Abstract

Kesehatan jasmani dan lingkungan merupakan kebutuhan dasar setiap individu, dan lingkungan yang sehat berkontribusi signifikan terhadap kesehatan fisik, sehingga kepedulian terhadap kebersihan lingkungan perlu ditanamkan sejak dini. Di Tempat Pendidikan Al-Qur’an (TPA) Desa Margo Jaya, kondisi lingkungan kurang terjaga akibat minimnya edukasi dan ketiadaan fasilitas tempat sampah, menyebabkan siswa membuang sampah sembarangan dan menciptakan lingkungan yang kotor. Menanggapi masalah ini, Kelompok KKN 397 melaksanakan pengabdian masyarakat berupa sosialisasi pentingnya menjaga lingkungan dan pengadaan tempat sampah sebagai upaya peningkatan kepedulian lingkungan. Kegiatan ini meliputi observasi, wawancara, sosialisasi kepada siswa dan pedagang, serta edukasi tentang penggunaan dan pemilahan sampah berdasarkan warna tempat sampah. Puncaknya adalah penyerahan empat unit tempat sampah kepada pengurus TPA pada tanggal 20 Agustus 2024, disertai dokumentasi kegiatan. Program ini bertujuan menumbuhkan kesadaran lingkungan pada anak-anak dan masyarakat sekitar TPA, serta mencegah penumpukan sampah yang berdampak negatif terhadap kesehatan dan kenyamanan lingkungan. Kegiatan ini terbukti efektif dalam membentuk kebiasaan peduli lingkungan dan menciptakan lingkungan belajar yang lebih bersih dan nyaman.

Abstract

Life and the harmony of Muslim households cannot be separated from the name of the income. A mandatory income because of the legitimate contract, the surrender of the wife to the husband. The living is only required for a husband because of the demands of the marriage contract and because of the sustainability of fun as the wife must obey her husband, always accompanying it, regulating the household, educating her children. Having is the main responsibility of a husband and his wife's main right. If given to the wife with a chest, without the slightest element of the master, it is the main contribution that can bring the balance and happiness of households. However, in practice, not a few husbands who did not provide a living wife and child. There are also some husbands even if their husbands provide a living in accordance with household welfare standards. Based on the phenomenon it is necessary to research and analyze the standard of living husband to wife in the perspective of the philosophy of Islamic law law. This research concludes the legal income is mandatory. The fulfillment of the living that becomes shopping is in the form of basic needs, such as eating, residence, education and others. Regarding the levels or size of the income that must be met by parents to children or husbands there is nothing certain, because it must be seen from the ability of the livelihood. In terms of philosophical, husband's obligations provide for a wife having great wisdom. When becoming a wife, the wife is shackled with marriage and has an obligation to obey her husband. Abstract

This article describes the istihsan method and examples of its application in several cases of shari'ah economic law. The approach used is an ontological, epistemological and axiological based philosophical approach which discusses the nature of istihsan, the principles of istihsan, the method of application and the impact of the istihsan method. The research method used is qualitative library research with a descriptive pattern and making the polautturats al-mu'tabaraoh as the main reference. The istihsan method was first introduced by Imam Abu Hanifah (d.767 AD) as the first absolute mujtahid imam among Muslims who managed to explore direct laws from the Al-Qur'an and Hadith. The istihsan method is basically a mujtahid with a good view of a reason in determining the legal status of a new case that has not been concretely stated in the law in the texts of the Qur'an and Hadith. In the next phase, the istihsan method received criticism from other madhab priests such as Imam Syafi'i.  However, this criticism is actually just a difference of opinion in defining the istihsan in question, which in essence there is no substantial difference between them. Istihsan is widely felt in Hanafiyah fiqh texts such as in the book of al-Mabsuth by as-sarkhasi (w.483 H). In this contemporary era, istisan is very relevant to be used, especially in determining the legal status of new cases that cannot be solved using the ushul figih method of the Syafi'iyah madhab or other schools of thought.Keywords :Istihsan, Kutubut Turats, Hanafiyah Madhab

