Abstract

Secara arti kata Sharih berasal dari kata sharah yang berati ‟terang‟ dan menjelaskan apa yang ada dalam hatinya terhadap orang lain dengan ungkapan yang seterang mungkin. Menurut abdul azhim bin badawi al-khalafi, bahwa yang dimaksud dengan sharih adalah suatu kalimat yang langsung dapat dipahami tatkala diucapkan dan tidak mengandung makna lain dalam pengertian istilah hukum, sedangkan Kinayah adalah lafadz yang memerlukan penjelasan. Adapun rumusan masalah dalam penelitian ini adalah bagaimana kajian lafaz dari segi penggunaan makna sharih dan kinayah makna penerapan dalam nash dan implikasi hukumnya. Al- Sharih adalah suatu pengertian yang secara nyata dapat diambil dari ungkapan tersebut karena pemakaiannya yang banyak baik pemakaian itu haqiqah maupun arti majaz. Jadi, pengertian al-Sharih itu adalah pengertian yang sudah jelas bagi si pendengar tanpa membutuhkan berpikir tentang maksud ungkapan tersebut. Sedangkan Al-Kinayah adalah suatu lafal yang tersembunyi maksudnya, tak bisa difahami tanpa adanya qarinah yang menunjukkan makna yang sebenarnya baik makna itu dimaksud kan sebagai makna haqiqat atau makna majazi.

Abstract

This research aimed to provide efforts to strengthen the law if changes to regulations occur, which must be accompanied by academic and socio-political approaches. In Indonesia, there is a new form of sexual crime whether verbal, non-physical, physical, or online. The prevalence of such incidents reflects a troubling trend that needs urgent attention from both authorities and society. This research was field research, equipped with qualitative data. The data sources included observational research, interviews, and documentation as well as literature studies by reviewing documents relating to criminal sanctions for adultery, especially from the Criminal Code, outside the Criminal Code, and manuscripts of Islamic criminal law. The beneficial theory used was the Al-Būtī version, which emphasized the validity of al-‘uqūbah al-Islāmiyah. The research findings revealed that in the event of changes to criminal law in Indonesia, maslahat considerations are prioritized, particularly in cases of grave sexual crimes, the death penalty should be applied. The government must consider things such as benefits, cultural values, and societal perspectives when making criminal punishment policies. In Indonesia, several backgrounds supported the choice of the death penalty for sexual crimes. The expected benefits are community protection, preventative action, justice for victims, and the elimination of dangerous perpetrators in the future. The legal situation governing sexual crimes in Indonesia is increasingly pitiful, and a change is needed.

Abstract

This study discusses al-D{aru>riya>t al-Khams in the Crime of Theft (Verdict Analysis in Pinrang District Court). It is the aim of this study to reveal the relationship between al-daru riyat al-khams and the verdict of criminal sanction of theft in Pinrang District Court. The implication of this study is that the Pinrang District Court verdict has considered aspects of al-daru riyat al-khams regarding assets’ safeguarding in terms of the theft case. The judge decided the case by prioritizing proven divine values by mentioning for the sake of justice based on that one godhead (Believe in the one and only God). Imposing sanctions by the judge is by taking into account the burdensome and mitigating elements for the benefit of the defendant.

Abstract

Baitul Mal wa Tamwil (BMT), as an Islamic microfinance institution, plays a pivotal role in providing fair and inclusive financial access to micro, small, and medium enterprises (MSMEs) in Indonesia. This study aims to comprehensively analyze the functions, product variations, and socio-economic roles of BMT, while also identifying the opportunities and challenges for BMT development in the modern era. Employing a qualitative descriptive approach through literature review, this research examines various sources related to Islamic microfinance and BMT. The analysis reveals that BMT not only serves as a provider of Sharia-compliant financing and manager of religious social funds, but also acts as an agent of community economic empowerment. In the digital era, BMT has significant opportunities to expand its services through product innovation and technology integration; however, it also faces challenges such as limited human resources, the need for stronger governance, and adaptation to evolving regulations and technologies. These findings highlight the importance of enhancing institutional capacity, strengthening Sharia financial literacy, and fostering collaboration with various stakeholders to optimize BMT’s role in supporting community economic empowerment and advancing sustainable Islamic financial inclusion.

