Abstract

Artikel ini bertujuan untuk menganalisis hukum penggunaan item fashion berbahan kulit hewan yang haram dikonsumsi menurut pandangan ulama mazhab. Jenis penelitian kualitatif yang berpedoman terhadap pengelolahan data yang didapatkan dari beberapa literatur. Adapun sumber data yang didapatkan diantaranya data sekunder dan data primer. Pendekatan penelitian ini menggunakan pendekatan normatif syar’i. Hasil penelitian menunjukkan bahwa mazhab al-Syafi’i berpandangan bahwa status hukum pemanfaatan bangkai dapat di bagi kepada dua bagian: yaitu kulit dan selain kulit. Pemanfaatan kulit apabila kulit itu selain kulit anjing dan babi maka setelah di samak kulit tersebut di hukumi suci dan boleh di manfaatkan sebagai item fashion sedangkan selain kulit seperti bulu tulang, tanduk, bulu dan lemak adalah najis dan tidak boleh dimanfaatkan. Mazhab Hanbali dan Mazhab Maliki memiliki persamaan pendapat mengenai status hukum penyamakan kulit hewan yaitu mereka menganggap bahwa penyamakan kulit hewan bukan merupakan sesuatu yang dapat menyucikan. Tetapi mereka memperbolehkan pemanfaatan dan penggunaan kulit hewan yang telah disamak. Menurut mazhab Zahiri semua kulit beserta bulunya adalah halal setelah di samak dan haram sebelum di samak. Sedangkan tulang, tanduk, kuku dan taring adalah suci tanpa di samak tetapi tidak halal di makan. Urat dan lemaknya tidak boleh dimanfaatkan karna ada larangan Nabi

Abstract

The emergence of public concerns regarding products that are still in doubt about the halalness of products in Indonesia makes the researcher try to understand the authority of the Indonesian Ulama Council, in this case issuing a fatwa related to the halal or haram of a product. Talking about fatwas, it cannot be separated from the authority of the Indonesian Ulama Council in issuing fatwas on the halal and haram of a product. This study employed library research with a siyasa syar'iyyah approach. The results showed that 1) the standards used by Indonesian Ulama Council in determining the halal and haram of a product by taking into account the legal status of the substances used, how to obtain them, how to produce them and how to market them, 2) related to the effectiveness of the inclusion of the halal logo and the existence of a halal certificate on every the product was still low because there were still products that did not have a halal certificate and the inclusion of a halal logo, and 3) the authority of Indonesian Ulama Council in halal certification from a siyasah syar'iyyah perspective by providing legal considerations among the people, even though it did not have binding legal force. As an implication of this study, it is hoped that there will be aware for the Muslim community to be more careful in consuming a product, especially Muslim business actors in order to understand the importance of halal certificates and the inclusion of a halal logo on each product.

Abstract

Artikel ini bertujuan untuk mengkaji pelaksanaan isbat nikah terhadap perkawinan siri dengan melihat studi kasus di Pengadilan Agama Sungguminsa. Penelitian ini adalah penelitian kualitatif dengan menggunakan pendekatan yuridis-normatif yang didukung dengan penelitian lapangan. Sumber data diperoleh dari Hakim Pengadilan Agama Sungguminasa. Metode pengumpulan data yang digunakan adalah kajian pustaka, observasi, wawancara dan dokumentasi. Hasil penelitian menemukan bahwa cara pelaksanaan isbat nikah yaitu dimulai dari pengajuan permohonan, setelah itu disidangkan, jika telah memenuhi rukun dan syarat maka hakim akan mengabulkan. Pertimbangan majelis hakim dalam memutuskan isbat nikah terhadap perkawinan siri, yaitu selama memenuhi rukun dan syarat perkawinan Islam dan pertimbangan-pertimbangan dasar hukum yang digunakan maka majelis hakim akan mengabulkan permohonan isbat nikah, dan efektivitas pelaksanaam isbat nikah, yaitu dapat memberikan jalan keluar bagi pasangan yang menikah siri, serta bisa menjaga pihak-pihak yang melakukan perkawinan itu sendiri seperti nafkah istri, hubungan orang tua dengan anak, kewarisan dan lainnya. Implikasi dari penelitian ini adalah harapan untuk semua hakim di Pengadilan Agama tanpa terkecuali menyampaikan kepada pemohon untuk memperhatikan prosedur pelaksanaan isbat nikah. Abstract

This study discusses al-D{aru>riya>t al-Khams in the Crime of Theft (Verdict Analysis in Pinrang District Court). It is the aim of this study to reveal the relationship between al-daru riyat al-khams and the verdict of criminal sanction of theft in Pinrang District Court. The implication of this study is that the Pinrang District Court verdict has considered aspects of al-daru riyat al-khams regarding assets’ safeguarding in terms of the theft case. The judge decided the case by prioritizing proven divine values by mentioning for the sake of justice based on that one godhead (Believe in the one and only God). Imposing sanctions by the judge is by taking into account the burdensome and mitigating elements for the benefit of the defendant.

