Abstract

The phenomenon of contract marriage (nikah kontrak) in Cianjur Regency has emerged as a significant legal and socio-religious issue within Indonesian society, attracting both national and international scholarly attention. This study is driven by two core research questions: (1) How is Regent Regulation No. 38 of 2021 implemented in addressing the practice of contract marriage? and (2) To what extent does this regulation reflect and uphold the objectives of Islamic law (Maqāṣid al-Sharīʿah)? The research aims to critically examine the legal implementation and social impact of the regulation, particularly on individuals involved in contract marriages. Employing a qualitative method with a descriptive-analytical and case-study approach, data were collected through in-depth interviews with contract marriage actors, community leaders, and government officials. The findings reveal that contract marriages in Cianjur occur through various forms of informal or semi-formal arrangements often without legal guardians or witnesses, or with invalid ones thereby fulfilling only the outward form of marriage without generating legal consequences such as the obligation of ʿiddah. From the Sunni legal perspective, such practices are considered invalid, whereas in the Shiʿa Imamiyah tradition, they may resemble nikah mutʿah under specific conditions. The persistence of contract marriage is influenced by internal factors (economic necessity, cultural accommodation) and external factors (social tolerance and weak enforcement). Although Regent Regulation No. 38/2021 seeks to curb the practice, its implementation has yet to produce a substantial deterrent effect. Within the broader global discourse on Islamic legal reform, this study underscores the necessity of integrating normative Islamic legal principles with contextual socio-legal realities. A more comprehensive strategy combining legal enforcement, community education, and theological engagement is essential to safeguard the higher objectives of Islamic law and protect vulnerable parties in marital relations.

Abstract

The growing number of petitions for marriage annulment and divorce raises a complex legal challenge, as each is grounded in different legal purposes and carries distinct implications. This issue has emerged in several cases before the Religious Courts within the DKI Jakarta High Religious Court jurisdiction, notably Case Number 3000/Pdt.G/2023/PA.JS, where both claims were filed simultaneously. This study aims to analyze the legal construction and judicial reasoning of judges in deciding cumulative applications for annulment of marriage and divorce lawsuits in the Religious Court within the jurisdiction of the DKI Jakarta High Religious Court. This study adopts a descriptive–analytical socio-legal method, drawing on legal construction theory, judicial reasoning, law enforcement principles, and the doctrine of maslahah mursalah to critically analyze judges’ legal reasoning and judicial outcomes. Data were analyzed through normative legal analysis supported by case law. The findings reveal that the legal construction applied by judges in handling the accumulation of annulment and divorce claims prioritizes justice, legal certainty, and human rights protection by harmonizing procedural law with substantive Islamic legal principles. The novelty of this research lies in formulating a coherent legal solution that legitimizes the selective acceptance of claims, enabling courts to resolve procedural conflicts while safeguarding the legal status and post-divorce rights of wives and children. This approach offers a workable judicial framework for adjudicating comparable cases within the Religious Courts.

Abstract

This study aims to determine how the gold murabahah investment product and customer welfare, as well as to determine how the effect of gold murabahah investment product on the welfare of customers at PT. Abadi Optimization Gold Bandung City Branch. The factors tested in this study were the gold murabahah investment product as the independent variable. While the welfare of customers as the dependent variable. The research method used in this research is verification method. The population in this study were customers of PT. Optima Eternal Gold as many as 100 people. The sampling technique used in this study is a non-probability sampling technique with a saturated sampling method, while to calculate the sample size using the slovin formula, so that the sample in this study is 100 customers of PT. Eternal Optima Gold. The analytical method used in this study is simple linear regression analysis at a significance level of 5%. The program used in analyzing the data uses the Statistical Package for Social Sciences (SPSS) Ver.19.00. Based on the results of the partial and simultaneous research, it shows that the gold murabahah investment product has an effect on the welfare of customers at PT. Abadi Optimization Gold Bandung City Branch. In addition, the magnitude of the influence of the gold murabahah investment product in contributing to the customer's welfare is 54.0%.

Abstract

Islamic fiqh is an evolving legal system influenced by the various fiqh madhhabs that have emerged since the early days of Islam. This diversity has contributed significantly to the application of Islamic law in the contemporary world. This study aims to analyze the historical development of the main fiqh madhhabs (Hanafi, Maliki, Shafi'i, and Hanbali) and their influence on the practice of Islamic law in the context of legal pluralism and fiqh reform in Muslim countries. This research uses a historical and analytical approach by examining classical fiqh literature and the development of modern Islamic law. It analyzes fiqh texts, legal decisions, and Islamic legal policies implemented in various Muslim countries. The results show that fiqh madhhabs played an important role in the formation of diverse Islamic legal systems. The influence of these madhhabs can be seen in the application of sharia law in various Muslim countries, despite differences in its recognition and implementation. In addition, the fiqh madhhabs also contribute to the socio-political dynamics in Muslim societies. This study asserts that despite the challenges in adapting fiqh to the modern era, a flexible and inclusive approach to fiqh can be a solution in dealing with global legal issues. Fiqh reforms that take into account the social context and needs of Muslim societies can enhance the relevance and justice of Islamic law in the contemporary era.
