Abstract

Human trafficking is not only a black record for Indonesia, but has become a global issue. The rise of this practice and the increasing number of cases from time to time finally led the United Nations Office on Drugs and Crime (UNODC) as an agency or organization that focuses on dealing with these polemics and also initiated a series of international convention to discuss issue related to this. It’s quite crucial. According to the PBB itself, human trafficking is categorized as one of the third largest illicit companies in the world. This is also proven by the fantastic income, which is 9.6 million USD. Not only that, but Human Trafficking is one of the darkest companies that is closely related to other elements. Such as money laundering, document falsification, drug trafficking (Drugs), and also immigrant smuggling (smuggling). Based on the quote above, it can be said that until now the practice of human trafficking is still rampant in the life of the world. These actions are very contradictory and at the same time contrary to the noble teaching and values of human rights (HAM). Because human trafficking is how someone is deprived of their rights and also cannot be souvereign like humans in general. This is a very serious matter and should not be left alone. There is a need for firm preventif measures to overcome these problems.

Abstract

The purpose of this article is to (1) inform the extent of legal protection efforts in preserving traditional dances, (2) and solutions that will be carried out in resolving international conflicts that occur due to cases of copyright claims for traditional dances which are the original cultural heritage of Indonesia by other countries. In making this article the type of research used is normative legal research. The approaches used in assisting the writing of this article are (1) the case approach (2) the analytical approach (3) the statute approach (4) and the conceptual approach. As well as in making this article using primary, secondary, and tertiary legal source materials. The results that can be concluded from the making of this article are (1) the National Regulation on the copyright of a dance is contained in Article 38 of Law no. 28 of 2014. In addition, from an international perspective, soft law is a form of law that has the power to bind it voluntarily, for example, the Universal Declaration of Human Rights (UDHR) 1948 and the International Covenant on Economic, Social and Cultural Rights (ICESCR) 1966 and United Nations Declaration on the Rights of Indigenous Peoples 2007. And Hard Law which has similarities with soft law with both having binding power and also having legal sanctions if violated, for example Convention for the safeguarding of the intangible cultural heritage 2003. (2) Efforts to resolve conflicts legally can be resolved by litigation or non-litigation with the following explanation: Litigation is a form of solving problems involving the law through a court process, both in the form of criminal and civil cases. Which can be achieved by a juridical path, ” The method uses the Pacific Settlement of Disputes, with this method providing accountability for each country in tackling the emergence of disputes, which can disrupt peace and regional harmony, and Non-Litigation is a process of resolving legal problems outside the court, which generally refers to civil cases only. because it tends to be closed. The settlement can be done by: Mediation, and Negotiation.

Abstract

The purpose of writing this article is to explain how to resolve international disputes that are being faced by countries. There are many solutions in a country to resolve an international dispute and it all depends on each country in this writing there is a peaceful dispute resolution and in this dispute resolution it can also be through an international court. In this dispute case, parties from other countries who have no interest cannot participate in this case in any form.

Abstract

Indonesia is a country that is still in the developing stage and that is also a problem for Indonesia itself due to the lack of human resources and the number of population numbers that continue to increase every year which results in the world of work sector, the lack of job vacancies in Indonesia has resulted in many citizens preferring to go abroad. to find work, they work as Indonesian workers. Indeed, working outside the country has many advantages such as the amount of wages earned. However, in reality there are still many problems regarding Indonesian workers, such as experiencing fraud by their departure agents, smuggling illegal workers, and when they are accepted to work there they receive inhumane treatment by their employers, such as physical violence or sexual violence. In these problems, it is necessary to take legal protection for Indonesian workers to prevent them from inappropriate actions, therefore the role of international law and national law is very much needed in overcoming these problems and cannot be separated from the role of the Indonesian government in protecting Indonesian workers who are abroad, and it should also be known what steps can be taken to protect Indonesian workers abroad.

