Abstract

This in-depth research explores the emerging relationship between artificial intelligence (AI) and legal systems by addressing key questions and understanding the evolution of global justice systems. This study focuses on the role of AI in strengthening the efficiency and objectivity of the judiciary, especially through the application of AI as judges in countries such as China and Estonia. This research aims to systematically analyse these developments, examining how AI is being integrated into justice systems in different parts of the world with challenges related to ethics, accountability, and human rights. The study results show that the integration of AI in the legal system brings increased efficiency and potential for transparency but also raises serious concerns about bias in AI algorithms, limitations in interpreting complex laws, and the impact on human rights principles. The main findings of this research show that the integration of AI in the legal system contains great potential for transformation but also requires a careful approach. While AI can improve the efficiency and quality of decision-making, it is important that AI is developed and implemented within a solid legal and ethical framework that respects human rights and maintains the justice system's integrity. This research emphasizes the need to consider each country's unique legal, cultural, and social context when adopting AI into their legal systems.

Abstract

The development of Artificial Intelligence (AI) has offered transformative opportunities in various sectors, including the justice system. In the Indonesian context, the implementation of AI as a judge promises the potential to address the integrity and efficiency challenges faced by the judicial system, which has been tainted by cases of corruption and susceptibility to subjective bias. By leveraging AI's ability to process big data quickly and objectively, it is expected to create a more transparent decision-making process, reduce bias, and minimise the potential for corruption. This research discusses the implementation of AI in the role of a judge in Indonesia's criminal justice system, examines the potential efficiency, objectivity, and transparency offered by AI, and explores the synergy between AI and human judges in improving the quality of legal services. Through theoretical analysis, this research highlights the importance of standards and protocol development, transparency, training and education, and regular evaluation in AI integration. Cooperation between AI and human judges not only enriches the decision-making process in the judiciary but also maintains the humanistic core of law. This research shows that with a careful and ethical approach, the integration of AI in the justice system can strengthen fairness, improve efficiency, and ensure that technology supports, not replaces, the discretion of human judges, opening a new era in a fairer, more efficient, and dignified judiciary. Abstract

In today's digital era, problems related to cybercrime are increasing, one of which is "Revenge Porn". Revenge porn refers to deliberately distributing pornographic content without the consent of the person seen in the content, often done by ex-spouses as a form of revenge. Due to the easy access and dissemination of information through the internet, revenge porn has become a threat to many individuals, especially women. Victims of this act often face social stigmatization, isolation, and depression. The stigma attached to victims affects their social and work lives, hampering their opportunities in many aspects of life. This research utilizes normative legal methods by adopting statutory, conceptual, comparative, and futuristic approaches. The nature of this research is descriptive-prescriptive. The data that has been collected is analyzed using the content analysis method. This research results in that apart from psychological and social impacts, and revenge porn also has legal implications. Some countries have responded by implementing specific laws to address this issue, but the challenge is distinguishing between the right to freedom of expression and invasion of privacy. Understanding this issue is essential for victims and society to build awareness and prevent the spread of this kind of digital crime. People can protect themselves and others from the dangers of revenge porn with proper understanding and preventive measures.Keywords: Revenge Porn, Digital Crime, Psychological Impact, Social Stigmatization.

Abstract

This research examines the urgency and challenges of eradicating foreign bribery in Indonesia, utilizing the perspective of Islamic law as an ethical and moral framework. Although Indonesia has committed to the eradication of corruption through ratification of the United Nations Convention against Corruption (UNCAC) and participation in the G20 Anti-Corruption Working Group, the persistence of a stagnant Corruption Perception Index (CPI) score and the absence of specific regulations on foreign bribery indicate a gap between international commitments and domestic implementation. Through a normative legal method, this research analyzes the legal framework and corruption eradication practices in comparison to the principles of fairness, transparency, and accountability in Islamic law. The results show that there are significant gaps in the regulation and practice of combating corruption, especially in relation to combating foreign bribery. This research recommends reforming regulations that not only meet international standards but also accommodate ethical and moral values from Islamic law, as well as emphasizing the importance of international cooperation based on the principle of solidarity in goodness. Efforts to eradicate foreign bribery in Indonesia require a comprehensive approach, combining legal reform, integration of Islamic values, and strengthening international cooperation, to increase the effectiveness of the fight against corruption and strengthen integrity and public trust.

