Abstract

This study aims to analyze the role of the Indonesian Constitutional Court in carrying out its function as a stronghold of law enforcement in Indonesia after the reform era, as well as evaluate the extent to which this institution has succeeded in protecting human rights through its decisions. Methods: This research is categorized as normative legal research with a philosophical and analytical approach. The focus is on rational, critical, and philosophical analysis of the legal issues raised. The analytical descriptive method is used to describe the applicable legislation, legal theory, and positive law enforcement practices related to the problem under study. Results: The results show that the Indonesian Constitutional Court plays an important role in upholding the Constitution and social justice with a careful and balanced approach. Key decisions such as No. 18/PUU-V/2007, No. 75/PUU-XIII/2015, and No. 102/PUU-XXI/2023 highlight the importance of legislative autonomy, legal clarity, and certainty, as well as the presumption of innocence and prudence in political intervention. The application of Aharon Barak's theory of "proportionality," Lon Fuller's "legal certainty," and Alexander Bickel's "judicial restraint" provides insight into ensuring a balance between human rights, legal certainty, and the integrity of due process.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hak anak atas identitas melalui pencatatan akta kelahiran berdasarkan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak dan efektivitas aplikasi OK-MAN dalam mengurangi jumlah anak tanpa akta kelahiran di Kabupaten Bonebolango. Penelitian menggunakan pendekatan gabungan normatif-empiris. Pendekatan normatif dilakukan dengan mengkaji peraturan perundang-undangan yang relevan, sedangkan pendekatan empiris melibatkan observasi dan wawancara dengan masyarakat serta aparatur Dinas Kependudukan dan Pencatatan Sipil. Hasil penelitian menunjukkan bahwa aplikasi OK-MAN berhasil meningkatkan efisiensi dan aksesibilitas layanan administrasi kependudukan, yang tercermin dari penurunan signifikan jumlah anak tanpa akta kelahiran. Namun, implementasi aplikasi ini menghadapi beberapa tantangan, seperti rendahnya literasi digital masyarakat, keterbatasan infrastruktur teknologi, dan kurangnya sosialisasi. Penelitian ini merekomendasikan peningkatan edukasi masyarakat, penguatan infrastruktur, dan pengembangan aplikasi agar lebih inklusif. Hasil ini diharapkan dapat mendukung penguatan kebijakan terkait perlindungan hak anak atas identitas.

Abstract

Penegakan hukum dalam Pemilukada di Indonesia masih menghadapi berbagai kendala, terutama dalam mekanisme penyelesaian sengketa yang melibatkan banyak lembaga dengan kewenangan berbeda. Situasi ini menyebabkan ketidakpastian hukum dan memperpanjang proses penyelesaian perkara. Penelitian ini bertujuan untuk menganalisis urgensi pembentukan lembaga peradilan khusus sebagai solusi dalam menangani sengketa Pemilukada secara lebih efektif dan efisien. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, historis, komparatif, konseptual, dan analitis. Sumber data terdiri dari bahan hukum primer, sekunder, dan tersier yang dianalisis menggunakan metode yuridis normatif serta hermeneutika hukum untuk memahami dan menafsirkan regulasi yang berlaku. Hasil penelitian menunjukkan bahwa sistem penyelesaian sengketa Pemilukada di Indonesia masih bersifat fragmentaris dan tidak efisien, yang berpotensi menghambat proses demokrasi. Pembentukan lembaga peradilan khusus yang bersifat ad hoc dinilai sebagai solusi yang dapat meningkatkan efektivitas penyelesaian sengketa serta menjamin kepastian hukum dalam Pemilukada. Studi ini merekomendasikan pembentukan pengadilan khusus dengan sistem yang terstruktur berdasarkan tingkatan, seperti model yang diterapkan di Brasil dan Meksiko, guna menciptakan mekanisme hukum yang lebih terintegrasi dan efektif.

