Abstract

The research objectives in this thesis are based on the two problem formulations raised, namely as follows: To find out and study the Presidential and Vice Presidential Election system based on Law Number 7 of 2017 concerning General Elections. To find out and study the Legal Politics of the President and Vice President in Indonesia based on Law Number 7 of 2017 concerning General Elections, viewed from the Pancasila Perspective. The research method used is normative juridical legal research. The results of the research and discussion are as follows: First, the direct and indirect Presidential election system emerged due to a misinterpretation of the 4th principle of Pancasila which reads "the people are led by wisdom in deliberation/representation". Second, the legal politics of a statutory norm fall into the category of open legal policy, so according to the Constitutional Court this norm is in an area of constitutional value with the 1945 Constitution. The concept of open legal policy itself was first used by the Constitutional Court. In its considerations, the Constitutional Court was of the opinion that such a policy choice is the right of the legislator and is protected by the constitution.

Abstract

The development of digital transformation technology requires the banking industry in the banking financial sector to innovate by combining digital technology with customer communication, a technology-based product called financial technology. This development is of course beneficial for the banking financial service system, but on the other hand it creates legal problems. The problems discussed in this study are First, what is the legal protection for debtors in the financial technology lending system (Peer to peer lending). Second, how is law enforcement in the financial technology lending system (peer to peer lending). The research method used is normative juridical law research with a statute approach and a conceptual approach. Legal materials in this study are divided into three sources of legal materials, namely primary, secondary and tertiary data. The results of the study show that debtors get legal protection, both preventive and repressive protection. Protection of preventive protection provided by the government with the aim of preventing before the occurrence of violations in the Peer to-peer lending financial technology transaction system. By providing a regulatory provision in both preventive and repressive protection efforts. The government's steps in preventive legal protection Peer to peer lending include service transparency, fraud prevention and the reliability of service systems and protection systems for personal data. Furthermore, regarding risk mitigation, system governance, education, limits on lending funds, First, repressive protection, handling of legal protection by the General court and by the Administrative Court in Indonesia. Second, government agencies which are administrative appeal institutions. Administrative sanctions in the form of fines, business restrictions, and revocation of activity permits. Law Enforcement in the Financial Technology Loan System through the application of administrative, civil and criminal law. Administrative law enforcement in the form of fines, restrictions on business activities and license revocation. Then, civil law enforcement through internal dispute resolution (IDR), Alternative Dispute Resolution (LAPS), as well as through general courts. While the enforcement of criminal law with criminal law procedures and criminal procedural law. On the other hand, the legal structure of OJK cooperates with law enforcement agencies in collaboration with Bank Indonesia, Polri, Kominfo and the Ministry of Cooperatives.

Abstract

Pengabdian Masyarakat Sosialisasi Pencegahan Pelanggaran Pemilihan Gubernur Dan Wakil Gubernur Serta Walikota Dan Wakil Walikota Tahun 2024 Dan Netralitas ASN Di Tangerang Selatan, diharapkan semakin berkurang pelanggaran terhadap pelaksanaan Pemilu Kepala Daearah (Pilkada), dan semakin minim pelanggaran yang dilakukan oleh ASN terkait netralitas dalam pelaksanaan Pilkada. Pilkada sebagai bentuk kedaulatan rakyat, harus dilaksanakan secara langsung, umum, bebas, rahasia, jujur, dan adil, untuk menjalankan sistem demokrasi sesuai dengan konstitusi yang berada pada wilayah provinsi/kabupaten/kota. Pilkada secara langsung yang legitimate dapat menghasilkan kepala daerah yang memiliki akuntabilitas lebih tinggi kepada rakyat, untuk kesejahteraan rakyat.

Abstract

Identity politics violations are a frequent phenomenon in elections in Indonesia, where ethnic, religious, ethnic, gender, or other social group identities are manipulated or exploited for political gain. The purpose of this study is to identify, analyze, and understand more deeply about identity politics violations in elections, as well as their implications for democracy and Indonesian society as a whole. The analysis will be based on the theory of identity politics, multiculturalism, and political participation. The results of the analysis show that political elites and candidates for regional heads tend to use or maintain identity politics for political interests and strengthen power hegemony. As a result, the use of religious issues as political tools in the 2019 Presidential Election is a source of tension and a potential threat to the country's social and political stability. With a deeper understanding of this phenomenon, this research is expected to provide valuable insights for political stakeholders, electoral institutions, and society at large to develop prevention and countermeasures against identity politics violation and strengthen the foundation of an inclusive and equitable democracy in Indonesia.

