Abstract

Pembatalan akta perjanjian sewa menyewa dengan pemilik lahan di Kecamatan Medan Tembung Kota Medan, terjadi karena tidak diperolehnya surat keterangan izin tetangga. Berdasarkan hal tersebut penelitian ini ditujukan untuk mengetahui, bagaimana prosedur pembatalan akta perjanjian sewa lahan, bagaimana tanggung jawab PT Dayamitra Telekomunikasi Tbk Cabang Medan, bagaimana penyelesaian hukum atas pembatalan akta perjanjian sewa lahan pembangunan Menara telekomunikasi PT Dayamitra Telekomunikasi Tbk Cabang Medan dengan pemilik lahan di Kecamatan Medan Tembung Kota Medan.Metode penelitian yang digunakan dalam penelitian ini adalah jenis penelitian hukum normatif dengan dukungan data empiris, bersifat deskriptif analitis, Analisis data dalam penelitian ini menggunakan metode kualitatif deskriptif. Sumber data dalam penelitian ini menggunakan data sekunder dan primer. Teknik pengumpulan data dilakukan melalui penelitian pustaka dan lapangan. Alat pengumpulan data dilakukan dengan studi dokumen dan wawancara, dan analisis data dilakukan secara kualitatif deskriptif dengan metode berfikir secara deduktif. Hasil penelitian menunjukkan bahwa, pembatalan Akta perjanjian sewa menyewa dilakukan guna kepentingan para pihak yang tersebut dalam akta agar dikemudian hari lepas dari tuntutan hukum yang mungkin timbul karena hal lain, adapun hal ini didasari pihak Perusahaan PT Dayamitra TBK cabang Medan tidak mendapatkan dukungan atau izin dari masyarakat sekitar lahan untuk pembangunan menara telekomunikasi yang merupakan salah satu persyaratan guna mendapatkan  Persetujuan Bangunan dan Gedung (PBG) dari Dinas Tata Ruang dan Tata Bangunan Kota. Melalui proses komunikasi dengan pemilik lahan, maka kedua belah pihak bersepakat untuk membatalkan Akta perjanjian sewa menyewa lahan, yang dilakukan kedua belah pihak dengan menanda tangani surat pernyataan pembatalan perjanjian kerja sama sewa menyewa lahan, dengan dihadiri saksi-saksi dari para pihak, yang dilakukan secara bawah tangan. Adapun dengan pembatalan akta tersbut maka sejak saat itu terjadi  pemulihan  kepada keadaan semula sebelum terjadinya perjanjian itu. Hak untuk meminta pembatalan perjanjian dan menuntut pemulihan sebagaimana keadaan semula merupakan hak bagi para pihak yang disebutkan dalam akta perjanjian sewa menyewa tersebut.

Abstract

Child marriage still occurs in Indonesia, even though Law No. 16/2019 has increased the minimum age for getting married from 16 year old for the bride specified in Article 7, paragraph 1 and 19 year old for the groom to 19 year old for both of them. Indonesia is the country which participates in the Convention of Elimination of All Types of Discrimination Against Women as it is specified in Article 16, paragraph 2 which reads : “the betrothal and the marriage of a child shall have no legal effect, and all necessary action, including legislation, shall be taken to specify a minimum age for marriage and to make the registration of marriages in an official registry compulsory.” Indonesia is also the country which participates in Beijing Declaration and Platform for Action in which there is the 12th of critical areas of concern : one of them is the elimination of all types of discrimination towards girls. Abstract

Debts and receivables used for business have not produced results, and some businesses have even failed. This is where problems arise because the debtor cannot fulfill his obligation to repay the credit loan in question. Negligence or delay (whether intentional or unintentional) in credit payments will result in a fine which must be borne by the debtor as agreed, because the debtor cannot fulfill its obligations because the debtor has died. The legal research method used is empirical normative supported by interviews, with data collection by means of documentation studies, literature studies and interviews. The heir is responsible for the debtor's debt with the aim of providing legal protection to the creditor in providing credit to the debtor who then after signing the credit, the debtor has died, then this becomes the obligation of the heir to pay the heir's debt.

