Abstract

Abstract. The crime of sexual intercourse with a child can be classified as an immoral crime that can damage the child's future. Article 82 Paragraph (1) Jo. Article 76 E of Law 23 of 2002 concerning Child Protection regulates the Act of Sexual Intercourse Against Children. The purpose of this study is to determine and analyze legal protection for children as victims of the crime of sexual intercourse committed by people who have family ties and are carried out continuously at the Muara Teweh District Court. To determine and analyze the obstacles and solutions to legal protection for children as victims of the crime of sexual intercourse committed by people who have family ties and are carried out continuously at the Muara Teweh District Court. The method used by the researcher is a normative legal aproach and the specifications in this study are descriptive analytical. The sources and types of data in this study are secondary data obtained from literature studies. The data is analyzed qualitatively using the theory of legal protection and the theory of legal effectiveness. Based on the results of the study, legal protection for child victims of sexual intercourse committed by people with ongoing family relationships in the Muara Teweh District Court is regulated in the Child Protection Law (Law Number 35 of 2014 concerning Child Protection) and related legislation. This law provides special protection through various efforts, including social rehabilitation, psychosocial assistance, and handling cases in juvenile courts. The criminal penalties imposed on the perpetrator are also increased if the act is carried out continuously or by the victim's parents. The penalties imposed for perpetrators of this crime are severe, and the juvenile justice system provides special protection to victims. Obstacles to legal protection for children as victims of sexual intercourse committed by people who have ongoing family relationships and carried out continuously in the Muara Teweh District Court are the lack of public awareness, the inability of law enforcement officers, and weak suport from family and the community. Solutions include: Increasing Education and Socialization, Training of Law Enforcement Officers, Increasing Suport from Family and the Community.

Abstract

Criminal acts of sexual violence are increasing in Indonesia. This crime is very detrimental to the victims because of the impacts it causes. Victims must receive protection for their rights as regulated in Law Number 12 of 2022, however, protection for the rights of victims of sexual violence has not been optimal due to weaknesses in terms of legal substance and legal culture. This study uses a constructivism paradigm, with a socio-legal research approach method. The specifications of this study are descriptive analytical. The data used are primary data and secondary data, which are then analyzed qualitatively. The results of the study show that: 1. Victim protection can also include abstract (indirect) and concrete (direct) forms of protection: (1) Abstract protection is basically a form of protection that can only be enjoyed or felt emotionally (psychically), such as satisfaction (satisfaction); (2) Concrete protection is basically a form of protection that can be enjoyed in real terms, such as the provision of material or non-material. 2. Implications of the Regulation of Legal Protection for Victims of Sexual Violence Based on Law Number 12 of 2022, there are weaknesses in the protection of victims' rights, in terms of: (1) legal substance, namely: (i) not all forms of sexual violence are regulated in Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, (ii) Law Number 12 of 2022 opens up space for subsidiary punishment or substitute punishment for perpetrators in the mechanism for providing restitution to victims, and (iii) overlapping laws and regulations governing sexual violence; (2) legal culture, namely: (i) law enforcement, (ii) society. 3. Legal Protection for Women Resulting from Criminal Acts of Sexual Violence: (1) Based on the laws and regulations in Indonesia, there are various regulations that regulate forms of sexual violence such as the 1945 Constitution, Law Number 1 of 1946 concerning the Criminal Code, Law Number 39 of 1999 concerning Human Rights, Law Number 26 of 2000 concerning the Human Rights Court, Law Number 23 of 2004 concerning the Elimination of Domestic Violence, Law Number 21 of 2007 concerning the Eradication of Criminal Acts of Human Trafficking, Law Number 35 of 2014 Amendment to Law Number 23 of 2002 concerning Child Protection, Law Number 17 of 2016 which stipulates the State Regulation in Lieu of Law Number 1 of 2016 concerning the second amendment to Law Number 23 of 2002 concerning Child Protection has become a Law, Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, Law Number 1 of 2023 concerning the Criminal Code and Law Number 17 of 2023 concerning Health. (2) Efforts to prevent sexual violence, including: a. The role of the government, b. The role of society, c. The role of the family and d. The role of oneself.

