Abstract

  Balap liar remaja merupakan fenomena sosial yang mengandung dimensi hukum dan moral yang kompleks. Meskipun Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan telah secara tegas melarang praktik balap liar dan menetapkan sanksi, implementasi hukumnya masih belum efektif karena berbagai kendala struktural dan kultural. Penelitian ini menggunakan pendekatan kualitatif dengan analisis hukum, observasi lapangan, dan kajian literatur untuk mengevaluasi efektivitas penegakan hukum terhadap balap liar di kalangan remaja. Hasil studi menunjukkan bahwa faktor sosiologis (lingkungan pergaulan) dan psikologis (pencarian identitas, pengaruh teman sebaya, serta unsur perjudian) turut menjadi pendorong utama perilaku ini. Penanganan balap liar remaja memerlukan pendekatan yang tidak hanya represif, tetapi juga preventif dan edukatif, melalui sinergi antara penegakan hukum, pendidikan karakter, peran keluarga, dan pengawasan sosial masyarakat.

Abstract

Sampah plastik yang dihasilkan sektor industri, telah menjadi permasalahan serius dengan dampak signifikan terhadap lingkungan, negara Indonesia sebagai pemasok sampah plastik terbesar nomor 2 (dua) di dunia. Hal tersebut berdampak pada meningkatnya kesadaran masyarakat terhadap produk ramah lingkungan memicu tren pemasaran hijau (green marketing) oleh perusahaan. Namun, sebagian perusahaan menyalahgunakan tren ini dengan melakukan greenwashing klaim palsu atau menyesatkan terkait ramah lingkungan demi keuntungan. Praktik ini menimbulkan kerugian bagi konsumen, seperti kebingungan informasi (green consumer confusion), meningkatnya skeptisisme, dan penyesatan dalam pengambilan keputusan pembelian. Penelitian ini menganalisis praktik greenwashing di Indonesia, dampaknya terhadap konsumen, serta perlindungan hukum berdasarkan UU No. 8 Tahun 1999 tentang Perlindungan Konsumen. Pada penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus perusahaan yang melakukan greenwashing. Kasus PT X menjadi sorotan utama dengan penggunaan klaim “Pure Life Natural Spring” dan “eco-shaped bottle” yang menyesatkan publik. Penulis menemukan belum adanya regulasi yang secara spesifik mengatur perihal Greenwashing, namun kerangka hukum perlindungan konsumen dapat digunakan sebagai dasar penindakan. Dengan demikian, penelitian ini diharapkan memberikan kontribusi terhadap penguatan perlindungan konsumen dan peningkatan kesadaran hukum dalam menghadapi praktik greenwashing di Indonesia.

Abstract

Penelitian ini membahas dampak pemasangan aplikasi pinjaman online (pinjol) tanpa izin pada perangkat smartphone serta implikasi perlindungan hukum bagi konsumen. Praktik pemasangan aplikasi pinjol tanpa persetujuan konsumen melanggar hak privasi dan kontrol pengguna terhadap perangkat mereka, sekaligus bertentangan dengan prinsip-prinsip perlindungan konsumen yang diatur dalam peraturan perundang-undangan seperti POJK 77/2016 dan Undang-Undang Perlindungan Konsumen. Studi ini menegaskan bahwa produsen smartphone memiliki tanggung jawab besar dalam memastikan produk yang mereka pasarkan bebas dari risiko pelanggaran hak konsumen. Regulasi yang ketat wajib ditegakkan untuk menjamin penyelenggaraan pinjol yang legal dan bertanggung jawab, sekaligus melindungi konsumen dari potensi kerugian hukum dan keuangan. Penelitian ini memberikan rekomendasi bagi pembuat kebijakan dan pelaku industri untuk memperkuat mekanisme pengawasan dan edukasi kepada masyarakat, demi menciptakan ekosistem finansial digital yang aman dan terpercaya. Hasil penelitian ini diharapkan mampu menjadi bahan pertimbangan dalam pengembangan regulasi perlindungan konsumen di era digital yang terus berkembang pesat.

