Abstract

Abstract: Adoption is a legal act in which a child is taken into a family, establishing a legal relationship between the adoptive parents and the adopted child. This study aims to examine and analyze the procedures and legal norms of adaption in Indonesia, this research employs a normative juridical approach with a descriptive-analytical method. The data used is secondary data obtained through a literature studi (document analysis). The findings indicate that the procedures and legal norms of adoption in Indonesia have evolved from customary systems to a more structured legal system involving strict legislative regulations, especially in cases of intercountry adoption. The legal status of an adopted foreign child concerning the inheritance of their adoptive parents obtained through a will, as seen in Decision No. 486/K/PDT/2020. Is subject to Indonesian inhertance law. In this case, the legal status of the adopted foreign child concerning the inhertance stated in the authentic deed was not recognized, aligning, with the court’s decision to overturn the previous high court ruling. Keyword: Adopted Child, Foreign National, Inhertance, Will Abstrak: Pengangkatan anak atau adopsi adalah perbuatan hukum yang mengambil anak orang lain ke dalam keluarga sendiri, sehingga menimbulkan hubungan hukum antara orang tua angkat dan anak angkat. Metode dalam penelitian ini menggunakan jenis penelitian yuridis normatif yang bersifat deskriptif analitis. Jenis data yang digunakan yaitu data sekunder dengan menggunakan studi kepustakaan (dokumen). Hasil penelitian ini menunjukkan bahwa Prosedur dan norma hukum pengangkatan anak di Indonesia telah berkembang dari sistem adat ke system hukum yang lebih terstruktur dan melibatkan peraturan perundang-undangan yang ketat, terutama dalam kasus adopsi oleh warga negara asing (Intercountry Adoption). Kedudukan hukum anak angkat WNA terhadap harta peninggalan orang tua angkatnya yang diperoleh berdasarkan wasiat dalam Putusan Nomor 486/K/PDT/2020 bergantung pada hukum waris Indonesia, Dalam kasus ini, kedudukan hukum anak angkat WNA terhadap harta peninggalan orang tua angkatnya yang diatur dalam akta autentik tersebut tidak diakui, sejalan dengan keputusan hakim yang membatalkan putusan pengadilan tinggi sebelumnya. Kata kunci: Anak Angkat, Warga Negara Asing, Harta Warisan, dan Wasiat

Abstract

Transfer of land rights can be done in various ways, one of which is through Transfer of Land Rights with Compensation (PHGR). Article 1338 paragraph 3 of the Civil Code states that an agreement must be carried out in good faith. Good faith when making an agreement means honesty. One of the legal issues regarding the transfer of land rights with compensation in the Medan District Court Decision Number: 275 / Pdt.G / 2020 / PN Mdn, in conjunction with the Medan High Court Decision Number: 370 / Pdt / 2021 PT MDN, in conjunction with the Supreme Court Decision Number: 4259 K / Pdt / 2022. The issues raised in this decision are: What are the legal consequences of the transfer of land rights based on the release of rights with compensation, how is the legal protection of the parties against the transfer of land rights with compensation that is transferred by borrowing a name and how is the analysis of the considerations of the Medan District Court Judge in Case Number 275 / Pdt.G / 2020 / PN Mdn in conjunction with Decision No. 370/Pdt/2021/PT MDN jo. Decision No. 4259 K/Pdt/2022. The research method used is normative juridical with a descriptive analytical approach. The data used are secondary data, including primary, secondary, and tertiary legal materials. Data collection was carried out through literature studies and interviews. The analysis was carried out qualitatively by drawing deductive conclusions to answer the research problems. The results of this study are known The legal consequences of the transfer of land rights with compensation are valid and transferred so that the recipient can use and take maximum benefits from the land they own, but this must meet the provisions of the elements of Article 1320 of the Civil Code. Legal protection for the parties against the transfer of land rights with compensation that is transferred by borrowing a name consists of 2 (two) forms, namely the first preventive legal protection is by registering the land, the second repressive legal protection through the General Court. Legal protection for holders of land rights that have not been certified in good faith as regulated in Article 24 and Article 32 of PP 24 of 1997 concerning Land Registration, namely being able to file complaints, objections and lawsuits through the court. and the Panel of Judges rejected the cassation application, while the legal consideration of the judge was that the Judex Facti Decision of the Medan High Court did not conflict with the law and/or statutes.

