Abstract

This article discusses the effectiveness of preventive mechanisms based on Internet of Things (IoT) technology and reputation assessment systems in reducing car rental disputes in the realm of binding law. The rapid growth of the car rental industry in Indonesia poses challenges in the form of potential defaults that are a major concern. Internet of Things (IoT) technology offers a solution by allowing vehicle owners to monitor the condition and location of the vehicle in real-time, this technology is also able to provide valid evidence if there is a breach of contract. The existence of a tenant rating system allows data-based assessment of the tenant's compliance history and contractual responsibilities so that this system can increase transparency and accountability, motivate tenants to act more responsibly, and make it easier for vehicle owners to assess the risk of prospective tenants. This research uses a normative juridical method with a literature study-based approach. This research found that the application of IoT technology can strengthen legal certainty and provide protection for rental owners against the risk of vehicle misuse. The combination of these two approaches is expected to build a safer, more effective, and sustainable car rental ecosystem. This research underscores the importance of detailed regulations and strict supervision to ensure the implementation of these technologies in the car rental industry.

Abstract

A private land sale and purchase agreement is a written contract between two parties without the involvement of an authorized public official. Although legally, a private land sale and purchase agreement meets the requirements set out in Article 1320 of the Indonesian Civil Code, which governs the legal validity of contracts, such an agreement carries significant consequences in terms of proof and may be subject to challenges regarding its validity. This study aims to examine, analyze, and address the validity of private land sale and purchase agreements under the provisions of named contracts as regulated in the Indonesian Civil Code, the legal protection afforded to the parties involved in such agreements, and the evidentiary mechanisms for resolving disputes arising from private land sale and purchase transactions. The findings of this research reveal that, while the sale is substantively valid, in terms of agrarian legal formalities, a private land sale and purchase agreement is not considered fully complete, as it is not executed through a Land Deed Official (PPAT) deed. Therefore, to protect the parties involved in a private land sale and purchase agreement, it is essential to strengthen the agreement through proper legal authorization.

Abstract

Karena lahan terbatas, pemerintah berusaha mencari berbagai cara untuk mendapatkan tanah guna mendukung pembangunan, salah satunya dengan melakukan tukar-menukar tanah. Jika salah satu pihak gagal memenuhi kewajibannya, hal ini dapat menyebabkan sengketa dan membatalkan tukar-menukar. Penelitian ini bertujuan untuk mengungkap penyebab sengketa dalam tukar-menukar tanah dan cara penyelesaiannya, khususnya dalam pembangunan fasilitas pendidikan di SDN 03 Pakintelan, Gunungpati, Semarang.Sengketa terjadi akibat kelalaian pemerintah Kota Semarang, khususnya Kelurahan Desa Mangunsari, dalam peralihan hak tanah. Penyelesaiannya dilakukan melalui musyawarah dan negosiasi antara kedua pihak. Oleh karena itu, pemerintah disarankan lebih cermat dan aktif dalam menjalankan tugasnya.

Abstract

The COVID-19 pandemic has introduced new challenges in various aspects, including employment relations. One significant issue is the use of force majeure clauses by companies in the termination of employment contracts. This study aims to analyze the legal implications of applying force majeure in employment contract terminations triggered by the COVID-19 pandemic, as well as its impact on workers’ rights. In this context, companies often argue that the pandemic constitutes an uncontrollable event that qualifies as force majeure, thus legitimizing contract terminations. However, the application of force majeure raises legal questions regarding the protection of workers’ rights, including compensation and other benefits. The study finds that the use of force majeure in cases of employment termination due to COVID-19 requires careful legal interpretation, as not all terminations during the pandemic can be classified under force majeure. These findings highlight the importance of clear legal guidelines and balanced protection between corporate interests and workers’ rights in times of crisis. Therefore, the results of this study are expected to contribute to a more comprehensive legal understanding of force majeure in the context of employment contract terminations due to extraordinary circumstances. Pandemi COVID-19 telah memunculkan tantangan baru dalam berbagai aspek, termasuk hubungan kerja. Salah satu isu yang signifikan adalah penggunaan klausul force majeure oleh perusahaan dalam pemutusan kontrak kerja. Penelitian ini bertujuan untuk menganalisis implikasi yuridis penerapan force majeure dalam pemutusan kontrak kerja yang dipicu oleh pandemi COVID-19, serta dampaknya terhadap hak-hak pekerja. Dalam konteks ini, perusahaan seringkali berargumen bahwa pandemi merupakan peristiwa di luar kendali yang memenuhi syarat force majeure, sehingga pemutusan kontrak kerja dianggap sah. Namun, penerapan force majeure ini menimbulkan pertanyaan hukum terkait perlindungan hak-hak pekerja, termasuk hak atas kompensasi dan tunjangan lainnya. Studi ini menemukan bahwa penerapan force majeure dalam kasus pemutusan hubungan kerja akibat COVID-19 memerlukan interpretasi hukum yang hati-hati, karena tidak semua kasus pemutusan kontrak kerja selama pandemi dapat dikategorikan sebagai force majeure. Temuan ini menyoroti pentingnya adanya pedoman hukum yang jelas dan perlindungan yang seimbang antara kepentingan perusahaan dan hak-hak pekerja dalam situasi krisis seperti pandemi. Dengan demikian, hasil penelitian ini diharapkan dapat memberikan kontribusi terhadap pemahaman hukum yang lebih komprehensif mengenai force majeure dalam konteks pemutusan kontrak kerja akibat kondisi luar biasa.

