Abstract

Syekh Yusuf al-Makassari, also known as Syekh Yusuf Abu MahasinHadiyatullah Ta al-Khalawati al-Makassari or simply Tuanta Salamaka ri Gowa (meaning "Our Great Teacher from Gowa"), was a prominent Islamic scholar,Sufi, and national hero of Indonesia. His tomb, located in Gowa, South Sulawesi,attracts people from both within and outside the region, who visit for variouspurposes, including fulfilling vows, making offerings, or simply praying for blessings and safety in this world and the hereafter. This research is an empirical legal study with a descriptive qualitative method. The research uses theological and anthropological approaches. The research findings show that, from the perspective of Islamic law, visiting graves is allowed as long as it meets the conditions and requirements according to the teachings of the Prophet Muhammad and does not deviate from these teachings. However, in the view of scholars, the tradition of visiting the Tomb of Syekh Yusuf, which is frequently practiced by the community, such as making vows, holding ceremonies, and asking for blessings, has varying opinions among scholars. Some permit it, while others prohibit it. It is advisable that when making a vow or asking for something, the community should fulfill it by holding a thanksgiving event or fasting as a form of gratitude to Allah SWT for the fulfillment of their vow.

Abstract

Artikel ini bertujuan untuk mengetahui bagaimana relevansi teori konsumsi dari Monzer Kahf dan Yusuf Al Qardhawi serta bagaimana bentuk implementasinya dalam halal lifestyle (gaya hidup halal) secara komprehensif. Penelitian ini menggunakan metode kualitatif, metode kualitatif dapat digunakan sebagai pendekatan yang tepat untuk mengeksplorasi pandangan dari kedua tokoh yakni Monzer Kahf dan Yusuf Al Qardhawi serta implementasi pola konsumsi Islami terhadap halal lifestyle. Data yang digunakan adalah data sekunder. Kedua teori tersebut memiliki kesamaan dalam menekankan pentingnya konsumsi yang adil, menghindari pemborosan, sifat kikir dan memenuhi kebutuhan dasar individu dan masyarakat. Pola konsumsi seorang muslim dengan mengimplementasikan gaya hidup halal dengan memperhatikan makna dan tujuan konsumsi dalam Islam yang sangat relevan dengan teori Monzer Kahf dan Yusuf Al Qardhawi.

Abstract

Pembagian harta warisan dalam masyarakat Indonesia memiliki tiga sistem hukum yang diakui: hukum waris Islam, hukum adat, dan hukum perdata. Di Kecamatan Tanete Riattang Kabupaten Bone masyarakat cenderung mengunnakan forum musyawarah adat yang dikenal sebagai tudang sipulung untuk menyelesaikan pembagian harta warisan. Fenomena ini menunjukkan adanya kearifan lokal yang kuat, sekaligus membuka ruang kajian terhadap kesesuaiannya dengan prinsip-prinsip hukum Islam. artikel ini bertujuan untuk mengkaji praktik tudang sipulung dalam perspektif hukum waris Islam serta merokonstruksi nilai-nilai syariah yang terkandung di dalamnya. Dengan menggunakan pendekatan yuridis empiris, penelitian ini menemukan bahwa tudang sipulung menjadi sarana eferktif dalam menyelesaikan sengketa warisan secara damai dan kekeluargaan. Meskipun tidak sepenuhnya merujuk pada ketetntuan fikih waris, praktik ini mengandung nilai-nilai keadilan, kemaslahatan dan persaudaraan yang sejalan dengan nilai keislaman. Hasil ini menunjukkan bahwa rekonstruksi hukum waris Islam yang berbasis pada kearifan lokal dapat menjadi alternatif penyelesaian sengketa yang kontekstual dan aplikatif. Kata Kunci: Warisan, Tudang Sipulung, Hukum Islam.

Abstract

This study aimed to analyze the implementation of the green investment paradigm in Morowali’s mining industry based on the principles of maqasid al-shari‘ah. The research method used was a qualitative approach with descriptive analysis through literature studies, interviews with mining industry stakeholders, and observations of the environmental impacts caused by mining activities. The data were analyzed using the maqasid al-shari‘ah approach to evaluate the extent to which the mining industry in Morowali had implemented sustainability principles in its operations. The results showed that although some companies had adopted environmentally friendly practices, such as land reclamation and the use of waste processing technologies, many aspects still did not align with maqasid al-shari‘ah. Excessive resource exploitation, environmental pollution, and social inequality remained, which impacted the welfare of the local community. In conclusion, the application of green investment in the mining industry of Morowali still required optimization based on maqasid al-shari‘ah, particularly in the areas of hifẓ al-bī’ah (environmental protection), hifẓ al-nafs (protection of life), and hifẓ al-māl (protection of wealth). Within the framework of contemporary Islam, this study emphasized the importance of revitalizing maqasid al-shari‘ah as an ethical and strategic foundation for sustainable investment. The academic contribution of this research lies in the integration of maqasid al-shari‘ah in the analysis of green investment in the mining sector, which has been limited in previous studies. This study provides a new perspective on Islamic economics by highlighting how the principles of maqasid al-shari‘ah can serve as an ethical framework for sustainable investment.

