Abstract

This study aims to determine: (1) law enforcement against perpetrators of criminals acts of babies disposal in the jurisdiction of the Buleleng Regency, (2) Efforts to overcome the occurrence of criminal acts of babies disposal in the jurisdiction of the Buleleng Regency. The location of this research was carried out in Buleleng Regency, namely at the Buleleng Resort Police, State Prosecutor Buleleng, and The Singaraja District Court Class 1B. This type of research is empirical legal research. The sampling technique used in this research is a non-probability sampling technique in a way that used in determining the research subject is the purposive technique sampling. For data processing analysis techniques, using the qualitative research result show that law enforcement against the perpetrators of the crime of illegal logging have gone well, which carried out with the investigation process, the investigator will continue with the arrest, prosecution and execution before a court with refers to Pasal 181 KUHP about Dead Conditions As for the efforts overcoming the occurrence of criminal acts of babies disposal in the jurisdiction of the Buleleng Regency is to instill moral and formally, providing counseling, and enforcing relevant regulations used to the fullest.

Abstract

This study aims to understand and analyze the mechanisms and regulations of international law that apply in providing protection and settlement as well as legal constraints faced against the case of catching traditional Indonesian fishermen, East Nusa Tenggara in Pualu Pasir which is Australian sovereignty. The research method used is normative legal research using 3 approaches, namely the approach to legislation, history, and cases that are processed with descriptive techniques that produce legal arguments. The results showed that legal protection against the fishing of traditional fishermen is regulated in three bilateral agreements between the governments of Indonesia and Australia: MoU BOX 1974, MoU BOX 1981, and Agreed Minute 1989. The purpose of this agreement is to ensure the rights of Indonesia's traditional fisheries. In the realm of international law, Article 51 paragraph (1982) of the Convention on the Law of the Sea (UNCLOS 1982) also clearly outlines the rights of traditional fishermen related to fisheries, but there is still a need for amendments to the bilateral agreement, as well as the main obstacles related to views on traditional fishers including differences in territorial boundaries, fishing gear used, and the economic sustainability of fishermen. The solution involves strengthening national regulations, legal recognition of traditional fishermen's rights, boundary agreements, and protection of marine resources in the area. However, differences in views, efforts to maintain traditions, pressure on resources, and economic challenges remain obstacles in addressing abuses committed by traditional fishermen in the Sand Island region.

Abstract

This research is focused on the normative problem of the vacuum of recognition norms by customary law communities which causes injustice in tourism development. This research is a normative legal research with a socio legal approach. This research approach uses a statutory approach, a legal approach with a policy orientation. The absence of norms at the level of the Law, plus contradictory interpretations regarding the conditions in Article 18B paragraph (2). At the local government level, the province of Bali has actually made a number of legal products that recognize indigenous peoples in the tourism sector. It is not sufficient to prove the recognition of indigenous peoples in one area. East Java Provincial Regulation as a comparative study. The results show that the recognition of customary law communities is still included in the product of tourism regulations. It affects ± 60% minimum operational funds, ± 15% low sharing funds, ± 10% local government contributions, and ± 5% sourced from sponsors. Regarding this fact, the alternative solution is through the reconstruction of the ideal legal model for the recognition of customary law communities in the tourism sector as a legal input for drafters.

Abstract

Basically everyone agrees that women and men are different. However this has led to the position of women in the family and society below men. The assumption that women should not have a higher position that men is one of the gender inequalities that can still be felt until now. A small example of this gender inequality can be found in a family environment. The main problem in this article is the difference in workload, as well as the use of the right to the rest and the right to enjoy a consolation by each gender in a family. The type of research method used in this article is a qualitative research method. And the legal research approach used in this study is a conceptual approach. The result showed that women had greater workload than men. And women also use the right to rest and enjoyy less consolation than men.

