Abstract

In order to welcome the election of regional heads and to realize elections based on reason or ratio by critically examining the thoughts or vision and mission of the candidate pairs so that substantive democratic values can be achieved. Substantive democracy itself is when a government can realize the wishes of the people in a country, where the people themselves have the highest sovereignty in a democracy. Class This socialization activity takes the form of providing material about elections and regional elections, then there is a question and answer session and a test after providing the material to see whether the students have understood the content of the material or not. This socialization activity aims to enable students to choose leaders critically and provide an understanding of elections and regional elections. It is hoped that this activity will enable the younger generation to actively participate in politics and also create an ideal government.

Abstract

This activity addresses the themes of literacy and guidance on gadget use, aiming to equip children at Sekolah Master Depok with the skills needed to navigate modern life while maintaining positive activities like reading. In an increasingly sophisticated digital world, gadgets are not something foreign across all age groups, including children. While these technologies provide easy access to both beneficial and harmful content, the need for digital literacy has never been more urgent. UNESCO reports that Indonesia’s reading interest index is just 0.001%, meaning only one in every 1,000 Indonesians is an avid reader. Furthermore, Senior Economist Aviliani of INDEF highlights that Indonesia's digital literacy rate is only 62%, the lowest in ASEAN, where the average is around 70%. In response to these concerns, this activity was implemented at schools that cater to children with limited access to educational resources. Several strategies were employed, including explaining the positive impacts of literacy, introducing books and educational apps, discussing the negative consequences of excessive gadget use, and guiding students on how to use gadgets for productive purposes. The final results (outputs) produced from the activity that will be achieved are in the form of articles, videos, and posters designed to encourage positive behaviors. The expected benefits include a greater interest in literacy and the responsible use of gadgets, particularly for children in underprivileged areas. Additionally, the program aims to prevent the negative effects of digital devices, such as exposure to pornography and online gambling.

Abstract

The state has an obligation to guarantee the human rights of all members of society, including people living with HIV/AIDS (PLWHA). However, in practice, the human rights of PLWHA are often violated through various forms of discrimination. One way the state provides legal guarantees is by enacting legislation related to specific issues. This is the objective of the author's research: to examine PLWHA from a human rights perspective and the urgency of formulating legislation in the context of legal protection for people living with HIV/AIDS. The author employs a Normative Juridical research method in this study. The findings of the research indicate that people living with HIV/AIDS, or PLWHA, still possess human rights despite often being targets of human rights violations in Indonesia. Consequently, the formation of legislation for the legal protection of PLWHA must be expedited to ensure their legal protection.

Abstract

Introduction: Perpetrators of obscene acts have carried out various criminal acts. Obscene acts are included in sexual violence that results in physical and psychological suffering.Purposes of the Research: This study aims to analyze the fulfillment of the rights of victims of obscene acts, whether it is appropriate or not. This is based on the phenomenon of indecent acts; the more extended the number of victims increases.Methods of the Research: This study uses a normative juridical method with a statute and case approach.Results of the Research: The results of the study indicate that the rights of victims of obscene acts have been regulated and guaranteed in the 1945 Constitution of the Republic of Indonesia, the Law on Human Rights, the Law for the Protection of Witnesses and Victims and the Act on the Crime of Sexual Violence. However, the problem is in the fulfillment of these rights, even though constitutionally, the duties and obligations of fulfilling the rights of victims are borne by the State, which in this case is in the components of the Criminal Justice System, the Ministry of Law and Human Rights, the Ministry of Women's Empowerment and Child Protection, The National Commission on Human Rights, the National Commission on Violence Against Women and the Witness and Victim Protection Agency. The importance of supervision and compliance with the application of rights in everyday life will determine how successful the State is in carrying out its obligations in fulfilling the requests of victims. So it is essential to cooperate between Ministries, Institutions, National Commissions, and law enforcement officials to realize the fulfillment of the rights of victims of criminal acts of obscenity.

Abstract

This research aims to discuss the evidentiary value of victim-witness testimony in sexual violence cases after the ratification of the Sexual Violence Crime Law and to examine the obstacles that still exist after the ratification of the Sexual Violence Crime Law. Evidence in sexual violence cases already existed in the Criminal Procedure Code before the enactment of the Anti-Sexual Violence Law. 5 (five) types of valid and admissible evidence are emphasized in KUHAP Article 184, namely: letters, instructions, expert testimony, witness testimony, and confessions of suspects or defendants. Thus, to prove that the perpetrator is guilty and imprison the suspect becomes difficult due to these provisions and requirements. As a result, the suspect in the sexual violence case was acquitted. In addition, in current practice, proving the crime of sexual violence is still found several obstacles. The author in this research uses normative legal research methods with a statute approach and conceptual approach to examine the existing problems. The results of this study are expected to provide theoretical benefits, namely as a source of information for future researchers in the field of criminal law, especially related to the emphasis of the TPKS Law on the evidentiary value of victim witnesses. Then in terms of practical benefits, it is hoped that it can provide a new perspective and basic information for writers and readers to support further research on sexual violence in Indonesia, as well as assist law enforcement in an effort to protect victims of sexual violence in Indonesia.