Abstract

Abstrak Lonjakan kajian kritis terhadap manuskrip fikih belum sepenuhnya menyingkap bagaimana varian tekstual perbedaan kata, ejaan, dan riwayat, pada Bab an-Nikāḥ mempengaruhi bangunan argumentasi hukum Islam. Artikel ini bertolak dari pertanyaan utama: bagaimana ulama Ushul Fiqh abad XIX mengelola varian tekstual tersebut melalui metode istidlāl guna menjaga koherensi syariat dan relevansi sosial? Dengan rancangan penelitian kepustakaan kritis, data diambil dari kolasi tujuh manuskrip nikāḥ abad XVIII–XIX, edisi cetak awal, serta risalah reformis Muhammad ʿAbduh dan Sayyid Aḥmad Khān; seluruhnya dianalisis secara filologis, kodikologis, dan hermeneutik-historis. Hasilnya menunjukkan, pertama, empat pola varian (leksikal, gramatikal, redaksional, dan komentar marginalia) berpotensi memicu divergensi hukum mahar, wali, dan ṭalāq. Kedua, para fuqahā abad XIX menata ulang istidlāl klasik dengan memadukan tarjih berbasis kekuatan sanad, maqāṣid al-sharīʿah untuk menimbang maslahat, serta teknik takhayyur-talfiq guna merespons realitas kolonial dan modernitas; pola ini membentuk “kerangka istidlāl adaptif” yang menegaskan legalitas varian tanpa meniadakan otoritas mazhab. Temuan ini mengisi kekosongan literatur tentang hubungan naskah, metode, dan reformasi hukum, serta menawarkan model konseptual yang dapat diadopsi lembaga fatwa kontemporer untuk merumuskan putusan nikāḥ lebih inklusif dan berbasis manuskrip. Kata Kunci: manuskrip ushul fiqh abad XIX; Bab an-Nikāḥ; filologi hukum Islam; kerangka istidlāl adaptif; maqāṣid al-sharīʿah; takhayyur talfiq.   Abstract The surge in critical studies of fiqh manuscripts has not fully revealed how textual variants, including differences in wording, spelling, and narration, in Chapter an-Nikāḥ influence the construction of Islamic legal arguments. This article begins with the main question: how did nineteenth-century Usul Fiqh scholars manage these textual variants through the istidlāl method to maintain sharia coherence and social relevance? Using a critical bibliographical research design, data were drawn from a collation of seven 18th-19th-century nikāḥ manuscripts, early printed editions, and the reformist treatises of Muhammad ʿAbduh and Sayyid Aḥmad Khān; all were analyzed philologically, codicologically, and hermeneutically-historically. The results indicate, first, four patterns of variants (lexical, grammatical, editorial, and marginal commentary) that have the potential to trigger divergence in the laws of dowry, guardianship, and ṭalāq. Second, nineteenth-century jurists reorganized classical istidlāl by combining tarjih based on the power of sanad (Islamic law), maqāṣid al-sharīʿah (the principles of Islamic law) for weighing benefits (maslahat), and takhayyur-talfiq (the techniques of Islamic law) to respond to colonial and modern realities. This pattern formed an “adaptive istidlāl framework” that affirmed the legality of variants without negating the authority of the madhhab (school of thought). This finding fills a gap in the literature on the relationship between manuscripts, methods, and legal reform and offers a conceptual model that contemporary fatwa institutions can adopt to formulate more inclusive and manuscript-based nikāḥ rulings. Abstract

This study examines the regulation of the minimum marriage age in the Compilation of Islamic Law as a form of progressive ijtihad based on maqaṣid al-shari‘ah. This research emphasizes how the marriage age requirement reflects the integration of maslahah fardiyyah (individual welfare) and maslahah ‘a’iliyyah (family welfare), both of which are legal principles aimed at protecting children and strengthening family institutions. Adopting normative legal methods with a statutory, conceptual, and philosophical approach, this research combines classical and contemporary Islamic legal thought and relevant laws and regulations in Indonesia. The theory of maṣlaḥah, developed by scholars such as al-Ghazali, al-Juwayni, al-Shaṭibi, and Ramadan al-Būṭi, forms the main theoretical foundation, particularly through the lens of ḍawabiṭ al-maṣlaḥah (parameters of public interest). These theories emphasize the preservation of life (ḥifẓ al-nafs), intellect (ḥifẓ al-‘aql), and lineage (ḥifẓ al-nasl) as central objectives of Islamic law. The findings show that the marriage age provision in the Compilation of Islamic Law is not merely an administrative policy but a legal strategy aligned with maqaṣid-based reasoning to prevent child marriage and its associated harms. This approach reflects a contextual reading of Islamic law that is responsive to socio-cultural changes, while remaining faithful to its foundational values. The study concludes that reinforcing a maṣlaḥah-based framework is essential to harmonize Islamic legal principles with national law and to ensure the well-being of individuals and families in contemporary society.

