Abstract

Pendidikan merupakan salah satu hal paling mudah yang dapat dimiliki oleh setiap manusia untuk mengubah nasib hidupnya serta memberikan sebuah kontribusi pemikiran terhadap kemajuan bangsa. Walaupun begitu, tidak semua orang dapat mendapatkannya, entah dikarenakan aksesibilitas dan fasilitas yang tidak mendukung maupun kurangnya kesadaran individu akan pentingnya pendidikan. Oleh karena itu, kami melakukan sebuah projek yang didasarkan pada urgensi permasalahan kurangnya kesadaran generasi muda bangsa terhadap pentingnya pendidikan melalui sosialisasi dan interaksi mutual. Mitra yang bekerja sama dengan kami adalah SMP Bakti Idhata (terkhususnya siswa-siswi kelas 9) dan Yayasan Al-Wardah (terkhususnya siswa-siswi sekolah dasar). Kami memilih untuk bekerja sama dengan kedua institusi pendidikan tersebut dikarenakan terdapat suatu permasalahan yang berkaitan dengan tema dan judul proyek yang kami bawakan, yakni tentang bagaimana siswa dan siswi memberikan sebuah pemaknaan mendalam terkait dengan pentingnya pendidikan dalam hidup mereka sehingga terdapat sebuah sinkronisasi antara kebutuhan kami selaku pelaksana proyek dengan mitra selaku target pelaksanaan sosialisasi kami.pelaksanaan. Pelaksanaan dari sosialisasi ini memberikan sebuah hasil yang sangat memuaskan di mana kami selaku pemapar materi berhasil menarik siswa-siswi untuk ikut berpartisipasi dalam mewujudkan terjadinya sebuah interaksi mutual antara kami sebagai pengajar dan siswa sebagai pelajar. Materi pemaknaan pentingnya pendidikan dilanjut dengan beberapa rencana yang dapat diambil oleh para siswa untuk mengambil langkah selanjutnya juga memberikan mereka sebuah pencerahan akan cita-cita mereka di masa depan dengan menempel post-it kepada sebuah spanduk dan pemberian feedback akan materi yang telah disampaikan. Dampaknya, siswa dan siswi memiliki pemahaman lebih dalam akan pentingnya pendidikan dalam hidup mereka, baik untuk kemaslahatan diri maupun orang di sekitar serta nusa dan bangsa.

Abstract

This study aims to analyze the settlement of cases of children in conflict with the law through a diversion approach at the investigation stage in order to realize restorative justice. . Diversion efforts at the investigation stage need to be carried out if cases of children in conflict with the law meet the requirements for diversion. Diversion means the granting of authority to law enforcement officials to take policy actions in dealing with or resolving the problem of child violations by not taking formal steps, including stopping or not continuing from the criminal justice process or returning it to the community. Or in other words, diversion is the transfer of a child's case from the criminal justice process to a process outside of criminal justice. This effort is carried out, especially in the investigation stage, which needs to be carried out in order to provide protection for children in conflict with the law, especially if the crime committed meets the diversion requirements. However, in reality in the field there are still many law enforcers, especially the police, who do not use this authority, this is due to various factors such as a lack of understanding from law enforcement officials regarding the treatment and handling of children in conflict with the law at every stage of the legal process. If diversion can be carried out early, it can prevent children in conflict with the law from having to go through all the long legal processes that can ultimately affect the child's psychological development. Diversion efforts are also in the context of realizing restorative justice which emphasizes recovery back to its original state rather than retaliation. The research method used is a juridical-normative approach with a statute approach and a conceptual approach. The results of the study conclude that firstly, for the best interests of the child, both as the perpetrator and the victim, it is necessary to make diversion efforts at the investigation stage if it meets the requirements to protect children. Second, the concept of diversion at the investigation stage experienced problems or was not carried out due to several factors such as the lack of understanding of law enforcement officials and the absence of agreement in the diversion deliberation.

Abstract

School environmental cleanliness is essential to create a healthy and productive learning environment. This study discusses various technologies that can be implemented in schools to improve effective and innovative cleanliness. These technologies include an app-based waste management system, the use of air quality sensors, and a digital platform to teach students about the importance of environmental cleanliness. Digital waste management systems enable schools to optimize waste collection and processing by monitoring and managing waste in real-time. Air quality sensors can also indicate levels of cleanliness and air pollution, which are essential for student health. In contrast, digital learning resources encourage students to actively participate in maintaining environmental cleanliness. Research shows that the use of technology not only improves school environmental cleanliness but also makes students more aware and responsible for cleanliness. In technology-based programs, students tend to have a positive attitude towards cleanliness and are more active in maintaining cleanliness. Consequently, incorporating technology into school environmental cleanliness has been shown to be effective in creating a cleaner, healthier, and more sustainable learning environment. For the future benefits of school environmental cleanliness, this study suggests further development of existing technologies.

