Abstract

Verbal sexual harassment is a form of non-physical sexual violence crime as regulated in Law No. 12 of 2022 concerning Sexual Violence Crimes. This action not only degrades the victim's dignity but can also cause prolonged psychological impacts. This research aims analyze the application of the restorative justice principle to the crime of verbal sexual harassment and examine the role of law enforcement officials in its implementation. This research uses a normative-juridical method with a statutory approach and a literature study of primary, secondary, and tertiary legal materials. The results of the research show that although the application of restorative justice is possible based on Police Regulation Number 8 of 2021, Attorney General's Regulation Number 15 of 2020, and Supreme Court Regulation Number 1 of 2024, its implementation cannot be done without careful consideration. This is because the crime of verbal sexual harassment is associated with the victim's immaterial loss, which is difficult to recover merely through a peace agreement. Additionally, there is a risk of victimization if the victim is in a vulnerable position during the reconciliation process. Therefore, a litigation approach should still be prioritized when the victim explicitly desires law enforcement for the sake of certainty and the protection of their rights.

Abstract

The Supreme Court Decision No. 813 K/Pid/2023, which commuted Ferdy Sambo's death sentence to life imprisonment, sparked controversy and debate regarding the judges' reasoning. This research addresses the analytical gap in previous studies by systematically deconstructing the non-normative foundation of the ruling. Employing normative-juridical research, this study focuses on the qualitative deconstruction of the Supreme Court Decision No. 813 K/Pid/2023 as the primary data, utilizing the constructivist paradigm as the main analytical framework. The novelty of this study lies in its systematic analysis of how the judicial panel actively engaged in judicial narrative construction of the Defendant’s Social and Psychological Experiences. The analysis reveals a dual construction: the defendant was portrayed as a meritorious public servant with long service (social experience), and as an individual whose 'soul was shaken' by emotional provocation (psychological experience). This dualistic construction became the foundation for applying a rehabilitative penal paradigm. The study evaluates that while constructivism effectively unpacks the process of judicial meaning-making, the resulting construction was found to have low normative validity and was imbalanced in considering the victim's interests. This research contributes theoretically to the study of judicial narrative construction and practically to fostering more comprehensive criminal justice practices.

Abstract

This study examines the causal factors of child-to-parent violence against mothers arising from consumerist lifestyles, as well as the effectiveness of criminal law protection for mother-victims in Indonesia. Employing a normative juridical approach, the analysis focuses on Law No. 23 of 2004 on the Elimination of Domestic Violence (PKDRT Law) and Law No. 11 of 2012 on the Juvenile Criminal Justice System (SPPA Law). The findings indicate that impulsive consumerism—driven by low financial literacy and social pressure—often escalates into frustration that manifests as physical and psychological violence against mothers. The PKDRT Law has yet to explicitly regulate active economic violence perpetrated by children, while the diversion mechanism under the SPPA Law creates a dilemma between safeguarding victims’ rights and rehabilitating juvenile offenders. Recommendations include revising Article 9 of the PKDRT Law, strengthening BAPAS social reports (Litmas) to incorporate financial literacy interventions, and implementing preventive programs through the Ministry of Women's Empowerment and Child Protection (KPPPA) in collaboration with the Financial Services Authority (OJK). This study contributes to filling the analytical gap on consumerism-driven child-to-parent violence (CPV) in Indonesia and enriches the discourse on restorative justice in Southeast Asia.

Abstract

Human trafficking, or the trafficking of human beings, especially women and children for commercial sexual exploitation, is a serious problem with widespread impacts, particularly on women and children as vulnerable groups. Efforts to prevent and address these cases require an effective legal framework as a foundation for protecting human rights and guaranteeing justice. This community service activity aims to educate and educate the community in Meruyung Village, Depok City, about the role of law in preventing and addressing human trafficking. The methods used include outreach, interactive discussions, and case study simulations to increase community awareness and ability to recognize potential human trafficking and prevent it. The expected outcome of this activity is an increased public understanding of the national legal framework, such as Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking, and the role of law enforcement officers in protecting victims and prosecuting perpetrators. In addition, this activity aims to encourage active community participation in preventing human trafficking through strengthening social networks and reporting cases. Thus, the Meruyung Village community is expected to become more responsive to the issue of human trafficking and contribute to creating a safe environment free from commercial sexual exploitation. In addition to legal and educational approaches, collaboration between various parties is also key to eradicating human trafficking. Local governments, civil society organizations, educational institutions, and law enforcement officials need to work together to build an integrated protection system. This synergy can be realized through training for community cadres, establishing complaint posts at the sub-district level, and involving community and religious leaders as agents of change. With a comprehensive, community-based approach, human trafficking prevention efforts are not merely reactive but also proactive in creating social resilience that can prevent exploitation from its early stages.