Abstract

This study examines the Constitutional Court's authority in resolving regional head election disputes, focusing on its role in ensuring substantive justice and the implications of the vote threshold in Article 158 of the Regional Head Election Law on candidates' constitutional rights. The research employs a normative legal method, utilizing a statutory approach to analyze the Court’s jurisdiction, a case approach to assess key decisions, and a conceptual approach to evaluate the principles of substantive justice in electoral disputes. Primary legal sources include the 1945 Indonesian Constitution and Constitutional Court rulings, while secondary sources consist of scholarly literature, legal commentaries, and tertiary legal references. The findings reveal that the Constitutional Court has played a pivotal role in upholding democratic principles by setting aside formalistic constraints such as the vote threshold when structured, systematic, and massive violations significantly impact election outcomes. However, this approach raises concerns regarding the consistency of judicial rulings and legal certainty. Additionally, the study highlights that Article 158 often limits candidates’ access to legal remedies, restricting their ability to contest elections despite substantial evidence of electoral fraud. The study contributes to the academic discourse on electoral justice by demonstrating how legal formalism can undermine substantive justice in democratic processes. It recommends revising Article 158 to introduce an exception mechanism that balances procedural efficiency with fairness, thereby enhancing the legitimacy and integrity of regional head elections. This reform is essential to ensure a more equitable electoral dispute resolution system that safeguards both democratic accountability and legal certainty.

Abstract

This study aims to evaluate the effectiveness of the role of mediators in reducing divorce rates through mediation mechanisms at the Class 1A Religious Court of Gorontalo City and to identify the main determinants that influence the success or failure of the divorce case resolution process from legal, psychological, and sociocultural aspects. The main problems underlying this study are the high divorce rate handled by the Religious Court every year, as well as the low success rate of mediation even though there is a normative basis in the form of Supreme Court Regulation Number 1 of 2016 which requires mediation efforts in every civil case, including divorce. This condition indicates a gap between the ideality of the law and its implementation in the field. The method used in this study is the empirical legal method with a qualitative approach. Data were obtained through direct interviews with mediator judges, certified mediators, and the parties to the case at the Class 1A Religious Court of Gorontalo City. The results of the study indicate that mediation has significant potential in preventing divorce if carried out seriously and professionally. The success of mediation is largely determined by the capacity and integrity of the mediator, especially in building effective communication, maintaining neutrality, and understanding the emotional aspects of the disputing parties. However, there are a number of inhibiting factors, including the absence of one of the parties in the mediation process, low good faith, lack of certified mediators, and inadequate mediation facilities. Psychological factors such as emotional trauma and unpreparedness to accept compromise are also quite dominant obstacles. In addition, cultural factors such as the public view that still considers the court as an arena for "victory" also make it difficult to achieve a peaceful resolution.

Abstract

This research seeks to examine the law enforcement approach addressing breaches of stay permits by foreign nationals (WNA) under the jurisdiction of the Class I TPI Gorontalo Immigration Office, as well as to identify the practical challenges encountered. This research primarily examines the coordination challenges across agencies in overseeing and prosecuting foreign nationals who breach visit visas, along with the obstacles faced by immigration agents in managing instances of stay permit abuse. This research employs an empirical legal methodology using a qualitative approach, supplemented by normative data. Data collection was conducted by observation, comprehensive interviews with immigration officers, and the recording of institutional data. The research was conducted in the Class I TPI Gorontalo Immigration Office due to the prevalence of visa abuse cases involving foreign nationals, particularly from Sri Lanka, Vietnam, and China. The study's findings reveal that breaches of stay permits by foreign nationals in Gorontalo predominantly arise from inadequate administrative oversight and a deficiency in both the quantity and expertise of personnel, particularly immigration investigators proficient in foreign languages and capable of executing their duties with professionalism. Furthermore, the cooperation across authorities like the National Police, the Indonesian National Armed Forces, the Ministry of Foreign Affairs, and local governments remains suboptimal, resulting in delayed discovery and management of infractions. Law enforcement via administrative means, including deportation and deterrent, has been implemented; nevertheless, it has proven insufficient without complementary preventative strategies, such as enhancing public legal knowledge and using information technology for oversight. Therefore, a reconfiguration of law enforcement strategies is essential, encompassing the enhancement of institutional capacity, the elevation of human resource quality, and intersectoral collaboration, enabling Indonesia to uphold immigration sovereignty equitably and responsibly in the context of globalization and transnational mobility.