Abstract

An advocate has the right to immunity in carrying out his profession by the professional code of ethics. However, there are problems regarding how lawyers are held accountable for mistakes when providing legal services such as making legal opinions that contain legal errors. Research was conducted to answer the legal problems that arise. This research utilizes normative legal research from statutory regulations, journals, and relevant news in the mass media. The research results show that giving a misleading legal opinion violates the ethics of honesty held by advocates, and the party harmed by a legal opinion can seek accountability through a lawsuit or complaint. Thus, even though advocates have immunity, they can still be held responsible for mistakes in making legal opinions they make. Keywords: Advocate; Legal opinion; Code of Ethics

Abstract

Konsep kebudayaan dan masyarakat merupakan satu kesatuan yang tidak bisa dipisahkan. Keberagaman budaya di negeri ini merupakan salah satu modal dasar pembangunan. Salah satu permasalahan utama dalam kebudayaan Indonesia yaitu adanya efek dari globalisasi. Sedangkan demi membantu pembangunan menuju Indonesia Emas, memanfaatkan warisan budaya dapat menjadi faktor pembantu yang efektif demi tercapainya tujuan. Penelitian ini bertujuan untuk menjelaskan pentingnya keikutsertaan budaya untuk pembangunan negara. Penelitian ini menggunakan metode penelitian kualitatif yang dibantu dengan teknik pengumpulan data studi pustaka. Hasil dari penelitian ini menunjukkan bahwa Indonesia mampu memanfaatkan kebudayaan mereka seperti negara-negara Asia Timur yang juga memiliki warisan budaya yang khas. Dengan SDM yang mumpuni, perubahan pola pikir menjadi growth mindset diperlukan. Indonesia dapat melihat kebudayaan negara lain seperti Korea Selatan, China, dan Jepang sebagai pemanfaatan dan pelestarian diberbagai aspek kehidupan. Kesimpulannya, kebudayaan memang sudah sepatutnya menjadi hal yang harus dibanggakan bagi suatu negara. Indonesia dapat melahirkan masyarakat yang unggul serta mewujudkan visi Indonesia Emas melalui salah satu pilar pendukung, yaitu memanfaatkan warisan kebudayaan.

Abstract

This article discusses one of the impacts of a serious problem that has hit the world, namely the Covid-19 pandemic, the impact of which is extraordinary, hundreds of thousands of people have lost their lives as a result of this terrible pandemic. Indonesia is one of the countries that has suffered enormous losses from the loss of human life and the collapse of the Indonesian economy. Apart from the loss of human life, other sectors such as the domestic and global economy have experienced destruction due to the impact of restrictions on social activities which have brought several economic sectors to a halt. The impact of this pandemic has forced many children in various parts of the world to lose their parents, they experience suffering and sorrow because they have lost the people they took refuge in. They are forced to live a life without their loved ones, they are forced to work to survive, and live a new life with all kinds of risks that they have to face, such as the potential for vulnerability, to experience various forms of violence from people around them who don't care about them. child's condition. The loss of the main guardian, namely parents or grandparents, puts children's future at risk. Without the presence of a guardian, children will have difficulty meeting their needs for clothing, food and shelter independently. Not only that, they are also threatened with losing the opportunity to continue the education they are currently receiving. Children's mental development is disrupted because they lose someone who always gives them attention and affection. Apart from that, they will also be vulnerable to child marriage, child trafficking and other acts of violence and crime. Abstract

In the rapidly evolving digital era like today, the phenomenon of kidfluencers or kids influencers has emerged as an intriguing aspect, sparking debates regarding another form of exploitation of children. Kid influencers are children who become influencers on social media by sharing content about their daily lives, often utilized to promote certain products or brands as well. While some argue that this phenomenon can serve as a platform for expressing children's talents and creativity, many also express concerns about the potential exploitation that may occur. This journal elaborates on the role of society towards kid influencers as another form of child exploitation. Society plays a dual role in this phenomenon, where they can act as watchdogs to prevent exploitation or, conversely, exploit the popularity of these children for personal gain. In the legal context, there is a need for stronger protection for children who become influencers. However, Indonesia itself has not yet established specific regulations regarding kid influencers, although some laws and government regulations can serve as a basis for protecting children from exploitation. Protecting children who become kid influencers requires a comprehensive approach, involving the role of the government, parents, and society as a whole. This includes creating clear regulations, enhancing education, developing guidelines, and implementing an effective reporting system to prevent child exploitation. Awareness of the dangers of child exploitation also needs to be raised, as well as the importance of reporting content that is suspected of exploiting children to the authorities. Thus, legal protection and societal awareness are crucial steps in safeguarding the well-being of children in this complex phenomenon of kid influencers.