Abstract

This article investigates how politics functions not merely as an external arena of pressure but as a medium of institutional survival for the Khalwatiyah Samman Order in South Sulawesi. While existing studies on Indonesian Sufi orders have predominantly emphasized doctrinal teachings, ritual systems, and patterns of social expansion, they tend to overlook the political mechanisms through which a tarekat negotiates authority, confronts accusations of heresy, and constructs long-term legitimacy within shifting power structures. Addressing this gap, the study focuses on two pivotal historical events—the 1931 heresy accusation issued by King Bone La Mappanyukki and the 1958 ulama assembly organized by the DI/TII movement in Wanua Waru—to demonstrate that the Khalwatiyah Samman Order has continuously acted as both a religious and socio-political institution capable of adapting to, resisting, and strategically engaging competing forces such as monarchy, colonialism, and radical Islamist militancy. Using a qualitative, descriptive-historical method based on manuscripts, archival sources, and oral testimonies, the research reveals that the tarekat’s endurance is sustained through three interconnected strategies: cultural accommodation within local power structures, intellectual-theological argumentation to counter delegitimization, and the mobilization of a broad follower base as a source of social capital. These strategies not only defend its orthodoxy but also allow the tarekat to convert political threats into opportunities for institutional consolidation. The article therefore argues that politics, in this context, is not solely a site of contestation but a resource for identity affirmation and doctrinal continuity, offering a new analytical lens for understanding Sufi orders in Indonesia as adaptive actors with historical agency in the negotiation of religious and political authority.

Abstract

This article aims to integrate the wasathiyah paradigm of the Majelis Ulama Indonesia (MUI) fatwa product and the reality of religious social issues in the midst of the pandemic coronavirus disease 2019 (COVID-19).  This article adopts the normative-sociological approach. This article found that MUI fatwa products acted on strong aspects of moderation (wasathiyah), not just issuing fatwas. Various aspects of considerations (al-muwazanat) in fatwa products are marked by revealing strict arguments by expressing the opinions of the Qur'an, sunna, ijma, qiyas, the opinion of the Imam of the school and credible scholars and the views of other experts who support the issuance of fatwa in accordance with the needs of Muslims. The Washatiyah paradigm of MUI fatwa product is not influenced by political interests. It is in accordance with the maqashid al-shari'ah. The paradigm of MUI fatwa was reflected when recommending to Muslims to support and obey the government.

Abstract

This study examines the transformation of the fatwa methodology of three major Islamic institutions in Indonesia, namely the Indonesian Ulema Council (MUI), Bahtsul Masā'il Nahdlatul Ulama (NU), and the Tarjih and Tajdid Council of Muhammadiyah in responding to digital transformation through the maqāṣid al-sharī'ah approach. This study uses a qualitative method based on a literature review of fatwas, institutional documents, and the latest academic literature on the epistemology of Islamic law in the digital era. The results of the analysis show that the three have different but complementary epistemological characteristics. The MUI presents an institutional maqāṣidī approach with a regulatory orientation, while NU maintains a model of ijtihād jamā'ī based on classical scientific traditions with a communitarian character. while Muhammadiyah develops an integrative rational framework through the bayānī, burhānī, 'irfānī model that is adaptive to developments in science and technology. In the context of digitalization, all three face the same challenge, namely maintaining scientific authority and the credibility of fatwas amid the proliferation of algorithms and religious content. However, this study emphasizes that the integration of maqāṣid al-sharī'ah values is key to balancing the authenticity of Islamic law and the demands of digital modernity. Therefore, the future direction of fatwa development should not only focus on the digitization of information systems, but also on the reconstruction of epistemological ijtihad towards a responsive digital maqāṣidī fiqh.

Abstract

This study critically examines the halal product certification process conducted by the Indonesian Council of Ulama (Majelis Ulama Indonesia, MUI) of South Sulawesi from the perspective of maslahah (public interest). The research is grounded in the urgent need to protect Muslim consumers, particularly in light of the growing consumption of both local and imported products that often lack clear halal status. While numerous studies have explored halal certification at the national level, there remains a significant gap in examining the regional dynamics and implementation of MUI fatwas, especially in South Sulawesi. This study aims to analyze the approaches employed by MUI South Sulawesi in determining halal certification and assess the extent to which maslahah serves as the guiding principle in their process. The research adopts a field research methodology with a descriptive qualitative approach and uses ushuliyyah (Islamic legal methodology) as its analytical framework. Data collection was carried out through observation, interviews, and documentation. The findings reveal that MUI South Sulawesi consistently upholds the principles of Islamic law in the halal certification process, emphasizing critical ingredients, production processes, and the cleanliness of facilities. Although the use of additives such as coloring and preservatives is permitted, it is contingent upon their halal status and freedom from impurities (najis). This approach reflects a moderate application of maqāṣid al-sharī‘ah, demonstrating adaptability to industrial developments while maintaining a cautious and principled stance. The study underscores the importance of transparency and education for business actors, and recommends further research focusing on post-certification supervision or comparative studies across regions. These findings offer valuable contributions to strengthening Indonesia’s halal assurance system based on the principles of public welfare.

