Abstract

The phenomenon of children facing the law or in conflict with the law requires special handling that is different from that of adults. Balai Permasyarakatan is one of the parties given the responsibility to be involved in conducting coaching. This study aims to find out how the function of the Balai Permasyarakatan Kelas 1 Makassar in conducting guidance for children who face the law. The research used is descriptive qualitative research with empirical normative and normative theological approaches. The results of this study show that the guidance of children facing the law by the Balai Pemasyarakatan Kelas Makassar is carried out through a personality guidance program, independence and supervision of child clients, especially those who obtain parole. The coaching program carried out by the Correctional Center has provided benefits, by fostering children who face the law before living a normal life in the community.

Abstract

Sexual harassment in verbal and non-verbal forms has become increasingly prevalent globally. This study revealed cases of sexual harassment in cyberspace in accordance with National Law regulations in Indonesia on immortality, such as the Criminal Code and Law Number 4 of 2008 concerning Pornography and Law Number 13 Of 2006 on Legal Protection of Witnesses and Victims. Meanwhile, in the Islamic legal order, sexual harassment in cyberspace is seen in the discussion of the Jinayah Fiqh, classified as jarimah takzir and contains elements of abomination or insulting acts. The legal protection for victims of sexual harassment in Islamic law is in the form of imposing sanctions on perpetrators, which the government determines following the magnitude of their crime. The hope of strengthening immoral punishment has become necessary for Indonesia by considering the spirit and value embodied in Islamic criminal law.

Abstract

The proliferation of counterfeit vaccinations was producing significant public health problems and was related with legal issues. This article compared the sanctions imposed by Islamic criminal law and national legislation on counterfeiters and distributors of fake vaccines. Several rules and regulations control the use and distribution of vaccinations in Indonesia. In accordance with Articles 196 and 197 of Law Number 36 of 2009 on Health, the criminal act of distributing counterfeit vaccines is punishable by a maximum prison sentence of ten years and a maximum fine of one billion in IDR. As opposed to Article 197, which stipulates a maximum punishment of 15 years in prison and a maximum fine of Rp. 1,500,000,000,000. counterfeiting and distributing counterfeit vaccines are considered serious crimes in both Islamic criminal law and Jināyah. The punishment for these crimes varies depending on the severity of the offense and the harm caused to society. In both systems of law, the punishment can range from fines and imprisonment to the death penalty. It is important to note that these punishments are intended to deter individuals from engaging in these crimes and protect public health and safety. It was believed that the government would increase legislation addressing the punishment of counterfeiters and drug dealers, who can harm the Indonesian national character.

Abstract

There is a deep connection between Islamic economics and philosophy. Philosophy as the mother of knowledge contributes greatly in developing Islamic economics. This research method is qualitative literature (library research) using a narrative approach. The data collection techniques are orientation and exploration. The collected data then analyzed using inductive and deductive techniques. The results explain that philosophy plays a role in making the scope of Islamic economics that includes normative, positive and predictive knowledge. Predictive and positive have produced Islamic economic theories, while normative has given birth to other branches of Islamic economics such as muamalah, Islamic economic ethics, Islamic financial system, Islamic accounting, Islamic economic development, Islamic leadership management and zakat. As for the location of facts and truths from the perspective of the philosophy of science in development of Islamic economics, namely in positive knowledge that produces Islamic economic theory. However, Islamic economic theory must be empirically proven through a series of truth tests.

Abstract

The subject of interfaith marriage in Indonesia, including its pros and cons, has been in the public purview recently. This research aims to answer public concerns, provide recommendations for strengthening regulations, and even prevent this type of marriage. A qualitative method alongside a sociological approach was applied, while data collection techniques included interviews and literature studies. It was concluded through sadd al-żarī'ah analysis, that interfaith marriage should be prohibited as it only leads to harm and difficulties in households and families. Furthermore, fatḥ al-żarī'ah analysis of the marriage of a Muslim man to an Ahlu al-Kitab woman is permitted by the majority of scholars. This is due to the possibility of benefits, namely the opportunity to guide the woman to embrace Islam. it is emphasized that this possibility is relative, as the Muslim man may change his faith. Therefore, this facility (al-żarī'ah) should not be opened (fatḥ al-żarī'ah). The implications of this study recommend sadd al-żarī'ah as material for consideration in strengthening the rules regarding interfaith marriages in the future. Moreover, the polemic of interfaith marriage should be resolved immediately by affirming and enforcing changes to the marriage law. Legal vacuums in the regulation of this matter should not be allowed or ignored due to the negative impact in terms of social and religious life.