Abstract

Background: Bermacam kendala yang muncul seperti masalah belum terdaftarnya suatu bidang tanah membuat kepemilikan akan hak atas tanahnya menjadi terganggu, ditambah setelah pendaftaran pun tetap masih ada ancaman dari pihak yang berkepentingan yang mana perlunya tindakan pemeliharaan data pendaftaran menjadi tindakan pencegahan lainnya. Belum lagi masalah lainnya seperti peralihan dan sebagainya. Semua permasalahan tersebut tidak di dasari dengan pengetahuan dan pemahaman yang cukup khususnya di masyarakat Kelurahan Menteng. Metode: Edukasi berupa metode penyuluhan dan sesi tanya jawab guna dapat menjadi bekal pengetahuan akan pentingnya perlindungan hukum terhadap kepemilikan atas tanah. Hasil: Proses hukum dan bagaimana warga dapat melakukan perlindungan atas kepemilikan tanahnya dan tindakan selanjutnya adalah melakukan perubahan terhadap data pendaftaran tanah dapat dibilang berjalan sesuai dan memenuhi standar keberhasilan kegiatan tersebut. Kesimpulan: Kegiatan ini menjadikan masyarakat di Kelurahan Menteng menjadi mengerti mengenai hukum agraria.

Abstract

Indonesian land law based on the Basic Agrarian Law (UUPA) adheres to the principle of nationality which prohibits foreign citizens (WNA) from owning freehold land.However, the high interest of foreign nationals in property investment has triggered legal smuggling (fraus legis) through nominee agreements, where the name of an Indonesian citizen (WNI) is used on the Certificate of Ownership (SHM) even though the land is controlled by a foreign national. This phenomenon creates a lack of synchronization between das sollen (legal norms) and das sein (societal practice), creating a legal vacuum because nominee agreements are not regulated in the Indonesian civil law system. The main legal issue is the binding force of SHMs from these illegal transactions and how justice is achieved when disputes arise between formal ownership and actual control. This research is a normative legal research with a statute approach and a case approach.. Secondary data consisting of primary, secondary, and tertiary legal materials were collected through library research. The data were analyzed qualitatively by focusing the study on three court decisions, namely Gianyar District Court Decision No. 259/Pdt.G/2020/PN. Gin, Denpasar District Court Decision No. 274/Pdt.G/2020/PN. Dps, and Gianyar District Court Decision No. 137/Pdt.G/2021/PN. Gin, to understand the judge's considerations in name-borrowing disputes. The results of the research show that the agreement to borrow a name by a foreign national is legally void because it does not fulfill the requirements of a lawful cause (Article 1320 of the Civil Code) and violates Article 26 paragraph (2) of the UUPA.The binding power of a SHM is absolute, with the court upholding the certificate as the sole valid evidence, demonstrating formal justice and legal certainty. This situation conflicts with substantive justice, as foreign nationals lose their investments without recourse. The judicial system ultimately prioritizes the integrity of national agrarian law by adhering to the principle of ex turpi causa non oritur actio, which states that no rights can arise from reprehensible acts.

Abstract

This research is motivated by the increasing misuse of bankruptcy mechanisms in Indonesia, where solvent debtors exploit bankruptcy as a strategy to evade obligations rather than as a genuine solution for financial distress. The study aims to analyze the regulation of corporate bankruptcy applications that reflect the principle of Commercial Exit from Financial Distress and to examine creditor protection in cases that deviate from this principle. Using a normative juridical approach through statute, case, and conceptual methods, this research relies on primary legal materials including Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations and two court decisions: Number 04/Pdt.Sus-Pailit/2023/PN Niaga Medan (PT Ricky Kurniawan Kertapersada) and Number 41/Pdt.Sus-Pailit/2025/PN Niaga Central Jakarta (PT Teknik Lancar Mandiri). The analysis was conducted qualitatively using sociological interpretation to link legal norms with judicial practice. The findings reveal that Indonesia’s bankruptcy system remains formalistic because it does not apply an insolvency test as a substantive basis for determining financial failure. The PT RKK case demonstrates bankruptcy abuse to avoid debt, while the PT TLM case exemplifies fair application of the Commercial Exit from Financial Distress principle. Hence, reform of bankruptcy law is essential to achieve substantive justice and equitable legal protection for creditors. Penelitian ini menggunakan metode hukum normatif dengan pendekatan yuridis normatif, melalui statute approach, case approach, dan conceptual approach. Bahan hukum primer yang digunakan meliputi peraturan perundang-undangan dan dua putusan pengadilan, yaitu Putusan Nomor 04/Pdt.Sus-Pailit/2023/PN Niaga Medan (PT Ricky Kurniawan Kertapersada) dan Putusan Nomor 41/Pdt.Sus-Pailit/2025/PN Niaga Jakarta Pusat (PT Teknik Lancar Mandiri). Analisis dilakukan secara kualitatif menggunakan metode interpretasi sosiologis untuk menemukan relevansi norma hukum dengan penerapannya di pengadilan. Hasil penelitian menunjukkan bahwa sistem kepailitan Indonesia masih bersifat formalistik karena belum menerapkan insolvency test sebagai dasar substantif. Kasus PT RKK menunjukkan penyalahgunaan mekanisme pailit untuk menghindari kewajiban, sedangkan PT TLM mencerminkan penerapan prinsip Commercial Exit from Financial Distress secara adil dan proporsional. Oleh karena itu, reformasi hukum kepailitan diperlukan untuk memastikan keadilan substantif dan perlindungan hukum kreditur secara seimbang.