Abstract

Abstract: The electronic certificate program still has loopholes for abuse of authority by the government, especially for the general public who do not understand electronic certificates and also the electronic certificate program. Electronic certificates do not fulfill one of the objectives of the law, namely justice, because there are still many areas that have limited internet access. The legal basis for regulating the issuance of electronic-based certificates as the basis for proof of ownership of land rights is regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 3 of 2023 concerning the Issuance of Electronic Documents in Land Registration Activities which regulates electronic systems, electronic documents, data, databases and electronic signatures. Legal protection for holders of electronic-based land certificates in Medan City in terms of proving electronic land certificates is not a problem because electronic land certificates.Keyword: Legal Protection, Certificates, ElectronicAbstrak: Program sertifikat elektronik masih saja memiliki celah penyalahgunaan kewenangan oleh pemerintah khususnya bagi masyarakat awam yang belum memahami tentang sertifikat elektronik dan juga program sertifikat elektronik. Sertifikat elektronik tidak memenuhi salah satu tujuan hukum yakni keadilan dikarenakan masih banyak daerah yang memiliki akses internet yang terbatas. Dasar hukum pengaturan penerbitan sertifikat berbasis elektronik sebagai dasar atas bukti kepemilikan hak atas tanah diatur dalam Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 3 Tahun 2023 Tentang Penerbitan Dokumen Elektronik Dalam Kegiatan Pendaftaran Tanah yang mengatur mengenai sistem elektronik, dokumen elektronik, data, pangkalan data dan tanda tangan elektronik. Abstract

Pengasuhan anak di bawah umur (hadhanah) yang merupakan salah satu akibat dalam perceraian dalam Pasal 105 KHI menyatakan bahwa pemeliharaan anak yang belum mumayyiz atau yang belum berusia 12 (duabelas) tahun adalah hak ibu kandung. Adapun permasalahan penelitian ini yaitu: Bagaimana konsep pemberian hak asuh dalam perspektif Undang-Undang No. 35 tahun 2014 tentang Perlindungan Anak dan Kompilasi Hukum Islam? Bagaimana pertimbangan hukum hakim dalam memberikan hak asuh anak yang masih di bawah umur kepada ayah pecandu narkotika pada Putusan No. 1039/Pdt.G/2023/PA. Lpk Jo Putusan Nomor 89/Pdt.G/2023/PTA.Mdn Jo Putusan Mahkamah Agung No. 103K/Ag/2024)? dan bagaimana implikasi dari putusan hakim yang memberikan hak asuh anak di bawah umur kepada ayah pecandu narkotika? Berdasarkan hasil penelitian ditemukan bahwa konsep pemberian hak asuh dalam perspektif Undang-Undang 35 tahun 2014 tentang Perlindungan Anak fokus utamanya adalah terletak pada perlindungan hukum anak, sedangkan konsep pemberian hak asuh dalam perspektif KHI mengatur secara rinci tentang kekuasaan orang tua terhadap anak. Pertimbangan hukum hakim dalam memberikan hak asuh anak yang masih di bawah umur kepada ayah pecandu narkotika pada Putusan No. 1039/Pdt.G/2023/PA. Lpk didasarkan pada keterangan yang disampaikan oleh Tergugat dan keterangan saksi dari Tergugat yang menyatakan bahwa Penggugat seorang ibu yang bekerja dan sering bepergian keluar kota. Pertimbangan hukum hakim tersebut didasarkan juga kepada Yurisprudensi Mahkamah Agung Nomor 110K/AG/2007. Majelis hakim di tingkat banding berpendapat pertimbangan di tingkat pertama telah menyimpangi ketentuan normatif Pasal 105 huruf a KHI. Pada Putusan Mahkamah Agung No. 103K/Ag/2024, majelis hakim menolak Kasasi yang diajukan oleh Tergugat, dengan pertimbangan bahwa putusan majelis hakim dalam tingkat banding tidak bertentangan dengan hukum.