Abstract

Sexual violence against children is a serious crime with long-term effects, requiring legal proceedings that prioritize the interests of children as victims. This study aims to analyze the factors that hinder the realization of the principle of the best interests of the child in the investigation process and to formulate its ideal implementation. The method used is normative legal research with a legislative and case study approach, supplemented by empirical data through interviews with investigators from the South Jakarta Metro Police PPA Unit. The results of the study show that the main obstacles include a lack of understanding among investigators, limited support facilities, the absence of explicit technical SOPs, the influence of conservative culture, and low public legal awareness. This study offers novelty by filling the gap in research on the principle of the best interests of the child specifically for children who are victims of sexual violence, with a focus on the investigation process an aspect that has been more extensively discussed in the context of children as perpetrators or at the trial stage. The implications of this study emphasize the importance of harmonizing regulations, developing technical guidelines based on the protection of children and victims of sexual violence, and enhancing the capacity of law enforcement officials to ensure optimal protection

Abstract

Kidfluencer from the words Kid and Influencer is the term used for children who are used as content on social media by their parents and get ad-sense or endorsements from various well-known brands that pay high prices. However, if this phenomenon is seen from a legal perspective, it has violated the child protection law which can be called economic exploitation of children, because it is the same as utilizing children’s labor for profit. The purpose of this study is to determine the factor that cause kidfluencer and the form of legal protection for victims of exploitation in the form of kidfluencer. This research uses a normative juridical method with a statutory approach. The results explain that the most contributing factor in the emergence of kidfluencers is the family factor, because their parents are influencers or artists so their children are included in it. Furthermore, Indonesia does not yet have a regulation specifically governing kidfluencers, causing uncertainty regarding whether kidfluencers are part of child exploitation in social media and which institutions are obliged to protect kidfluencers.

Abstract

The function of law as a social controller is very important, especially in formulating effective policies and law enforcement, including in the context of criminal law that is oriented towards deterrent and restoration effects. This research aims to explore the criminal liability of third parties in the crime of embezzlement in Indonesia. The formulation of the problem includes the concept of third parties in embezzlement and their criminal liability. The method used is normative juridical legal research with statutory and conceptual approaches, and qualitative data analysis. The results show that third parties can be involved either directly or indirectly in the criminal act of embezzlement, and can be subject to criminal sanctions if proven to have knowledge of the origin of illegally obtained money. Legal handling of these third parties is important to close the loopholes for the main perpetrators and prevent money laundering. This research provides new insights into the complexity of criminal liability in embezzlement cases and its implications for law enforcement in Indonesia

Abstract

The ethical violation committed by Constitutional Court Justice Anwar Usman in the Constitutional Court Decision No. 90/PUU-XXI/2023 underscores the urgent need to strengthen ethical oversight mechanisms to safeguard the integrity of the judiciary. This article analyzes the ethical breach and its implications for public trust and the legitimacy of the Constitutional Court as the guardian of the Constitution. The research employs a normative legal method with statutory, case, and conceptual approaches. The findings indicate that violations of the principles of impartiality, independence, and integrity not only tarnish the image of individual justices but also erode public confidence in the constitutional justice system. Therefore, systemic reform and greater transparency in the enforcement of judicial codes of ethics are essential to restoring the moral authority and professionalism of Indonesia’s highest judicial institution.

Abstract

This study discusses the role of the prosecutor's code of ethics in supervision and accountability to maintain the integrity of law enforcement in Indonesia, considering that integrity is the main foundation of public trust in the justice system. The purpose of this study is to analyze the extent to which the prosecutor's code of ethics acts as an instrument for controlling professional behavior and the effectiveness of the mechanism for supervision and accountability for ethical violations in the prosecutor's office. This study uses a normative legal research method with a statute approach and a conceptual approach, as well as data collection techniques through literature studies. The results of the study indicate that although the prosecutor's code of ethics has been regulated normatively and becomes a guideline for professional behavior, its implementation still faces challenges, such as weak internal supervision, less strict sanctions, and limited external supervision authority by the Prosecutor's Commission. Various cases of violations of the code of ethics, such as abuse of authority and conflicts of interest, indicate a gap between rules and practices. Therefore, it is necessary to strengthen the supervision system, update the substance of the code of ethics, and increase transparency and accountability to realize law enforcement with integrity and public trust.
