Abstract

Pancasila, as the foundation of the Indonesian state, provides a philosophical and ethical framework for the administration of law and social life in the country. In the context of constitutional law, Pancasila serves as the highest source of law that guides lawmaking and regulatory interpretation. However, the implementation of Pancasila in law is not always in line with the social realities that occur in society, such as the phenomenon of elopement. Kawin lari, which is a marriage performed without going through official procedures or family permission, often reflects the misalignment between social norms, legal practices and socio- economic conditions of society. In Indonesian society, elopement can be considered an act that violates the legal provisions of marriage, which require official registration and consent from the relevant parties. However, in practice, elopement is often caused by factors such as social pressure, economic necessity or gender inequality. This phenomenon suggests an urgent need for harmonization between the principles of Pancasila and the application of constitutional law as well as policy adjustments that are more responsive to the social dynamics of society. This research aims to explore the relationship between Pancasila, constitutional law, and the reality of elopement in Indonesian society by analyzing the various legal and social dimensions of the phenomenon. The results are expected to provide insights into how the country’s fundamental principles can be more effectively integrated in legal practice as well as how legal reform can address existing social challenges.

Abstract

This study discusses the strengthening of constitutional law based on Pancasila in indoensia’s modern democratic era. Panncasila, as the foundation of the state, embodies values that should guide the formulation and implementation of laws, particulary in safeguarding justice, unity, and social welfare. However, the application of Pancasila’s values in constitutional law still faces several challenges, including weak law enforcement institutions, high levels of corruption, social inequality, and limited public participation in the democratic process. This study analyzes the necessary efforts to strengthen constitutional law through institutional reform, combating corruption, increasing public participation, strengthening the Constitutional Court, implementing fair economic redistribution policies. Drawing on expert opinions and recent data, this research offers systemic solutions aimed at achieving the supremacy of law grounded in Pancasila’s values. The conclusion emphasizes the importance of synergy between the government, law enforcement intitutions, and society in carrying out legal and democratic reforms in Indonesia.

Abstract

Dual nationality is a growing phenomenon in the era of globalization, but it presents various challenges from both Islamic law and international law perspectives. In Islamic law, dual nationality is not explicity addressed; however, principles such as the unity of the ummah (community) and obligations toward the state can create dilemmas concerning dual obligations, such as taxes or military service. Islam teaches compliance with laws that do not contradict Sharia, but dual nationality can lead to conflicts between duties toward the state and religious obligations. Meanwhile, in international law, dual nationality often raises issues related to state sovereignty, dual obligations, and legal conflicts between countries. Countries that permit dual nationality face difficulties in terms of diplomatic protection and the regulation of individual rights. Possible solutions include international negotiations, the adoption of more flexible dual nationality policies, and increasing legal awareness for individuals involved. This paper aims to explore the challenges faced by individuals with dual nationality in the context of Islamic law and propose pratical solutions to address these issues.

Abstract

The role of marriage guardians is discussed in the context of Islamic law, Pancasila and the Indonesian constitution, as well as challenges and solutions in their implementation. The marriage guardian has a central function in Islamic law as the party responsible for witnessing and ratifying the marriage contract. This research explores how the role of marriage guardian is integrated with Pancasila values ​​which emphasize justice and equality, and how this is in line with provisions. The research method used in this research is a qualitative descriptive research method, taking the research location at the Polokarto District Religious Affairs Office. The population and sampling method used was purposive sampling while the respondents were heads and employees at the KUA office and husband and wife couples. The types and sources of data used are primary and secondary data. The data collection technique uses interviews and literature study, while the data analysis technique is interactive analysis. The results of the research show that according to Islamic law the role of the guardian in marriage is very important because all marriages carried out must be with the permission and blessing of the marriage guardian, especially the guardian of the lineage, namely the father, because the marriage is based on the teachings of the Islamic religion. Marriage without the guardian's permission is invalid. This is emphasized in Article 19 KHI. Having a marriage guardian in marriage can play a role in protecting women from possible harm in their marriage household, and by first fulfilling the conditions and pillars of marriage and what is no less important is having permission and blessing from the marriage guardian, especially the father before the marriage. carried out will have an influence on psychological aspects for the continuity and peace of the married household of the daughter.

Abstract

Islamic law provides a comprehensive framework that regulates the rights and obligations of individuals in their relationships with God, fellow humans, and the state. The integration of Islamic law into public affairs in Indonesia, a predominantly Muslim country, presents the challenge of aligning the principles of this religion with the country's pluralistic legal framework. This research explores how Islamic legal principles regarding the rights and responsibilities of citizens interact with the Indonesian legal system, which is based on the principles of Pancasila and the national constitution. This research uses the research methodology of a legislative approach (law approach), legal cases (case approach), conceptual analysis (conceptual approach), historical perspective (historical approach), and comparative. The research results show that although there is potential conflict between Islamic law and national law, proper integration can strengthen social order and justice. This research also highlights the importance of dialogue between stakeholders to formulate legal policies that are inclusive and fair, and support the supremacy of law in Indonesia. This research provides a critical assessment of the application of Islamic law in Indonesia, especially in the context of citizenship, and proposes several solutions to overcome potential conflicts between legal systems. By highlighting real cases in several regions that strictly apply Sharia law, this research concludes that harmonization of Islamic law with the national legal system is not only important to maintain the religious identity of the majority of Indonesian society, but also to maintain the integrity of the nation in the midst of diversity.