Abstract

A valid marriage under Article 2 paragraph (1) of Law Number 1 of 1974 is one conducted in accordance with religious law, provided it does not contradict the Marriage Law. However, in practice, unregistered marriages, including polygamous ones, still occur and generate significant legal consequences, particularly in divorce cases. This study aims to examine the validity of itsbat nikah (marriage validation) for unregistered polygamous marriages within Indonesia’s positive law, to analyze its position as a form of legal protection for wives in divorce proceedings, and to evaluate judicial considerations in Religious Court Decision Number 43/Pdt.G/2021/PA.Batg. Using a normative juridical approach, supported by literature review and case analysis, this research finds that the rejection of itsbat nikah in this case was legally flawed. The absence of valid evidence of the husband’s first marriage led to the neglect of the wife’s rights. Article 71 of the Compilation of Islamic Law (KHI) clearly states that itsbat nikah is designed to acknowledge marriages valid under religion, even when unregistered, rather than to legitimize unlawful polygamy. These findings highlight the need for more consistent judicial interpretation to ensure the protection of women’s rights in unregistered polygamous marriages.

Abstract

This research aims to analyze, (1) legal protection of the absolute rights of legitimate heirs in cases of gifts that violate the legitime portie; (2) legal consequences related to the cancellation of the gift deed due to violation of the absolute rights of the legitimate heirs; (3) as well as analyzing the judge's legal considerations in canceling the gift deed due to a violation of the absolute rights of the legitimate heir. The legal theories used are the theory of legal protection, legal consequences and judge's consideration. The research method used is normative juridical. The primary source of material comes from statutory regulations relating to grants, namely the KUHPerdata and Putusan Mahkamah Agung No. 2954K/Pdt/2017, while secondary data comes from books, magazines, scientific journals, articles, free articles from the internet and newspaper. The results of this research are (1) regarding the grant deed in the aquo case, the author found that there were several conditions that were not fulfilled in granting the grant, making the status of the grant deed considered legally defective and therefore null and void; (2) Because the deed of gift is null and void and causes harm to the subjective rights of other heirs, the judge's decision regarding land that cannot be divided is based on legitiieme portie to be auctioned.

Abstract

Pelaksanaan jual-beli apartemen ini dilakukan dengan cara memesan atau indent terlebih dahulu yang kemudian dituangkan dalam bentuk perikatan pendahuluan atau perikatan jual beli yang lebih dikenal dengan Perjanjian Pengikatan Jual Beli sebagai pedoman untuk mengamankan kepentingan para pihak. Rumusan masalah dalam tesis ini adalah bagaimana  perlindungan hukum terhadap pembeli yang hak dan kewajibannya tidak diikat dalam akta pengikatan perjanjian jual beli dihadapan notaris, bagaimana  perjanjian jual beli unit apartemen yang tidak dituangkan dalam akta pengikatan perjanjian jual beli dihadapan notaris, bagaimana penyelesaian sengketa antara pembeli dan developer dalam transaksi jual beli unit apartemen pada putusan Mahkamah Agung RI No 323/Pdt/2021. Penelitian dilakukan menggunakan penelitian hukum, yaitu yuridis normatif yang bersifat deskriptif analitis merupakan penelitian yang bertujuan menggambarkan suatu keadaan atau gejala atau untuk menentukan ada tidaknya hubungan antara suatu gejala dengan gejala lain. Teknik pengumpulan data digunakan adalah studi dokumen. Hasil penelitian dan pembahasan menunjukkan bahwa perlindungan hukum terhadap pembeli yang hak dan kewajibannya tidak diikat dalam akta pengikatan perjanjian jual beli dihadapan notaris adalah perlindungan hukum dalam bentuk preventif. Perjanjian tersebut dapat dijadikan suatu bentuk perlindungan hukum karena dapat menjadi suatu alat bukti dengan kekuatan pembuktian yang lemah. Perjanjian jual beli unit apartemen yang tidak dituangkan dalam akta pengikatan perjanjian jual beli dihadapan notaris mengakibatkan ketidak pastian bagi pengembang maupun pembeli.  Kekuatan hukumnya terbatas dibandingkan dengan akta otentik atau akta yang dibuat oleh notaris. Penyelesaian hukum terhadap sengketa dalam transaksi jual beli unit apartemen dalam putusan Mahkamah Agung RI Nomor 323 K/Pdt/2021 adalah berupa penggantian biaya rugi dan bunga seperti yang telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Undang-Undang Nomor 20 tahun 2011 tentang Rumah Susun dan penulis setuju dengan putusan hakim sebab perjanjian jual beli apartemen yang tidak dibuat dalam akta notaris yaitu perjanjian pemesanan sebagai wadah hukum bagi para pihak dalam melakukan hubungan hukum pengikatan jual beli berlaku mengikat bagi para pihak sehingga keterlambatan pengembang menyerahkan unit apartemen merupakan perbuatan wanprestasi.

