Abstract

This article comprehensively analyzes the Indonesian Constitution as a crucial foundation and solid bulwark for strengthening Environmental Criminal Law. Given the alarming global ecological crisis, characterized by massive deforestation, uncontrolled pollution, biodiversity loss, and excessive resource exploitation, reforming the criminal law framework to be adaptive, responsive, and progressive is urgent. This research firmly argues that the Constitution isn't just a general, declarative legal umbrella; it intrinsically embodies fundamental constitutional values and principles. These include every citizen's right to a good and healthy environment and the state's obligation to protect it, which must be actively interpreted, internalized, and expanded into all norms and practices of Environmental Criminal Law enforcement. Using a normative-juridical approach focused on analyzing legal texts, doctrines, and court decisions, this article systematically examines how in-depth constitutional interpretation and creative elaboration of principles can catalyze stronger, more comprehensive, and ecologically just environmental criminal regulations. The discussion identifies and critically analyzes structural and substantive weaknesses in current environmental criminal law enforcement, such as evidentiary challenges, weak sanctions, and limited scope of legal subjects. Furthermore, this article explores the Constitution's potential to legitimize overcoming these obstacles. This includes strengthening criminal sanctions for proportional deterrence, expanding the definition of environmental crimes to encompass new and complex ecological offenses, and enhancing more effective corporate accountability mechanisms. Ultimately, this article affirms that reforming and developing Environmental Criminal Law, firmly rooted in constitutional values and principles, is an absolute prerequisite for building a holistic and sustainable environmental protection system. This step is essential in preventing further ecological degradation, restoring the balance of nature, and effectively guaranteeing environmental rights for current and future generations.

Abstract

Perkembangan teknologi informasi dan komunikasi telah menjadikan media sosial sebagai ruang interaksi utama masyarakat di era digital. Namun, ruang tersebut juga menghadirkan persoalan serius berupa cyber sexual harassment sebagai bentuk kekerasan berbasis gender yang banyak dialami perempuan. Fenomena ini tidak hanya menimbulkan dampak psikologis dan sosial bagi korban, tetapi juga membatasi kebebasan perempuan dalam berekspresi, berpartisipasi, dan merasa aman di ruang digital. Artikel ini bertujuan menganalisis konsep, bentuk, dan karakteristik cyber sexual harassment terhadap perempuan di media sosial, menelaah dampaknya terhadap upaya mewujudkan kesetaraan gender, serta mengkaji penguatan kepatuhan platform digital sebagai bagian dari perlindungan hukum di Indonesia. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan melalui penelusuran buku, jurnal ilmiah, artikel, dan peraturan perundang-undangan yang relevan. Hasil kajian menunjukkan bahwa cyber sexual harassment berakar pada ketimpangan relasi kuasa dan budaya patriarki yang turut direproduksi dalam ruang digital. Bentuknya meliputi komentar seksual yang tidak diinginkan, pengiriman konten seksual tanpa persetujuan, ancaman penyebaran konten intim, pelecehan berbasis gambar, hingga pemerasan seksual digital. Meskipun Indonesia telah memiliki instrumen hukum seperti KUHP, UU ITE, dan UU TPKS, perlindungan korban masih menghadapi hambatan berupa lemahnya implementasi, rendahnya literasi digital, budaya victim blaming, serta kurangnya kepatuhan platform digital terhadap regulasi nasional. Oleh karena itu, penanggulangan cyber sexual harassment memerlukan penguatan regulasi, penegakan sanksi terhadap platform yang tidak patuh, peningkatan literasi digital berperspektif gender, dan kolaborasi antara pemerintah, platform digital, serta masyarakat. Upaya tersebut penting untuk menciptakan ruang digital bersama yang aman, inklusif, berkeadilan, dan responsif terhadap perlindungan hak perempuan di era digital secara berkelanjutan.

