Abstract

Pandemi Corona (COVID-19) membuat pemerintah mengeluarkan kebijakan Pemberlakuan Pembatasan Masyarakat di Indonesia (PPKM). Yang langsung memberikan dampak signifikan terhadap kehidupan masyarakat Indonesia khususnya pada aspek pekerjaan yang berkaitan dengan perjanjian atau kontrak. Perjanjian pada masa pandemi memerlukan peranan Asas Rebus Sic Stantibus agar berjalan dengan baik. Tujuan dari penelitian ini melengkapi kekurangan dari studi terdahulu dengan memberikan gambaran Bagaimana implementasi asas rebus sic stantibus pada perjanjian saat pandemic covid-19 dan Apakah penyebab asas rebus sic stantibus harus diterapkan pada perjanjian saat pandemi covid-19. Metode penelitian menggunakan metode yuridis-normatif dengan pendekatan konseptual tentang perjanjian, asas rebus sic stantibus serta pendekatan perundang-undangan serta mendeskripsikan suatu analisis (deskriptif analitis) dan didasarkan pada pengumpulan berita-berita online yang dipilih berdasarkan tema berita yang berkaitan dengan tema penelitian. Hasil dari penelitian dapat disimpulkan bahwasannya perorangan, badan hukum dan instansi mendapatkan arahan dalam melaksanakan perjanjian dengan memasukan peranan asas rebus sic stantibus dan memberikan penjelasan mengapa asas rebus sic stantibus harus diterapkan pada perjanjian nasional khususnya saat pandemi covid-19 ataupun PPKM ini. Kesimpulan penting dari kajian ini adalah perlunya implementasi asas rebus sic stantibus kedalam perjanjian nasional, sehingga penyelesaian permasalahan dalam perjanjian tersebut tidak batal melaikan adanya perundingan kembali renegosiasi antara masing-masing pihak dan mengharapkan pemerintah untuk memasukan asas rebus sic stantibus kedalam KUHPerdata sehingga bisa digunakan dengan baik disetiap perjanjian.

Abstract

Indonesia has designated the Covid-19 pandemic as a disease that causes a public health emergency and the government has issued several regulations requiring people to work from home. This research covers two main problems  First, how is the validity of notary deeds made by the cyber notary system? Second, what is the urgency of implementing a cyber notary system amid the Covid-19 pandemic? This writing uses normative juridical research. Notary deeds made by cyber notary have the power of proof as underhand deeds. The importance of implementing cyber notary amid a pandemic is strengthened one of which is the Minister of Health Regulation Number 9 of 2020 and Government Regulation Number 21 of 2020 which requires closing the office sector and working from home to break the line of the spread of the coronavirus in Indonesia.

Abstract

Buying and selling transactions, both services and goods, are growing rapidly along with technological developments. The profession of financial planning has been in great demand by the public in recent times, but this is inseparable from the existence of disputes which result in losses for consumers. Misappropriation of authority and violations committed by financial planning companies violate consumer rights. The Financial Services Authority has also yet to supervise because financial planners are not included in the financial sector. This research examined legal protection for financial planning consumers through supervision based on safety, certainty, and benefit principles. A statutory approach supports the normative juridical method and uses secondary data. The results of the study show that legal protection for consumers of financial planning companies is based on Article 10 letter c of Law Number 8 of 1999 on Consumer Protection, Articles 103 and Article 104 of Law Number 8 of 1995 on Capital Markets, Article 28 of Law Number 19 of 2016 on ITE, Article 378 and Article 372 of the Criminal Code and Article 1365 of the Civil Code.