Abstract

Wanprestasi merupakan kondisi di mana seseorang tidak mampu menjalankan kesepakatan atau melanggar kewajiban yang telah disepakati, baik karena kesengajaan maupun kelalaian. Tulisan ini bertujuan untuk mengkaji bentuk-bentuk wanprestasi yang terdapat dalam Keputusan Pengadilan Tingkat Pertama di Kota Kupang dengan Nomor Perkara 18/PDT.G/2016/PN.KPG, serta untuk menganalisis dampak hukum yang dikenakan kepada pihak yang gagal memenuhi kewajiban dalam kasus tersebut. Kasus ini melibatkan sengketa jual beli kios beserta isinya, di mana Tergugat gagal melunasi pembayaran sesuai dengan perjanjian yang telah disepakati. Keseluruhan dari penelitian ini dilakukan dengan secara spesifik, dengan fokus pada studi kepustakaan dan tinjauan yuridis terhadap egulasi atau ketentuan hukum yang terkait. Paper berikut berfokus secara spesifik pada studi kepustakaan dan analisis yuridis terhadap regulasi atau ketentuan hukum yang terkait. Poin dari paper ini, dilakukan pengkajian sangat mendalam terhadap berbagai sumber hukum yang ada, dengan tujuan untuk memahami secara lebih rinci ketentuan-ketentuan yang berlaku dan implikasinya. Hasil analisis ini menyimpulkan bahwa terdapat dua poin penting. Pertama, jenis pelanggaran yang dilakukan oleh Tergugat adalah tidak memenuhi kewajiban kewajibannya sesuai dengan perjanjian, yakni dalam hal pembayaran sisa pembelian kios. Meskipun perjanjian tersebut dilaksanakan sebagian, namun tidak sepenuhnya berdasarkan kesepakatan yang telah dicapai. Kedua, konsekuensi hukum terhadap pihak yang gagal memenuhi kewajiban dalam kasus ini adalah Tergugat diwajibkan untuk membayar sisa pembayaran kios kepada Penggugat senilai Rp. 80.500.000,- (delapan puluh juta lima ratus ribu rupiah). Selain itu, Tergugat dikenai kewajiban agar membayar jumlah biaya terkait perkara Rp. 571.000,- (lima ratus tujuh puluh satu ribu rupiah). Keputusan ini menekankan pentingnya memenuhi kewajiban yang tercantum dalam kesepakatan perjanjian serta memberikan garansi hukum terhadap pihak yang mengalami kerugian akibat pelanggaran kontrak. Breach of contract, or "wanprestasi," occurs when a party fails to fulfill their obligations or defaults on an agreement, whether due to intentional actions or negligence. This research seeks to determine the various forms of contract breaches in the decision of the Kupang District Court No. 18/PDT.G/2016/PN.KPG and analyze the legal consequences for the party at fault. The case revolves around a dispute involving the sale of a kiosk and its contents, where the Defendant failed to make the agreed payment in full. Using a normative legal approach and library research, this study employs a descriptive-analytical method to examine the legal issues and connect them to relevant legal theories and practices. The results of the study highlight two key points: first, the breach of contract in this case was partial, as the Defendant fulfilled the agreement but not in the manner stipulated, particularly in regard to the payment of the remaining balance for the kiosk purchase. Second, the legal consequence of this breach was that the Defendant was required to pay the remaining Rp. 80,500,000 (eighty million five hundred thousand rupiahs) and cover the court fees of Rp. 571,000 (five hundred seventy-one thousand rupiahs). This ruling underscores the importance of fulfilling contractual obligations as agreed and provides legal protection for parties harmed by a breach of contract.

Abstract

Artikel ini membahas penyelesaian sengketa perjanjian waralaba dalam Putusan Nomor 321/PDT/2021/PT.DKI. Tujuan dari penelitian ini adalah untuk menganalisis keabsahan perjanjian waralaba, penerapan asas pacta sunt servanda menurut Kitab Undang-Undang Hukum Perdata (KUHPer) dan untuk memahami implikasi hukum dari putusan tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan deduktif. Hasil penelitian menunjukkan bahwa perjanjian waralaba antara penggugat dan tergugat ditolak oleh hakim karena tidak memenuhi syarat sah perjanjian, khususnya syarat objektif Mengenai pendaftaran kekayaan intelektual dan kepatuhan terhadap aturan hukum waralaba. Asas pacta sunt servanda dianggap sangat penting untuk menjaga kepastian hukum, namun gugatan penggugat ditolak karena kurangnya bukti yang kuat tentang adanya cacat kesengajaan atau penipuan. Penelitian ini menekankan bahwa pentingnya kepatuhan terhadap ketentuan hukum dalam perjanjian waralaba untuk mencegah sengketa di masa yang akan datang This article discusses the settlement of a franchise agreement dispute in Decision Number 321/PDT/2021/PT.DKI. The purpose of this research is to analyze the validity of the franchise agreement, the application of the principle of pacta sunt servanda according to the Civil Code (KUHPer) and to understand the legal implications of the decision. The research method used is normative legal research with a deductive approach. The results showed that the franchise agreement between the plaintiff and the defendant was rejected by the judge because it did not meet the legal requirements of the agreement, especially the objective requirements regarding intellectual property registration and compliance with the rules of franchise law. The principle of pacta sunt servanda is considered very important to maintain legal certainty, but the plaintiff's claim was rejected due to the lack of strong evidence of intentional defects or fraud. This research emphasizes the importance of compliance with legal provisions in franchise agreements to prevent future disputes.

