Abstract

Recent developments in the field of neuroimaging in the world of neuroscience, when combined with artificial intelligence and, more specifically, with the use of mechanical engineering, have resulted in the creation of brain reading technology that may soon be widely used in scientific fields in the world including detecting, for example, criminal lies. When used in forensic psychiatry, this approach can increase the precision of risk assessment and help determine areas where intervention can be most effective. Neuro prediction with artificial intelligence can be called AI. This neuroprotection is a method of predicting criminal behaviour by finding biomarkers of brain function that can indicate that someone is committing crimes in the future. Normative legal research or library legal research (library research), with a statute, conceptual, comparative, historical, or futuristic approach. The nature of the research used in this research is descriptive-prescriptive and uses content analysis. The result of this research is to dissect the development of AI Neuroprediction in forensic psychiatry and criminal justice with attention to this technology's legal and ethical implications and potential applications. In the future, AI neuroprediction may play an important role in integrating forensic psychology into the criminal justice system. Through in-depth analysis of neurological data, AI neuroprediction could assist in identifying behavioral patterns or tendencies that might influence a person's criminal propensity, thus enriching traditional forensic psychological evaluations. It may also contribute to creating more precise and personalized intervention strategies to prevent repeat crimes.

Abstract

Within the context of both countries, influenced significantly by Islamic legal norms, corruption and illicit enrichment are condemned as violations of justice, honesty, and integrity. In Thailand, where the legal framework for handling illicit enrichment is relatively well-structured, these values can be further integrated to enhance transparency and accountability. Shifting the burden of proof, in line with Islamic ethical principles, can imbue the law enforcement process with a robust moral and social dimension. In Indonesia, where the concept of illicit enrichment is not fully articulated in anti-corruption legislation, these values can serve as a foundation to complement the existing legal framework. The KPK, empowered to monitor officials' wealth, can incorporate these principles into its vetting and investigative mechanisms, reinforcing a values-based approach to corruption prevention and prosecution. Applying Islamic teachings in governance and law can provide an ethical underpinning, fortifying existing legal structures. It entails not only introducing new rules but also nurturing a culture of integrity in society and emphasizing the moral responsibility of public officials. By grounding their legal systems in profound Islamic values, both countries can advance their battle against corruption and illicit enrichment, fortify their legal frameworks, and ultimately promote the development of more transparent and accountable governance.

Abstract

Anti-corruption village is a concrete manifestation of community participation in preventing criminal acts of corruption. Therefore, this research aimed to eradicate corruption in Indonesia from village level serving as an important indicator and responsible for large amounts of funds. By establishing anti-corruption village, funds were more accountable for optimal development. Meanwhile, doctrinal legal research using primary, secondary, and tertiary legal materials was adopted with statute, conceptual, comparative, and futuristic methods. A descriptive-prescriptive nature was used with the examination of the data or materials through content analysis. The results showed that anti-corruption village program initiated by Corruption Eradication Commission (KPK) disseminated the importance of building integrity and anti-corruption values among government and village community. Additionally, this program functioned as a pilot project to prevent corruption and oversee the development of village community.

Abstract

This research delves into the nuanced interplay between religious freedom and legal norms in Indonesia, with a specific focus on the Sikh practice of carrying the kirpan. This ceremonial dagger, integral to Sikh faith and identity, presents a unique challenge within Indonesia's diverse legal and socio-cultural landscape, marked by the country's commitment to Pancasila, which emphasizes religious freedom, unity in diversity, and social justice. By employing a normative juridical approach, this study scrutinizes the tension between the kirpan as a manifestation of religious expression and public safety concerns, utilizing comparative analysis to explore international perspectives and solutions. The investigation reveals a critical need for Indonesia to refine its legal and policy frameworks to more effectively accommodate religious practices like the kirpan. Drawing lessons from countries such as India, the UK, Canada, the US, and Sweden, the research advocates for inclusive legal reforms, enhanced public education, and robust intercultural dialogue. These strategies aim to reconcile the practice of carrying the kirpan with public safety imperatives, reflecting a deeper understanding and respect for religious diversity. The findings underscore the significance of integrating Indonesia's foundational principles of Pancasila into the contemporary discourse on religious freedom and minority rights. The study posits that respecting the kirpan within this ideological framework not only aligns with Indonesia's commitment to diversity and tolerance but also strengthens national unity and social harmony. This research contributes to the broader discourse on balancing religious expression and public safety in pluralistic societies, offering a comprehensive blueprint for policy and legal reforms that honor both religious freedom and collective well-being. It emphasizes the importance of dialogue, education, and legal inclusivity in fostering a society that upholds the dignity and rights of all individuals, irrespective of their religious practices. Abstract

In the criminal justice system, due process of law is defined as a legal process that is good, true and fair. Such legal process occurs, when law enforcement officers related to the process, not only carry out their duties in accordance with existing rules, but also implement the principles and principles which underlie a fair legal process. Implementation of Due Process Of Law is indispensable in maintaining human rights are protected, is associated with its own criminal law issues, protection of witnesses and victims of crime as well as the role of the community towards the protection of victim.