Abstract

Territorial borders in a country is one proof that the country is already independent and has been recognized internationally. However, from direct observation as part of the international community, I feel that some are still experiencing disputes related to this territorial issue, especially from the issue of maritime territorial violations. So in resolving these disputes peacefully without any violence, especially in achieving world peace and order, it is necessary to have the role of courts run by the International Court of Justice under the auspices of the United Nations. This paper will explain further and in depth about the role of the International Court of Justice in resolving disputes over territorial violations.

Abstract

This research aims to (1) find out and understand the legal protection of Indonesian cultural heritage, the protection made by the Indonesian state itself as a form of effort to protect its national wealth, then the protection of Indonesian cultural heritage in terms of international law, and (2) know and understand the claims on Indonesian cultural heritage made by foreign countries. The type of research used is normative juridical research. The approach used in this research is the statutory approach, and the conceptual approach, and the case approach. The legal material analysis techniques used in this study are description, analysis, and argumentation techniques. The legal material studied is the 1998 Rome Statute. The results show that (1) legal protection of Indonesian cultural heritage has been carried out with various efforts by the Indonesian government as the regulator to ensure the preservation of Indonesian cultural heritage by issuing Law no. 28 of 2014 concerning Copyright then with Law no. 5 of 2017 concerning the Advancement of Culture. In terms of international law, there are 2 types of protection that can be associated with cultural heritage, namely soft law, which is a voluntary law, and hard law, which is law that has binding force and has sanctions if violated. (2) Efforts to claim Indonesian cultural heritage by other countries have not occurred only once. The claims made even involve the United Nations International Agency which is specifically engaged in the field of culture, namely UNESCO. Cultural heritages that have been claimed include Batik, the song "Rasa Sayange", Wayang Kulit, Angklung.

Abstract

This paper examines international law and the territory between countries. International law was born because of the existence of an international community so that this became the basis for the formation of international law. The international community is used as a sociological foundation in shaping international law. International relations arise because of a factor that requires each other from one country to another in various interests. The territory of the state is part of one element that has a very important meaning. According to international law, the territory of a state consists of land, sea and air. A country's territory will be said to be a permanent territory if it has definite boundaries. State boundaries are something that is very valuable and important in order to clarify or show the boundaries of the country's sovereignty to be implemented. In this case, there will be territorial boundary problems between countries. According to international law, there are several ways of settlement in the form of a peaceful settlement and a forced or violent settlement.

Abstract

This study aims to examine and analyze law enforcement against foreign nationals who violate the immigration rules in Buleleng Regency and the supervision carried out by the Buleleng Regency immigration authorities to prevent misuse of foreign citizens' residence permit visas in Buleleng Regency. This type of research is empirical legal research. The sampling technique used in this study is non-probability sampling with purvosive sampling technique and analyzed using qualitative methods. The results of the study show that Law Enforcement Against Foreign Citizens Violating Immigration Rules in Buleleng Regency, is divided into 2 (two) namely: Immigration Actions in Administrative Forms and Immigration Actions in the Form of Litigation or Judicial Processes. Supervision of the Immigration Office of Buleleng Regency to prevent the Misuse of Foreign Citizens' Residence Permit Visas, includes 2 (two) ways, namely: Administrative Supervision and Field or Operational Supervision.

Abstract

This study aimed to analyze Pancasila as the source of all sources of law and the actualization of Pancasila in constructing the national legal system. The type of research was normative legal research with a statutory and conceptual approach. The researchers did library research techniques as secondary data sources. This study analyzed qualitatively juridically. The study results showed that the formulation of laws in every political stage of legal reform should follow the values contained in Pancasila as the source of all sources of law. The formation or renewal of norms would have implications for interests and impact people's lives or the construction of national and community life. In the development of law, Pancasila was a philosophical foundation, namely the view of life, awareness, and legal ideals of the Indonesian nation. The values of divinity, humanity, unity, democracy, and justice should be actualized into the legal substance, legal structure, and legal culture that would be built.