Abstract

Theft is one of the actions or deeds that are against the law. In the Criminal Code, theft can be subject to Article 362. The purpose of the research in this study: 1). To study and analyze the implementation of restorative justice in handling criminal acts of theft in Indonesia; 2). To study and analyze the obstacles and solutions to the implementation of restorative justice in handling criminal acts of theft in Indonesia. This study uses a sociological juridical approach, with a descriptive analytical research method. The data used are primary and secondary data which will be analyzed qualitatively. The research problems are analyzed using the theory of restorative justice and the theory of the legal system of Lawrence Friedman. The results of the study concluded that: 1) The implementation of restorative justice for the crime of theft has begun to be maximized since the issuance of the Circular of the Chief of Police Number SE/2/II/2021 on February 19, 2021 and the Regulation of the Republic of Indonesia National Police Number 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice issued on August 20, 2021; 2). The application of restorative justice as an alternative to resolving petty theft cases still has several obstacles or weaknesses. The weakness in the legal substance aspect is the time limit stipulated in Article 9 paragraph (5) of the Prosecutor's Regulation No. 15 of 2020, which stipulates a deadline of 14 days from the submission of the file. The weakness in the legal structure aspect is the lack of understanding of law enforcement officers regarding the implementation of resolving the crime of theft with restorative justice. The weakness of the legal culture of the application of Restorative Justice is that not all people are aware of the concept of Restorative Justice as a replacement for the general criminal system. The solution to the weakness of the legal substance aspect is that it is necessary to review the regulations governing the time limit in the Prosecutor's Regulation No. 15 of 2020, with the aim of adding time so that the resolution of cases is not rushed. The solution to the weakness of the legal structure aspect is the need to improve the quality of personnel by providing further education to law enforcers in handling restorative justice cases by improving the quality of personnel, it will also improve the abilities of members, especially restorative justice cases. The solution to the weakness of the legal culture aspect is that the government is advised to re-socialize the implementation of Restorative Justice as an initial step that should be taken in implementing law enforcement in the community.

Abstract

This study aims to analyze legal protection for children as victims of sexual harassment, with a focus on handling by the Women and Children Protection Unit (PPA) of the Semarang Police. Legal protection for child victims of sexual violence is very important considering the psychological and social impacts it causes. The method used in this study is sociological juridical, with a qualitative approach to research specifications in the form of analytical descriptive. Data sources consist of primary data, secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. The results of the study show that the Semarang Police through the PPA Unit have made legal protection efforts through a fast investigation process, psychological and legal assistance, and coordination with related agencies such as the Social Service and Child Protection Agency. However, there are still obstacles such as limited number of experts, lack of supporting facilities, and lack of public understanding of the importance of reporting cases of sexual abuse against children. Therefore, better synergy between institutions is needed as well as increased education and socialization to the community to create optimal protection for children.

Abstract

The purpose of this study is to determine and analyze the implementation of law enforcement in overcoming the crime of falsification of motor vehicle documents in the jurisdiction of the Batang Police, the obstacles faced by police investigators in overcoming the crime of falsification of motor vehicle documents in the jurisdiction of the Batang Police, and the obstacles faced by police investigators in overcoming the crime of falsification of motor vehicle documents in the jurisdiction of the Batang Police. This study uses a sociological legal approach method, with analytical descriptive research specifications. The data used are secondary data obtained through literature studies and primary data obtained from interviews with respondents related to law enforcement of criminal acts of forgery of motor vehicle documents in the jurisdiction of the Batang Police. The formulation of the problem is analyzed using the theory of law enforcement and Criminal Responsibility in Islam. The results of this study are that the handling of motor vehicle document forgery cases by the Batang Police has been carried out in accordance with criminal law provisions, specifically referring to Article 263 of the Criminal Code. The legal process is carried out systematically, starting from the stages of investigation, inquiry, prosecution, to court decisions. In the Decision of the Batang District Court Number: 182 / Pid.B / 2024 / PN Btg, the defendant Waryono bin Yakub was legally and convincingly proven to have committed the crime of making and using fake documents, and was sentenced to one year in prison. From an Islamic legal perspective, this act of forgery is included in the category of ta'zir crimes, namely violations whose punishment is determined by the judge, because these actions are contrary to the values of honesty and justice in Islam. Batang Police investigators face various obstacles such as perpetrators who move from place to place, a neat and organized forgery network, lack of information from the public, and limited facilities, infrastructure, and human resources. To overcome these obstacles, the Batang Police have made various efforts such as routine raids, cross-agency cooperation, community outreach, and intelligence infiltration into the perpetrators' network.

Abstract

Abstract: Defamation in the digital realm is a form of cybercrime that has increasingly evolved alongside advancements in information technology. This act involves the dissemination of false or slanderous information that harms an individual's reputation. In the context of Indonesian law, defamation is regulated under Articles 310–321 of the Criminal Code (KUHP) and Law Number 1 of 2024, which amends the Electronic Information and Transactions Law (ITE Law), particularly Articles 27A and 27B paragraph (2) in conjunction with Article 45. The new national Criminal Code, effective January 2, 2026, also addresses defamation under Articles 433, 434, 435, 441, and 158. The evidentiary process for such crimes refers to Article 184 of the Criminal Procedure Code (KUHAP) and Article 5 of the ITE Law, which recognizes electronic information and documents, including their printouts, as valid legal evidence. In addition to repressive legal approaches, restorative justice as regulated in the National Police Chief’s Circular Letter SE/8/VII/2018 offers an alternative resolution to achieve substantive justice and legal certainty.Keywords: Law Enforcement, Cyber Crime, Defamation Crime.

