Abstract

The management of BUMDesa is not yet optimal because many BUMDesa administrators still need to understand BUMDesa regulations and institutions. Seeing these problems, there needs to be capacity building preceded by legal reasons as a guideline for regulating BUMDesa management signs. Increasing the capacity of Village-Owned Enterprises (BUMDesa) as an organ driving the village economy can be carried out through the Job Creation Era, which has become a momentum for structuring BUMDesa regulations and institutions. The era of work creation referred to is the birth of Law Number 11 of 2020 concerning Job Creation which is now declared invalid with the presence of Government Regulation  (Perpu) Number 2 of 2022 concerning Job Creation. This study uses normative legal research methods(normative legal research). The author uses this legal research because the focus is on studying literature and laws and regulations related to the object of research. The results of the research show that the Job Creation Perpu needs to be pushed into law so that it can become a legal umbrella for the establishment and management of BUMDesa institutions because, in fact, the spirit that is carried out in the Job Creation Era, namely improving the investment ecosystem and business activities, one of them through the institutional arrangement of BUM Desa.

Abstract

This research discusses the strength of the Constitutional Court's decision regarding judicial review in Indonesia. The Constitutional Court is an institution of judicial power tasked with exercising the authority of judicial review born from the 3rd Amendment to the 1945 Constitution. In this study, the philosophical and normative foundations that form the basis for the strength of the Constitutional Court's decision to conduct judicial review will be discussed. The method used is normative juridical, using secondary materials such as laws, decisions of the Constitutional Court, and related legal literature. This study's results confirm that the Constitutional Court's decision to conduct a judicial review has a powerful dimension of power. This power can be viewed from several angles, both philosophical and normative. In the philosophical aspect, the strength of the Constitutional Court's decision lies in the principles of popular sovereignty and constitutional supremacy. While in the normative aspect, the strength of the Constitutional Court's decision is based on the provisions of laws and regulations governing the authority and procedures of the Constitutional Court in conducting judicial reviews.

Abstract

The implementation of the ijon system by the community, especially farmers, has become a habit that has been passed down from generation to generation and has become entrenched in a number of areas, including Gorontalo. The 1945 Constitution, especially in Article 18B paragraph two (2) which reads that the State recognizes and respects customary law community units along with their traditional rights as long as they are still alive and in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia, which is regulated in law. Even so, buying and selling under the debt bondage system, in the eyes of the law, is strictly prohibited because in buying and selling the bonded bond system is very unclear because this is a form of extortion that can harm other people. The sale and purchase of the ijon system has also been confirmed in article 8 paragraph 3 of Law number 2 of 1960 concerning production sharing agreements, which reads: "payments by anyone, including owners and cultivators, to cultivators or owners in whatever form they have elements of ijon, are prohibited". The provisions used as the legal basis for the use of standard contracts in Indonesia are Article 1338 Paragraph (1) of the Civil Code which stipulates: "all agreements made legally apply as laws for those who make them" from the words all can be interpreted that every legal subject can make an agreement with any content, there is freedom of the legal subject to determine the form of the agreement. In other words, through the principle of freedom of contract, legal subjects have the freedom to make agreements, including opening opportunities for legal subjects to make new agreements that have not been regulated in the Civil Code so that they can follow the needs of society due to the times

