sengketa akad mudharabah. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan studi literatur, yaitu menganalisis putusan pengadilan agama, peraturan, fatwa DSN-MUI, serta literatur yang berkaitan dengan ekonomi syariah. Temuan penelitian menunjukkan bahwa mayoritas hakim sudah mengikuti prinsip hukum Islam dalam hal pembagian keuntungan dan tanggung jawab risiko, serta menekankan pentingnya amanah dan kejujuran. Akan tetapi, dalam beberapa kasus, penerapan nilai-nilai moral dan sosial belum sepenuhnya konsisten karena faktor sosial yang dipertimbangkan. Secara keseluruhan, pertimbangan para hakim memberikan kontribusi dalam membangun sistem hukum ekonomi syariah yang lebih adil, transparan, dan memberikan kepastian hukum bagi masyarakat.

Abstract

Indonesia's considerable mineral resources including coal, nickel, copper, and bauxite are pivotal to economic development and the worldwide green energy supply chain. Nonetheless, expedited extraction has resulted in significant environmental degradation, socio-economic disruption, and legal-ethical issues, especially in areas facing deforestation, water contamination, habitat fragmentation, and community displacement. These effects underscore the urgent necessity for a governance framework that enforces regulatory compliance while incorporating ethical and environmental accountability. This study analyzes the potential of Islamic legal concepts to provide a normative and ethical framework for enhancing sustainable mining governance in Indonesia. This study aims to achieve three objectives: (1) to assess the environmental, social, and economic consequences of mineral extraction; (2) to investigate Islamic legal principles pertinent to resource governance, including maqāṣid al-sharī‘ah, khilāfah, milkiyyah ‘āmmah, ḥifẓ al-bī’ah, and hisbah; and (3) to develop a cohesive analytical framework that harmonizes Islamic jurisprudence with Indonesia’s mining regulatory framework. This article utilizes a qualitative narrative-descriptive methodology, using statutory and regulatory texts, ancient and modern Islamic legal sources, MUI fatwas, environmental reports, and recent academic research. The data were systematically categorized by theme and examined using triangulation to confirm the coherence and validity of the arguments.The results indicate that Islamic law provides a thorough ethical framework that can effectively address governance deficiencies in Indonesia's mining industry. Principles such as lā ḍarar wa lā dirār and dar’ al-mafāsid muqaddam ‘alā jalb al-maṣāliḥ offer robust ethical basis for more stringent environmental regulations, while hisbah legitimizes governmental involvement to avert ecological damage. Incorporating these concepts with national mining rules and ESG standards can improve environmental protection, guarantee equitable benefit sharing, fortify community rights, and advance intergenerational justice. This research finishes by presenting a normative-ethical framework for sustainable mining that aligns positive law with Islamic environmental jurisprudence.

Abstract

Legal protection for children is a measure of national civilization, therefore it is mandatory to be attempted according to the capabilities of the nation and state. Because child protection is a legal action that has legal consequences. As educators, parents are responsible for creating a nurturing environment that can provide a sense of security and comfort to children. Based on this responsibility, parents must be good role models for their own children, but this responsibility cannot be fulfilled if parents become thieves and carry out actions that are reproachful, one of which is being involved in drugs and online gambling that occurs in Rade Village. This study aims to describe the condition of parents as drug and online gambling addicts with a phenomenological approach and case studies, data is collected through in-depth interviews with informants. The results of this study indicate that there are no laws and regulations governing the protection of children from parents who are addicted to drugs and online gambling. Parents who are addicted to drugs and online gambling have an impact on children, both in terms of economy, family, children's education, and even children's health, both in terms of children's psychology and physical health. In the maqasyid syaroah, the protection of children from parents who are addicted to drugs and online gambling is included in al daruriyat al khams which includes maintaining religion (hifz ad din), maintaining the soul (hifz an nafs), maintaining family and descendants (hifz an nasabu wal ar raddu), maintaining reason (hifz al aql), and maintaining property (hifz al mal). This category of ad daruriyah al-khams is something that must not be absent (must exist) for the sake of upholding goodness and welfare, both concerning hereafter and worldly affairs. If this aspect does not exist, then it cannot be realized, namely worldly life (chaos) and a life in the hereafter that is suffering and miserable. Legal protection efforts that can be given to children whose parents are addicted to drugs and online gambling are in the form of assistance and determining the child's custody rights so that they do not fall into the hands of irresponsible parents.

Abstract

This study discusses how global currents influence the formation, implementation, and adaptation of Islamic law in Indonesia . The purpose of this study is to analyze how the processes of globalization and transnationalization influence the development and adaptation of Islamic law in Indonesia as a state based on the principle of nomocracy, as well as to identify the challenges faced in integrating Islamic law into the national legal system. The research method used is library research, which involves searching for and collecting data from libraries, such as history books, using a sociological approach to Islamic law. The results of this study demonstrate that globalization is a unique phenomenon in human civilization. Globalization in Islamic law is not only related to external influences but also concerns how Islamic law responds to the challenges and changes of the modern world. Transnationalization creates new space for Islamic law to grow within a country. The dynamics of globalization and the transnationalization of Islamic law demonstrate how Islamic law develops and adapts in an increasingly globally connected world. Several challenges to integrating Islamic law into the legal system arise, including political challenges, legal pluralism, and international resistance to sharia.

