The registration of private deeds in legal context is the recording of underhand documents by a notary in a special register to provide legal certainty regarding their existence and date, without converting them into authentic deeds. This normative legal research analyzes the legal status and evidentiary strength of registered private deeds, examining Court Decision No. 29/Pdt.G./2019/PN.Pya. Using secondary data from legal documents and regulations, the study finds that registration under the Notarial Law provides administrative formality and legal protection. However, registered private deeds retain their original nature, with probative value depending on signatories' acknowledgment. Notaries are responsible for procedural accuracy but not content validity.

A Notary is a public official authorized to create authentic deeds, including Foundation Establishment Deeds according to Article 9 paragraphs (1) and (2) of Law Number 28 of 2004 concerning Foundations. This normative juridical research uses statutory, conceptual, and case approaches analyzing Langsa District Court Decision Number: 4/Pdt.G/2018/PN.Lgs jo Cassation Decision Number: 3480/K/Pdt/2019 jo Judicial Review Number: 188/PK/PDT/2021. Research findings indicate the Notary committed unlawful acts by failing to apply the precautionary principle in issuing deeds according to Law Number 30 of 2004 jo Law Number 2 of 2014 concerning Notarial Position, resulting in the deed being declared invalid and the foundation owner's rights being restored.

Abuse of circumstances (misbruik van omstandigheden) is a jurisprudential doctrine not yet regulated in Indonesian written law. A normative juridical research method was used to analyze Decision Number 143/PDT/2016/PT. DKI. Research findings indicate characteristics of abuse of circumstances include special circumstances and awareness. Sale and Purchase Binding Agreement Deeds containing abuse of circumstances can be declared null and void. The Panel of Judges ruled that the use of absolute power of attorney exploiting deteriorating economic conditions constitutes abuse of circumstances causing defective consent. Legal reform of the Civil Code is needed to regulate this doctrine to provide legal certainty and protection.

PPAT as a public official has the authority to create land sale and purchase deeds and is obligated to apply the prudential principle. This study of Decision Number 69/Pid/2020/PT. Smr analyzes PPAT's accountability in land sale and purchase processes resulting in criminal embezzlement. There is no concrete regulation regarding PPAT's prudential principle, creating legal ambiguity. Embezzlement by PPAT should be subject to Article 374 of the Criminal Code (embezzlement in office), but the judge erroneously applied Article 372 of the Criminal Code. Clearer regulations are needed regarding prudential indicators and embezzlement acts by PPAT, as well as more comprehensive judicial considerations in deciding similar cases to establish legal certainty.

The Sale and Purchase Binding Agreement (PPJB) as an authentic deed has perfect evidentiary power based on Article 1868 of the Civil Code. Decision Number 27/Pdt.G/2019/PN Krs canceled the PPJB due to the buyer's default in failing to fulfill payment obligations. Cancellation of the deed results in the restoration of the parties' rights to their original position in accordance with Article 1451 of the Civil Code. However, there was an error by the Judge for not considering Article 16 paragraph (1) letter m of the Notary Position Law regarding the requirement of 2 witnesses in deed preparation, thus creating legal uncertainty regarding the evidentiary power of PPJB as an authentic deed.

Legal certainty regarding amendments to the management deed of Bintang Laot Cooperative conducted without the Annual Members' Meeting (RAT) becomes the focus of this study. Unilateral changes using allegedly falsified documents and notarized without proper verification have caused internal conflicts, suspension of economic activities, and legal uncertainty. These actions fulfill the elements of unlawful acts as stipulated in Article 1365 of the Civil Code. Legal remedies such as summons, civil lawsuits, and criminal reports have been pursued to restore legality. This case demonstrates weak notarial supervision and legal protection for cooperatives, necessitating more stringent regulatory reforms.