Abstract

Penelitian ini mengusulkan untuk melakukan implementasi dan evaluasi efektivitas pelatihan mediasi sebagai alat untuk menyelesaikan perselisihan di masyarakat Desa Molowahu. Metode yang digunakan dalam penelitian ini melibatkan pendekatan perencanaan partisipatif, pelaksanaan pelatihan mediasi, dan evaluasi berkelanjutan untuk mengukur dampak dan keberhasilannya. Tujuan utama penelitian ini adalah untuk meningkatkan pemahaman masyarakat tentang mediasi sebagai metode penyelesaian konflik yang efektif dan memperkuat kapasitas mereka dalam menyelesaikan perselisihan. Pelatihan mediasi dirancang untuk memberikan pengetahuan dan keterampilan praktis kepada peserta, sehingga mereka dapat menjadi mediator yang terlatih dan kompeten dalam memfasilitasi penyelesaian konflik di masyarakat mereka. Hasil penelitian menunjukkan adanya peningkatan yang signifikan dalam pemahaman masyarakat tentang mediasi setelah mengikuti pelatihan. Masyarakat menjadi lebih sadar akan pentingnya berkomunikasi dengan baik, mendengarkan dengan empati, dan mencari solusi yang adil dan saling menguntungkan dalam menyelesaikan konflik. Mereka juga mengembangkan keterampilan dalam mengelola emosi, mengidentifikasi kepentingan bersama, dan memfasilitasi dialog yang konstruktif. Selain itu, pelatihan mediasi ini juga berhasil mendorong perubahan sosial yang positif dalam masyarakat Desa Molowahu. Masyarakat mulai mengadopsi pendekatan penyelesaian konflik yang lebih damai dan demokratis, menghindari kekerasan atau tindakan yang merugikan pihak lain. Mediasi menjadi pilihan utama dalam menyelesaikan perselisihan, menggantikan metode konfrontasi atau penyelesaian melalui pihak ketiga yang tidak efektif.

Abstract

Penyandang disabilitas merupakan bagian integral dari masyarakat dan berhak mendapatkan perlindungan hukum serta diakui keberadaannya. Meski demikian, realitas menunjukkan masih banyak penyandang disabilitas yang mendapatkan diskriminasi dan tidak mendapatkan haknya secara penuh. Kabupaten Boalemo, seperti daerah lain di Indonesia, memiliki jumlah penyandang disabilitas yang signifikan. Namun, perlindungan hukum dan pemenuhan hak-hak mereka masih menjadi isu yang perlu mendapatkan perhatian lebih. Diskriminasi, akses yang terbatas terhadap pendidikan, pekerjaan, dan fasilitas publik, serta kurangnya pemahaman masyarakat terhadap hak dan kebutuhan penyandang disabilitas menjadi tantangan utama. Penelitian ini bertujuan untuk memahami pengaruh budaya dan nilai-nilai masyarakat di Kabupaten Boalemo terhadap pandangan dan perlakuan terhadap penyandang disabilitas serta merumuskan rekomendasi tentang bagaimana perlindungan hukum bagi penyandang disabilitas dapat ditingkatkan dengan memperhatikan budaya dan nilai-nilai lokal. Pendekatan cultural studies menjadi landasan dalam mengungkap dinamika dan interaksi antara budaya, hukum, dan hak-hak penyandang disabilitas.

Abstract

Indonesia’s constitutional law embodies the ideals of Islamic law, guaranteeing the right to religion and worship in Article 29 of the 1945 Constitution. Local Sharia regulations, known as Sharia Perda, are one manifestation of this ideal. However, Sharia Perda is not without problems, such as discrimination and exclusivity towards non-Muslims and limitations on women’s freedom. This research aims to identify the main characteristics of Sharia Perda and discuss its compatibility with constitutional law. The research employs a normative juridical approach, analyzing relevant laws and regulations, and using the legal hermeneutic method to interpret their meaning and philosophy. Sharia Perda has two main characteristics: Sharia compliance and local speciƶcity. However, its implementation has resulted in controversies and conǁicts, such as the prohibition of alcohol and criminalization of pre-marital sex. These controversies arise from the tension between Islamic law principles and constitutional law, particularly regarding individual rights and freedoms. This study contributes to the discussion of the compatibility of Islamic law and constitutional law, highlighting the need to address the problems of Sharia Perda, particularly the limitations on women’s freedom and discrimination towards non-Muslims.