Abstract

This research aims to examine, study and explore the legal position of electronic certificate services (e-certificate) and personal data protection within the scope of legal arrangements. In addition, the author wants to encourage the responsiveness and responsibility of the National Land Agency (BPN) in organizing regulations and policies that are fair, certain and beneficial to land rights holders who are legal subjects, as mandated by the 1945 Constitution Article 28D Paragraph 1, Article 28G Paragraph 1 and Article 28H Paragraph 4. The policy of electronic land registration and issuance of electronic certificates organized by BPN is a step to improve land services in Indonesia through digital transformation which aims to provide a sense of security, justice and legal certainty for holders of land rights. However, many of these policies have created pros and cons in the community because the electronic system in Indonesia as a whole is still very vulnerable to cyber threats. Therefore, the importance of BPN's responsibility in providing legal certainty to land rights holders is regulated by legislation because until now the regulation does not exist so the author suggests the establishment of new regulations that contain the form and mechanism of responsibilities that must be carried out by BPN. This research uses an approach that has been used by other researchers, namely normative juridical with a statute approach and conceptual approach through literature studies analyzed descriptively qualitative. The problems to be answered regarding the regulation or legal basis of the implementation of the electronic land certificate policy and the limits of the responsibility of the BPN in providing legal certainty and justice to land rights holders.

Abstract

Buying and selling is a process of exchanging goods or assets based on an agreement, as regulated under Article 1320 of the Indonesian Civil Code (KUHPerdata). However, the implementation of such transactions often faces challenges due to breaches of agreement, leading to disputes, as exemplified in Decision No. 1530 K/Pdt/2003. This article aims to analyze the resolution of land sale and purchase disputes when one party fails to fulfill the agreement and examine the impact of the sale and purchase deed (AJB) as evidence in disputes that result in the blocking of land certificates. The study also seeks to provide insights into the importance of strengthening regulations and dispute resolution mechanisms in land sale and purchase transactions to ensure legal certainty and protect the rights of the parties involved.

Abstract

This research aims to examine the changing dynamics of fiduciary security execution after Indonesian Constitutional Court Decisions No. 18/PUU-XVII/2019. The focus of this research lies on the creditor's responsibility in the context of forced withdrawal of the fiduciary object after the debtor's failure. This research uses a normative juridical research method with a legal source approach and case analysis. Through in-depth analysis of legal sources such as the constitution, laws, and relevant court decisions, this research identifies significant changes in the practice of fiduciary security execution. The case approach is used to understand the implementation of legal decisions in concrete situations. The results show that, in the case of a default agreement, parate execution can be an acceptable alternative, providing flexibility in settlement. However, when there is no agreement, court intervention is required to ensure fairness. This research provides a deeper understanding of the changes in the practice of fiduciary security execution, as well as a new outlook on creditor responsibilities and the need for adjustments in legal practice. Therefore, the novelty of this research lies in the in-depth understanding of creditor responsibilities in situations of forced withdrawal of fiduciary objects, especially after recent legal changes.

Abstract

Penelitian ini bertujuan untuk menganalisis keabsahan hukum penerapan Cyber Notary di Indonesia dalam perspektif Undang-Undang Jabatan Notaris. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa penerapan Cyber Notary di Indonesia memiliki potensi untuk meningkatkan efisiensi dan efektivitas dalam pelaksanaan tugas notaris, namun masih menghadapi berbagai tantangan. Tantangan utama termasuk kepastian hukum, legalitas sistem, dan ketidaksesuaian regulasi yang ada. Meskipun beberapa aktivitas kenotariatan sudah dapat dilakukan secara elektronik, pembuatan akta otentik secara elektronik masih memerlukan rekonstruksi hukum yang lebih komprehensif. Disarankan agar dilakukan pembaruan pada Undang-Undang Jabatan Notaris untuk mengakomodasi penggunaan teknologi elektronik, pengembangan infrastruktur hukum yang mendukung transaksi elektronik, serta peningkatan sosialisasi dan pelatihan kepada notaris. Selain itu, kolaborasi dengan organisasi internasional juga penting untuk memastikan penerapan Cyber Notary di Indonesia diakui secara global.
