ABSTRAK Demokrasi konstitusional dianggap sebagai sistem pemerintahan yang ideal karena menyeimbangkan kekuasaan negara dengan perlindungan hak-hak warga negara. Di Indonesia, sistem ini diwujudkan melalui konstitusi UUD 1945 yang menjadi hukum tertinggi, mengatur struktur pemerintahan dan menjamin hak-hak dasar rakyat. Hukum tata negara memainkan peran penting dalam memastikan prinsip-prinsip demokrasi konstitusional tetap hidup, dengan mengatur pembagian kekuasaan antar lembaga negara, mekanisme checks and balances, serta perlindungan hak asasi manusia. Namun, penerapan demokrasi konstitusional di Indonesia menghadapi berbagai tantangan, termasuk dinamika politik, globalisasi, dan meningkatnya tuntutan masyarakat akan transparansi dan akuntabilitas pemerintah. Artikel ini menganalisis peran hukum tata negara dalam mempertahankan prinsip-prinsip demokrasi konstitusional di Indonesia, mengidentifikasi tantangan yang dihadapi, serta mengeksplorasi implementasi hukum tata negara dalam memperkuat mekanisme checks and balances. Kajian ini menyoroti pentingnya adaptasi hukum tata negara terhadap perubahan zaman tanpa mengorbankan nilai-nilai demokrasi, guna menjaga keadilan, transparansi, dan akuntabilitas dalam sistem pemerintahan Indonesia.Kata Kunci: Demokrasi, Hukum, Konstitusi. ABSTRACTConstitutional democracy is considered an ideal system of government because it balances state power with the protection of citizens' rights. In Indonesia, this system is realized through the 1945 Constitution, which is the supreme law, regulating the structure of government and guaranteeing the basic rights of the people. Constitutional law plays an important role in ensuring the principles of constitutional democracy are kept alive, by regulating the division of power between state institutions, checks and balances mechanisms, and the protection of human rights. However, the implementation of constitutional democracy in Indonesia faces various challenges, including political dynamics, globalization, and increasing public demands for government transparency and accountability. This article analyzes the role of constitutional law in maintaining the principles of constitutional democracy in Indonesia, identifies the challenges faced, and explores the implementation of constitutional law in strengthening checks and balances mechanisms. It highlights the importance of adapting constitutional law to changing times without compromising democratic values, in order to maintain fairness, transparency and accountability in Indonesia's governance system.Keyword: Democracy, Law, Constitution