Abstract

Most students in the fashion program, particularly at SMK Negeri 6 Semarang, still show low levels of understanding regarding the principles of sustainability in the fashion industry. This is evident from the failure to meet the Learning Objective Achievement Criteria (KKTP) of 75. This condition indicates the need for more engaging, contextual, and relevant learning solutions aligned with global issues. So far, the material has been delivered conventionally through textbooks and presentations, which have proven ineffective. There is a need for the development of more engaging learning media. This study aims to assess the effectiveness of the Sustainable Fashion E-Module in enhancing student ability to analyze the fashion industries impact on the environment. The research uses a quantitative method with a pretest-posttest control group design. The sample consists of 69 students from the fashion program at SMK Negeri 6 Semarang, divided into experimental and control groups. The instruments used were pretest and posttest questions. The research data were tested for normality and homogeneity as prerequisites for analysis. Data analysis was then performed using the Normalized Gain (N-Gain) test to measure learning improvement and the Independent Sample T-Test to examine significant differences between groups. The results showed that the average N-Gain for the experimental group was 76%, categorized as effective, while the control group had only a 37% N-Gain, categorized as less effective. The T-Test showed a significance value of 0.000 < 0.05, indicating a significant difference between the two groups. Based on these findings, it can be concluded that the use of the E-Module is effective in enhancing student cognitive abilities regarding the concept of sustainable fashion

Abstract

This research is based on the problem of low logical thinking skills of PTIK students in programming algorithms, and cannot be optimized through traditional teaching methods. the main thing of the research is to design and assess interactive modules based on the Problem Based Learning (PBL) model to improve the logical thinking skills of PTIK students. The research method used is the Research and Development (R&D) approach with the ADDIE model which includes the stages of Analysis, Design, Development, Implementation and Evaluation. These stages involve determining needs, organized planning, digital product development, implementation in a real learning context, and thorough evaluation. The resulting module combines the features of a live coding editor to support practice. The findings of this study indicate that this interactive module is very useful and practical to implement. Expert validation confirmed that in terms of functionality, ease of use, reliability and efficiency, the module has good quality, and the module also proved successful in improving the logical thinking skills of PTIK students. In conclusion, the PBL-based interactive module can be considered as a practical and effective learning tool. The new discovery in this research is the provision of an innovative integrated digital learning solution, which directly supports the improvement of logical thinking skills in the field of programming.

Abstract

People with mental disorders are often stereotyped as being involved in criminal acts, especially violence and threats to the safety and security of those around them. This perspective causes people with mental disorders to be feared and shunned, even though they need care and protection. Regional governments are responsible for providing mental health services for their communities and playing a strategic role in managing and preventing mental health issues. In Kudus, there are still displaced people with mental disorders who have not received proper care. The local government can progressively address mental health issues through regulatory instruments to ensure that people with mental disorders receive the appropriate treatment and support they need. This study aims to examine the mental health policies of the Kudus local government, emphasizing policies prioritizing human rights. The research uses a normative juridical method involving a thorough analysis of policies concerning people with mental disorders in the Kudus district. The results show that although the Kudus Regional Government has established policies related to mental Disability and mental health, these policies do not sufficiently address the prevention of mental disabilities or fully incorporate human rights considerations.

Abstract

Lack of creativity is caused by students' lack of knowledge and lack of interest in reading books and looking for references from other sources. A monotonous bun turns out to be an indicator of a student's lack of creativity, and is often the same as several other students. The researcher decided to carry out research on the effectiveness of educational media on traditional bun videos on traditional bun students at SMK Negeri 06 Semarang with the basic competencies of bun gelung malang, bun pusung tagel and bun ukel konde which have the advantage of making interesting video tutorials.The method used in this research is R&D with the ADDIE model which consists of analysis, design, development, implementation and evaluation stages. This research method uses data collection techniques in the form of a Likert scale questionnaire and is analyzed using quantitative descriptive techniques. This research was implemented at SMK Negeri 06 Semarang with a total population of class XI majoring in beauty engineering with a sample of 60 studentsThe results of this research show (1) Development research using the ADDIE model produces a learning media product in the form of traditional bun video educational media that is suitable for use. (2) Feasibility results from the validity test using Aiken V. In terms of material feasibility, an Aiken score of 0.783 was obtained and media feasibility with an Aiken score of 0.719 in the valid category (3) Effectiveness test results using a sample t-test with significant results and t value = 6.847 > t table (df-2) = 2,048 (4). and the N Gain test results show that the N-Gain in the control class is 22.9% in the low category and the N-Gain in the experimental class is 62.5% in the medium category. So that educational media is effective in improving learning outcomes for beauty system students.