Abstract

The development of online buying and selling transactions has also given rise to a rise in fraud cases that are detrimental to consumers. Article 28 paragraph (1) of Law Number 19 of 2016 concerning ITE needs to be legally reviewed to determine the extent to which these provisions are able to provide protection for consumers from fraudulent acts in online transactions. Therefore, this study aims to legally analyze the provisions of Article 28 paragraph (1) of Law Number 19 of 2016 concerning Information and Electronic Transactions (UU ITE) as a form of legal protection for consumers in dealing with the rampant fraud in online buying and selling transactions. The main problems in this study include how the concept of legal protection for consumers is formulated in the article and what are the legal implications for perpetrators of fraud. This study uses a normative method with a legislative, conceptual, and case approach. Data were obtained from primary, secondary, and tertiary legal materials through literature studies. The results of the study indicate that Article 28 paragraph (1) of the ITE Law provides legal protection through a prohibition on the dissemination of false information that is detrimental to consumers in electronic transactions, with a maximum prison sentence of six years and/or a fine of up to one billion rupiah as regulated in Article 45A paragraph (1). In addition to being a repressive instrument, this provision is also preventive in nature by demanding that sellers be responsible for conveying honest and accurate information. This study emphasizes the urgency of law enforcement and digital literacy in strengthening consumer protection amidst the rapid growth of e-commerce.

Abstract

Land buying and selling transactions without certificates still occur frequently in society due to limited access to formal land certification processes. This study aims to analyze the form of legal protection for buyers in land sale and purchase transactions that have not been certified, and to offer a new approach model in the form of intermediate legal recognition to overcome limited access to the formal land registration process. This study uses a normative legal research method with a statutory approach, a conceptual approach, and a case approach, and refers to primary legal materials such as UUPA No. 5 of 1960 and PP No. 24 of 1997. The results of the study indicate that although land sale and purchase transactions without certificates can be declared valid in civil law, the absence of a certificate weakens the legal position of the buyer, especially in terms of proving ownership rights before the law. The temporary legal recognition model based on village administrative documents is considered to be a transitional solution that provides preventive protection while strengthening the drive to follow the land certification process in full. This approach also reflects the need for land law reform that is more responsive to the social and economic conditions of the community. The results found that the absence of a certificate weakens the legal position of the buyer, so a temporary legal recognition model based on village administrative documents is needed as transitional protection.

Abstract

Buying and selling is an activity that takes place and is inherent in every society in the State of Indonesia. Therefore, there are many rules that regulate the matter of buying and selling in Indonesia. Agreements made by the community in terms of buying and selling must be clear and have a legal basis because every agreement born of an agreement is bound by law, as stated in article 1338 of the Civil Code (KUHPerdt). Buying and selling also has its own way, including buying and selling in the ijon or ngijon system, namely selling fruit that has not been seen. This research is categorized into the type of empirical normative legal research, it is based on the issues and or themes raised as research topics. Empirical normative legal research uses case studies in the form of products of legal behavior, for example reviewing laws and their application in society.

Abstract

Inter-regional cooperation is a system of working relationships carried out by two or more regions that are in a level and balanced position to achieve a common aim of enhancing people's welfare. South Bolaang Mongondow Regency's government is highly concerned about the significance of collaboration, both with neighboring regions, In this paper there 2 (two) research questions, namely; 1). What is the urgency of inter-regional cooperation in regional development?; 2). What are the philosophical, sociological and juridicial considerations for the information of a draft regional regulation on the implementation of Regional Coopertaion in South Bolaang Mongondow Regency?. The urgency of inter-regional cooperation found by the author is as follows; 1). Public Service Improvement; 2). Border Area; 3). Spatial Order 4).Disaster Management and Handling Potential Conflicts; 5). Poverty Reduction and Regional Disparities; 6). Increasing Role of Provinces; 7). Regional Expansion. And the Implementation of Regional Cooperation in South Bolaang Mongondow Regency required much deliberations and considerations in philosophical foundation, sociological foundation, and juridicial foundation. These considerations are as follows; a). Philosophical Foundation, The philosophical basis is a consideration or reason that demonstrates that the regulations formed base on Pancasila and 1945 Constitution; b). Sociological Foundation, Cooperation based on the needs and considerations of efficiency, effectiveness of public services and carried out in a mutually beneficial manner; c). Juridicial Foundation, The juridical or normative basis of a rule or rule, if the rule is part of a certain legal rule which in the legal rules points one to another.