Penelitian ini bertujuan untuk mengkaji Kajian lafaz dari segi penggunaan makna haqiq dan majazi (makna, penerapan dalam nash dan implikasi hukumnya) Fokus utama penelitian adalah untuk memahami haqiqi dan majazi dalam makna, penerapan dalam nash dan implikasi hukumnya metode penelitian library riset misalnya buku-buku sejarah, artikel jurnal, manuskrip kuno, dan dokumen-dokumen terkait lainnya dengan menggunakan content analisis. Kesimpulan Integrasi pemahaman haqiqi-majazi essential untuk menghasilkan interpretasi nash yang akurat dan kontekstual dalam pengembangan hukum Islam kontemporer. integrasi pemahaman haqiqi-majazi berarti menyatukan penafsiran makna asli (haqiqi) dan makna kiasan (majazi) untuk memahami teks, khususnya dalam al-Qur’an dan hadis. Ini adalah metode penting dalam studi agama untuk memahami makna sebenarnya dari suatu perkataan, sekaligus mengenali penggunaan ungkapan kiasan yang memerlukan konteks, budaya, dan interpretasi yang mendalam. Dengan mengintegrasikan kedua pemahaman ini, seseorang dapat menguasai ilmu-ilmu Al-Qur’an dan hadis secara lebih komprehensif, yang sangat penting dalam menafsirkan dan mengaplikasikan hukum Islam.

Abstract

This study analyzes the semantic dynamics of lafaz al-amr (imperative form) in the context of its designation and application in Islamic scriptural texts (nash) and its implications for legal determination. Despite numerous studies on al-amr, in-depth research on meaning variations based on linguistic, historical, and socio-cultural contexts, as well as their legal implications, remains limited. The research problems are: how does the semantic dynamics of al-amr function in various contexts of nash, and what are the legal implications of different interpretations of al-amr. This research employs a qualitative method with a normative-juridical approach through textual analysis of Quranic verses and hadiths containing the shighat al-amr (imperative formula). The findings indicate that the meaning of al-amr is contextual and variable, depending on the form of shighat, qarinah (contextual indicators), and socio-historical context. Its legal implications encompass obligatory (wajib), recommended (sunnah), permissible (mubah), or advisory (irsyad), which require comprehensive interpretation to maintain the relevance and justice of Islamic law application in contemporary contexts.

Abstract

This study examines the concepts of ‘Amm and Khâsh in uṣūl al-fiqh, which play a significant role in understanding the Qur’an and Hadith. The purpose of this research is to explain the meaning, types, and legal implications of general and specific expressions in Islamic legal interpretation. The method applied is library research by reviewing classical and contemporary scholarly works that discuss ‘Amm and Khâsh. The findings show that ‘Amm refers to expressions that apply to all individuals within a category without exception, while Khâsh points to a singular expression with a definite and limited meaning. This study also highlights three main forms of ‘Amm: ‘Amm yurâdu bihi ‘Amm, ‘Amm yurâdu bihi Khusûs, and ‘Amm makhsûs, whose interpretation depends heavily on context and qarīnah. In conclusion, a deeper understanding of ‘Amm and Khâsh is essential for ensuring accuracy in deriving Islamic laws and for affirming both the universal and specific nature of the Sharī‘ah in various situations

Abstract

The development of Islamic law in the modern era requires a methodology of istinbāṭ capable of addressing contemporary issues. However, in practice, confusion still arises in understanding the differences in function between Qawāʿid Uṣūliyyah, Qawāʿid Fiqhiyyah, and Qawāʿid Tasyriʿiyyah. This reality raises a fundamental question regarding the conceptual and applicative positions of these three types of legal maxims in the determination of Islamic law. This study formulates the following research problems: how do the functions and applications of Qawāʿid Uṣūliyyah, Qawāʿid Fiqhiyyah, and Qawāʿid Tasyriʿiyyah differ, and how can their integration strengthen contemporary Islamic legal methodology. This research employs a normative-qualitative method with a descriptive-comparative approach. Data were collected from classical uṣūl al-fiqh literature, fiqh works, and contemporary studies (2018–2025), and were analyzed using content analysis to identify differences, similarities, and patterns of integration among the three types of legal maxims. The findings indicate that Qawāʿid Uṣūliyyah function as the methodological foundation in the process of legal istinbāṭ, Qawāʿid Fiqhiyyah serve as practical guidelines for resolving everyday cases, while Qawāʿid Tasyriʿiyyah function as a normative basis for the formulation of Islamic law oriented toward maqāṣid al-sharīʿah..
