Abstract

Corporate Social Responsibility (CSR) is a corporate commitment to contribute to sustainable economic development by focusing on the balance between attention to economic, social, and environmental aspects. This paper argues that corporations are subject to criminal law, which can be subject to criminal liability if they do not carry out CSR obligations. This study aims to find out the linkage of sanctions arrangements and the urgency of regulations on criminal liability if the corporation does not carry out CSR obligations. In practice, CSR is only based on corporate awareness and commitment. In the meantime, CSR enforcement's most basic weakness is the absence of strict sanctions for corporations that deny CSR, especially in terms of criminal sanctions. Instead, the sanction is limited to administrative as set out in Act No. 25/2007 on Investment, with a lack of legislation governing criminal sanctions against CSR prevention. In so doing, there is a need to introduce sanctions against corporations that deny CSR, by taking into account adverse impacts to the environment and community. Abstract

Indonesia has the potential to manage natural resources in such a way that social justice, public welfare, and the prosperity of the people is also realized. Contract law is the primary legal umbrella used in efforts to protect natural resources from exploitation. This study uses normative juridical methods that prioritize secondary data as the primary sources. This study shows the form of the legal protection of state assets related to oil and gas management including the government has the right of immunity, the existence of provisions regarding state revenue, state levies, and bonuses and the existence of provisions for contractors to distribute a portion of the production share. Thus, the government uses Production Sharing Contracts (PSC) to enter into oil and gas management agreements with contractors, specifically regarding upstream business activities. The Oil and Gas Law does not elaborate on the meaning of the PSC. Rather, it only states that the PSC is one form of the contracts. Abstract

The gig economy has transcended mere trend status, emerging as a resilient force that promotes economies, even in the face of adversities like the COVID-19 pandemic. The gig economy not only impacts employment law but also intersects with regulations governing digital banking. Surprisingly, despite the exponential growth of gig workers in Indonesia, little attention has been given to comprehensively elucidating the legal interplay between employment law and digital banking. Therefore, this research aims to analyze the potential and legal challenges posed by the gig economy's development in the Indonesian economy. This research uses the Global South perspective as the gig economy offers unique challenges to an environment where issues in employment are already a problem. Furthermore, it examines the utilization of digital banking as a mechanism to address the pressing issues faced by gig workers. The potential limitation of this study is the lack of comprehensive data and empirical evidence, which may restrict the depth of analysis and the generalizability of the findings. The rationale of this legal study is to address the lack of comprehensive understanding regarding the legal interplay between employment law and digital banking in the context of the gig economy in Indonesia and bridge the gaps to connect these concepts under the legal context. Employing a normative legal research method with a statutory approach, this study offers a conceptual analysis of these intertwined concepts and their alignment with Indonesia's existing positive laws. The findings reveal significant connections between employment law and digital banking yet highlight the absence of well-defined legal boundaries within Indonesia's legal framework. Consequently, this research catalyses a novel branch of legal development in Indonesia, focusing on the gig economy and its profound implications.Keywords: Digital Banking, Employment Law, Gig Economy.

Abstract

In Indonesia, the Commission for the Supervision of Business Competition or Komisi Pengawas Persaingan Usaha (KPPU) is granted the power according to Law Number 5 of 1999 but such a power cannot be optimally implemented. KPPU often experiences difficulties and obstacles in the process of enforcing business competition law due to a large number of business actors and uncooperative witnesses so that this hinders the process of examining cases. In particular, KPPU has lack of cooperation of involved parties during the inspection process. However, the KPPU in carrying out its authority can include the role of the Indonesian police to assist in the process of enforcing business competition law. This paper shows that the role of the Indonesian police in the enforcement of business competition law can be initiated during the investigation process if the KPPU requests assistance to present the reported party, witnesses, and expert witnesses. Until the decision is issued by the KPPU, investigators can follow up with relevant individuals that may have cases that contain criminal aspects.