Abstract

AbstractThis study aims to determine how the implementation of sakinah family guidance for household resilience in KUA Maniangpajo District, Wajo Regency. The method used is descriptive qualitative in the form of field research. Data collection methods used are observation, interviews and documentation. The data analysis technique used is the Miles and Huberman model which consists of: data collection, data reduction, data presentation, and drawing conclusions/verification. The results showed that the efforts made by KUA in realizing a sakinah family for household resilience in Maniangpajo District, Wajo Regency, were through the development of religious aspects, aspects of preparing a quality generation and health aspects of prospective brides through the guidance of the sakinah family. The supporting factors in realizing a sakinah family are the rights and obligations between family members, the local government support for fostering a sakinah family, the existence of supporting facilities and infrastructure to provide counseling for sakinah family guidance for household resilience, and the community in particular and prospective brides who participate. Counselors always receive directions from the sakinah family guidance counselor for the resilience of the household. The inhibiting factor is the low understanding of Islam, understanding of creating a quality generation and understanding of health. The implications of the research are for guidance participants to understand and implement the material presented, to KUA Maniangpajo District to innovate in disseminating activities, and to the Wajo Regency government to impose sanctions on participants who do not follow the directions of the presenters.Keywords: Sakinah Family Guidance, Household Resilience.

Abstract

Kuliah Kerja Nyata (KKN) merupakan suatu kegiatan perkuliahan intrakulikuler dalam bentuk pengabdian kepada masyarakat yang dilakukan oleh mahasiswa secara disiplioner dan terstruktur. Kegiatan ini merupakan bagian dari tri dharma perguruan tinggi yaitu pendidikan, penelitian dan pengabdian. Metode pendekatan yang digunakan dalam pengabdian masyarakat yaitu Intervensi sosial yang dimana intervensi sosial merupakan upaya perubahan terencana terhadap individu, kelompok, maupun komunitas dengan asas kekeluargaan dan kemandirian. Tujuan utama dari intervensi sosial adalah memperbaiki fungsi sosial (individu, kelompok, masyarakat) yang merupakan sasaran perubahan, ketika fungsi sosial seseorang berfungsi dengan baik, diasumsikan bahwa kondisi kesejahteraan akan semakin mudah dicapai. Tahapan terpenting dalam intervensi yaitu pengumpulan data yang merupakan tahap dimana pekerja sosial mengumpulkan informasi yang dibutuhkan terkait masalah yang akan diselesaikan. Hal ini dapat membantu masyarakat dalam pelaksanaan pembangunan diberbagai bidang, terutama pendidikan, kesehatan, agama, dan sosial. Mahasiswa KKN ini melakukan kegiatan di Desa Lanca Kecamatan Tellu Siattinge Kabupaten Bone. Penduduk Desa Lanca pada umumnya menyambut baik kedatangan mahasiswa untuk membawa perubahan melalui pemberdayaan masyarakat dalam meningkatkan kualitas pendidikan, kesehatan, agama dan sosial.

Abstract

The religious authoritative institution of the Indonesian Ulema Council (MUI), is facing infiltration by members connected with acts of terrorism. This leads to public demands for its dissolution under the banner of "Joint Enemy Terrorism". Therefore, this study aimed to assess the possibility of dissolving MUI by reviewing the root causes of terrorism within the religious institution. Through the lens of Islamic political analysis and a critical examination of various data sources, it became evident that the discourse advocating for the dissolution centered around the hashtag #BubarkanMUI#. This hashtag campaign was initiated to frame the participation of MUI members in extremist activities, thereby posing a threat of criminal terrorism. MUI, on the other hand, was beyond dispute due to its strong and legally entrenched position. In this context, the prospect of the dissolution became irrelevant, impractical, and challenging to materialize primarily due to membership issues. The existence of MUI was strengthened and secured through several laws mandating its engagement, including the certification of halal products and regulation of Sharia banking. This showed the religious institution must embark on a thorough evaluation and enhancement of both its structural framework and membership recruitment processes. Regarding the authority to dissolve non-political institutions and organizations, this prerogative should be entrusted to the Constitutional Court, serving as a judicial entity responsible for safeguarding democracy, human rights, and constitutional principles.

Abstract

Penyelesaian kasus kejahatan mengalami perkembangan cukup pesat. Pasalnya, penyelesaianmelalui pengadilan dan non pengadilan menghiasi rana peradilan pidana diIndonesia. Secara subtantif, terjadi pergeseran pemidanaan yang semulanya menititikberatkan pada pembalasan (retributif) menjadi pemulihan (restoratif). Konsep keadilan restoratif (restorative justice) hadir sebagai jawaban atas kekhawatiran masyarakat utamanya korban yang mengalami kerugian secara materil maupun inmateril.Dalam perjalanannya, keadilan restoratif telah menjadi instrumen fundamentaldalam sistem peradilan nasional, misalnya tindak pidana anak melalui diversi.  Bahkan tercatat dalam sejarah, keadilan restoratifmelalui Komisi Kebenaran dan Rekonsiliasi pernah diberlakukan sebagai jalan penuntasan kejahatan HAM. Akan tetapi, pada akhirnya Undang-Undang Komisi Kebenaran dan Rekonsiliasi dicabut atas Putusan  Mahkamah Konstitusi Nomor 6/PUU-IV/2006dan kembali menjadi Program Legislasi Nasional 2015-2019. Dengan demikian, restorative justice bagi kejahatan HAM mengalami pasang surut dan dimungkinkan adanya prospek keadilan restoratif pada praktik peradilan pidana di Indonesia.Kata Kunci: Keadilan Restoratif; Kejahatan; HAM; KKR.
