Abstract

This article aims to reveal the intersection of the relevance of democracy in the modern state system and the system of government in Islam. This research uses a socio-cultural approach. The results show that democracy has two essential aspects, namely as a system and form of the state, and as universal values that are fought for the sake of human dignity. In the first aspect, as a system and form of state, democracy cannot meet the concept of Islam because it does not speak of a particular system and form of a state. Islam is more of a religion and a social rule of life, not talking about a system, let alone the form of a state. In the second aspect, human values must be fought. Democracy can be in line with Islamic teachings. It covers the value of egalitarianism (al-musāwah), freedom (al-huriyah) and pluralism (ta` adudiyah), does not contradict Islamic principles, even long before Islam has spoken about and fought for these values. It does not mean that democracy is entirely following the spirit and breadth of Islam. Islam also contains other principles that democracy does not carry. The principles in question are the principles of syūrā (deliberation). From this understanding of democracy, what the Islamic democratic system wants to aim at is the implementation of Islamic teachings as a whole and consequently to create a benefit as aspired by siyāsah syar'iyah.Keywords: Democracy; Islamic Politics; Modern State; Siyasah Shar’iyyah

Abstract

Abstract Karia custom is a custom carried out by the Muna community who are Muslim. The main problem of this research is the 'urf' view of the traditional karia procession in the Muna community in Laiworu Village, Batalaiworu District, Muna Regency with sub problems, namely:1. How is the practice of performing traditional caries in the Muna community in Laiworu Village, Batalaiworu District, Muna Regency? And 2. What is 'urf's view on the practice of performing traditional caries in the Muna community in Laiworu Village, Batalaiworu District, Muna Regency? This type of research is a field research (field research), which is descriptive qualitative. The research approach used is the 'Urf approach and the Socio-cultural approach. The results of this study indicate that: Karia is one of the customs of the Muna tribe that has been passed down from generation to generation. And the karia custom is a custom that includes 'urf sahih, meaning that the karia custom is a custom that is allowed in Islam. The implication of this research is that for the Muna Regency Government, adat karia as cultural heritage values ​​should be preserved, especially noble values ​​in the implementation of adat karia to shape women's personalities in living married life. Abstract

Muhammad Shahrur has a different view about polygamy from other scholars. According to him, polygamy is only permitted for widows who have orphans. This condition applies to second, third and fourth wives. This requirement refers to the principle of protection for widows and the principle of justice towards orphans. This research is descriptive qualitative research. The data collection technique is a literature study by exploring various literature, both literature in the form of books and articles related to Muhammad Shahrur's thoughts. Likewise, it is related to the social conditions of Indonesian society, especially the phenomenon of polygamy in Indonesia. This research explores Muhahmmad Shahrur's opinion regarding the requirements for polygamy and looks at its relevance to social conditions in society. This research concludes that the conditions for polygamy expressed by Muhammad Shahrur are very relevant and can bring benefits if implemented and legislated into regulations in Indonesia. First, because polygamy regulations in Indonesia adhere to the principle of open monogamy. Second, polygamy can be a solution for widows and their orphaned children in Indonesia who face many problems. Third, polygamy is not prescribed to cause problems, but to provide solutions. Including solutions to social conditions in society.

Abstract

This article delves into the comprehensive examination of the dispute resolution in adultery cases within the Tolaki Tribe, specifically through the traditional practice of "Kalosara." The research also explores the relevance of Kalosara to the al-Ishlah concept in Islamic criminal law. This research uses the literature review method to establish a robust theoretical foundation. This research indicates a significant relevance between the Kalosara custom and the concept of Ishlah in the context of Islamic criminal law. The practice of Kalosara in resolving cases of adultery within the Tolaki Tribe reflects the principles of Ishlah, emphasizing reconciliation, restoration, and conflict resolution. The stages of the resolution process, from the acknowledgment of the perpetrator to the purification ceremony, mirror a holistic approach to achieving restorative justice. The research results show that the integration of Kalosara customary law in the Ishlah process reflects the aspirations of the Tolaki community for a comprehensive resolution and effective recovery at various levels, including individual, social, and broader community contexts. In the settlement through Kalosara, adulterers are expected to admit their actions, express regret, and carry out a purification process with a holistic approach to resolving conflicts and restoring social relations.