Abstract

Adopted children have inheritance rights similar to the inheritance rights of biological children, as stated in Staats Blad 1917 No. 38 Article 12 states that adopted children are equated with biological children born to the husband and wife who adopted them. Typically, adoption of such a child is an act that equalizes the position of the adopted child with the biological child, both in terms of care and inheritance. The problem formulation in this research is: What is the legal position of adopted children regarding the inheritance of adoptive parents based on Supreme Court Decision Number 3626 K/Pdt/2016; What are the judge's legal considerations in providing legal protection for the rights of adopted children to the inheritance of adoptive parents in Supreme Court Decision Number 3626 K/Pdt/2016; What are the implications of Supreme Court Decision Number 3626 K/Pdt/2016 for the legal protection of the inheritance rights of adopted children in Indonesia. The research method used in this research is normative juridical research, which is supported by secondary data sources, and qualitative analysis is carried out. The results of the research and discussion are that the legal position of adopted children regarding the inheritance of adoptive parents based on Decision Number 3626 K/Pdt/2016 is valid which is in accordance with the adoption decision issued by PN Number 08/Pdt.P/2003/PN Kbj. dated 28 May 2003 which determined that Rehulina Br Gurusinga was the adopted child and sole heir of Langsat Karo-Karo Gurusinga and Silo Br Sembiring. The judge's legal considerations in providing legal protection for the adopted child's rights to the inheritance of the adoptive parents in Decision Number 3626 K/Pdt/2016 by determining Rehulina br Gurusinga as the adopted child of the heir and entitled to receive the heir's property, because the judge considered the juridical aspect of where the Plaintiff was. is the adopted son and only heir of Langsat and Silo. The implications of the decision for the legal protection of the inheritance rights of adopted children in Indonesia have contributed to strengthening the legal protection of adopted children for the inheritance of their adoptive parents.

Abstract

Abstract: Land delivery services have an important role in the distribution of goods and support national economic development. Delivery of goods is carried out based on an agreement between the sender and the service provider, but damage to goods often occurs due to negligence of the delivery service, so legal protection is needed in accordance with Law Number 8 of 1999 concerning Consumer Protection, the Civil Code, the Commercial Code, and Law Number 22 of 2009 concerning Road Traffic and Transportation. This study aims to analyze the regulation of PT. Dakota Buana Semesta Banda Aceh Branch's liability in the event of damage to goods during the delivery process, limitations of liability, and legal protection for the sender of goods to demand responsibility if there is damage to goods during the delivery process. The method used in this thesis is normative juridical research supported by field research or prescriptive analysis. The results of the study indicate that the company's liability is based on the delivery agreement as regulated in the Civil Code, the Commercial Code, Law Number 8 of 1999 concerning Consumer Protection, and Law Number 22 of 2009 concerning Road Traffic and Transportation. Limitations of liability apply to high-value, uninsured goods and those affected by force majeure. While legal protections offered to shippers include preventive and repressive measures, they still face challenges in claims procedures, reporting deadlines, and compensation amounts. Keyword: Legal Liability, Damage to Goods, Delivery of GoodsAbstrak: Jasa pengiriman darat memiliki peranan penting dalam distribusi barang dan mendukung pembangunan ekonomi nasional. Pengiriman barang dilakukan berdasarkan perjanjian antara pengirim dan penyedia jasa, namun kerusakan barang kerap terjadi akibat kelalaian pihak jasa pengiriman, sehingga diperlukan perlindungan hukum sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, KUHPerdata, KUHD, serta Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Penelitian ini bertujuan untuk menganalisis pengaturan pertanggungjawaban PT. Dakota Buana Semesta Cabang Banda Aceh dalam hal terdapat kerusakan barang dalam proses pengiriman, pembatasan pertanggungjawaban, serta perlindungan hukum pengirim barang untuk meminta pertanggungjawaban apabila terdapat kerusakan barang dalam proses pengiriman. Metode yang digunakan dalam tesis ini adalah penelitian yuridis normatif didukung dengan penelitian lapangan atau preskriptif analisis. Hasil penelitian menunjukkan bahwa tanggung jawab perusahaan didasarkan pada perjanjian pengiriman sebagaimana diatur dalam KUHPerdata, KUHD, Undang- Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, dan Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Pembatasan tanggung jawab diberlakukan untuk barang bernilai tinggi yang tidak diasuransikan dan dalam keadaan force majeure. Perlindungan hukum yang diberikan kepada pengirim mencakup perlindungan preventif dan represif, namun masih menghadapi kendala dalam prosedur klaim, batas waktu pelaporan, dan nominal ganti rugi.Kata kunci: Pertanggungjawaban Hukum, Kerusakan Barang, Pengiriman Barang