Abstract

The advancement of digital technology has brought significant changes to the patterns of political participation in society. In this context, Civic Education (PKn) plays an essential role in fostering civic technology skills (Civic Tech Skills) to enable citizens to participate actively and responsibly in digital spaces. This study employs a qualitative approach by analyzing various literature sources and relevant social phenomena. The findings show that Civic Education not only provides political knowledge but also nurtures critical thinking, democratic values, and practical skills for digital interaction, particularly through social media. By integrating civic values with technological utilization, this education helps the younger generation express their aspirations, engage in political discussions, and contribute to building an inclusive and adaptive society in response to contemporary developments. Therefore, Civic Education serves as a vital means of shaping digital citizens who are intelligent, ethical, and ready to face the challenges of democracy in the digital era.

Abstract

Amidst rising intolerance, moral decline, low social solidarity, and a national identity crisis, reforming Civics Education (PKn) has become an urgent need to restore the nation's identity based on the values of Pancasila. PKn aims not only to instill an understanding of laws and norms, but also to develop character, integrity, responsibility, and social empathy. This renewal process involves innovations in orientation, methods, and learning practices that are more contextual and interactive, and capable of increasing social awareness and active student involvement in national life. There is a close relationship between the revitalization of Civics and the Sustainable Development Goals (SDGs) because both share the same goal: building a peaceful, just, inclusive, and sustainable society. Civics plays a crucial role in helping achieve several SDG goals, such as quality education, reducing inequality, addressing climate change, and strengthening global peace and cooperation. Through an approach that emphasizes civic engagement, Civics encourages students not only to understand their rights and obligations but also to actively participate in social, political, and environmental issues. The choice of the theme of revitalizing Civics (PKn) to increase civic engagement in the SDGs movement is based on the challenge of declining community participation, especially among the younger generation, who are becoming indifferent to national issues. Furthermore, the development of digitalization has changed moral values and nationalism, so Civics must adapt to create critical and responsible digital citizens. With the revitalization of Civics based on the values of Pancasila and the spirit of the SDGs, education can function as a transformative force in shaping a generation of quality, critical thinkers, empathizers, and committed to peace and social justice both at the national and global levels.

Abstract

The climate crisis is a global issue that demands everyone to take a role and take action towards the environment for its sustainability. Therefore, in this context, civic responsibility is not limited to social and political matters but also encompasses ecological responsibilities and must be internalized in educational practices. This study aims to accelerate the integration of civic education and environmentally conscious citizenship, which is one step to affirm civic responsibility amid the climate crisis. This study uses a qualitative method through a library study that examines several educational institutions, learning practices, and policies related to citizenship, the environment, and environmental learning. The results obtained indicate that civic education has great potential in developing critical awareness, active participation, and responsibility in students towards the environment. By incorporating environmental education into the civic education curriculum, the moral, cognitive, and participatory dimensions of civic responsibility that depend on ecology (ecological citizenship) will be formed. Therefore, the climate crisis, especially in learning activities that implement integrated civic education with the environment.

Abstract

Along with the rapid adoption of social media, the digital space has become a new arena for social interaction, particularly among Indonesian youth. However, this development has also brought serious challenges, one of which is the phenomenon of hate speech. This study aims to analyze the dynamics of digital citizenship and the patterns of hate speech dissemination on social media, focusing on a case study among adolescents. Using a qualitative approach with a case study method, data were collected through in-depth interviews with several teenagers, online participatory observation, and content analysis of conversations on social media platforms. The results of the study show that the patterns of hate speech dissemination among adolescents vary, ranging from discriminatory comments, identity-based mockery, to cyberbullying. These patterns are often driven by psychological and social factors, such as anonymity, peer pressure, lack of understanding of digital ethics, and the influence of provocative viral content. The study also found a gap between adolescents’ theoretical understanding of digital citizenship and their daily practices on social media. They tend to perceive the digital space as a consequence-free arena, which reduces their sense of moral responsibility. Thus, this research concludes that the phenomenon of hate speech among adolescents is not merely a technical issue but a reflection of the challenges in building a substantive awareness of digital citizenship. The implication is that a holistic approach involving formal education, parental roles, and platform regulation is needed to equip teenagers with strong digital literacy and a responsible expression ethic.

Abstract

Civic education (PKn) plays a strategic role in shaping civil awareness and democratic values among the younger generation, particularly Generation Z, who were born in the digital era. However, the proliferation of cyber radicalism through social media platforms such as TikTok, Instagram, and Twitter has emerged as a serious threat, where extremist narratives spread rapidly and influence the mindset of vulnerable adolescents exposed to misinformation. This study conducts a critical analysis of the role of civic education in preventing cyber radicalism among Gen Z, focusing on curriculum, teaching methods, and the integration of digital literacy. Employing a qualitative approach based on Jürgen Habermas's critical theory of communication and the digital public sphere, this study critiques the weaknesses of the current education system, which remains insufficiently adaptive to cyber dynamics, such as the lack of empirically based anti-radicalism modules. Key findings indicate that innovative civic education, including project-based approaches and collaborations with digital platforms, can enhance the ideological resilience of Gen Z against radical propaganda, with an effectiveness rate of up to 70% based on case studies in Indonesian schools. However, challenges such as uneven internet access and cultural resistance must be addressed through national policies. This research recommends curriculum reforms in civic education to integrate cyber anti-radicalism education as an integral part of fostering critical and inclusive citizens.