Abstract

Land disputes between the government and the community, especially related to overlapping land rights, have become an important issue in land governance. This research aims to identify the causes of disputes and the forms of their resolution. The method used is a qualitative approach with an empirical legal research type through field studies at the Land Office and the City Spatial Planning Department in Semarang. Data were obtained through interviews and documentation, and then analyzed qualitatively in a descriptive manner. The results indicate that the main causes of disputes include inaccuracies in tracing land history, measurements conducted without involving legitimate owners, the absence of a legal basis for issuing usage rights, and PTSL procedures that do not comply with regulations. Resolutions are carried out through non-litigation pathways such as mediation and conciliation, as well as litigation avenues through the Administrative Court (PTUN). As a result of this case, the PTUN stated that it does not have jurisdiction to examine the matter because the core of the dispute concerns land ownership, which falls under the jurisdiction of general courts. Abstract

Micro, Small, and Medium Enterprises (MSMEs) serve as the economic backbone of communities, with their sustainability influenced by various factors, including adherence to business legality. Among the crucial legal aspects, obtaining halal certification stands out as a pivotal requirement. This certification plays a vital role for business entities, aiming to bolster consumer confidence in the products they offer. The research conducted adopts a mixed-methods approach, combining qualitative and quantitative data collection and analysis. Surveys and direct interviews with service partners reveal significant challenges faced by these partners. These challenges encompass a spectrum from comprehending the importance of halal food products and the processes involved in their production to understanding the intricacies of halal certification and the necessary steps to obtain it. In accordance with the Halal Product Assurance regulations, the implementation of halal certification in Indonesia is mandated to expedite. Notably, by no later than October 17, 2024, all products entering, circulating, and trading in Indonesia must be duly halal-certified. This stringent timeline underscores the urgency for businesses to prioritize obtaining halal certification, positioning it as a critical component of their legal obligations. The significance of halal certificates extends beyond mere compliance, serving as a testament to a business's commitment to meeting the ethical and religious considerations of its diverse consumer base. This study also advocates for the important role of halal certification in sustaining MSMEs as the economic backbone of communities. The findings underscore the need for robust policy-making, emphasizing the urgency of halal certification in accordance with Halal Product Assurance regulations in Indonesia. The research aligns with the advocacy for policies that prioritize the timely implementation of halal certification, recognizing it as a critical component for MSMEs to meet legal obligations and enhance consumer trust.

Abstract

This article comprehensively analyzes the Indonesian Constitution as a crucial foundation and solid bulwark for strengthening Environmental Criminal Law. Given the alarming global ecological crisis, characterized by massive deforestation, uncontrolled pollution, biodiversity loss, and excessive resource exploitation, reforming the criminal law framework to be adaptive, responsive, and progressive is urgent. This research firmly argues that the Constitution isn't just a general, declarative legal umbrella; it intrinsically embodies fundamental constitutional values and principles. These include every citizen's right to a good and healthy environment and the state's obligation to protect it, which must be actively interpreted, internalized, and expanded into all norms and practices of Environmental Criminal Law enforcement. Using a normative-juridical approach focused on analyzing legal texts, doctrines, and court decisions, this article systematically examines how in-depth constitutional interpretation and creative elaboration of principles can catalyze stronger, more comprehensive, and ecologically just environmental criminal regulations. The discussion identifies and critically analyzes structural and substantive weaknesses in current environmental criminal law enforcement, such as evidentiary challenges, weak sanctions, and limited scope of legal subjects. Furthermore, this article explores the Constitution's potential to legitimize overcoming these obstacles. This includes strengthening criminal sanctions for proportional deterrence, expanding the definition of environmental crimes to encompass new and complex ecological offenses, and enhancing more effective corporate accountability mechanisms. Ultimately, this article affirms that reforming and developing Environmental Criminal Law, firmly rooted in constitutional values and principles, is an absolute prerequisite for building a holistic and sustainable environmental protection system. This step is essential in preventing further ecological degradation, restoring the balance of nature, and effectively guaranteeing environmental rights for current and future generations.