Abstract

This research is motivated by the lack of synchronization between das sollen (the ideal law) and das sein (the reality) in the implementation of administrative sanctions during tax objection and appeal processes. Law Number 7 of 2021 concerning the Harmonization of Tax Regulations (HPP) introduced reforms to enhance compliance and fairness, yet its application often raises issues of legal uncertainty and potential injustice for taxpayers. The study aims to examine how taxpayer protection against administrative sanctions in the objection and appeal process can be implemented fairly. Using a normative juridical method with statutory, conceptual, and comparative approaches, this research analyzes primary legal sources (laws and regulations), secondary materials (literature and journals), and tertiary materials as support. The analysis employs descriptive-analytical techniques with deductive reasoning. The findings reveal that the administrative sanctions under the HPP Law still create justice-related problems, particularly concerning legal certainty and the protection of taxpayers’ rights. Although intended to enforce compliance, these sanctions may burden taxpayers seeking justice. Therefore, a more proportional and transparent protection mechanism is required to align sanction enforcement with the principles of justice and fairness, balancing the interests of the state and taxpayers in resolving tax disputes. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan perbandingan (comparative approach). Bahan hukum primer berupa peraturan perundang-undangan terkait, bahan hukum sekunder berupa literatur dan jurnal hukum perpajakan, serta bahan hukum tersier digunakan sebagai pendukung analisis. Teknik analisis yang digunakan adalah deskriptif-analitis dengan penalaran deduktif untuk menarik kesimpulan. Hasil penelitian menunjukkan bahwa sanksi administratif dalam proses keberatan dan banding sebagaimana diatur dalam UU HPP masih menyisakan problematika keadilan, baik dari sisi kepastian hukum maupun perlindungan hak wajib pajak. Di satu sisi, sanksi administratif dimaksudkan sebagai instrumen penegakan kepatuhan. Namun, di sisi lain, penerapannya dalam konteks keberatan dan banding berpotensi membebani wajib pajak yang sedang memperjuangkan haknya. Oleh karena itu, diperlukan perlindungan WP terhadap sanksi administratif yang lebih proporsional, transparan, dan konsisten dengan asas keadilan, sehingga dapat menciptakan keseimbangan antara kepentingan negara dalam pemungutan pajak dan hak wajib pajak untuk memperoleh keadilan dalam sengketa perpajakan.

Abstract

When carrying out regular reporting, each servant reported a number of problems and potentials in Bengkol Mdura village, Bengkol Manado village, and Mekar Sari Jambi village which have a number of potentials to be developed into tourism villages with their own characteristics. The reult in this article show 1. Comparative studies have the main objectives, namely: 1. Comparing various groups or elements. 3. Identify common differences and similarities. 2. Data collection methods such as surveys, interviews, or secondary data analysis are used for various purposes, such as improving understanding, decision making, or hypothesis testing. 2. Tourism villages in the context of rural tourism are tourism assets based on rural potential with all its uniqueness and attractions which can be utilized and developed as a tourism product to attract tourist visits to the village location. 3. The author and teacher in this article believes that comparative studies are a solution for Bengkol Madura village, Bengkol Manado village, and Mekar Sari village in studying all aspects of tourist villages that have been recognized, have stable Village Original Income, and have been running for more from one year, in this case the villages of Tondano, Muaro Jambing, and Slopeng which became models for creating tourist villages.

Abstract

This study conducts a bibliometric analysis to explore the scholarly landscape on the effectiveness of accountability in public policy, focusing on literature indexed in Scopus. Using VOSviewer, the study visualizes thematic clusters, co-authorship networks, and country collaborations, offering insights into key trends, influential authors, and global research dynamics. Accountability emerges as a central concept, closely linked to transparency, governance, and public trust, with significant applications in sectors such as healthcare, education, and sustainable development. The analysis reveals the interdisciplinary nature of accountability research while highlighting gaps in addressing digital governance and underrepresented regional perspectives. The findings emphasize the importance of robust accountability frameworks in enhancing public policy effectiveness and the need for integrative and inclusive research to address contemporary governance challenges. This study provides valuable insights for academics and policymakers, offering a foundation for advancing accountability frameworks in diverse governance contexts.
