Abstract

This article discusses one of the impacts of a serious problem that has hit the world, namely the Covid-19 pandemic, the impact of which is extraordinary, hundreds of thousands of people have lost their lives as a result of this terrible pandemic. Indonesia is one of the countries that has suffered enormous losses from the loss of human life and the collapse of the Indonesian economy. Apart from the loss of human life, other sectors such as the domestic and global economy have experienced destruction due to the impact of restrictions on social activities which have brought several economic sectors to a halt. The impact of this pandemic has forced many children in various parts of the world to lose their parents, they experience suffering and sorrow because they have lost the people they took refuge in. They are forced to live a life without their loved ones, they are forced to work to survive, and live a new life with all kinds of risks that they have to face, such as the potential for vulnerability, to experience various forms of violence from people around them who don't care about them. child's condition. The loss of the main guardian, namely parents or grandparents, puts children's future at risk. Without the presence of a guardian, children will have difficulty meeting their needs for clothing, food and shelter independently. Not only that, they are also threatened with losing the opportunity to continue the education they are currently receiving. Children's mental development is disrupted because they lose someone who always gives them attention and affection. Apart from that, they will also be vulnerable to child marriage, child trafficking and other acts of violence and crime. Abstract

In the rapidly evolving digital era like today, the phenomenon of kidfluencers or kids influencers has emerged as an intriguing aspect, sparking debates regarding another form of exploitation of children. Kid influencers are children who become influencers on social media by sharing content about their daily lives, often utilized to promote certain products or brands as well. While some argue that this phenomenon can serve as a platform for expressing children's talents and creativity, many also express concerns about the potential exploitation that may occur. This journal elaborates on the role of society towards kid influencers as another form of child exploitation. Society plays a dual role in this phenomenon, where they can act as watchdogs to prevent exploitation or, conversely, exploit the popularity of these children for personal gain. In the legal context, there is a need for stronger protection for children who become influencers. However, Indonesia itself has not yet established specific regulations regarding kid influencers, although some laws and government regulations can serve as a basis for protecting children from exploitation. Protecting children who become kid influencers requires a comprehensive approach, involving the role of the government, parents, and society as a whole. This includes creating clear regulations, enhancing education, developing guidelines, and implementing an effective reporting system to prevent child exploitation. Awareness of the dangers of child exploitation also needs to be raised, as well as the importance of reporting content that is suspected of exploiting children to the authorities. Thus, legal protection and societal awareness are crucial steps in safeguarding the well-being of children in this complex phenomenon of kid influencers.

Abstract

Abstrak: Praktik pengangkatan anak merupakan suatu prosedur yang mengizinkan seseorang untuk menjadi orangtua angkat bagi anak yang tidak memiliki orangtua dan keluarga. Pengangkatan anak dilaksanakan dengan motif dan tujuan yang berbeda-beda, meskipun tujuan dan latar belakang yang berbeda-beda dalam mengangkat seorang anak, ndamun semua prosesdur harus mengikuti hukum positif yang berlaku. Pasca pengangkatan anak, maka hak asasi manusia yang melekat harus dilindungi dan dijaga dengan baik, seperti hak untuk memperoleh perlindungan, pendidikan, dan lain-lain. Dengan makna lain artinya seorang anak harus tercapai kesejahteraannya. Di Indonesia realitanya kesejahteraan anak adopsi masih jauh dari optimal. Penelitian ini merumuskan suatu masalah bagaimana praktik hak pengangkatan anak (adopsi) beserta kesejahteraannya berdasarkan hukum positif dan bagaimana faktor pendukung dan faktor penghambat dalam menciptakan kesejahteraan anak di Indonesia? Adapun Metode penelitian yang digunakan adalah penelitian normatif yuridis, melalui pendekatan perundang-undangan dan pendekatan konsep akan menjawab kedua rumusan masalah. Hasil penelitian menunjukkan bahwa undang-undang hak asasi manusia terhadap anak beserta undang-undang kesejahteraan anak sudah cukup mengakomodir untuk mendukung jalannya kesejahteran seorang anak pasca pengangkatan anak (adopsi), namun dalam praktiknya masih kurang optimal, hal ini menjadi salah satu faktor penghambat kesejahteran anak itu dapat terwujud, saran untuk pemerintah adalah menciptakan kegiatan sosialisasi kebutuhan anak secara masif dan sistematis secara nasional. Kata Kunci : Adopsi Anak, Kesejahteraan anak, Hak Asasi Manusia, Undang-Undang.   Abstract; The practice of child adoption is a procedure that allows a person to become an adoptive parent for a child who does not have parents and family. Although there are different purposes and backgrounds for adopting a child, all processes must follow the applicable positive law. After the adoption of a child, the inherent human rights must be protected and maintained properly, such as the right to protection, education, and others. In other words, it means that a child's welfare must be achieved. In Indonesia, the reality is that the welfare of adopted children is far from optimal. This research formulates a problem of how the practice of child adoption rights and welfare based on positive law and how the supporting factors and inhibiting factors in creating child welfare in Indonesia? The research method used is juridical normative research, through a statutory approach and concept approach will answer both problem formulations. The results of the study indicate that the law on human rights to children and the law on child welfare have accommodated enough to support the welfare of a child after adoption, but in practice it is still not optimal, this is one of the inhibiting factors for the welfare of the child to be realized, the suggestion for the government is to create massive and systematic socialization activities of children's needs nationally. Abstract