Abstract

Growth and economic development are very closely related. Economic growth is an important indicator in carrying out economic development in a country. Some economists pay special attention to capital as one of the factors that influence economic growth. One of the efforts that can be made by the government in encouraging economic growth is to seek capital or sources of financing, one of which is through investment both domestically and abroad. Like other developing countries, Indonesia relies heavily on investment to support the financing of its economic development, both through foreign and domestic investment. Islam strongly recommends investment from both a non-economic and an economic point of view. Viewed from an economic point of view, investment is a commitment to sacrifice funds in a definite amount at the present time to gain the profits in future, of course, with the guidance of the Shari'a. Investment activities are part of Muamalah activities that are permissible unless there is an implication of the argument from the Qur'an and al-Hadith which prohibits it either explicitly or implicitly.Keywords: Investment, Development Islamic Economics, and Economic Growth

Abstract

This study examines the comparative mechanisms of halal certification between Indonesia and Malaysia from the perspective of Sharia economic law. The aim of this research is to analyze the differences and similarities in the halal certification procedures applied in both countries, as well as the legal and economic implications arising from these differences. The research method utilized is a qualitative approach with a literature review technique, where secondary data is obtained from literature, regulations, and documents related to halal certification. The analysis involves examining government policies, certification bodies, and the role of Sharia economic law in promoting the implementation of halal standards. The findings reveal that both countries have a strong Sharia legal foundation for halal certification, yet there are significant differences in implementation and standards. In Indonesia, halal certification is managed by the Halal Product Assurance Agency (BPJPH) with oversight from the Indonesian Ulema Council (MUI). In contrast, Malaysia's halal certification is handled by the Department of Islamic Development Malaysia (JAKIM), which possesses full authority and employs a more centralized and integrated approach. The economic implications of these differences include variations in certification costs, processing times, and consumer trust in halal labels. Based on the perspective of Islamic economic law, this study finds that halal certification is not merely an administrative process but a component of implementing sharia principles in the economy, including: the Principle of Justice, Social Responsibility, Consumer Protection, and Market Integrity.Keywords: Halal certification, Indonesia, Malaysia, Sharia economic law, halal industry

Abstract

This research aims to determine and analyze the handling of the COVID-19 pandemic in Lampung Province and West Java from the perspective of maqāshid sharīa. Given that the pandemic has a wide impact on society, its handling must be comprehensive. This research method uses a qualitative method with an ethnographic approach. The data was obtained from the Lampung and West Java Provincial Governments, namely from the Regional Secretary and members of the DPRD. The data analysis uses interactive analysis and concept analysis. This study found that to handle the COVID-19 pandemic, the Lampung and West Java Provincial Governments have made several policies, including regional and gubernatorial regulations. The policy is intended to limit the worship and economic activities of the community. From the perspective of maqāshid sharia, restrictions on worship and economic activities are part of protecting the human soul (hifdz al-nafs) as the highest protection or value before wealth (hifdz al-māl) and even religion (hifdz al-dīn). With this handling, the rate of the virus spread can be prevented so that more human lives can be saved

Abstract

Mut 'ah marriage has been a controversial model of marriage and its validity is still a debate between sunnis and Syiah down to this day.The study is classified in the library or library research that USES the judicial approach method.The study concluded that there was no fuqaha difference of opinion among Ahlu Sunnah and Shia about the mut 'marriage performance during the time of god's messenger PBUH. But then mut 'ah's marriage became an effort among them. According to fuqaha ahluu sunnah that mut's marriage is a illegitimate law (haram) in the era after the prophet has until now even until the end of days, just as the prophet has kept him for six different occasions.While fuqaha shia shi 'ah imamiyah allows mut'ah marriage on the ground that there is not a single verse that does not forbid mut 'ah marriage and is fine men out of the safar state, however well as the muqim, and mut 'ah marriage laws are still legal. Although in recent times, some peoples of the Shia would gave opinion, not all those halal must be executed.