Abstract

Malulo, a traditional dance of the Tolaki people, is integral to various religious and social activities such as harvests, weddings, and aqiqah. This research explores the cultural significance of the Malulo dance in Kecamatan Lambai, Kabupaten Kolaka Utara, and examines its alignment with Islamic values, particularly regarding interactions between men and women. The study addresses whether the physical contact in the dance contradicts Islamic teachings and offers solutions to preserve the tradition while adhering to religious principles. Using a qualitative approach, interviews with religious leaders, cultural practitioners, and community members were conducted, alongside an analysis of Islamic legal perspectives on urf (customs). The findings show that while Malulo fosters community cohesion and has deep cultural roots, the practice of hand-holding between non-mahram men and women is seen as inconsistent with Islamic teachings. The research suggests modifications, such as separating men and women during the dance, to preserve the tradition without violating religious values. The study's originality lies in its attempt to reconcile a local cultural tradition with Islamic jurisprudence, offering a balanced solution that respects both heritage and religious principles. This approach highlights the broader importance of harmonizing cultural practices with religious norms, particularly in multi-ethnic and multi-religious societies, and could serve as a model for resolving similar conflicts elsewhere.

Abstract

This research was a comparative study on the effect of young age in the crime of murder between Islamic jurisprudence and Indonesian law. The presence of children around us needs attention, especially with regard to their behavior, which is out of control. the phenomenon of their deviation is one of the negative social phenomenon which required protection, guidance and education. According to previous studies, children who deviated and were not controlled would become a criminal when he reaches adulthood. Nowadays, the children's delinquency is widely spread, they are involved in committing crimes such as drugs, theft, fighting, and increased to murder. This research will focus on the murder committed by under age children, because murder is a very dangerous crime to the indivdual life and is one of the law violation againts the five  principles of shariah (daruriyat al khamsah).

Abstract

This study examined the depth of Caliph Umar bin Khattab's philosophical thinking in applying ijtihad in the context of Islamic criminal law, especially related to the restorative justice approach. By analyzing various policies and legal decisions taken by Umar, this study attempted to uncover the philosophical basis underlying the application of the principles of restorative justice in the Islamic justice system during his leadership by identifying the values of justice, humanity, and maslahah as the main pillars of Umar bin Khattab's ijtihad thinking in the context of restorative justice. Using a descriptive qualitative approach, this study examined primary and secondary sources, including fiqh books and modern literature on restorative justice. The results of the study showed that Umar's ijtihad was not only based on literal Sharia texts but also considered maslahat (benefit) and the social context of society. This could be seen in decisions such as the temporary suspension of the punishment of amputation of hands during a time of famine, which illustrated the law's flexibility in responding to emergencies.

Abstract

This paper is intended to find a method of understanding maqâsid al-syarî'ah in Ijtihad of Islamic law. The method used is literature review using descriptive analysis. The study in this writing demonstrates that the method of understanding maqâsid al- syarî'ah has four forms of approach taken by experts, namely (1) lafziyah, (2) maknawiyah (3) meaning outside the text using Istihsân and Istislah (Maslahah al- Mursalah) and (4) lafziyah and meaning. While there are also contemporary thinkers who develop methods of understanding maqâsid al-syarî'ah with the term al-adillah al-syar'iyyah al-maqâsid al-syarî'ah iyyah divided into two methods: (1) al-adillah al-syar'iyyah al-maqâsid al-syarî'ah iyyah the development of al-adillah al-syar'iyyah ushul fiqh. (2) al-adillah al-syar'iyyah al-maqâsid al-syarî'ah iyyah excluding al- adillah al-syar'iyyah ushul fiqh. The urgency of this study is to create welfare, peace and happiness for humanity both in this world and in the hereafter and to answer problems in Islamic lawwhich do not find its law in the Qur'an and Sunnah.

Abstract

This study examines the dynamics of the Mombolosuako (elopement) tradition among the Tolaki ethnic group in Southeast Sulawesi, Indonesia, focusing on its practice in religiously diverse communities. This research specifically compares the implementation and acceptance of this tradition between the Muslim-majority Anggaberi District and Catholic-majority Puasana Village in Konawe Regency. Using a qualitative approach with a comparative case study design, data were collected through in-depth interviews with 16 key informants, field observations, and document analysis analyzed through Interpretative Phenomenological Analysis (IPA). The findings reveal that in Anggaberi, where Muslims and Tolaki are the majority, Mombolosuako is practiced as a non-normal marriage from cultural identity although some consider it contrary to Islamic teachings. This practice is supported by Regional Regulation No. 1 of 2018 concerning the Implementation of Sara Merapu Customary Law of the Tolaki Tribe. Conversely, in Puasana, where Muslims and Tolaki are minorities, this tradition is neither known nor practiced. This indicates that diversity can reduce the role of customs in social structures. This research emphasizes the importance of adaptive and contextual regulatory approaches in multicultural societies, so that customary policies can balance between preserving traditions and dynamic social needs. These findings provide insights for policymakers and academics in designing more inclusive customary policies and add to the literature on the interaction between customary law, religion, and formal regulations in plural societies.