Seeing from the historical side, violence is one of the oldest social problems, which may be as old as human civilization, this is understandable because basically humans are homo homini lupus creatures, referring to the thoughts of the famous philosopher Aristotle, that humans can become wolves for others, can become "cannibals" in the sense that in certain situations humans can commit acts of violence against others both in physical and psychological forms. One form of violence that has been a serious problem for a long time is gender-based violence, especially against vulnerable groups, namely women. The phenomenon of violence against women is a global issue that continues to be discussed in various forums on a domestic, regional and international scale. Gender-based violence does not only target women, but can also occur in several other groups such as men, transgender or LGBT people. However, statistically, it does happen more to women. Gender-based violence targeting women is an act of terror against women that occurs quite a lot in various parts of the world Online Gender-Based Violence (GBV) has become a global phenomenon that is happening along with the progress and increased access to internet-based communication technologies. This research is a normative legal research that is reinforced with primary data to sharpen analysis. The results show that the forms of gender-based violence against women are cyber grooming, cyber harassment, hacking, illegal content, infringement of privacy, threat of personal photo/video distribution (malicious distribution), online defamation, and online recruitment. Legal protection for women victims of online gender-based violence refers to the regulations stipulated in the PKDRT Law, ITE Law, Child Protection Law, Pornography Law and TPKS Bill.

Abstract

Masyarakat marginal merupakan kelompok masyarakat yang paling rentan diperlakukan secara tidak adil dan diskriminasi. Dilihat dari kenyataan yang ada, seringkali masyarakat marginal menjadi korban ketidakadilan dalam proses penegakan hukum di Indonesia. Dengan menggunakan pendekatan restorative justice, maka upaya negara dalam memberikan perlindungan hukum dan keadilan bagi masyarakat marginal yang melakukan suatu tindak pidana ringan dapat direalisasikan. Namun hingga saat ini, sistem peradilan pidana masih belum sepenuhnya mengatur terkait penyelesaian tindak pidana melalui pendekatan restorative justice. Penelitian ini bertujuan untuk mengetahui bagaimana cara penerapan konsep restorative justice sehingga dapat memberikan perlindungan hukum dan keadilan dalam penyelesaian perkara tindak pidana ringan yang melibatkan kaum marginal. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif dan teknik pengumpulan data dilakukan dengan studi kepustakaan, menggunakan sumber data sekunder. Hasil penelitian ini menunjukkan bahwa mekanisme penyelesaian perkara menggunakan restorative justice, dapat dilakukan dengan menggunakan musyawarah mufakat maupun mediasi, dimana para pihak yang berkepentingan dapat berkompromi agar tercapainya suatu kesepakatan bersama. Selain itu, proses penyelesaian perkara melalui pendekatan restorative justice dilakukan dengan mencari solusi bersama-sama antara semua pihak yang terkait, tanpa adanya salah satu pihak yang dominan, dan semua pihak tersebut diberikan perhatian serta kesempatan yang sama.

Abstract

This study aims to analyze the prospects of legalizing cannabis for medical use in Indonesia through a comparative study with the policies implemented in Thailand. The method used is normative-empirical legal research, combining literature review (legislation and literature) with in-depth interviews with the National Narcotics Agency and Lingkar Ganja Nusantara to enrich and validate normative findings. The results of the study show that the potential for medical cannabis legalization in Indonesia is highly dependent on the implementation of strict and structured regulations, an effective monitoring system, and a phased approach. The comparative study with Thailand provides crucial lessons on the need for a mature legal framework and strong control mechanisms to avoid the risks of uncontrolled liberalization. The novel contribution of this research lies in the integration of empirical perspectives from key actors in analyzing lessons learned from Thailand to formulate an adaptive policy model in Indonesia. Thus, this study concludes that the legalization of medical cannabis in Indonesia has great prospects for realization, provided it is supported by comprehensive policies that prioritize public health interests and legal certainty.