Abstract

Legal counseling can be done through community empowerment which is one of the efforts made by lecturers at the Faculty of Law, Gorontalo State University in understanding legal knowledge to the community, including about, parents' civil responsibility for post-divorce in Kaaruyaan Village, Mananggu District, Boleoa Regency. Legal prohibition for violations of non-fulfillment of children's rights after divorce often occurs in a number of areas including in some villages where this is caused by ignorance of the community in general and parents are concerned about what are the rights and obligations of parents to children after divorce where the case is mostly dominated by fathers as insurers who have not fulfilled their obligations as fathers, Especially when the father re-married another woman. So the impact of empowering this legal counseling is the independence and understanding of the community in overcoming their legal problems through community initiatives and creativity and village officials assisted by lecturers in the environment of the Faculty of Law, Gorontalo State University. Of course, it requires people who are willing and able and have the knowledge, skills and attitudes to get out of their problems. This paper uses the quality descriptive method, in this case the descriptive analysis will discuss the condition of partners regarding understanding of the law. While quantitative analysis is carried out to calculate the feasibility of legal settlements carried out by partners. The result of this discussion is that with the growing understanding of law, the pillars of justice and expediency must be accompanied by efforts to foster and develop to legal counseling so that it becomes a law-conscious, independent and sustainable society.

Abstract

The emergence of various regional legislative products concerning zakat management, such as the Regional Regulation of Pohuwato Regency Number 6 of 2015 on Zakat Management, harbors potential complications. These issues pertain mainly to the implementation of good governance principles and innovation in the regulations and practices of zakat management. The primary aim of this study is to evaluate the effectiveness and accountability of zakat management in Pohuwato Regency, as enforced through the Regional Regulation of Pohuwato Regency Number 6 of 2015 on Zakat Management. Furthermore, this study seeks to identify critical steps that ought to be considered when addressing the challenges of zakat management. The adopted research methodology is empirical legal research, with an analytical and observational approach. The focus of this research is to gather factual data through case studies and interviews, as well as observing and analyzing the practical application and enforcement of the law. The study's findings highlight that coordination, transparency, accountability, empowerment of mustahiq (the poor and needy), and zakat literacy should be considered to establish effective and efficient zakat management in Pohuwato Regency. Vital steps requiring attention include professionalism, accountability, transparency, public participation, effectiveness, and coordination between agencies. By implementing these steps, zakat can optimize its benefits, thereby enhancing the quality of life and overall welfare of the people.

Abstract

Program Kuliah Kerja Nyata (KKN) Tematik dengan tema "Pembangunan Desa Melalui Penguatan Organisasi Karang Taruna Dalam Memaksimalkan Praktik Politik Dan Pemililhan Duta Demokrasi di Desa Muara Bone Kecamatan Bone" dirancang sebagai upaya konkret dalam mewujudkan partisipasi politik yang lebih inklusif dan efektif. Program ini dirancang untuk mencapai beberapa tujuan, termasuk implementasi tridharma perguruan tinggi dan kemitraan antara Universitas Negeri Gorontalo dengan pemerintah daerah. Melalui berbagai kegiatan seperti penyuluhan hukum kepemiluan, pemilihan duta demokrasi, dan pendampingan masyarakat, program ini tidak hanya menawarkan solusi praktis tetapi juga berdampak pada penguatan partisipasi politik masyarakat dan karang taruna. Penekanan pada pendidikan dan keterlibatan pemuda melalui karang taruna, serta kolaborasi antar-stakeholder, menjadikan program ini sebuah model potensial untuk intervensi serupa di masa mendatang. Program ini juga sejalan dengan prinsip-prinsip dari Merdeka Belajar Kampus Merdeka (MBKM) dan mencakup indikator kinerja utama dalam tata kelola desa.

Abstract

The purpose of this study is to investigate the rationale and consequences of the strategy of reducing executive authority, particularly that of the president, that was incorporated into the Republic of Indonesia Constitution of 1945 (UUD 1945) via a series of modifications. To comprehend the modifications to the constitution, this study employs a normative or doctrinal approach, concentrating on the analysis of pertinent papers, reports, and literature. According to the findings, these amendments were implemented in reaction to calls for reform and democratization. They sought to build a more balanced system of government with strong principles of checks and balances among the executive, legislative, and judiciary, and they eliminated the sacred and static views of the 1945 Constitution during the New Order era. This embodies the shift in Indonesian governance from a top-down, autocratic system to a bottom-up, democratic one, where checks and balances on the presidency are put in place to forestall any return to autocracy and guarantee greater citizen input into policymaking