Abstract

This article aims to examine the formalization of Islamic law in the form of a Sharia Regional Regulation (Perda) in Bulukumba. The approach in this research is juridical-normative. This approach is used to understand the phenomenon of the formalization of Islamic law in the Bulukumba area. The results show that the formalization and application of sharia regulations in Bulukumba is running quite well, this is based on the development of public understanding and compliance with the Perda. On the other hand, these sharia-based regulations sometimes run less effectively. This is because there are still many Bulukumba people who do not know, let alone understand the Sharia Regional Regulations well.

Abstract

Lesbian, Gay, Bisexual and Transgender (LGBT) is a term used since the 1990s to describe a group of people with different sexual orientations and behaviors. This term replaces the previous phrase "Gay Community". Some countries that reject LGBT people are Saudi Arabia, Yemen, Sudan and Iran, which are known to have imposed the death penalty on LGBT people. Though there have been no reports of actual death sentences in recent years. This study aims to reveal the relationship between the benefits of Islamic law and the possibility of imposing the death penalty on LGBT offenders. A normative approach is used in this study and it is found that in Islam, LGBT is prohibited. Although scholars differ on the punishment for LGBT offenders, there are still LGBT offenders found in the Muslim community. The maslahah perspective is presenting studies and guidelines that can be used as a reference in determining the appropriate punishment for LGBT offenders. The assumption about the permissibility of being LGBT can be rebutted by the presence of power that underlies one's religious beliefs. Scientists hope that punishment for LGBT offenders will not only become a discourse but should be considered if possible to be implemented. The government and all related elements must be able to provide awareness that stigma, discrimination or prejudice against LGBT people is something that can happen because religion prohibits LGBT actions and the concept of human rights is upheld in Indonesia.

Abstract

The purpose of this research is to explain the meaning of Fatwa and Qada, how are the similarities and differences between fatwa and qada and their implementation in Indonesia, and to explain how the wisdom of fatwa and qada is. This research is qualitative, the type of research is library research and uses phenomenological and normative approaches. The results showed that; 1) The word fatwa comes from Arabic, which means the answer to what is the problem of syarak or legislation. The word Qada comes from Arabic, which means law and determination. It can be understood that the meaning of a fatwa in the term is the answer to the explanation of the mufti regarding religious questions or problems asked by someone or mustafti. The meaning of Qada in terms is a legal decision from qadi regarding cases or events based on arguments and evidence through mechanisms, the scope of qada is limited and is binding and obligatory. 2) The brief similarity of both of them is both legal products and determined based on the Quran and Hadith. First, the fundamental difference between the two is that fatwas are not binding while qada is binding/force. Second, that the scope of coverage of fatwas is wider than qada. Fatwa application in Indonesia is more dominant than qada. 3) The honesty of Fatwa and Qada can be seen from the existence of the arguments which make it conducive, it is the arguments that position the fatwa and Qada as two legal matters as part of Islamic law, especially Islamic justice.

Abstract

This paper explores the basic concepts and correlations of illat, hikma and sabab, all three of which are terms that often intersect in the construction of Islamic law. exploring and contemplating the existence of the three concepts is very important to map out the basic differences between the three. Concept exploration uses library sources that are analyzed to obtain the basis for conceptual differences and explore the relationship between illat, hikma and sabab. The correlation between Illat, Wisdom and Sabab can be divided into two: first; the relationship between illat and sabab to wisdom, wisdom is complementary to both in providing a more philosophical construction of law, not just punishing. Second; The relationship between illat and sabab is complementary if you look at the generality and specificity of the two.

