Abstract

The use of lafadz with absolute and or limited capacity (muqayyad) is one of the beauties of Arabic rhetoric. And in that indisputable Book, he was acquainted with the absoluteness of the Quran wa muqayyaduh or the absoluteness of the Qur’an and its limitations. In this article will discuss the meaning of absolute and muqayyad, examples of absolute and muqayyad lafadz, the law of absolute and muqayyad lafadz, and the division of absolute and muqayyad lafadz. The purpose of this discussion is for the reader to understand the concepts of absolute and muqayyad more deeply. By understanding the meaning of a particular verse, a believer will more easily obtain a legal ruling. Law has been established , then it will be easier for anyone to apply it. Absolute and muqayyad are fundamental concepts in jurisprudence that serve as guidelines in understanding and extracting law from the nash-nash of Shariah. Absolute is a pronoun that expresses a general meaning without any particular restriction, whereas a muqayyad is a pronoun that is limited by a specific attribute, condition, or condition. Both play an important role in a careful and responsible legal istinbath process.

Abstract

This study aims to align the principles of fiqh of disasters with Indonesia’s disaster management policies, particularly Law No. 24 of 2007. It seeks to explore how Islamic legal objectives can enrich and complement Indonesia's disaster governance framework. Using a maqāṣid based analytical approach, the research identifies and categorizes key elements within the maqāṣid framework, including concepts, objectives, values, societal groups, universal laws, divine commands, and textual evidences. These components are then systematically examined to evaluate their relevance and alignment with national disaster management strategies. The findings reveal a significant divergence in the interpretation of disaster and disaster management stakeholders between the two paradigms. Indonesian law defines disaster in technical-administrative terms, while fiqh emphasizes theological dimensions, such as divine awareness and submission to God’s will. Furthermore, the integration of religion as a vital element in disaster management remains insufficiently addressed in current policy frameworks. This study offers a novel integration of maqāṣid al-sharīʿah into the context of disaster management, proposing a theological-ethical dimension often overlooked in secular policy discourse. It bridges religious jurisprudence with contemporary disaster governance. The research suggests that involving religious leaders, institutions, and the Ministry of Religious Affairs in all disaster stages of prevention, response, and recovery can strengthen community resilience by fostering spiritual preparedness, psychological support, and culturally grounded disaster literacy.

Abstract

Abstrak Perkembangan Ushul Fiqh di era modern menunjukkan pergeseran yang signifikan dari pendekatan tekstual-rigid menuju metode yang semakin kontekstual, berbasis maqāṣid, dan interdisipliner. Artikel ini mengkaji tiga dimensi utama: transformasi metodologis Ushul Fiqh klasik, evolusi paradigma ijtihad dari mujtahid tunggal (fardi) ke kolektif (jama’i), serta penerapan prinsip-prinsip Ushul dan maqāṣid dalam fenomena kontemporer seperti fintech, blockchain, crowdfunding, dan perlindungan data pribadi. Berdasarkan penelitian kualitatif-deskriptif dan analisis komparatif, hasil studi menunjukkan sistem hukum Islam modern kini bersifat dinamis dan relevan terhadap tantangan teknologi dan sosial. Disarankan agar kurikulum ushul fiqh lebih interdisipliner, memperkuat mekanisme ijtihad jama’i, serta mendorong publikasi dan evaluasi empiris terhadap fatwa keagamaan kontemporer. Kata kunci: Ushul Fiqh, maqāṣid, ijtihad jama’i, fintech syariah, hukum Islam modern   Abstract The development of Ushul Fiqh in the modern era marks a notable shift from a textual-rigid approach to a more contextual, maqāṣid-based, and interdisciplinary methodology. This article examines three core dimensions: the methodological transformation of classical Ushul Fiqh, the paradigm shift of ijtihad from individual (fardi) to collective (jama’i) reasoning, and the application of Ushul Fiqh principles and maqāṣid in contemporary phenomena such as fintech, blockchain, crowdfunding, and personal data protection. Utilizing a qualitative-descriptive method and comparative analysis, the study finds that modern Islamic legal systems have become dynamic and responsive to technological and social challenges. It is recommended to develop interdisciplinary Ushul Fiqh curricula, strengthen collective ijtihad mechanisms, and encourage the publication and empirical evaluation of contemporary religious fatwas. Abstract