Abstract

KYC (Know Your Customer) is a process undertaken by financial institutions to identify and verify the identity of their customers. The aim is to prevent financial crimes such as money laundering, fraud and terrorist financing. This Know Your Customer (KYC) model can be used as a strategic framework for financial institutions to prevent misuse of financial services including child sexual exploitation transactions that are rampant. The model emphasizes rigorous customer identification, verification and continuous monitoring of transactions to detect suspicious activity. By carefully understanding customer financial behavior, financial institutions can identify anomalies that may indicate illicit activities, including those related to child exploitation. Globally, financial service providers including major banks such as HSBC, JPMorgan Chase, and Citigroup, as well as digital payment platforms such as PayPal and Stripe exemplify and can play a key role in preventing child sexual exploitation. This research uses normative legal research methods. The nature of this research is descriptive-prescriptive. The result of this research states that in the future, financial institutions can implement strict KYC (Know Your Customer) policies, monitor suspicious transactions, and cooperate with law enforcement agencies from various countries. This comprehensive approach not only helps combat child exploitation, but also improves global regulatory compliance, thus maintaining the integrity of the financial system. The implementation of the KYC model involves collaboration with law enforcement and utilizes advanced technology for efficient data analysis and customer monitoring. Ultimately, this model serves to protect vulnerable populations while upholding ethical standards within the financial sector.

Abstract

ABSTRACT Efforts to recover assets from crime is one of the studies of anti-corruption communities in the world. Through the Draft Law on Asset Confiscation which has been initiated by the government, it is hoped that activities/efforts to recover assets resulting from crimes can be streamlined for the benefit of law enforcement. The concept adopted in the Draft Law on Asset Confiscation is actually very well-founded and also has a very clear purpose, but of course in its presentation there are still gaps that can be criticized and debated, for example related to human rights and principles in law. Criminal acts are nothing but all of this intended for the common good, both for the community as subjects who are subject to the law and also law enforcement officers as implementers of the rules made. The research method used is the normative legal method in the form of library research which is carried out by collecting legal materials, both primary, secondary and/or tertiary. The technique of collecting materials used in this research is literature study. The collected materials were analyzed qualitatively and to classify legal materials, the authors used content analysis.Keywords: Asset Confiscation, Human Rights, Principles of Criminal Law. ABSTRAKUpaya-upaya dalam pemulihan aset dari kejahatan merupakan salah satu kajian dari komunitas-komunitas anti korupsi di dunia. Melalui Rancangan Undang-Undang Perampasan Aset yang sudah digagas oleh pemerintah, diharapkan kegiatan/upaya pemulihan aset hasil kejahatan dapat diefektifkan untuk kepentingan penegakan hukum. Konsep yang diadopsi dalam Rancangan Undang-Undang Perampasan Aset ini sesungguhnya telah amat berdasar dan juga memiliki tujuan yang sangat jelas, namun tentu dalam penyajiannya masih saja ada celah yang dapat dikritik dan diperdebatkan, misalnya dikaitkan dengan Hak Asasi Manusia dan Prinsip-Prinsip di dalam Hukum pidana, tidak lain dan tidak bukan semua itu dimaksudkan untuk kebaikan bersama, baik masyarakat sebagai subjek yang dikenai hukum dan juga aparat penegak hukum sebagai pelaksana dari aturan yang dibuat. Metode penelitian yang digunakan adalah metode hukum normatif yaitu berupa penelitian kepustakaan (library research) yang dilakukan dengan mengumpulkan bahan hukum baik primer, sekunder dan atau tersier. Teknik pengumpulan bahan yang dilakukan dalam penelitian ini adalah studi kepustakaan. Bahan-bahan yang telah terkumpul dianalisis secara kualitatif dan untuk melakukan klasifikasi bahan-bahan hukum, penulis menggunakan analisis isi (content analysis).Kata Kunci: Perampasan Aset, HAM, Prinsip Hukum Pidana.

