Abstract

Penelitian ini bertujuan menganalisis praktik jual beli organ tubuh manusia sebagai bagian dari tindak pidana perdagangan orang yang bertentangan dengan hukum nasional, hukum Islam, dan prinsip hak asasi manusia, serta merumuskan strategi penegakan hukum pidana yang efektif. Metode penelitian menggunakan yuridis empiris dengan pendekatan kualitatif deskriptif-analitis, melalui wawancara dengan aparat penegak hukum, lembaga perlindungan korban, dan studi kepustakaan atas peraturan perundang-undangan serta literatur hukum. Hasil penelitian menunjukkan bahwa keterbatasan donor resmi dan tingginya permintaan transplantasi organ mendorong berkembangnya pasar gelap yang dikelola sindikat terorganisir dengan modus penipuan, bujuk rayu, jeratan utang, penculikan, hingga pembunuhan. Korban mengalami kerugian materiil, penderitaan fisik dan psikis, bahkan kematian. Meskipun Indonesia telah memiliki perangkat hukum seperti UU No. 21 Tahun 2007, UU No. 35 Tahun 2014, dan UU No. 36 Tahun 2009, implementasinya belum optimal akibat lemahnya koordinasi, pengawasan perbatasan, dan pembuktian perkara. Kesimpulan penelitian ini menegaskan perlunya strategi penegakan hukum terpadu: preventif melalui penguatan pengawasan dan sosialisasi hukum; represif dengan penerapan sanksi maksimal hingga pidana mati; serta protektif melalui restitusi, rehabilitasi, dan pemulihan hak korban. Pendekatan komprehensif ini diharapkan mampu memberikan efek jera bagi pelaku sekaligus menjamin perlindungan martabat.

Abstract

This study examines the effectiveness of criminal law enforcement against street children associated with the "Kreak" phenomenon in Semarang Regency within the framework of the Juvenile Criminal Justice System (SPPA). The research is grounded in the identified gap between Indonesia's child-centered juvenile justice norms, particularly diversion and restorative justice, and their inconsistent implementation in practice. Using a normative juridical method, this study analyzes primary legal materials, including Law No. 11 of 2012 on the Juvenile Criminal Justice System and Law No. 1 of 2023 on the Criminal Code, supported by relevant legal literature. The findings indicate that law enforcement effectiveness remains limited due to inconsistent diversion practices, weak inter-agency coordination, insufficient rehabilitation and reintegration facilities, and a limited understanding of restorative justice among law enforcement officials. Social stigma and the complex socio-economic background of children further hinder reintegration efforts. This study emphasizes that effectiveness should be measured through rehabilitative outcomes rather than punitive indicators and recommends strengthening restorative justice training, harmonizing SPPA implementation with the Criminal Code, enhancing institutional coordination, and expanding community-based prevention and reintegration programs to ensure child protection and sustainable public safety.

Abstract

Administrative sanctions play an important role in promoting legal compliance within Indonesian administrative law, yet their effectiveness remains limited due to inconsistencies between normative design and enforcement practice. This study addresses the need for a more systematic understanding of administrative sanctions by examining their normative structure across sectors and evaluating their practical implementation. The research adopts a socio-legal approach that prioritizes normative legal analysis, supported by limited empirical insights from interviews and secondary legal materials. The analysis is guided by a theoretical framework that integrates legal substance, institutional structure, and legal culture. The findings show that administrative sanctions are formally structured through a graduated model, but their application is often inconsistent, with weak escalation, limited monitoring, and fragmented institutional coordination. As a result, sanctions tend to function symbolically rather than as effective instruments of compliance. The study proposes a theoretical model of administrative sanction effectiveness based on the alignment of normative coherence, institutional capacity, and enforcement legitimacy. Strengthening this alignment is essential for transforming administrative sanctions into reliable tools of regulatory governance and achieving sustainable legal compliance.

Abstract

Rape can be occured in all women from all side of life, occupations, age, and marital status, which was done alone or abuzz. The perpetrators of violence also come from various circles, work, age, social class and marital status. In this case, the number of women violence against in Atambua is quite high. Sexual abuse cases and sexual harassment turned out most of the perpetrators are still related to blood with victims, such as biological father, siblings, uncle and neighbors. The cases of sexual assault against women in Atambua are resolved in customary. However, any form of resolution, the act of violence of rape against viewed from various aspects still must be responded as a criminal act, for example the custom settlement of tallitan tafani still apply penal sanction in the form of penalty as one of the effort of restoration of good name, and also dignity for the victim.