The study aims to explain the practices of productive waqf management, development, and utilisation by waqf managers in Islamic boarding schools in Maros Regency. This is a qualitative study. The research design is field research. The results of this study indicate that: The management of productive endowments at the Raudaturrasyidin DDI Cambalagi Islamic boarding school is categorised as unproductive with insignificant income growth due to irregular harvests throughout the year. The realisation of the utilisation of profits from productive endowment income at the Raudaturrasyidin DDI Cambalagi Islamic Boarding School. Meanwhile, the management of productive endowments at the Nurul Ikhwan Islamic Boarding School through the boarding school canteen is categorised as productive with a significant increase in income. Meanwhile, the management of productive endowments at the Nahdlatul 'Ulum Islamic Boarding School through the mini market Aminah demonstrates productive management of productive endowments on endowed assets, namely the Mini Market Aminah, which is categorised as moderately productive with significant income growth from May to December 2023 and May to December 2024. Each portion of the income from productive endowments at the three boarding schools has a designated allocation for utilisation. On the other hand, development aspects are not being implemented at the pond managed by the al-Irsyad Foundation.

Abstract

The division of property before the death of the heir in the Manggala sub-district of Makassar city from the perspective of Islamic Law is the subject matter and discussion in this study. Qualitative research is the type of research used in this research with theological-normative syar'i and sociological approaches. And to be able to describe and analyze the problems that occur and produce a conclusion, data collection methods are carried out through observation, interviews and documentation. The results showed that some people in the Manggala sub-district of Makassar city divided their property to the heirs before death, with the assumption that if the property was divided after death it could cause disputes or disputes among the heirs because of unfairness in dividing the inheritance. Although the distribution of property is divided before death, they still term it as inheritance, this is clearly contrary to what is understood in Islamic law, because one of the conditions for inheritance is the death of the heir, while this condition is not fulfilled. The implication of this research is the importance of the community to know the knowledge of inheritance and explain it to the family so as to reduce the impact of disputes in the distribution of inheritance.

Abstract

This research is motivated by the importance of understanding the niqab (face veil) as a religious symbol and an identity marker for Muslim women, which continues to spark public debate in Indonesia. The niqab is often viewed from various perspectives—religious, cultural, social, and political—making it a controversial topic. These differing viewpoints highlight the need for a deeper exploration of the meaning and practice of wearing the niqab, especially within Islamic higher education institutions. The study aims to examine both the normative and sociological aspects of niqab use among female students at Ma’had Al-Birr, Muhammadiyah University (Unismuh) Makassar. This institution is known for having a significant number of students who wear the niqab, each with different backgrounds and motivations, ranging from theological beliefs to personal convictions and environmental influences. The research employs a descriptive qualitative method with a field-based approach. It combines normative Islamic theological perspectives with sociological analysis, using data collection techniques such as observation, in-depth interviews, and documentation. The findings reveal that students perceive the niqab not merely as a religious obligation to cover one's aurat (parts of the body that should be concealed), but also as a symbol of piety, honor, obedience, and personal ijtihad (independent reasoning) in practicing Islamic teachings. An inclusive campus environment supports these students in engaging freely in both academic and social activities. However, challenges still arise, particularly in the form of stereotypes and perceptions of exclusivity that some individuals associate with niqab wearers. These misconceptions underscore the importance of cross-perspective understanding in addressing this phenomenon. This study is expected to contribute to the development of campus policies that support freedom of expression, uphold mutual respect, and promote a more inclusive, open, and tolerant atmosphere within Islamic higher education institutions—one that embraces the diversity of religious practices and encourages respectful coexistence.