Abstract

Pembentukan Undang-Undang Nomor 7 Tahun 2020 (UU 7/2020) sebagai perubahan ketiga dari Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi mendapat sorotan besar dari publik. Tulisan ini bertujuan untuk menjawab dua pertanyaan penting, pertama bagaimana bentuk penolakan masyarakat terhadap UU 7/2020 tentang Mahkamah Konstitusi dan kedua, bagaimana respon negara dalam menghadapi tuntutan masyarakat atas penolakan terhadap UU 7/2020 tentang Mahkamah Konstitusi. Guna menjawab dua pertanyaan itu, penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan. Tulisan ini mengakui bahwa tiga aspek dasar fungsi hukum terhadap hubungannya dengan politik oleh Miro Cerar sangat membantu untuk menganalisis bagaimana hukum difungsikan terhadap politik serta bagaimana karakter hukum yang dihasilkan dalam fenomena ini. Hasil penelitian menunjukkan bahwa bentuk penolakan masyarakat terhadap UU 7/2020 diwujudkan dengan pengujian UU 7/2020 ke Mahkamah Konstitusi. Pembentukan UU yang cenderung abnormal menjadikan hukum difungsikan sebagai alat (means) untuk mencapai tujuan-tujuan politik tertentu dan menempatkan politik menjadi independent variabel sedangkan hukum menjadi dependent variable. Adapun respon negara dalam menghadapi tuntutan masyarakat atas penolakan terhadap UU 7/2020 diwujudkan dengan menolak permohonan pengujian UU 7/2020 untuk seluruhnya oleh yudikatif dan penyusunan perubahan keempat UU 24/2003 oleh pembentuk undang-undang. Hal tersebut mencerminkan revisi perubahan ketiga dan keempat UU MK memiliki karakter hukum yang bersifat konservatif/ortodoks. Penelitian ini menyarankan pengembangan konsep partisipasi dalam pembentukan UU, perluasan penggunaan Amanat Presiden, dan mempertimbangkan perluasan dokrin kerugian konstitusional pada pengujian UU di Mahkamah Konstitusi.

Abstract

Robot prosecutors represent the integration of robotic technology and artificial intelligence (AI) into the traditional role of a prosecutor, reflecting the global trend towards automation and the application of technology within the legal system. This concept is no longer merely a theoretical; it has begun to materialize in certain jurisdictions. For instance, China has emerged as a pioneer in this field by successfully developing an innovative AI program capable of not only of identifying crimes through detailed data analysis but also of filing appropriate lawsuits. This progress underscores the immense potential of this technology to enhance efficiency and accuracy in judicial processes, while simultaneously raising significant questions about ethics, transparency, and justice. This study employed normative methods and utilizing several approaches, including comparative, conceptual, and futuristic approaches. Qualitative analysis was applied to the collected materials; and content analysis was used to classify legal materials. The findings emphasize that while robot prosecutors can improve efficiency in handling routine and data-driven cases, their role should not replace human judgment in more complex and ethically sensitive cases. The legal system must ensure a balance between technological advancements and fundamental principles of justice. Collaboration between AI and human prosecutors, guided by clear protocols, is essential to maintain fairness and ethical integrity, particularly in cases involving moral and social considerations. Thus, Indonesia’s approach to integrating robot prosecutors should focus on establishing transparent oversight mechanisms and protecting the rights of defendants, particularly the right to appeal, to ensure that technological advancements support rather than compromise justice. The adoption of robot prosecutors in Indonesia has the potential to revolutionize the legal landscape. However, it must be pursued cautiously, taking into account both the technological benefits and the human values that underpin justice.
