Abstract

This study aims to examine the legal protection and recognition of children born through surrogacy by comparing the legal frameworks of three countries: Indonesia, Iran, and Australia. The objective is to analyze how each country regulates the civil status, identity, and inheritance rights of children born through assisted reproductive technologies, with a specific focus on surrogacy arrangements. The research method used in this study was normative legal research with a comparative approach. It utilizes secondary legal materials such as statutory laws, judicial decisions, and religious doctrines to assess the extent of legal certainty and child protection provided under each national legal system. The novelty in this research lies in its integrative comparative analysis of countries with differing legal traditions, Australia with its positivist legal framework, Iran with its reliance on Shi’a Islamic jurisprudence and religious fatwas, and Indonesia which currently lacks specific regulations governing surrogacy. This research also proposes the adoption of a Parentage Order mechanism in Indonesia, inspired by Australia’s legal model, to ensure the recognition of genetic parenthood without requiring adoption procedures. Based on the research, it is concluded that Indonesia presents the weakest legal protection due to the absence of specific legislation, resulting in legal uncertainty for children born through surrogacy. In contrast, Iran provides legal clarity through religious and judicial mechanisms, while Australia offers a well-regulated system grounded in the best interests of the child. The findings suggest that Indonesia urgently needs legal reform to recognize surrogacy and ensure comprehensive protection of children’s rights in accordance with international human rights standards.

Abstract

The protection of economic rights for songwriters and musicians in Indonesia is regulated under Law No. 28 of 2014 on Copyright and Government Regulation No. 56 of 2021 on royalty management. However, implementation through the National Collective Management Institution (LMKN) still suffers from weak transparency, accountability, and data integration. This study analyzes the transparency of Indonesia’s royalty distribution system, compares it with practices in Australia and the United States, and proposes reform strategies. Using a normative legal research method with statute, conceptual, and comparative approaches, this research examines primary legal sources, academic works, and institutional reports. The findings reveal Indonesia lacks an integrated database, detailed audits, and independent supervision, causing legal uncertainty and eroding creators’ trust. By contrast, Australia’s APRA AMCOS and the U.S. system through ASCAP, BMI, SESAC, and the Mechanical Licensing Collective (MLC) offer greater transparency via digital monitoring, open annual reports, and strict regulatory oversight. These mechanisms enable creators to trace royalty flows and secure fair compensation. The study concludes that Indonesia requires comprehensive reform through digitalization, a national database, transparent reporting, and stronger independent monitoring to achieve a fair and accountable royalty distribution system.

Abstract

The advancement of assisted reproductive technology (ART) has raised new challenges in Islamic jurisprudence, particularly concerning lineage (nasab) and inheritance rights. One of the most complex bioethical and legal issues is posthumous conception, where a child is conceived after the father death using stored sperm or embryos. Classical Islamic law recognizes lineage only within a valid marriage (al firasy), which terminates upon the husband death, thus, posthumous conception questions the legitimacy of paternal lineage and inheritance. This study analyzes the legal position of such children under Islamic jurisprudence using a normative comparative method. It examines primary Islamic legal sources the Quran, Hadith, classical juristic opinions, and contemporary fatwas from institutions such as the OIC Fiqh Academy and Dar al Ifta al Misriyyah through the lens of maqasid al syariah. The findings confirm that posthumously conceived children cannot be attributed paternally because the marital bond has legally ended. Consequently, they are not entitled to inheritance under faraidh since they were not alive at the father death. Nevertheless, based on principles of justice (adl) and protection of lineage and wealth (hifz al nasl wa al mal), such children deserve moral and financial protection through non-inheritance mechanisms such as hibah or wasiat wajibah. The study concludes that Islamic law must adapt to biomedical developments while maintaining its core principles of lineage clarity, social justice, and compassion. This reinterpretation within the framework of maqasid al syariah ensures that Islamic family law remains just, humane, and responsive to modern ethical challenges

Abstract

The rapid growth of Indonesia’s cosmetics industry has led to a rise in misleading product claims that pose risks to consumers and weaken legal protections. This study examines the role of regulatory authorities in enforcing laws against misleading cosmetic claims in Indonesia and compares these mechanisms with those of the European Union to identify structural, procedural, and substantive gaps that influence enforcement effectiveness. Using a normative legal research method combined with a comparative approach, the study analyzes relevant legislation, official regulatory documents, and judicial decisions. The findings show that although Indonesia has a solid legal foundation through the Consumer Protection Act and the Health Law, supported by both pre-market and post-market surveillance, enforcement remains significantly weaker than in the European Union. Key factors include the absence of detailed claim-assessment standards equivalent to the EU’s Common Criteria, limited authority of BPOM in pursuing criminal actions, and a reactive, case-by-case enforcement model. Conversely, the European Union employs a preventive and systematic framework characterized by rigorous claim verification, standardized scientific substantiation, and broad supervisory powers. This study concludes that Indonesia’s challenges stem not from inadequate legal norms but from insufficient technical standards and institutional capacity. The research offers novelty by highlighting the institutional and technical gaps that hinder Indonesia’s enforcement of misleading cosmetic claims and by providing recommendations for strengthening national regulatory mechanisms to align with international consumer protection standards.
