Abstract

Instilling anti-corruption and anti-drug attitudes is the first step in instilling positive attitudes. This is useful for preventing and overcoming the rampant corruption and drugs that can lead the generation of the Indonesian nation into negative things. Through the counseling or socialization method, this activity includes basic materials on drugs and corruption, including the definition, prevention, impacts, factors that can cause abuse, symptoms, the influence of corruption and drugs on the development of the Indonesian economy, religious perspectives, and instilling attitudes in society, especially the younger generation. The importance of instilling anti-corruption and anti-drug attitudes in the fields of formal and non-formal education can encourage awareness of preventing corruption and drugs. The impact is to create the next generation of Indonesia who have honesty, integrity, high responsibility, and intelligence in leading Indonesia in the future. This can lead to the realization of the golden Indonesia 2045.

Abstract

The increase in criminal cases, the length of the judicial process, and the overcrowding of correctional institutions have prompted the need for reform of criminal procedure law in Indonesia. One of the breakthroughs adopted in the New Criminal Procedure Code (KUHAP) is the mechanism of guilty pleas through the Special Track, which is conceptually similar to plea bargaining as applied in the United States criminal justice system. This study aims to analyze the comparison between the plea bargaining mechanism in the United States and the Special Track in Indonesia's New KUHAP, as well as to examine the implications of adopting elements of plea bargaining on the protection of the principle of due process of law and the application of the principles of swift, simple, and inexpensive justice. The research method used is normative juridical with a legislative, comparative, and conceptual approach, supported by a literature study of primary, secondary, and tertiary legal materials. The results of the study show that although both mechanisms have the same objective, namely the efficient resolution of criminal cases, there are fundamental differences in their structure, scope of negotiation, and the role of judges. The Special Track in the New Criminal Procedure Code places judges as the main controllers of the guilty plea process, thereby potentially strengthening the protection of due process of law. However, without clear technical regulations and strict judicial oversight, this mechanism risks putting pressure on defendants and reducing their right to a fair trial.

Abstract

The development of information technology has driven a transformation in the modus operandi of illicit drug trafficking from conventional methods to digital methods through encrypted communication applications, such as Zangi, which complicates the tracking and evidence gathering processes for law enforcement agencies. This study aims to analyze the modus operandi of narcotics trafficking syndicates through digital media and to examine the urgency of reformulating Law No. 35 of 2009 on Narcotics. This study is a normative legal research employing legislative, conceptual, and case based approaches. The findings indicate that current regulations do not explicitly address drug trafficking based on electronic systems, rendering them ill suited to the evolution of digital technology. Although electronic evidence is recognized under criminal procedure law, its implementation still faces technical challenges and limitations in law enforcement capacity. Therefore, a reformulation of the Narcotics Law is necessary, encompassing the expansion of the legal definition of digital based criminal offenses, the strengthening of cyber oversight authorities, and the regulation of electronic platform liability to achieve an adaptive and effective criminal law policy in the digital era.
