Abstract

This study addresses the growing utilization of traditional music performances as a tourism attraction, which simultaneously raises legal concerns, including unauthorized commercialization, lack of clarity in royalty arrangements and benefit-sharing, and risks of misuse through recording and digital promotion. These conditions reflect a gap between the normative recognition of traditional music and its practical implementation within the tourism sector. This research aims to compare the legal frameworks in Indonesia, the Philippines, and Malaysia, and to formulate an ideal regulatory model for Indonesia in protecting traditional music performances in tourism. The method employed is normative legal research using statutory and comparative approaches. The findings indicate that Indonesia emphasizes state custodianship over Traditional Cultural Expressions (TCEs), the Philippines prioritizes recognition of indigenous communal rights, cultural registration, and institutional strengthening, while Malaysia adopts a more operational regulatory framework concerning performers’ rights, remuneration, and the commercial use of performances. An ideal regulatory framework for Indonesia should be directed toward the classification of utilization permits, strengthening the role of custodian communities, identifying primary commercial users, regulating benefit-sharing mechanisms, establishing standard contractual provisions, monitoring digital use, and enhancing cross-sectoral coordination to ensure greater legal certainty and fairness in protecting traditional music performances.

Abstract

The Anti-Money Laundering (AML) program is designed to detect and prevent the flow of illicit funds, particularly those linked to terrorism financing. However, law enforcement efforts face significant challenges, including inadequate coordination in tracking digital transactions, technical limitations, and the complexity of proving criminal acts. These issues are especially pronounced in the Riau Islands Province, Indonesia, which has the highest potential for money laundering due to its strategic border location. Batam City, a key economic hub, ranks second after Jakarta regarding suspicious financial transactions. This study examines the effectiveness of the AML program in addressing money laundering in Batam City. Using an empirical approach, the research analyzes the coordination and implementation of AML initiatives at regional and provincial levels. Findings reveal critical gaps in enforcement strategies and highlight the need for improved interagency collaboration, advanced technical capabilities, and streamlined legal processes to combat money laundering effectively. The study concludes by proposing actionable solutions to reduce the prevalence of suspicious financial activities in Batam City. Key recommendations include strengthening regulatory frameworks, enhancing digital transaction monitoring, and fostering regional cooperation. This research contributes to the broader effort of fortifying Indonesia’s financial security and integrity

Abstract

The phenomenon of off-procedure transactions between consumers and business actors is increasingly prevalent in business practices. The legal issue arising from this practice is the uncertainty in consumer protection, as business actors frequently evade liability by invoking the doctrine of ultra vires. This research aims to analyze the legal certainty of consumer protection in off-procedure transactions using an analytical approach based on the principles of ultra vires and vicarious liability. This study employs a normative legal research method, utilizing secondary data obtained through literature review. The findings indicate that the Consumer Protection Law, as lex specialis, provides a strong legal foundation to guarantee the protection of consumer rights, including in transactions conducted outside official procedures, provided that consumers act in good faith and the transactions are related to goods or services traded by business actors. Article 19 of the Consumer Protection Law applies the principle of strict liability, requiring business actors to compensate consumers for losses incurred, while Article 1367 of the Indonesian Civil Code reinforces corporate liability for employees’ actions conducted within the scope of employment under the vicarious liability doctrine. Although business actors may assert the ultra vires doctrine, this principle cannot be used as an absolute defense to evade liability when transactions are connected to the business activities of the company. Therefore, consumer protection must remain a priority to ensure legal certainty and fairness in transactions within Indonesia’s business landscape.

Abstract

Mandatory sustainability reporting is an important method for evaluating and monitoring sustainable development. Therefore, this study aimed to explore the feasibility of adapting the principles underlying the EU's Corporate Sustainability Reporting Directive to enhance the sustainability reporting framework in Indonesia. A normative legal study method was used with a comparative approach to provide relevant analysis. The results showed that the direct modelling of the EU’s legal framework for mandatory sustainability disclosure was unrealistic for Indonesia due to the substantial disparity in legal development between the jurisdictions. This study contributed to the literature by proposing a novel regulatory sandbox framework as a transitional legal mechanism for Indonesia to adapt EU CSRD principles into the sustainability disclosure policy. Unlike direct transplantation approaches, this phased experimental model enabled evidence-based policy development while accounting for institutional capacity gaps and a fragmented regulatory landscape. The proposed framework offered a practical pathway for developing economies to bridge the developmental gap in sustainability disclosure requirements without imposing premature financial burdens on enterprises.

Abstract

This study explores the practice of informed consent in Batam's public health centers, focusing on information asymmetry and its implications for human rights protection. The objective is to analyze the effectiveness of informed consent implementation and its alignment with patients' rights to information and autonomy. Using an empirical legal method and a socio-legal approach, the research collects data through interviews, questionnaires, and document analysis involving medical personnel and patients. Findings indicate that although the legal framework for informed consent is adequate, its application remains flawed due to issues such as inadequate communication, passive patient behavior, and cultural factors. Only 58.33% of healthcare professionals provide comprehensive information, contributing to information asymmetry. This imbalance undermines patients' ability to make fully informed decisions, potentially compromising their right to consent. The study calls for improved communication practices and legal reforms to better protect patients' human rights in healthcare.