Abstract

This study examined the urgency of reforming Indonesia’s military justice system in accordance with the principle of Nemo Est Supra Leges, which asserts that no individual stands above the law. The research aimed to analyze the normative disharmony between Article 9 of Law No. 31 of 1997 on Military Courts and Article 65 of Law No. 34 of 2004 on the Indonesian National Armed Forces, as well as to evaluate the application of the Nemo Est Supra Leges principle in the case involving the shooting of a car rental business owner by members of the Indonesian Navy. The study employed a normative juridical method with statutory, case, and conceptual approaches. The findings revealed that the inconsistency between the two legal provisions resulted in overlapping jurisdictions and weakened the principle of equality before the law within the national judicial system. Moreover, the implementation of the Nemo Est Supra Leges principle had not been fully realized. The study concluded that reforming the military justice system is imperative to ensure fair, transparent, and accountable law enforcement in alignment with the rule of law in a democratic state.

Abstract

Pemidanaan terhadap pecandu narkotika terdapat dua sisi pandangan dalam aspek penegakan hukumnya. Pecandu narkotika dipandang sebagai korban berdasarkan sudut pandang ilmu kesahatan serta dari aspek hukum karena di dalam UU Narkotika pencandu narkotika dianggap sebagai orang sakit yang perlu mendapatkan rehabilitasi, akan tetapi di dalam kenyataannya seringkali pecandu narkotika diperlakukan sebagai penjahat dan dijatuhi hukuman berupa pidana penjara dalam proses penegakan hukum di Indonesia. Dalam penelitian ini, pemidanaan terhadap pecandu narkotika di Indonesia akan ditinjau berdasarkan aspek tujuan penegakan hukum. Metode penelitian yang digunakan yuridis normatif dengan sumber data utama adalah studi kepustakaan. Pendekatan masalah yang digunakan adalah pendekatan teoritis dan analisa putusan. Hasil penelitian menunjukkan bahwa pemidanaan bagi pecandu narkotika di Indonesia tidak sesuai dengan tujuan dari penegakan hukum yaitu keadilan, kemanfaatan, dan kepastian hukum. Pemidanaan berupa pidana penjara terhadap pecandu narkotika di Indonesia juga dinilai tidak efektif, karena dinilai tidak mampu memperbaiki para pecandu narkotika maupun menimbulkan dampak positif bagi masyarakat dan negara. Kata kunci: Narkotika, Pecandu Narkotika, Tujuan Penegakan Hukum. Abstract Penalties for narcotics addicts have two sides of view in the aspect of law enforcement. Narcotics addicts are seen as victims from a medical point of view as well as from the legal aspect because in the Narcotics Act narcotics addicts are considered as sick people who need to get rehabilitation, but in reality often narcotics addicts are treated as criminals and sentenced in the form of imprisonment in the enforcement process law in Indonesia. In this study, the punishment of narcotics addicts in Indonesia will be reviewed based on the aspects of law enforcement objectives. The research method used by normative juridical with the main data source is literature study. The problem approach used is the theoretical approach and decision analysis. The results of the research show that criminal punishment for narcotics addicts in Indonesia is not in accordance with the objectives of law enforcement, namely justice, expediency, and legal certainty. The conviction in the form of imprisonment of narcotics addicts in Indonesia is considered ineffective, because it is considered unable to improve narcotics addicts or to have a positive impact on society and the country.

Abstract

This research analyzes the implementation of rehabilitation policies under Law Number 35 of 2009 on Narcotics and their misuse by certain law enforcement officers. The study focuses on understanding rehabilitation as a right for victims of narcotics abuse and identifying the factors leading to extortion practices. The research employs a normative legal approach combined with statutory, case, and conceptual analyses. The findings reveal that although rehabilitation is regulated as an alternative to imprisonment aimed at health recovery and social reintegration, its implementation faces significant challenges, including limited facilities, social stigma, and unclear technical regulations. These conditions create opportunities for police officers to exploit legal loopholes and the vulnerable position of victims through extortion. Economic motives, social environment, weak internal supervision, and a permissive police organizational culture are identified as the main contributing factors. This study emphasizes the importance of strengthening regulations, enhancing law enforcement accountability, and expanding access to legal aid to ensure that rehabilitation policies truly protect victims and remain free from abuse of authority.