Abstract

This research explores the contestation of Islamic religious authority in the digital space of Instagram, where traditional boundaries of religious interpretation are increasingly challenged by new forms of expression. With the rise of social media, platforms like Instagram have given rise to virtual Muslim communities, or the "e-Ummah," transforming the landscape of religious authority in Indonesia. The study examines three prominent Instagram accounts—@nuonline_id (Nahdlatul Ulama), @lensamu (Muhammadiyah), and @indonesiabertauhidofficial (an independent Salafi account)—to analyze how they represent, challenge, and redefine religious authority. Through qualitative content analysis, it investigates how these accounts utilize various forms of digital content, including infographics, videos, and quotes, to convey differing interpretations of Islamic teachings. The findings reveal significant variations in influence, with @indonesiabertauhidofficial boasting the largest following, indicating its considerable impact on digital discourse. The content of each account reflects distinct religious perspectives: @indonesiabertauhidofficial emphasizes Salafi principles, focusing on purification and strict adherence to the Qur’an and Sunnah, while NU and Muhammadiyah highlight traditional practices and moral guidance. The contestation of religious authority is particularly evident in discussions about the role of the state, interfaith relations, and the commemoration of the Prophet Muhammad’s birthday. الملخص تبحث هذه الدراسة في تنازع السلطة الدينية الإسلامية في الفضاء الرقمي على إنستغرام، حيث تتحدى الحدود التقليدية للتفسير الديني بشكل متزايد أشكالًا جديدة من التعبير. مع ظهور وسائل التواصل الاجتماعي، أدت منصات مثل إنستغرام إلى ولادة مجتمعات إسلامية افتراضية، أو ”الأمة الإلكترونية“، مما أدى إلى تغيير مشهد السلطة الدينية في إندونيسيا. يفحص هذا البحث ثلاثة حسابات بارزة على إنستغرام، وهي@nuonline_id (نهضة العلماء)، @lensamu (المحمدية)، @indonesiabertauhidohidofficial (حساب سلفي مستقل)، لتحليل كيفية تمثيلها وتحديها وإعادة تعريفها للسلطة الدينية. من خلال تحليل المحتوى النوعي، تبحث الدراسة في كيفية استخدام هذه الحسابات لأشكال مختلفة من المحتوى الرقمي، بما في ذلك الرسوم البيانية ومقاطع الفيديو والاقتباسات، للتعبير عن تفسيرات مختلفة للتعاليم الإسلامية. وتكشف النتائج عن اختلافات كبيرة في التأثير، حيث يستحوذ حساب @indonesiabertauhidohidofficial على أكبر عدد من المتابعين، مما يشير إلى تأثيره الكبير على الخطاب الرقمي. ويعكس محتوى كل حساب وجهات نظر دينية مختلفة: إذ يؤكد حساب @indonesiabertauhidohidofficial على المبادئ السلفية، مع التركيز على التطهير والالتزام بالقرآن والسنة، في حين يؤكد حسابا نهضة العلماء والمحمدية على الممارسات التقليدية والتوجيه الأخلاقي. يتجلى التنازع على السلطة الدينية بشكل خاص في المناقشات المتعلقة بدور الدولة، والعلاقات بين الأديان، وإحياء ذكرى المولد النبوي الشريف. Abstrak Penelitian ini mengeksplorasi kontestasi otoritas agama Islam di ruang digital Instagram, di mana batas-batas tradisional penafsiran agama semakin ditantang oleh bentuk-bentuk ekspresi baru. Dengan munculnya media sosial, platform seperti Instagram telah melahirkan komunitas Muslim virtual, atau e-Ummah, yang mengubah lanskap otoritas keagamaan di Indonesia. Penelitian ini mengkaji tiga akun Instagram terkemuka-@nuonline_id (Nahdlatul Ulama), @lensamu (Muhammadiyah), dan @indonesiabertauhidofficial (sebuah akun Salafi independen)-untuk menganalisis bagaimana akun-akun tersebut merepresentasikan, menantang, dan mendefinisikan ulang otoritas keagamaan. Melalui analisis konten kualitatif, penelitian ini menyelidiki bagaimana akun-akun tersebut menggunakan berbagai bentuk konten digital, termasuk infografis, video, dan kutipan, untuk mengekspresikan interpretasi yang berbeda dari ajaran Islam. Temuan-temuan tersebut mengungkapkan variasi pengaruh yang signifikan, dengan @indonesiabertauhidofficial memiliki pengikut terbesar, yang menunjukkan dampaknya yang cukup besar pada wacana digital. Konten setiap akun mencerminkan pandangan keagamaan yang berbeda: @indonesiabertauhidofficial menekankan prinsip-prinsip Salafi, dengan fokus pada pemurnian dan kepatuhan terhadap Al-Qur’an dan Sunnah, sementara NU dan Muhammadiyah menekankan praktik-praktik tradisional dan panduan moral. Kontestasi otoritas keagamaan sangat jelas terlihat dalam diskusi terkait peran negara, hubungan antar agama, dan peringatan Maulid Nabi Muhammad.