Abstract

Abstrak: Permasalahan mitra adalah terkait tanah yang belum bersertipikat dan tanah yang telah bersertipikat namun pada proses penyerahan dalam peralihannya tidak tuntas hingga proses balik nama bahkan terdapat pula Proses peralihan tanah yang tidak melalui akta Pejabat Pembuat Akta Tanah (PPAT). Berdasarkan hasil survei dan wawancara hal tersebut diakibatkan kekhawatiran masyarakat terhadap pajak-pajak yang akan dikenakan dalam proses balik nama. Tujuan kegiatan ini, selain melaksanakan Tri Dharma Perguruan Tinggi juga untuk meningkatkan pengetahuan warga masyarakat tentang Pertanahan sebagaimana yang selama ini sering menimbulkan permasalahan di lapangan. Mitra adalah masyarakat RW. 008, Kelurahan Gandul, Kecamatan Cinere, Kota Depok. Mitra yang terlibat berjumlah 20 (dua puluh) orang. Hasil pengabdian masyarakat menunjukkan kasus yang paling banyak terjadi adalah turun waris, jual beli dan hibah. Monitoring dan evaluasi dilaksanakan dalam bentuk angket. Hasil menunjukkan bahwa dari semua materi yang disampaikan oleh tim terdapat peningkatan pengetahuan mitra tentang pengetahuan pajak jual beli tanah meningkat sebesar 45%. Mengenai pengetahuan pajak tanah warisan, hasilnya meningkat sebesar 70%. Mengenai pengetahuan pajak hibah tanah, hasilnya meningkat sebesar 40%. Mengenai pengetahuan pajak jual beli tanah, hasilnya meningkat sebesar 30%. Selanjutnya, mengenai cara menghitung pajak hibah tanah, hasilnya meningkat sebesar 50%, terakhir mengenai pajak tanah warisan hasilnya meningkat sebesar 50%. Pentingnya kasus pertanahan yang terjadi di masyarakat, mendorong peran serta Pemerintah khususnya berkaitan dengan sertipikat hak atas tanah beserta penghitungan pajak peralihan hak atas tanah.Abstract: The partner's problem is related to land that has not been certified and land that has been certified, but the handover process in the transfer is not complete until the process of transferring names is even the process of transferring land that is not through the deed of the Land Deed Making Officer (PPAT). Based on the results of surveys and interviews, this was caused by people's concerns about the taxes that would be imposed in the process of transferring names. The purpose of this activity, in addition to carrying out the Tri Dharma of Higher Education, is also to increase the knowledge of the community about land, which has so far often caused problems in the field. Partners are the RW community. 008, Gandul Village, Cinere District, Depok City. The partners involved are 20 (twenty) people. The results of community service show that the most common cases are inheritance, buying and selling and grants. Monitoring and evaluation is carried out in the form of a questionnaire. The results show that from all the material presented by the team, there is an increase in partners' knowledge about knowledge of land buying and selling tax which increases by 45%. Regarding knowledge of inherited land tax, the result increases by 70%. Regarding the land grant tax knowledge, the result increased by 40%. Regarding land sale and purchase tax knowledge, the result increases by 30%. Furthermore, regarding how to calculate land grant tax, the results increase by 50%, finally regarding inherited land tax the results increase by 50%. The importance of land cases that occur in the community encourages the participation of the Government, especially with regard to certificates of land rights along with the calculation of the tax on the transfer of land rights.

Abstract

IMPLIKASI HUKUM PENUNJUKAN AHLI WARIS BERDASARKAN KLAUSUL PERJANJIAN ASURANSI DALAM PERSPEKTIF HUKUM WARIS PERDATA (BW) RINGKASAN Penelitian ini bertujuan untuk (1) mengkaji dan menganalisis legalitas penunjukan ahli waris berdasarkan klausul asuransi dalam perspektif hukum perdata (BW) dan, (2) mengkaji dan memberikan implikasi hukum penunjukan ahli waris berdasarkan klausul asuransi dalam perspektif hukum perdata (BW) Jenis penelitian ini adalah penelitian hukum yuridis normatif. Secara normatif, penelitian ini mengacu kepada norma-norma serta asas-asas hukum yang terdapat dalam peraturan perundang-undangan, Menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder dan yang relevan dengan fenomena hukum yang berkaitan dengan penelitian ini. Data dikumpulkan dengan cara melakukan penelitian kepustakaan (library research) Dalam klausul asuransi pihak tertanggung diberikan kebebasan untuk menunjuk ahli waris. Padahal dalam perspektif hukum waris perdata telah ditentukan golongan-golongan ahli waris dengan asas golongan sat menutup golongan dua, golongan dua menutup golongan tiga, golongan tiga dapat mewaris bersama golongan empat. Olehkarena itu dibutuhkan penelitian mengenai lealitas dan implikasi hukum penunjukan ahli waris b erdasarkan klausul perjanjian asuransi. Abstract

The creditor holding a mortgage has a prioritized position as stated in Law No. 4 of 1996 about Mortgage Rights on Land and Objects Related to Land. Issues may arise when the court grants a request for a security seizure on an object currently encumbered with a mortgage, as this could lead to overlapping rights over the same immovable property. Normative legal research is the method employed in this study, utilizing a statutory and case-based approach. The findings indicate that seizure cannot be applied to land rights encumbered with a mortgage; instead, only Adjustment/Equality Seizure can be imposed. Although a security seizure was initially requested on the mortgaged object, the court may automatically grant the request as an Adjustment/Equality Seizure. The creditor holding the mortgage retains a superior position compared to the holder of the Adjustment/Equality Seizure

Abstract

This article discusses the effectiveness of preventive mechanisms based on Internet of Things (IoT) technology and reputation assessment systems in reducing car rental disputes in the realm of binding law. The rapid growth of the car rental industry in Indonesia poses challenges in the form of potential defaults that are a major concern. Internet of Things (IoT) technology offers a solution by allowing vehicle owners to monitor the condition and location of the vehicle in real-time, this technology is also able to provide valid evidence if there is a breach of contract. The existence of a tenant rating system allows data-based assessment of the tenant's compliance history and contractual responsibilities so that this system can increase transparency and accountability, motivate tenants to act more responsibly, and make it easier for vehicle owners to assess the risk of prospective tenants. This research uses a normative juridical method with a literature study-based approach. This research found that the application of IoT technology can strengthen legal certainty and provide protection for rental owners against the risk of vehicle misuse. The combination of these two approaches is expected to build a safer, more effective, and sustainable car rental ecosystem. This research underscores the importance of detailed regulations and strict supervision to ensure the implementation of these technologies in the car rental industry.