Abstract

Physical fitness is one of the key factors supporting the health, growth, and learning ability of elementary school students. Differences in environmental characteristics between urban and rural areas are thought to influence students’ physical fitness levels. This study aims to compare the physical fitness levels of elementary school students in urban and rural areas of Klaten Regency. The study employed a survey method using a comparative quantitative approach. The sample consisted of 89 male and female students with an average age of 11 years, selected using purposive sampling, comprising 48 students from SD Muhammadiyah 1 Tonggalan and 41 students from SDIT Persada Bayat. Data collection was conducted on April 20–24, 2026, using the Indonesian Physical Fitness Test (TKJI) for ages 11–12, which included a 40-meter run, 30-second sit-ups, 30- second sit-to-stand, standing long jump, and a 600-meter run. Data were analyzed using descriptive statistics and the Independent Samples t-test after meeting the normality and homogeneity tests. The results showed no significant differences in the bent arm hang, sit-up, and vertical jump components. However, there were significant differences in the 40-meter run and 600-meter run components. Urban students demonstrated better performance in the speed component, while rural students performed better in the cardiorespiratory endurance component. These findings suggest that environmental characteristics have the potential to influence specific physical fitness components in elementary school students.

Abstract

Pertumbuhan investasi di Indonesia mengalami peningkatan seiring dengan berkembangnya teknologi dan kebutuhan masyarakat akan pendapatan tambahan. Rendahnya literasi keuangan serta lemahnya pengawasan terhadap entitas ilegal membuat masyarakat rentan menjadi korban penipuan berkedok investasi. Penelitian ini bertujuan untuk menganalisis bentuk kerugian yang dialami konsumen akibat investasi ilegal serta mengevaluasi peran Otoritas Jasa Keuangan (OJK) dalam memberikan perlindungan kepada konsumen. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus, termasuk analisis terhadap kasus DNA Pro yang menjadi salah satu bentuk nyata kerugian masif akibat investasi ilegal. Hasil penelitian menunjukkan bahwa meskipun OJK telah melakukan berbagai upaya preventif dan represif melalui edukasi keuangan, pengawasan, serta pembentukan Satgas Waspada Investasi, perlindungan hukum terhadap korban investasi ilegal masih belum optimal karena adanya kekosongan hukum dan keterbatasan yurisdiksi. Oleh karena itu, diperlukan penguatan regulasi dan sinergi antarlembaga guna mewujudkan sistem perlindungan hukum yang menyeluruh dan berkeadilan bagi seluruh lapisan masyarakat.

Abstract

Produk skincare dengan aplikator microneedle mulai bermunculan di pasaran sebagai salah satu inovasi dalam perawatan kulit. Namun, produk semacam ini wajib memenuhi ketentuan hukum yang berlaku, termasuk dalam hal memiliki izin edar dari Badan Pengawas Obat dan Makanan. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum yang diberikan kepada konsumen yang dirugikan akibat penggunaan produk skincare dengan aplikator microneedle yang izin edarnya telah dicabut, serta untuk mengkaji upaya hukum yang bisa dilaksanakan oleh konsumen dalam menghadapi kerugian tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan terhadap peraturan perundang-undangan dan pendapat para ahli hukum. Hasil penelitian menunjukkan bahwa perlindungan hukum konsumen telah diatur pada peraturan perundang-undangan, termasuk hak atas keamanan dan keselamatan dalam penggunaan produk. Konsumen yang mengalami kerugian dapat menempuh upaya hukum melalui jalur litigasi maupun non-litigasi. Kesimpulannya, bentuk perlindungan hukum terhadap konsumen mencakup hak atas keamanan serta ganti rugi, serta adanya tanggung jawab dari pelaku usaha. Upaya hukum yang tersedia memberikan dasar keadilan bagi konsumen, namun implementasinya memerlukan pengawasan yang konsisten dan penegakan hukum yang tegas agar hak-hak konsumen benar-benar terlindungi.

Abstract

This study aims to analyze the problems of copyright dispute mediation implementation and their impact on dispute resolution effectiveness at the Regional Office of the Ministry of Law of Central Java. The main issue examined is the low mediation success rate despite mediation being mandated as the primary alternative dispute resolution mechanism before litigation. This study employs a qualitative descriptive method with an empirical juridical approach through in-depth interviews with officials and mediators, analysis of mediation case documents, and review of relevant laws and regulations. The analysis applies Soerjono Soekanto's Legal Effectiveness Theory, encompassing five determining factors: legal substance, law enforcement, facilities and infrastructure, society, and legal culture. Results indicate that during 2023 to 2025, only two of six mediated copyright disputes reached agreement, yielding a success rate of 33.3 percent. Three interrelated problems were identified: institutional problems involving weak structural positioning and limited institutional support; mechanism problems involving divergent party expectations, adversarial orientation of legal representatives, and substantive complexity of copyright disputes; and human resource problems involving limited mediator availability, insufficient copyright-specific competence, and excessive workload. Failed mediations were generally escalated to criminal proceedings, reflecting a tendency to criminalize inherently civil disputes. This study concludes that mediation effectiveness at the regional level remains suboptimal, necessitating institutional strengthening, mechanism improvement, and enhanced mediator competence grounded in intellectual property expertise.