Abstract

Character education is an important element in the effort to prepare superior Indonesian human resources, it is of particular concern to be applied especially among students, there is a need for character education because the attitudes and behavior of the people and people of Indonesia now tend to ignore the noble values of Pancasila which are highly respected and should be rooted in everyday attitudes and behaviors, values such as honesty, politeness, togetherness and religious, gradually eroded by foreign cultures that tend to be hedonistic, materialistic, and individualistic, so that the noble character values are ignored in the future if students and young people are not equipped with character education. Law students have their own challenges, especially in the era of globalization. This paper analyzes and illustrates the character strengthening program for law student activists in Semarang State University through several programs, namely public speaking, strengthening student idealism, strengthening advocacy capacitation and human rights assistance and self-motivation. This research is a field research with the object of research as activists of law students who are members of student organizations. This research confirms that the programs for strengthening the character of students experience several obstacles, one of which is the model used and a relatively short time. However, character education for student activists helps students to survive in real life as part of community members.

Abstract

This article studies the incorporation of environmental concerns in the political campaigns of women candidates within the context of local Indonesian politics. The impacts of environmental problems in coast areas such as Semarang, Demak, Pekalongan, Kendeng mountains, and Wadas Purworejo are serious and pose an overwhelming challenge for women's exacerbated socio-domestic duties. The research is conducted by a normative legal approach through using statutory and implementation frameworks focusing on environmental issues concerning women’s political campaigns in Indonesian local politics, employing content analysis of authoritative books, peer-reviewed journals, on legal advocacy and sustainable development. The findings of the study highlight the stark urban-rural divide where urban candidates were more proactive in pushing sustainable development frameworks. In addition, women who managed to penetrate the legislative milieu exhibited different degrees of engagement with environmental policies; those framed as environmentalists tended to have higher proposed regulation rates. The research shows that most women do not, in campaign rhetoric, grasp the growing public discourse on contestation over policy frameworks at multiple levels—national, regional, and local—and legislative governance approaches that integrate ecological issues and sustainability as a central concern at local and global levels. To address these gaps, the authors argue women politicians need women’s targeted capacity building on environmental legislation that could enhance advocacy for sustainable development at the local level.

Abstract

Price fluctuations and the scarcity of cooking oil in Indonesia prompted the government to launch Minyakita as a subsidy product with the Highest Retail Price (HET) setting. However, the implementation of Minyakita distribution in Semarang City still raises various problems, especially related to mismatches in doses and violations of the HET. This research aims to examine legal provisions, the implementation of supervision, and the form of legal protection for consumers for these violations. This study uses an empirical juridical approach with a qualitative type. The results of the study showed that there was a practice of filling the dosage that did not match the packaging label and the selling price was above the HET (Rp15,700 per liter) which was Rp16,000-Rp17,000 per liter, which was clearly detrimental to consumers. On the other hand, supervision by the Trade Office and the Legal Metrology Unit has not run optimally due to limited resources and low public awareness in using the complaint mechanism. In conclusion, although there is a strong legal basis such as Law No. 8 of 1999, BPOM Regulation No. 31 of 2018, and Permendag No. 18 of 2024, the implementation of consumer protection is still weak at the regional level. Therefore, it is recommended to strengthen decentralized supervision, increase consumer education, and apply strict sanctions to violating business actors, in order to realize a fair, transparent, and community-friendly cooking oil distribution system.

Abstract

This study examines the legal violation aspects that occurred in the illegal reclamation project carried out by PT Panca Anugrah Nusantara (PT PAN) in the coastal area of Tanjung Pendam, Belitung. PT PAN was proven to have carried out reclamation activities without obtaining AMDAL, UKL-UPL documents, or valid environmental approvals in accordance with the provisions of Law Number 32 of 2009. The main focus of this study is to analyze the implementation of environmental approvals in reclamation projects and assess the legal consequences of the violations that occurred. This research was conducted through a normative legal approach with qualitative methods, reviewing legal regulations and relevant court decisions. These findings underline the importance of strengthening participatory mechanisms in the AMDAL preparation process and the need for strict law enforcement against violating corporations. The court decision imposing sanctions on PT PAN is an important precedent in enforcing criminal liability for legal entities. This study suggests the need for comprehensive reform in the licensing system, the implementation of technology-based supervision, and substantial increase in public participation in order to realize sustainable and environmentally fair reclamation.