Abstract

Al-Adah al-Muhakkamah yaitu adat adalah hukum. Secara etimologi kata al-Adah berarti pengulangan baik berupa perkataan atau perbuatan. Secara terminologi al-Adah berarti sebuah kecenderungan berupa ungkapan atau pekerjaan pada suatu obyek tertentu sekaligus pengulangan akumulatif pada obyek pekerjaan dimaksud, baik dilakukan oleh pribadi maupun kelompok. Terdapat beberapa macam kaidah turunan dari al-Adah al-Muhakkamah yang masing-masing berorientasi pada adat kebiasaan masyarakat yang dapat dijadikan landasan hukum. Namun tidak semua adat dapat dijadikan sebagai landasan hukum. Hanya adat yang tidak bertentangan dengan syariat dapat dijadikan sebagai landasan hukum dalam hukum Islam.

Abstract

Inheritance in Islam has principles, procedures, and things that need to be fulfilled. The division of inheritance must be done fairly and transparently to avoid inheritance disputes. However, in Indonesia, the customary inheritance system has been used since long ago and has become a tradition, but most people already understand how the Islamic inheritance system works. The purpose of this discussion is to examine the inheritance distribution system in the awo' community, from the perspective of Islamic law. This research is qualitative research. The data collection method used in this research is by conducting field observations, interviews, and literature review. This research emphasizes the division of inheritance property in awo' society. This research aims to find out how the application of the division of inheritance property in awo' society from the perspective of Islamic law and customary law. In addition, this research also aims to find out the advantages and disadvantages that exist in the application of the inheritance system.

Abstract

Hukum Islam bersifat universal. Hukum harus berkembang sesuai dengan kebutuhan sosial masyarakat, sebagaimana kaidah dalam fikih bahwa "hukum berubah seiring dengan perubahan zaman dan perubahan waktu". Hukum Islam pada realitasnya belum idealistik dan terkesan tidak dapat mengantisipasi perubahan zaman dan cenderung jauh dari keadilan. Sebagai contoh, produk hukum Islam lama menyatakan bahwa perkawinan atau ijab kabul wajib dilaksanakan dalam satu majelis. Alasan atau illat hukum dari satu majelis adalah untuk menjaga kontinuitas dan keyakinan saksi terhadap dua pihak yang sedang melaksanakan akad. Perkembangan sosial dalam masyarakat Indonesia, khususnya dalam bidang teknologi saat ini tumbuh dengan cepat. Di antara isu-isu hukum yang bias kemajuan teknologi adalah pernikahan melalui Telepon. Masalah ini menimbulkan pro dan kontra di kalangan ulama Indonesia. Perbedaan pendapat tersebut didasari pada perbedaan penafsiran tentang konsep kesatuan majelis (ittihadul majlis) dalam akad nikah. Oleh karena itu diperlukan kepastian hukum guna mengisi kekosongan hukum akibat perbedaan pendapat. Dibutuhkan sebuah konstruksi hukum yang baik, yang dapat mengakomodasi kepentingan-kepentingan masyarakat modern.

Abstract

This research aims to: (1) understand the reality of the flexing phenomenon on social media; (2) examine its impact on students of UIN Alauddin Makassar; and (3) analyze it from the perspective of Maqāṣid Sharīʿah. Using a field research method with phenomenological and theological approaches, this study explores students' subjective experiences and the relevance of Maqāṣid Sharīʿah, particularly in maintaining religion (hifz al-Din), life (hifz an-Nafs), intellect (hifz al-Aql), lineage (hifz an-Nasl), and wealth (hifz al-Mal). The primary data sources are 10 postgraduate students and 8 undergraduate student representatives from each faculty, selected through purposive sampling, complemented by an interview survey of 39 students. Data were analyzed by reducing negative impacts and mapping behaviors, effects on actors, and effects on others, followed by verification for validity and reliability. The results show that flexing on social media is controversial, causing more harm than benefit, with cases linked to fraud, corruption, and even loss of life. Among UIN Alauddin Makassar students, flexing leads to insecurity, social pressure, and self-comparison, though a few view it as motivational. From the Maqāṣid Sharīʿah perspective, excessive flexing conflicts with values of simplicity, family morals, and prudent wealth management. This research highlights the need for ethical and moral awareness in social media use, urging young people to align online behavior with Islamic teachings through the framework of Maqāṣid Sharīʿah.