Abstract

This study aims to analyze how the TPS3R Program can be optimally implemented to meet the waste management standards stipulated in Government Regulation Number 81 of 2012. The main problem studied is the gap between normative provisions regarding waste reduction and handling based on the Reduce, Reuse, Recycle (3R) principle and its implementation conditions in various urban areas. The method used is normative legal research with a statutory regulatory approach linked to empirical conditions through a literature study of primary, secondary, and tertiary legal sources. The analysis is conducted by comparing normative provisions (das sollen) with the reality of implementation in the field (das sein). The results of the study indicate that normatively the legal framework related to TPS3R is adequate and provides a systematic, comprehensive, and sustainable basis for local governments in managing waste. However, in practice, various challenges remain, including limited facilities and infrastructure, dependence on regional budgets and community contributions for funding, uneven institutional capacity, and fluctuating levels of community participation. Differences in success rates between cities indicate that the program's effectiveness is greatly influenced by the synergy between regulations, institutional support, and changes in community behavior. Therefore, it is necessary to strengthen guidance, provide economic incentives, innovate waste processing technology, and improve coordination between stakeholders so that 3R-based waste management can run effectively, measurably, and sustainably.

Abstract

Developments in legal relationships within the corporate world indicate that obligations are no longer limited to contractual relationships alone, but also arise from internal corporate mechanisms, one of which is the distribution of dividends. In practice, issues arise when dividends that have been approved but not yet paid are used as the basis for a bankruptcy petition, leading to a debate over whether dividends can be classified as debt under bankruptcy law. This study aims to analyze the status of dividends as debt under Indonesian bankruptcy law and their relationship to the principle of simplified proof. The research method employed is a normative legal approach using both statutory and case-law analyses, through an examination of the Limited Liability Companies Act, the Bankruptcy Act, and the PKPU, as well as relevant court rulings. The research findings indicate that dividends decided upon by the General Meeting of Shareholders (GMS) and that have become due substantively meet the elements of a debt because they possess economic value, arise from a contractual obligation, are binding, and are enforceable. However, in practice, the application of this concept is not divorced from the principle of simple proof, which is a characteristic of bankruptcy law. If there is a dispute regarding the validity of the GMS, the amount of dividends, or the company’s financial condition that requires complex proof, then filing for bankruptcy becomes inappropriate. Thus, although dividends can be categorized as debt substantively, their use as the basis for a bankruptcy petition must be strictly limited. This restriction is important to prevent the misuse of bankruptcy as a tool for coercion in corporate disputes, as well as to maintain legal certainty, justice, and business continuity, and to ensure balanced protection for creditors and shareholders.

Abstract

Deepfakes, which utilize artificial intelligence to produce hyper-realistic audiovisual content in social media advertisements, are increasingly being misused by irresponsible businesses, who are exploiting deepfake technology to create advertising content. This study aims to identify existing regulatory frameworks in Indonesia and consumer legal protection against the misuse of deepfake technology, and to provide recommendations for strengthening the legal system to combat content manipulation by deepfake abuse. This study employs a normative juridical method, employing a statute approach. The data used in this study include both primary and secondary legal materials, including relevant regulations and related literature. The data collection technique used a literature study. The results of the study indicate a legal vacuum and significant difficulties in detecting and proving deepfake violations in social media advertisements. Although regulations exist, the misuse of deepfake technology is not yet explicitly regulated, so legal protection for consumers is not optimal. Consumer legal protection can be provided through two approaches: preventive legal protection and repressive legal protection. The increasingly sophisticated development of AI also increases the risk of misuse that harms consumers and society, necessitating adaptive legal responses to ensure more effective protection in this era of technological advancement. This research is expected to serve as a reference for regulators in developing strategic steps to address the threat of deepfakes.