Abstract

National defense is not only related to military defense, but also encompasses the active role of citizens in maintaining social and economic stability. Workers are a vital element in national development. Therefore, protecting workers' rights is an integral part of national defense efforts. This article aims to analyze the legal protection of workers' rights under Law Number 13 of 2003 concerning Manpower and relate it to the values ​​of national defense. The method used is a normative juridical approach through literature review. The results of the study indicate that labor regulations have regulated various workers' rights, but implementation challenges in the field remain high. The active role of all parties is needed to ensure legal protection is truly realized as a form of civil national defense. This indicates that legal protection for workers needs to be strengthened through the active roles of the government, employers, and workers themselves to create social and economic stability, which is an integral part of national defense. Therefore, an active role is needed from all parties, including the government, employers, and workers themselves, to realize optimal legal protection as a form of civil national defense that supports the sustainability of national development.

Abstract

Law Number 35 of 2009 concerning Narcotics provides legal space for drug addicts to receive rehabilitation as an alternative to imprisonment. This policy aims to restore addicts' condition so they can return to normal life and reduce overcrowding in correctional institutions. This study aims to analyze the effectiveness of implementing rehabilitation as a form of alternative punishment for drug addicts, both from a legal and practical perspective. The method used is normative legal research with a legislative approach and empirical studies in several rehabilitation institutions and law enforcement institutions. The results of the study indicate that although normative legal provisions already accommodate rehabilitation, in practice there are still various obstacles such as minimal coordination between agencies, a lack of facilities and infrastructure, and low public legal awareness. Therefore, strengthening regulations, increasing the capacity of rehabilitation institutions, and consistent law enforcement are needed so that rehabilitation can be an effective solution in dealing with drug abuse. Abstract

This study compares how criminal liability for sexual offenses is addressed in Indonesia and Texas through a normative analysis. Indonesia has shifted from its Dutch colonial legal background toward a victim-focused approach under Law No. 12 of 2022 (UU TPKS), which covers both non-physical and psychological abuse. In contrast, Texas relies on common law principles that stress consent, categorize offenses as felonies, and require offender registration. The research shows that Indonesia emphasizes restorative justice and uses wider definitions, while Texas prioritizes public safety with strict monitoring after convictions. These differences reflect distinct legal philosophies for dealing with sexual violence.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap anak penyandang disabilitas yang berhadapan dengan hukum menurut peraturan perundang-undangan di Indonesia serta penerapan konsep diversi bagi anak penyandang disabilitas pelaku tindak pidana kekerasan. Penelitian ini dilatarbelakangi oleh masih sedikitnya penelitian mengenai penerapan diversi pada anak penyandang disabilitas. Kebaharuan dari penelitian ini adalah belum adanya penelitian yang membahas mengenai penerapan diversi bagi anak penyandang disabilitas yang berhadapan dengan hukum sebagai pelaku tindak pidana kekerasan. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conseptual approach). Hasil penelitian menyimpulkan bahwa pertama, untuk kepentingan pemeriksaan proses hukum, anak penyandang disabilitas berhak mendapakan pendampingan dari keluarga atau pendamping yang bersangkutan. Kedua, konsep diversi dapat diterapkan untuk kasus kekerasan yang dilakukan anak penyandang disabilitas mulai dari tahap penyidikan, penuntutan, hingga proses peradilan di Pengadilan Negeri.

Abstract

This research discusses legal protection for child victims of dating violence in Indonesia, referring to Law Number 35 of 2014 concerning Child Protection. The phenomenon of dating violence among children and adolescents is becoming increasingly normalized by society, yet the available legal protection is still inadequate. The purpose of this research is to analyze the challenges and formulate efforts in implementing effective legal protection for children who are victims of dating violence. This research uses a normative juridical method with a legislative, conceptual, and legal implications approach. The research findings indicate three main challenges: the absence of legal norms due to the lack of explicit regulations regarding dating violence in the Child Protection Law, obstacles to reporting and accessing justice due to low awareness and social stigma, and weak inter-agency coordination in implementing child protection. The Indonesian Child Protection Commission (KPAI) has attempted to overcome these obstacles thru strengthening institutional synergy, policy advocacy, digital-based monitoring, and promoting responsive local regulations. However, the implementation of legal protection has not been comprehensive due to the limited understanding and sensitivity of law enforcement officials and the public. Therefore, legal updates are needed by including dating violence as a form of violence against children, increasing public legal literacy, and strengthening cross-sectoral coordination to realize child protection in accordance with the principle of the best interests of the child.

Abstract

This research explores the enforcement of criminal sanctions against union-busting practices in Indonesia, with a particular focus on the conflict between the CNN Indonesia Workers’ Solidarity (SPCI) and PT. CNN Indonesia. Employing a juridical-normative approach, the study reviews legal frameworks such as Law No. 21 of 2000 on Trade Unions and the Indonesian Criminal Code, while drawing comparisons with labor court rulings in Belgium, Germany, and France. The findings reveal that, although Indonesia’s legal system formally classifies union busting as a criminal act, its implementation remains ineffective due to the dominance of civil or bipartite settlements that rarely impose real sanctions. The research emphasizes the need for stronger institutional commitment and a more proactive role from law enforcement bodies to safeguard workers’ rights and ensure corporate accountability. Strengthening these measures will help harmonize Indonesia’s labor law with international standards promoted by the International Labour Organization (ILO).