Abstract

International trade is trade carried out between countries or state governments with other countries undergoing a trade relationship in accordance with the agreement between the two parties conducting international trade. Trading international trade is trade carried out by residents of a country with residents of other countries by mutual agreement. The population in questions can be between individuals (individuals with individuals), between individuals and the government of a country, or the government of one country with the government of another country. By conducting international trade, it will provide benefits and make the country’s economic growth directly in the form of an influence on the allocation of resources or directly such as the number of investors entering. Intrernational is also important because it can help create jobs.

Abstract

This study aims to find out and also examine the equality of human rights. Gender and women's empowerment in the perspective of International Law, as well as reviewing solutions in cases of gender equality, human rights, and women's empowerment which will be discussed sequentially. The type of research used by the author in this study is normative legal research, a research method which in this case combines elements of normative law which is then supported by additional data or empirical elements. and case approach. This writing uses materials in doing writing with primary, secondary and tertiary legal materials which can show that this research is based on international law in general. A legal and normative concept which states that humans have rights that are very inherent in themselves because they are human beings who have full rights and these rights apply anytime and anywhere, differences that often occur make humans lose their rights such as inequality. Gander, which makes humans different from other humans, occurs very often, giving rise to the feeling that differences are a mistake. The progress achieved by a woman and the achievement of equality between women and men is one of the issues of human rights and a necessary condition for the welfare of society.

Abstract

Human trafficking is not only a black record for Indonesia, but has become a global issue. The rise of this practice and the increasing number of cases from time to time finally led the United Nations Office on Drugs and Crime (UNODC) as an agency or organization that focuses on dealing with these polemics and also initiated a series of international convention to discuss issue related to this. It’s quite crucial. According to the PBB itself, human trafficking is categorized as one of the third largest illicit companies in the world. This is also proven by the fantastic income, which is 9.6 million USD. Not only that, but Human Trafficking is one of the darkest companies that is closely related to other elements. Such as money laundering, document falsification, drug trafficking (Drugs), and also immigrant smuggling (smuggling). Based on the quote above, it can be said that until now the practice of human trafficking is still rampant in the life of the world. These actions are very contradictory and at the same time contrary to the noble teaching and values of human rights (HAM). Because human trafficking is how someone is deprived of their rights and also cannot be souvereign like humans in general. This is a very serious matter and should not be left alone. There is a need for firm preventif measures to overcome these problems.

Abstract

The purpose of this article is to (1) inform the extent of legal protection efforts in preserving traditional dances, (2) and solutions that will be carried out in resolving international conflicts that occur due to cases of copyright claims for traditional dances which are the original cultural heritage of Indonesia by other countries. In making this article the type of research used is normative legal research. The approaches used in assisting the writing of this article are (1) the case approach (2) the analytical approach (3) the statute approach (4) and the conceptual approach. As well as in making this article using primary, secondary, and tertiary legal source materials. The results that can be concluded from the making of this article are (1) the National Regulation on the copyright of a dance is contained in Article 38 of Law no. 28 of 2014. In addition, from an international perspective, soft law is a form of law that has the power to bind it voluntarily, for example, the Universal Declaration of Human Rights (UDHR) 1948 and the International Covenant on Economic, Social and Cultural Rights (ICESCR) 1966 and United Nations Declaration on the Rights of Indigenous Peoples 2007. And Hard Law which has similarities with soft law with both having binding power and also having legal sanctions if violated, for example Convention for the safeguarding of the intangible cultural heritage 2003. (2) Efforts to resolve conflicts legally can be resolved by litigation or non-litigation with the following explanation: Litigation is a form of solving problems involving the law through a court process, both in the form of criminal and civil cases. Which can be achieved by a juridical path, ” The method uses the Pacific Settlement of Disputes, with this method providing accountability for each country in tackling the emergence of disputes, which can disrupt peace and regional harmony, and Non-Litigation is a process of resolving legal problems outside the court, which generally refers to civil cases only. because it tends to be closed. The settlement can be done by: Mediation, and Negotiation.

Abstract

There are many solutions in a country to resolve an international dispute and it all depends on each country in this writing there is a peaceful dispute resolution and in this dispute resolution it can also be through an international court.