Abstract

Operasi caesar adalah suatu cara melahirkan janin dengan membuat sayatan pada dinding uterus melalui dinding depan perut untuk mengeluarkan janin dari dalam rahim. Operasi caesar sekarang dilakukan bukan hanya untuk menyelamatkan ibu maupun janin saja tetapi juga untuk memenuhi keinginan pribadi seseorang. Untuk itu, perlu melihat lebih dalam bagaimana hukum Operasi Caesar tersebut. Penelitian ini dilakukan di Rumah Sakit Umum Daerah Abdul Moeloek, dengan sumber data diperoleh secara langusng dari narasumber melalui wawancara. Analisis maqashid asy-syari’ah terhadap kelahiran melalui operasi caesar di RSUD Abdul Moeloek dengan alasan darurat termasuk maqashid asy-syari’ah yang menempati hifz al-nafs atau memelihara jiwa pada tingkatan dharuriyyat dan dihukumi wajib yang mana jika tidak dilakukan operasi caesar akan menimbulkan kematian bagi si ibu atau bayinya, sedangkan untuk menjaga vaginanya agar tetap rapat termasuk maqashid asy-syariah pada tingkatan hajiyyat dan dihukumi sunnah yang mana tujuannya benar-benar untuk menjaga vagina demi menyenangkan suami dan terjaganya rumah tangga, dan memilih tanggal cantik termasuk maqashid asy-syari’ah pada tingkatan tahsiniyat dan dihukumi boleh jika alasan memilih tanggal cantik tersebut dengan harapan sebagai pembawa kebahagiaan ataupun keberkahan.

Abstract

DPRD has a strategic position in the development of an area. Because, the people's representative institution has three inherent functions, namely the function of making local regulations (legislation), supervision (controlling) and budget function (bugeting). However, the reality of the implementation of the dprd function is still not optimal. This is due to the incomprehension of legislators in describing legislation, even more extreme, the existence of the function is not to assist local governments in carrying out government duties but rather as a tool for personal and party interests. This writing uses normative juridical research methods, where the author uses laws, journal articles, books and documents that support in discussing the issue of optimizing the tasks and functions of dprd members in realizing clean government. This study concluded, good governance can be done by optimizing and improving the quality of dprd members by improving the quality and understanding of DPRD members to their duties and functions. The fruit of quality improvement can be measured by how much the role of the DPRD in terms of partnership with executive institutions in making local regulations, drafting budgets, and in monitoring the course of government.

Abstract

The implementation of social welfare and religious services for the elderly, in practice, involves various activities that must align with their religious beliefs. Ogan Komering Ulu Timur Regency in South Sumatra, as the implementing unit represented by the Department of Social Affairs, has the responsibility to identify the religious and spiritual needs of the elderly through planning, supervision, and the execution of religious and spiritual programs. This research aims to analyze the implementation of Article 6 of Government Regulation Number 43 of 2004 regarding the Implementation of Efforts to Improve the Social Welfare of the Elderly from the perspective of fiqh Siyāsah tanfidziyah in Ogan Komering Ulu Timur Regency, South Sumatra. The research method employed is field research, conducted by collecting data from the research location. The results indicate that the Department of Social Affairs has fulfilled its duty as the responsible government body by implementing various efforts to fulfill the spiritual needs of the elderly, although not entirely maximized due to several challenges. These challenges include the need for a deeper focus on individual religious preferences, the enhancement of religious program variations, and the search for solutions to overcome limited available resources. From the perspective of Siyāsah tanfidziyah, the government and stakeholders can ensure that religious and spiritual mental services for the elderly truly contribute to improved social welfare, as emphasized by the Quranic verse Q.S An-Nissa 58, underlining the importance of safeguarding trust and establishing fair laws.