Abstract

Complex bankruptcy issues are still possible, notwithstanding the rise in trade between businesspeople of different nationalities, particularly in cases of cross-border insolvency or bankruptcy that transcend national borders. The severity of the issues in cross-border insolvency proceedings in Indonesia is increased by the lack of consistency or harmonization of bankruptcy laws (statutory regulations) throughout nations worldwide about proposed bankruptcy rulings. This study employs the Normative Juridical research method, emphasizing literature reviews using relevant Indonesian laws and regulations and several relevant book references. It also takes an analytical descriptive approach. The following research findings were derived from the studies that were conducted: Efforts to create legal products that agree on cross-border bankruptcy laws in order to tackle global economic integration, particularly in the ASEAN region, are greatly aided by the UNCITRAL Model Law on Cross-Border Insolvency with Guide to Enactment. Indonesia may choose to implement the Model Law in light of ASEAN's economic cooperation. Only three articles—Articles 212, 213, and 214—of the Bankruptcy Rules now in force govern international matters. These three paragraphs do not govern the technique and process of execution; they solely deal with the transfer of assets included in bankruptcy overseas and the transfer of all or a portion of debts or receivables to third parties.

Abstract

This study aimed to determine the impact of the ASEAN Economic Community (AEC) on the national shipping industry highly imbalanced with relevant business policies. The AEC agreement is also expected to positively affect the shipping industry while controlling domestic and competing in international activities. In this study, a normative method was used, with the collection of data carried out through literature studies. The Maritime Vision of Indonesia, which is the Policy Direction and Strategy for The Development of Marine Transportation, was also implemented to motivate the country toward becoming the World Maritime Axis. This emphasized becoming a developed, sovereign, independent, and strong maritime country, which was able to positively contribute to regional and global security and peace, according to national interests. Furthermore, the Marine Policy of Indonesia was prepared regarding the Development Vision of the country, as stated in Law Number 17 of 2007 concerning the National Long-Term Development Plan 2005-2025 and Law Number 32 of 2014 emphasizing Marine Affairs. The results showed that the implementation of ASSM (ASEAN Shipping Single Market) impacted the national shipping industry, due to increasingly open competition. Based on the AEC era, Indonesia should be internally and externally ready, for the effective and efficient prioritization of shipping transportation activities. The country should also be ready to compete nationally and internationally, specifically in sea transportation, as one of the important components of the national shipping sector.

Abstract

Digital technology advancement has prompted the exploration of digital signatures as alternatives to conventional signatures. This research examines the potential implementation of digital signatures in notarial deeds to achieve legal certainty in Indonesia. Using normative juridical methods with analytical-descriptive approach, this study analyzes secondary legal materials. The findings demonstrate that digital signatures possess legal validity under the Law on Information and Electronic Transactions (UU ITE), provided authentication, integrity, and non-repudiation requirements are met. However, implementation faces regulatory obstacles due to the Notary Position Law (UUJN) lacking explicit digital signature provisions. Harmonization among relevant laws, strengthened digital infrastructure, and enhanced legal literacy for notaries are essential. Consequently, digital signatures hold significant potential to increase efficiency, security, and legal certainty in notarial deed execution within Indonesia's digital era.

Abstract

In marriage, marital property (gono-gini) arising from valid marital bonds requires spousal consent for transfer. This study employs normative juridical methodology with descriptive analytical approach to examine Temporary Land Deed Officials' (PPATS) responsibility in facilitating marital property sales without spousal consent based on Supreme Court Decision Number 3325K/PDT/2020. Research findings demonstrate that PPATS bears administrative and disciplinary accountability, sales agreements are void under Article 1320 Indonesian Civil Code, good-faith buyers retain legal protection, and parties may file deed annulment suits or pursue mediation to ensure legal certainty and justice.

Abstract

In leasing practice, transfer of fiduciary collateral objects to third parties occurs through informal agreements where payment obligations may shift between parties. This normative juridical research employs qualitative library study methodology to produce descriptive-analytical findings. The study examines three critical aspects: first, the legal position of transferring fiduciary security rights without lessor consent, which violates the Fiduciary Security Law requiring written authorization; second, legal protection mechanisms for lessors through civil and criminal liability provisions; and third, lessee accountability under Decision Number 25/Pid.B/2024/PN Ketapang, where the court correctly determined the defendant fulfilled criminal elements under Article 36 of the Fiduciary Security Law for transferring secured objects without prior written fiduciary receiver consent.