Abstract

Abstrak Penelitian ini bertujuan untuk mengetahui mekanisme penghimpunan dana zakat pada BAZNAS Kabupaten Bima dan untuk mengetahui manfaat dana zakat produktif yang diberikan kepada mustahik bantuan zakat produktif oleh BAZNAS Kabupaten Bima. Jenis penelitian ini adalah penelitian kualitatif dengan pendekatan penelitian menggunakan pendekatan sosiologis. Metode pengumpulan data yang dilakukan adalah observasi, wawancara dan dokumentasi. Teknik analisis data yang digunakan adalah model Miles dan Huberman yang terdiri dari: pengumpulan data, reduksi data, penyajian data, dan penarikan kesimpulan/verifikasi. Hasil penelitian menemukan bahwa tingkat keefektifan pendayagunaan dana zakat produktif adalah efektif, hal ini berdasarkan mekanisme pengumpulan dan pendistribusian zakat, dan manfaat yang dirasakan oleh mustahik bantuan zakat produktif dari BAZNAS Kabupaten Bima. Mekanisme pengumpulan zakat dimulai dengan sosialisasi kepada masyarakat bersama UPZ Desa dan UPZ Kecamatan, kemudian dilakukan pengumpulan zakat yang dilakukan oleh UPZ Tingkat Desa berkoordinasi dengan Pemerintahan Desa, kemudian diberikan kepada UPZ Kecamatan untuk diserahkan kepada BAZNAS Kabupaten Bima. Pengumpulan zakat profesi dilaksanakan oleh UPZ Instansi, setelah zakat dikumpulkan kemudian diserahkan kepada BAZNAS Kabupaten Bima. Pendistribusian zakat dilaksanakan di setiap Kecamatan, dana zakat diberikan oleh BAZNAS Kabupaten Bima dan UPZ Kecamatan kepada UPZ Desa, kemudian dana zakat diberikan oleh oleh UPZ Desa kepada mustahik. Manfaat bantuan zakat produktif yang dirasakan oleh mustahik bantuan zakat produktif dari BAZNAS Kabupaten Bima adalah adanya peningkatan pendapatan, keuntungan sehingga dapat memenuhi kebutuhan hidup sehari-hari. Selain itu membantu pemerintah mengurangi angka pengangguran di Kabupaten Bima. Diharapkan kepada mustahik agar memanfaatkan bantuan tersebut dengan baik. Kepada BAZNAS Kabupaten Bima agar meningkatkan jumlah bantuan, melakukan pengawasan, pelatihan dan pembinaan terhadap mustahik. Sedangkan kepada Pemerintah Kabupaten Bima agar mengeluarkan peraturan Daerah untuk memaksimalkan potensi zakat produktif. Kata Kunci: Pendayagunaan, Usaha Mikro, Zakat Produktif. Abstract This study aims to determine the mechanism for collecting zakat funds at BAZNAS Bima Regency and to determine the benefits of productive zakat funds given to mustahik for productive zakat assistance by BAZNAS Bima Regency. This type of research is a qualitative research with a research approach using a sociological approach. Data collection methods used are observation, interviews and documentation. The data analysis technique used is the Miles and Huberman model which consists of: data collection, data reduction, data presentation, and drawing conclusions/verification. The results of the study found that the level of effectiveness of the utilization of productive zakat funds was effective, this was based on the mechanism for collecting and distributing zakat, and the benefits felt by mustahik of productive zakat assistance from BAZNAS Bima Regency. The mechanism for collecting zakat begins with socialization to the community with UPZ Desa and UPZ Sub-district, then zakat collection is carried out by UPZ at the Village Level in coordination with the Village Government, then given to UPZ District to be submitted to BAZNAS Bima Regency. Professional zakat collection is carried out by UPZ Agencies, after zakat is collected it is then handed over to BAZNAS Bima Regency. The distribution of zakat is carried out in each sub-district, zakat funds are given by BAZNAS Bima Regency and UPZ Sub-district to UPZ Desa, then zakat funds are given by UPZ Desa to mustahik. The benefits of productive zakat assistance felt by mustahik of productive zakat assistance from BAZNAS Bima Regency are an increase in income, profits so that they can meet the needs of daily life. Besides helping the government reduce the unemployment rate in Bima Regency. It is hoped that mustahik will make good use of this assistance. To BAZNAS Bima Regency to increase the amount of assistance, carry out supervision, training and guidance for mustahik. Meanwhile, the Bima Regency Government should issue regional regulations to maximize the potential of productive zakat. Keywords: Empowerment, Micro Business, Productive Zakat.