Abstract

Background: Caesarean section (CS) is a surgical procedure performed when vaginal delivery is not possible due to medical or non-medical indications. The increasing prevalence of CS worldwide has raised concerns regarding maternal and neonatal health. Objectives: This study aims to identify maternal factors contributing to the increased incidence of CS at Sitti Khadijah 1 Maternity Hospital, Makassar, for the period of January 1 – December 31, 2023. This research provides a unique contribution by analyzing CS prevalence and risk factors in a private Islamic maternity hospital, a setting underrepresented in national data. Furthermore, quantitative evaluation using multivariate analysis was conducted to determine the most dominant risk factors, supporting evidence-based prioritization in clinical decision-making and antenatal care planning in similar urban Indonesian contexts.Methods: A cross-sectional study was conducted using secondary data from medical records of mothers who delivered at Sitti Khadijah 1 Maternity Hospital in 2023. Maternal age, history of CS, premature rupture of membranes (PROM), gestational age, and preeclampsia were analyzed. Statistical tests included Chi-Square and multivariate analysis.Results: Of 341 deliveries, 300 (88.0%) were CS cases. Significant associations were found between CS and history of CS (p=0.004), preeclampsia (p=0.000), and PROM (p=0.000), while maternal age (p=0.751) and gestational age (p=0.183) were not significant. Mothers with a previous CS had a 99.0% likelihood of undergoing repeat CS. Preeclampsia strongly predicted CS, with 94.8% of cases delivered surgically. PROM was also a determinant, with 96.3% undergoing CS. Multivariate analysis confirmed history of CS as the strongest predictor (OR=19.689; 95% CI 2.589–149.737; p=0.004).Conclusion: History of CS, preeclampsia, and PROM are significant factors associated with CS. The risk of CS is significantly associated highest with history of CS. These findings highlight the need for improved maternal healthcare strategies to manage high-risk pregnancies and reduce unnecessary CS procedures.

Abstract

Tulisan ini bertujuan untuk mendeskripsikan bagaimana hukum Islam dalam merespon permasalahan kontemporer yang relevan dengan kaidah al-maṣlaḥah al-mursalah. Kaidah al-maṣlaḥah al-mursalah merupakan salah satu metode penetapan hukum dalam Islam yang sangat efektif dalam menyikapi, serta memberikan solusi terhadap permasalahan kontemporer dan dapat dijadikan hujjah jika sesuai dengan bebarapa syarat yang diformulasikan secara ketat oleh para ulama. Majelis Tarjih Muhammadiyah yang merupakan suatu majelis yang bernaung di bawah bendera Muhammadiyah memiliki tanggung jawab yang amat besar dan strategis di dalam memberikan bimbingan keagamaan (religious practical guidance) di kalangan umat, khususnya bagi warga persyarikatan Muhammadiyah itu sendiri. Wujud tanggung jawab Majelis Tarjih tersebut meliputi upaya perumusan keputusan-keputusan hukum yang didasarkan pada metodologi pengambilan hukum (manhaj istinbat al-ahkam) yang cukup adekuat. Untuk itu, sejak tahun 1935 upaya perumusan metodologi hukum di tubuh Muhammadiyah telah mulai dilakukan. Langkah yang pertama adalah mengkaji masalah lima (mabadi al-khamsah) yang merupakan sikap dasar Muhammadiyah dalam persoalan keagamaan secara umum. Namun demikian, dalam perjalanannya, Majelis Tarjih Muhammadiyah juga tidak terelakkan dari masalah-masalah keagamaan kotemporer yang tidak memiliki dalil perintah atau larangan secara tegas, sehingga Majelis Tarjih Muhammadiyah menggunakan pendekatan al-maṣlaḥah al-mursalah dalam menggali suatu hukum kontemporer tersebut. Di antara permasalahan kontemporer yang difatwakan oleh Majelis Tarjih Muhammadiyah dengan menggunakan pendekatan al-maṣlaḥah al-mursalah adalah hukum talak di depan persidangan, di mana Menurut Majelis tarjih Muhammadiyah, talak seroang suami dikatkan sah apabila dilakukan di depan persidangan.