Abstract

Abstrak: Praktik pengangkatan anak merupakan suatu prosedur yang mengizinkan seseorang untuk menjadi orangtua angkat bagi anak yang tidak memiliki orangtua dan keluarga. Pengangkatan anak dilaksanakan dengan motif dan tujuan yang berbeda-beda, meskipun tujuan dan latar belakang yang berbeda-beda dalam mengangkat seorang anak, ndamun semua prosesdur harus mengikuti hukum positif yang berlaku. Pasca pengangkatan anak, maka hak asasi manusia yang melekat harus dilindungi dan dijaga dengan baik, seperti hak untuk memperoleh perlindungan, pendidikan, dan lain-lain. Dengan makna lain artinya seorang anak harus tercapai kesejahteraannya. Di Indonesia realitanya kesejahteraan anak adopsi masih jauh dari optimal. Penelitian ini merumuskan suatu masalah bagaimana praktik hak pengangkatan anak (adopsi) beserta kesejahteraannya berdasarkan hukum positif dan bagaimana faktor pendukung dan faktor penghambat dalam menciptakan kesejahteraan anak di Indonesia? Adapun Metode penelitian yang digunakan adalah penelitian normatif yuridis, melalui pendekatan perundang-undangan dan pendekatan konsep akan menjawab kedua rumusan masalah. Hasil penelitian menunjukkan bahwa undang-undang hak asasi manusia terhadap anak beserta undang-undang kesejahteraan anak sudah cukup mengakomodir untuk mendukung jalannya kesejahteran seorang anak pasca pengangkatan anak (adopsi), namun dalam praktiknya masih kurang optimal, hal ini menjadi salah satu faktor penghambat kesejahteran anak itu dapat terwujud, saran untuk pemerintah adalah menciptakan kegiatan sosialisasi kebutuhan anak secara masif dan sistematis secara nasional. Kata Kunci : Adopsi Anak, Kesejahteraan anak, Hak Asasi Manusia, Undang-Undang.   Abstract; The practice of child adoption is a procedure that allows a person to become an adoptive parent for a child who does not have parents and family. Although there are different purposes and backgrounds for adopting a child, all processes must follow the applicable positive law. After the adoption of a child, the inherent human rights must be protected and maintained properly, such as the right to protection, education, and others. In other words, it means that a child's welfare must be achieved. In Indonesia, the reality is that the welfare of adopted children is far from optimal. This research formulates a problem of how the practice of child adoption rights and welfare based on positive law and how the supporting factors and inhibiting factors in creating child welfare in Indonesia? The research method used is juridical normative research, through a statutory approach and concept approach will answer both problem formulations. The results of the study indicate that the law on human rights to children and the law on child welfare have accommodated enough to support the welfare of a child after adoption, but in practice it is still not optimal, this is one of the inhibiting factors for the welfare of the child to be realized, the suggestion for the government is to create massive and systematic socialization activities of children's needs nationally. Abstract

Seeing from the historical side, violence is one of the oldest social problems, which may be as old as human civilization, this is understandable because basically humans are homo homini lupus creatures, referring to the thoughts of the famous philosopher Aristotle, that humans can become wolves for others, can become "cannibals" in the sense that in certain situations humans can commit acts of violence against others both in physical and psychological forms. One form of violence that has been a serious problem for a long time is gender-based violence, especially against vulnerable groups, namely women. The phenomenon of violence against women is a global issue that continues to be discussed in various forums on a domestic, regional and international scale. Gender-based violence does not only target women, but can also occur in several other groups such as men, transgender or LGBT people. However, statistically, it does happen more to women. Gender-based violence targeting women is an act of terror against women that occurs quite a lot in various parts of the world Online Gender-Based Violence (GBV) has become a global phenomenon that is happening along with the progress and increased access to internet-based communication technologies. This research is a normative legal research that is reinforced with primary data to sharpen analysis. The results show that the forms of gender-based violence against women are cyber grooming, cyber harassment, hacking, illegal content, infringement of privacy, threat of personal photo/video distribution (malicious distribution), online defamation, and online recruitment. Legal protection for women victims of online gender-based violence refers to the regulations stipulated in the PKDRT Law, ITE Law, Child Protection Law, Pornography Law and TPKS Bill.

Abstract

Masyarakat marginal merupakan kelompok masyarakat yang paling rentan diperlakukan secara tidak adil dan diskriminasi. Dilihat dari kenyataan yang ada, seringkali masyarakat marginal menjadi korban ketidakadilan dalam proses penegakan hukum di Indonesia. Dengan menggunakan pendekatan restorative justice, maka upaya negara dalam memberikan perlindungan hukum dan keadilan bagi masyarakat marginal yang melakukan suatu tindak pidana ringan dapat direalisasikan. Namun hingga saat ini, sistem peradilan pidana masih belum sepenuhnya mengatur terkait penyelesaian tindak pidana melalui pendekatan restorative justice. Penelitian ini bertujuan untuk mengetahui bagaimana cara penerapan konsep restorative justice sehingga dapat memberikan perlindungan hukum dan keadilan dalam penyelesaian perkara tindak pidana ringan yang melibatkan kaum marginal. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif dan teknik pengumpulan data dilakukan dengan studi kepustakaan, menggunakan sumber data sekunder. Hasil penelitian ini menunjukkan bahwa mekanisme penyelesaian perkara menggunakan restorative justice, dapat dilakukan dengan menggunakan musyawarah mufakat maupun mediasi, dimana para pihak yang berkepentingan dapat berkompromi agar tercapainya suatu kesepakatan bersama. Selain itu, proses penyelesaian perkara melalui pendekatan restorative justice dilakukan dengan mencari solusi bersama-sama antara semua pihak yang terkait, tanpa adanya salah satu pihak yang dominan, dan semua pihak tersebut diberikan perhatian serta kesempatan yang sama.