Abstract: Notaries in carrying out their duties require the assistance of others, so notaries can employ people as employees in their offices with certain specifications to help fulfill their duties. The results of the research and discussion show that the legal obligation for Notary employees regarding the confidentiality of Notary deeds is not specifically regulated in the UUJN so that ethically and morally Notary employees are also obliged to keep the contents of the Notary deed confidential. The legal responsibility of Notary office employees is related to maintaining the confidentiality of Notary deeds made before a Notary, so if the Notary employee does not maintain the confidentiality of the deed, he is legally responsible and can be categorized as an unlawful act. The Notary's responsibility towards Notary employees in order to maintain the confidentiality of deeds made before a Notary in carrying out his position is that the Notary can be held civilly liable for misuse of the confidentiality of the minutes of the deed by his employees, even though in this case the notary did not make a direct mistake. Keyword: Accountability, Employees, Notary DeedsAbstrak: Notaris dalam menjalankan tugasnya memerlukan bantuan orang lain, maka notaris dapat mempekerjakan orang sebagai karyawan di kantornya dengan spesifikasi tertentu untuk membantu memenuhi tugasnya. Hasil penelitian dan pembahasan menunjukkan bahwa kewajiban hukum bagi karyawan Notaris terhadap kerahasiaan akta Notaris adalah tidak diatur secara khusus dalam UUJN sehingga secara etika dan moral karyawan Notaris juga berkewajiban merahasiakan isi akta Notaris tersebut. Tanggungjawab hukum karyawan kantor Notaris terkait menjaga kerahasiaan akta Notaris yang dibuat dihadapan Notaris, maka apabila pegawai notaris tidak menjaga kerahasiaan akta bertanggung jawab secara hukum dan dapat dikateogrikan sebagai perbuatan melawan hokum. Pertanggungjawaban Notaris terhadap karyawan Notaris dalam rangka menjaga kerahasiaan akta yang dibuat dihadapan Notaris dalam menjalankan jabatannya adalah Notaris dapat dipertanggungjawabkan secara perdata akibat penyalahgunaan kerahasiaan minuta akta oleh pekerjanya, meskipun dalam hal ini notaris tidak melakukan kesalahan secara langsung. Abstract: Insurance companies that are in a critical period will raise receivables for policy holders, so that the policy holders are entitled to the money and ask the insurance company to pay the insurance claim debt in accordance with the previously agreed insurance policy. Claiming insurance can lead to problems, such as the company not being able to provide insurance claims, which can lead to debts and possibly the insurance company going bankrupt. What are the consequences of bankruptcy law on insurance companies that have been declared bankrupt? What is the position of insurance policy holders in insurance companies that have been declared bankrupt? What is the role of the Financial Services Authority in protecting the rights of insurance policy holders against insurance companies that have been declared bankrupt? The research method used in this research is normative legal research with library study data collection. The data sources used in this research are primary and secondary data sources and the data analysis used is qualitative. The results of this research are (1) An insurance company that is declared bankrupt or insolvent based on a Commercial Court decision, results in the company losing its civil rights to control and manage its assets since the bankruptcy decision was declared. (2) The policy holder is positioned in the group of creditors with special privileges or as a preferred creditor whose level is higher or prioritized in receiving their rights regarding the distribution of their assets. (3) The Financial Services Authority is required to ensure that the company is insolvent in order to protect more significant interests. Keyword: Bankruptcy, Insurance Company, Financial Services Authority Abstrak: Perusahaan asuransi yang berada dalam masa kritis akan memunculkan piutang bagi pemegang polis, sehingga pemegang polis berhak atas uang tersebut dan meminta kepada perusahaan asuransi untuk membayarkan utang klaim asuransi sesuai dengan polis asuransi yang telah disepakati sebelumnya. Untuk mengklaim sebuah asuransi bisa saja mendapat permasalahan, seperti halnya pihak perusahaan tidak dapat memberikan klaim asuransi sehingga dapat memunculkan utang dan memungkinkan perusahaan asuransi tersebut mengalami pailit. Bagaimana akibat hukum kepailitan terhadap perusahaan asuransi yang telah dinyatakan pailit Bagaimana kedudukan pemegang polis asuransi pada perusahaan asuransi yang telah dinyatakan pailit. Bagaimana peran Otoritas Jasa Keuangan dalam melindungi hak pemegang polis asuransi terhadap perusahaan asuransi yang telah dinyatakan pailit. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pengumpulan data studi kepustakaan. Sumber data yang digunakan dalam penelitian ini adalah sumber data primer dan sekunder dan analisis data yang digunakan bersifat kualitatif. Hasil penelitian iniadalah (1) Perusahaan asuransi yang dinyatakan bangkrut atau pailit berdasarkan putusan Pengadilan Niaga, mengakibatkan Perusahaan tersebut kehilangan hak keperdatanya untuk menguasai dan mengurus kekayaannya sejak putusan pailit dinyatakan. (2) Pemegang polis diposisikan dalam golongan kreditor dengan hak istimewa atau sebagai kreditur preferent yang tingkatannya lebih tinggi atau diutamakan dalam menerima hak-haknya atas pembagian harta kekayaannya. (3) Otoritas Jasa Keuangan diharuskan memastikan bahwasanya perusahaan tersebut memanglah dalam keadaan insolvent guna melindungi kepentingan yang lebih signifikan pula. Tanggung jawab hukum notaris terhadap akta perjanjian sewa menyewa tanah yang dilakukan dihadapannya atas dasar iktikad tidak baik. Implikasi hukum atas perjanjian sewa menyewa yang dilakukan dengan iktikad tidak baik oleh penyewa terhadap objek sewa yang juga dilakukan jual beli dengan itikad baik pada putusan Pengadilan Negeri Bangli Nomor 31/Pdt.G/2021/PN BLI. Jenis penelitian yang digunakan yuridis normatif, penelitian deskriptif analitis. Sumber data dalam penelitian yaitu data sekunder. Pengumpulan data dengan cara penelitian kepustakaan, alat pengumpul data studi dokumen. Analisis data menggunakan metode kualitatif. Kedudukan penyewa terhadap objek sewa yang dialihkan kepada pihak lain. Selama itu hak penyewa dimaksud tidak hilang sekalipun objek dialihkan kepada pihak ketiga, kecuali terjadinya pelepasan atau pembatalan perjanjian karena suatu sebab. Hukum perdata dikenal suatu kaedah yang diatur dalam Pasal 1576 KUHPerdata, yaitu Jual beli tidak memutuskan sewa menyewa. Pasal ini memberikan kedudukan yang kuat bagi penyewa dalam memanfaatkan objek sewa. Tanggung jawab hukum notaris terhadap akta perjanjian sewa menyewa tanah yang dilakukan dihadapannya atas dasar iktikad tidak baik. Sebagai pejabat publik yang memiliki kewenangan untuk membuat akta autentik, notaris memiliki tanggung jawab hukum terhadap isi dari akta tersebut. Jika notaris membuat akta tersebut meskipun mengetahui adanya iktikad tidak baik, maka notaris dapat terkena sanksi hukum. Sanksi hukum yang dapat diterapkan terhadap notaris yang membuat akta dengan iktikad tidak baik antara lain adalah pembatalan akta, tuntutan ganti rugi, dan sanksi disiplin. Implikasi hukum atas perjanjian sewa menyewa yang dilakukan dengan iktikad tidak baik oleh penyewa terhadap objek sewa yang juga dilakukan jual beli dengan itikad baik pada putusan Pengadilan Negeri Bangli Nomor 31/Pdt.G/2021/PN BLI. Jika penyewa melakukan perjanjian sewa menyewa dengan iktikad tidak baik dan kemudian melakukan tindakan yang merugikan pemilik objek sewa, maka pemilik objek sewa dapat mengajukan gugatan terhadap penyewa atas pelanggaran kontrak..

Every land dispute requires resolution, either through litigation or non-litigation. Non- litigation dispute resolution is also known as an alternative, out-of-court solution that provides legal certainty in a cost-effective, efficient, and faster manner that benefits both parties. This study discusses How to Resolve Land Disputes Owned by PT Kereta Api Indonesia Seized by the Community in a Civil Law Perspective? What are the Pros and Cons of Communities in Land Disputes with PT KAI? How is the Analysis of the Judge's Legal Considerations on the Settlement of Land Disputes Between PT.KAI and the Community (Study of Medan District Court Decision Number 300 / Pdt / G / 201/ PN.Mdn. The research method used in this study uses normative legal research. The results of this study The settlement of land disputes between PT.KAI and the community can be done first with mediation efforts before the court realm, the Government as the main regulator in railway transportation needs to facilitate dialogue between the railway (operator, management) and the community. This can be in the form of discussion forums, mediation, or even face-to-face meetings. Community Involvement: Educating the community about train operational procedures. The community also needs to be given an understanding of their responsibilities as users of train services, for example about the importance of following safety and discipline rules when at the station or on the train. Independent Supervision: The community can invited to participate in monitoring public facilities such as railway lines to reduce undesirable incidents.