Abstract

This study aims to analyze the judges’ legal considerations in granting child custody to a father who is a drug addict, as reflected in Decision No. 1039/Pdt.G/2023/PA.Lpk Jo No. 89/Pdt.G/2023/PTA.Mdn Jo No. 103K/Ag/2024. Using a normative juridical method with statutory and case approaches, the research focuses on examining the conformity between the Compilation of Islamic Law (KHI) and Law No. 35 of 2014 on Child Protection in relation to judicial reasoning in hadhanah (child custody) cases. The findings reveal that the Child Protection Law emphasizes legal safeguards for children, while the KHI provides detailed provisions on parental rights and responsibilities in child care. At the first level, the court granted custody to the father based on the mother’s busy work schedule, referring to Supreme Court Jurisprudence No. 110K/AG/2007. However, the appellate court ruled that such reasoning contradicted Article 105(a) of the KHI, which clearly stipulates that custody of children who are not yet mumayyiz belongs to the mother. The Supreme Court subsequently rejected the cassation appeal, affirming that the appellate decision was consistent with the law. This study underscores the importance of upholding the principle of the best interest of the child as the primary consideration in all custody determinations.

Abstract

This study examines the legal issues regarding the sale of collateral objects that are not bound by a deed of debt recognition, where in Decision No. 2811 K/Pdt/2019 there is a deed of sale and purchase issued as a guarantee of the return of rights. Through the normative legal research method, it was found that the sale of collateral objects based on a power of attorney to sell when the credit is in default is only valid if the debtor is proven to be in default and there is an agreement of the parties in accordance with Article 20 paragraphs (2) and (3) of the UUHT, while the power of attorney to sell made when the credit is binding is invalid because it is contrary to Law No. 4 of 1996 concerning Mortgage Rights and results in the cancellation of the power of attorney by law

Abstract

This study analyzes the validity of a deed of gift that eliminates the rights of heirs through a study of the Sidoarjo Religious Court Decision No. 3937/Pdt.G/2021/PA.Sda dated May 18, 2022. Using a normative legal research method with an analytical descriptive approach, this study examines three main problems: the position of the deed of gift in relation to the cancellation of the deed due to the loss of heirs' rights, legal protection for the recipient of the gift, and a legal analysis of the Sidoarjo Religious Court Decision No. 3937/Pdt.G/2021/PA.Sda. The results of the study indicate that a deed of gift that eliminates the rights of heirs does not have binding legal force and can be canceled through the Religious Court, legal protection for the recipient of the gift only applies if it does not exceed 1/3 of the assets or obtains the consent of the heirs, and the court decision in this case is considered inappropriate because it cancels 3/4 of the gift even though the recipient of the gift should still be entitled to 1/3 of the part according to the provisions of the Compilation of Islamic Law.