Abstract

Dalam tindak pidana penipuan berbasis online tidak banyak yang menggunakan pasal-pasal yang ada pada UU ITE. Tindak pidana penipuan berbasis online, yang seharusnya menggunakan pasal 28 ayat 1 UU ITE, tetapi aparat penegak hukum terutama penyidik lebih cenderung menggunakan pasal 378 KUHP. Maka menjadi penting untuk menkaji tentang penegakan hukum terhadap tindak pidana penipuan berbasis online. Metode pendekatan penulisan adalah yuridis normatif yaitu mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan. Metode penulisan ini dikenal juga sebagai penelitian doktrinal, metode yang digunakan untuk melihat permasalahan berdasarkan hukum tertulis atau analisis yuridis. Hasil dari penelitian ini adalah tercapainya penegakkan hukum dan peraturan yang tepat dalam menindak tindak pidana penipuan berbasis online. Selain itu, UU ITE pasal 28 ayat 1 dapat diterapkan secara maksimal oleh aparat penegak hukum terutama penyidik.

Penegakan hukum merupakan suatu sistem yang menyangkut penyerasian antara nilai dengan kaidah serta perilaku nyata manusia. Kaidah-kaidah tersebut kemudian menjadi pedoman atau patokan bagi perilaku atau tindakan yang dianggap pantas atau yang seharusnya dilakukan oleh manusia sebagai subjek hukum. Perilaku atau sikap tindak itu bertujuan untuk menciptakan, memelihara, dan mempertahankan kedamaian dan ketertiban di dalam kehidupan bermasyarakat, berbangsa dan bernegara.

Abstract

The rapid advancement of artificial intelligence (AI) introduces unprecedented opportunities and complexities, particularly in its intersection with the legal domain. This study envisions a future where autonomous decision-making robot lawyers play a pivotal role in legal proceedings, providing counsel and representation. Examining the implications of AI’s scientific progress on Indonesian law, normative legal research methods were employed, encompassing statutory, conceptual, comparative, and futuristic analyses. Qualitative scrutiny and content analysis were applied to collected materials. The study reveals the potential of robot lawyers to enhance efficiency in Indonesia’s criminal justice system, aiding in evidence gathering, case analysis, and indictment drafting. This technological integration promises to alleviate the workload of legal professionals and expedite case resolutions, thereby improving public access to legal services. However, challenges loom, including ethical concerns, data security, and professional qualifications. To address these challenges, the study advocates for collaborative efforts among the government, industry, and academia. This cooperation is crucial for formulating regulations and establishing supportive infrastructure for the seamless integration of robot lawyers. Additionally, enhancing digital literacy and public understanding of AI in the legal sphere is emphasized as a vital step toward maximizing the benefits of this technology. In essence, the study underscores the transformative potential of AI in reshaping legal processes, emphasizing the need for a concerted, informed effort to navigate the challenges and optimize the benefits of this evolving technological landscape.

Abstract

Di era globalisasi dan pertumbuhan ekonomi yang cepat, tekanan terhadap lingkungan hidup dan biodiversitas semakin meningkat, khususnya dalam sektor agraria. Penelitian ini mengeksplorasi bentuk-bentuk kejahatan terhadap biodiversitas dalam konteks agraria dan efektivitas penegakan hukum pidana sebagai sarana perlindungan. Fokus penelitian ini adalah pada praktik-praktik yang mengancam keberagaman hayati, seperti penggunaan lahan tanpa memperhatikan prinsip ekologi, penggunaan pestisida dan herbisida berlebihan, serta konversi lahan dari ekosistem alami ke pertanian monokultur yang berpotensi merusak habitat dan menurunkan kualitas genetik tanaman lokal. Penelitian ini merupakan studi yang mengadopsi metode penelitian hukum normatif, menggunakan pendekatan multidimensional, termasuk perundang-undangan, konseptual, komparatif, dan futuristik. Hasil penelitian ini menunjukkan bahwa meskipun undang-undang di banyak negara telah menetapkan kerangka kerja untuk perlindungan biodiversitas, masih terdapat kesenjangan dalam implementasi dan penegakan hukum yang efektif. Keterbatasan sumber daya, kurangnya kesadaran, dan konflik kepentingan seringkali menjadi hambatan dalam melindungi biodiversitas di sektor agraria. Rekomendasi dari studi ini termasuk peningkatan kerjasama lintas sektoral, pengembangan kapasitas penegak hukum, serta penggunaan pendekatan yang lebih holistik dalam perencanaan penggunaan lahan yang mempertimbangkan kepentingan ekologis.

Abstract

Overcriminalization in the context of criminal law refers to the phenomenon where too many behaviors are defined as criminal offenses, which ultimately results in the expansion of law enforcement powers and an increase in the number of individuals caught up in the criminal justice system. This study examines overcriminalization in the formulation of religious offenses contained in Law Number 1, the Year 2023 on the Criminal Code (KUHP), focusing on Article 302 on incitement of a person to no religion or belief adopted in Indonesia and its impact on atheists or non-religious communities. The analysis highlights several important issues, such as the unclear definition of "inciting" in the article, its impact on freedom of speech, potential discrimination against minorities, and misuse of the law for political purposes. The research was conducted using a qualitative method, combining document studies, literature reviews, and analysis of relevant case law. The results show that Article 302 of the New National Criminal Code may lead to overcriminalization, as it regulates acts that can be considered part of freedom of expression and religion. This article can also be considered as limiting the right of individuals to choose their beliefs or religion, including the right not to have religious beliefs. In addition, this research highlights that this article is vulnerable to abuse by parties who have political interests or want to target specific groups. As a recommendation, this study suggests the need to reform the formulation of Article 302 of the National Criminal Code to reduce the impact of overcriminalization and protect human rights, such as freedom of speech.