Abstract

A private land sale and purchase agreement is a written contract between two parties without the involvement of an authorized public official. Although legally, a private land sale and purchase agreement meets the requirements set out in Article 1320 of the Indonesian Civil Code, which governs the legal validity of contracts, such an agreement carries significant consequences in terms of proof and may be subject to challenges regarding its validity. This study aims to examine, analyze, and address the validity of private land sale and purchase agreements under the provisions of named contracts as regulated in the Indonesian Civil Code, the legal protection afforded to the parties involved in such agreements, and the evidentiary mechanisms for resolving disputes arising from private land sale and purchase transactions. The findings of this research reveal that, while the sale is substantively valid, in terms of agrarian legal formalities, a private land sale and purchase agreement is not considered fully complete, as it is not executed through a Land Deed Official (PPAT) deed. Therefore, to protect the parties involved in a private land sale and purchase agreement, it is essential to strengthen the agreement through proper legal authorization.

Abstract

Karena lahan terbatas, pemerintah berusaha mencari berbagai cara untuk mendapatkan tanah guna mendukung pembangunan, salah satunya dengan melakukan tukar-menukar tanah. Jika salah satu pihak gagal memenuhi kewajibannya, hal ini dapat menyebabkan sengketa dan membatalkan tukar-menukar. Penelitian ini bertujuan untuk mengungkap penyebab sengketa dalam tukar-menukar tanah dan cara penyelesaiannya, khususnya dalam pembangunan fasilitas pendidikan di SDN 03 Pakintelan, Gunungpati, Semarang.Sengketa terjadi akibat kelalaian pemerintah Kota Semarang, khususnya Kelurahan Desa Mangunsari, dalam peralihan hak tanah. Penyelesaiannya dilakukan melalui musyawarah dan negosiasi antara kedua pihak. Oleh karena itu, pemerintah disarankan lebih cermat dan aktif dalam menjalankan tugasnya.

Abstract

The COVID-19 pandemic has introduced new challenges in various aspects, including employment relations. One significant issue is the use of force majeure clauses by companies in the termination of employment contracts. This study aims to analyze the legal implications of applying force majeure in employment contract terminations triggered by the COVID-19 pandemic, as well as its impact on workers’ rights. In this context, companies often argue that the pandemic constitutes an uncontrollable event that qualifies as force majeure, thus legitimizing contract terminations. However, the application of force majeure raises legal questions regarding the protection of workers’ rights, including compensation and other benefits. The study finds that the use of force majeure in cases of employment termination due to COVID-19 requires careful legal interpretation, as not all terminations during the pandemic can be classified under force majeure. These findings highlight the importance of clear legal guidelines and balanced protection between corporate interests and workers’ rights in times of crisis. Therefore, the results of this study are expected to contribute to a more comprehensive legal understanding of force majeure in the context of employment contract terminations due to extraordinary circumstances. Pandemi COVID-19 telah memunculkan tantangan baru dalam berbagai aspek, termasuk hubungan kerja. Salah satu isu yang signifikan adalah penggunaan klausul force majeure oleh perusahaan dalam pemutusan kontrak kerja. Penelitian ini bertujuan untuk menganalisis implikasi yuridis penerapan force majeure dalam pemutusan kontrak kerja yang dipicu oleh pandemi COVID-19, serta dampaknya terhadap hak-hak pekerja. Dalam konteks ini, perusahaan seringkali berargumen bahwa pandemi merupakan peristiwa di luar kendali yang memenuhi syarat force majeure, sehingga pemutusan kontrak kerja dianggap sah. Namun, penerapan force majeure ini menimbulkan pertanyaan hukum terkait perlindungan hak-hak pekerja, termasuk hak atas kompensasi dan tunjangan lainnya. Studi ini menemukan bahwa penerapan force majeure dalam kasus pemutusan hubungan kerja akibat COVID-19 memerlukan interpretasi hukum yang hati-hati, karena tidak semua kasus pemutusan kontrak kerja selama pandemi dapat dikategorikan sebagai force majeure. Temuan ini menyoroti pentingnya adanya pedoman hukum yang jelas dan perlindungan yang seimbang antara kepentingan perusahaan dan hak-hak pekerja dalam situasi krisis seperti pandemi. Dengan demikian, hasil penelitian ini diharapkan dapat memberikan kontribusi terhadap pemahaman hukum yang lebih komprehensif mengenai force majeure dalam konteks pemutusan kontrak kerja akibat kondisi luar biasa.