Abstract

The Larung Sesaji or Sedekah Laut tradition is one expression of local wisdom among coastal communities in Indonesia, embodying values of gratitude, social solidarity, and ecological spirituality. This study aims to examine how this tradition represents a form of syncretism between Islamic teachings and local culture within the context of coastal society. Employing a literature review (library research) method, the study explores various up-to-date academic sources that discuss the dialectical relationship between Islamic law, cultural anthropology, and the sociology of religion. The findings indicate that Larung Sesaji has undergone a process of religious reinterpretation through the living Islam approach, in which traditional elements considered problematic are reconstructed into symbols of gratitude and charitable giving (sedekah) aligned with the values of tawhid. This tradition also serves significant social functions, including fostering social cohesion, strengthening cultural identity, and promoting environmental awareness. The syncretism observed is not a form of deviation, but rather an adaptive strategy employed by the community to maintain harmony between faith and custom. Thus, Larung Sesaji reflects a contextual practice of Islam Nusantara that is deeply rooted in the cultural wisdom of coastal communities.

Abstract

The transformation of Indonesian criminal law through Law Number 1 of 2023 opens opportunities for integrating Islamic sharia values within the national legal pluralism framework. This research examines the compatibility of qisas and diyat concepts with Indonesia's positive punishment system through a normative juridical approach analyzing philosophical convergence, juridical legitimacy, and sociological acceptability. Qisas as proportional retributive sanction and diyat as financial compensation represent a restorative justice paradigm aligned with contemporary punishment theories. Analysis of Articles 2, 51-52, and 96-97 of the new Criminal Code demonstrates that national legislation has accommodated living law in society, including religious values, as the basis for criminal case resolution. Philosophical convergence is identified through alignment between maqasid al-shariah (al-zajr, al-tashfiyah, al-islah) and national punishment objectives emphasizing preventive, rehabilitative, and restorative aspects. Juridical legitimacy is strengthened by the implementation experience of qanun jinayat in Aceh Province based on Law Number 11 of 2006 concerning Aceh Governance. The recommended implementation model encompasses diversion and restorative justice mechanisms for case resolution through penal mediation, formal application in autonomous regions, and integration of diyat as alternative sanction with judicial discretion

Abstract

Tulisan ini membahas peran otoritatif fatwa Majelis Ulama Indonesia (MUI) dalam dinamika hukum Islam di Indonesia pada era kontemporer. Kajian ini dilatarbelakangi oleh pentingnya posisi MUI sebagai lembaga keulamaan yang menjembatani antara norma-norma syariat Islam dengan kebutuhan hukum masyarakat modern. Tujuan penelitian ini adalah untuk menganalisis otoritas fatwa MUI dalam dinamika hukum Islam di Indonesia, menelusuri sumber legitimasi keilmuan dan sosialnya, serta menilai sejauh mana fatwa MUI berkontribusi terhadap perkembangan hukum Islam dan kebijakan publik nasional. Hasil penelitian menunjukkan bahwa otoritas fatwa MUI bersumber dari dua aspek utama, yaitu otoritas keilmuan ulama dan legitimasi sosial umat Islam. Fatwa MUI berfungsi sebagai living law, yakni hukum yang hidup dan memengaruhi praktik sosial serta kebijakan publik, terutama dalam bidang keuangan syariah, jaminan produk halal, dan isu-isu sosial-keagamaan. Namun, di era digital modern, MUI menghadapi tantangan besar seperti pada bidang muamalah dan isu-isu di era digital. Meski demikian, dengan menjaga independensi kelembagaan, memperkuat literasi keagamaan publik, serta memperluas kerja sama kelembagaan, MUI dapat terus mempertahankan relevansinya sebagai lembaga otoritatif yang berperan penting dalam pembentukan hukum Islam kontemporer dan penguatan moralitas publik di Indonesia.

Abstract

The phenomenon of granting marriage dispensations in Indonesia demonstrates a complex interaction between Islamic law, state law, and socio-cultural norms. This study aims to assess the consistency of the application of maqāṣid al-syarī'ah in decisions on child marriage dispensations in several Religious Courts in Indonesia, particularly in relation to the extent to which judges consider comprehensive child protection aspects. Using a qualitative method based on a normative juridical approach, this study analyzes four Religious Court decisions, namely PA Palembang No. 139/Pdt.P/2023/PA.PLG, PA Samarinda No. 335/Pdt.P/2021/PA. Smd, PA Samarinda No.148/Pdt.P/2023/PA.Smd, and PA Sengkang No. 1/Pdt.P/2020/PA.Skg, using the framework of legal pluralism  and maqāṣid al-Syarī’ah. The findings show that the judges' decisions in the four cases varied in terms of the balance between state law, religious values, and child protection. Social, cultural, and moral factors remain the main drivers in granting dispensations. However, from the perspective of maqāṣid al-Syarī’ah, most decisions still place ḥifẓ al-nasl and ḥifẓ al-'irḍ as the main basis for granting dispensations, especially to avoid social stigma resulting from pregnancy outside of marriage. while more fundamental considerations such as ḥifẓ al-nafs and ḥifẓ al-'aql, which include physical health, psychological readiness, and the child's education, have not been applied consistently. Only Samarinda Religious Court Decision No. 335 displays a more comprehensive use of maqāṣid. Based on these findings, this study recommends more operational technical guidelines so that the application of maqāṣid al-syarī'ah is not partial, but functions as a comprehensive child protection instrument in the context of Indonesian legal pluralism.