Abstract

The placement program of Indonesian migrant workers overseas is the Indonesian government’s program for the society’s welfare. One of the referential laws used in the working relations between the Indonesian migrant workers and the Arabic employers is the employment agreement. The Saudi Arabian employment agreement implements the sharia law which is influenced by the Hambali school of taught. The King’s decree No. M/51 year 2005 regulates the labor laws in Saudi Arabia, and this country’s government only accepts employment agreements written in Arabic. The solution is that the employment agreements written in two languages are prepared, with Arabic as the authoritative language. Apart from implementing the Kafala System, as a substitute of tax, Saudi Arabia also implements the Nitaqat Policy. The employment agreements in Saudi Arabia have a high risk of being misused by the agencies, as the position of the Indonesian migrant workers is under the responsibility and under the power of the agencies, who have the right to terminate or to send the workers back home if there are some problems. The employment agreements are made because of the employer’s complaints on how the migrant workers often run away, which undoubtedly causes them a high loss. The aim of the contract is so that both parties may achieve a win-win solution, and that they are both given protection. Yet, the contract also limits the participation of the host country’s delegates, as all affairs are given to the Saudi Arabian Immigration Office. The employment agreement must be owned by both parties. Yet, based on some researches established by the Embassy of the Republic of Indonesia’s safe house, it is known that almost none of the migrant workers keep an employment agreement. Another problem is that there are multiple contracts: one before departing for Saudi Arabia, and a different one after having arrived in the country. Another written agreement that is signed by the employer and the agency in Saudi Arabia doesn’t involve the domestic worker. The three contracts which are signed in Indonesia, in front of the Immigration Office, and the one-sided contract between the employer and the agency regulates the same thing, though there is a chance that in all three contracts, the wages written are different.

Abstract

Sistem pemilu menjadi penting dalam negara yang menganut demokrasi perwakilan karena memiliki konsekuensi terhadap tingkat proporsionalitas hasil pemilu . Salah satu bentuk sengketa Pemilu adalah sengketa penghitungan suara,oleh karena itu tertarik untuk mengkaji lebih lanjut mengenai penyelesaian sengketa hasil pemilu di Indonesia dalam perspektif penegakan hukum. Hal ini menjadi menarik untuk dikaji lebih lanjut, karena sangat berhubungan dengan kepercayaan publik terhadap Pemerintahan serta keterlibatan masyarakat dalam penyelenggaraan pemerintahan sehingga pemerintahan berjalan dengan efektif. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menjelaskan Penegakan hukum dalam penyelesaian sengketa hasil pemilu di Indonesia diatur dalam Peraturan Mahkamah Konstitusi Nomor 2 Tahun 2018, peraturan ini memperkuat peran partai politik dalam perselisihan hasil pemilu. Indonesia pernah menggunakan dua skala sistem baik tertutup ataupun terbuka. Berdasarkan  Undang-Undang Nomor 12 Tahun 2003 tentang Pemilihan Umum Anggota DPR, DPRD, dan DPRD, sistem proporsional tertutup diganti dengan sistem proporsional terbuka dan tetap digunakan. Sistem proporsional Ada dua sistem yaitu sistem proporsional terbuka dan sistem proporsional tertutup Sejak PMK No 2 Tahun 2018 dikeluarkan, penegakan hukum permasalahan PHPU status hukum calon anggota DPR dan DPRD perseorangan telah diberikan pada permasalahan PHPU.Kata Kunci: Penyelesaian Sengketa, Pemilu, Penegakan Hukum

Abstract

ABSTRAKInkonsistensi bentuk perjanjian perdagangan internasional berkenaan dengan kedudukannya yang disamakan atau tidaknya dengan Undang-Undang dan Peraturan Presiden pada umumnya.  Penelitian ini menggunakan metode yuridis normative, hasil penelitian ini menjelaskan Kedudukan instrumen ratifikasi Perjanjian Perdagangan Internasional akan bermuara pada kewenangan badan Peradilan seperti halnya Mahkamah Konstitusi, UUD 1945 sejatinya tidak menyebutkan masalah mana yang seharusnya diatur di dalam Undang-Undang dan masalah mana yang seharusnya diatur di dalam peraturan perundang-undangan lainnya. Peraturan Presiden ditetapkan untuk menentukan policy rules atau regels sesuai dengan prinsip freies ermessen dalam rangka menjalankan Undang-Undang. instrumen hukum ratifikasi Perjanjian Perdagangan Internasional belum memiliki kedudukan yang jelas dalam hierarki dalam Tata Urutan Peraturan Perundang-Undangannya. Permasalahan yang ada saat ini sering kali berkaitan dengan permasalahan kedudukan instrumen hukum ratifikasi Perjanjian Internasional. Terlebih lagi, jika berbicara mengenai Perjanjian Perdagangan Internasional, sejatinya Perjanjian tersebut memiliki kaitan yang erat dengan akses pasar yang berarti akan berdampak besar bagi kepentingan nasional dan hak masing-masing individu dalam masyarakat. Kata kunci : inkonsistensi, perjanjian, perdagangan, internasional
