Abstract

This research aims to explore the perspectives on consanguineous marriage in the context of Islamic jurisprudence (usul fiqh) and Islamic family law. Research adopts a comparative and descriptive approach, gathering primary data through in-depth interviews with experts in Islamic jurisprudence and Islamic family law. The findings reveal that consanguineous marriage is firmly grounded in Islamic law, with its theological basis found in the Quran and Hadith, which unequivocally prohibit it. However, variations exist in the interpretation and emphasis between usul fiqh and Islamic family law perspectives. Social and cultural factors influence the occurrence of consanguineous marriages, with differing community understandings in Kota Padang being a key factor in disparate viewpoints. Despite these distinctions, there are commonalities, such as the prohibition of consanguineous marriage, the reliance on the Quran and Hadith as legal foundations, and the acknowledgment of negative consequences by both perspectives. Lastly, the legal principles underpinning these views in both fields center on concepts such as maslahah (public interest), maqasid syariah (objectives of Islamic law), and ta'addud al-asbab (consideration of circumstances), all aimed at safeguarding the welfare of humanity. While emphasis may differ, these principles serve as guiding frameworks for understanding the phenomenon of consanguineous marriage in Kota Padang

Abstract

The occurrence of reunions has been recognized as a contributing reason to the increasing divorce rates in Padang City, with evidence of infidelity frequently associated with these gatherings. This paper examines the research gap about the function of reunions in divorce proceedings within the Religious Court jurisdiction of Padang City. The main aim is to investigate the impact of Islamic legal principles on divorce cases prompted by considerations connected to reunion. The study use a descriptive qualitative methodology to collect empirical data from real-world examples for comprehensive examination. This research distinctly emphasizes the convergence of social activities, such reunions, with legal and theological contexts, providing innovative insights into their role in marital strife. The results suggest that reunions may serve as a catalyst for marital breakdown, especially when preexisting relational difficulties are present. Court proceedings frequently exhibit elevated emotional tension, with judges and legal practitioners crucially responsible for upholding civility. Mediation efforts are often impeded by mistrust arising from reunion situations. Nonetheless, the application of Islamic law principles, including the prevention of harm and the promotion of justice, provides fair resolutions for both parties while striving to uphold the sanctity of marriage when possible. This research enhances the debate by recognizing reunions as a distinct and consequential social catalyst in divorce cases and suggesting Islamic legal strategies to alleviate their effects. These findings offer a novel viewpoint for policymakers and legal professionals to tackle rising issues in family law.

Abstract

MPW is an institution established by Muhammadiyah to manage Waqf. Although its role in supporting the welfare of the community in Padang City, its actual economic impact requires further investigation, making it an interesting topic for research. This study aims to analyse the role of MPW in optimising productive Waqf to support the local economy. Using a qualitative case study approach, primary data was collected through in-depth interviews with regional executives and three Waqf beneficiaries. Secondary data was obtained from a review of relevant literature. The findings highlight several key points. With regard to the achievement of objectives, the economic impact on beneficiaries remains limited, and full economic independence has not yet been achieved. This requires a strategic shift from direct assistance towards empowerment through entrepreneurship training, small business mentoring, and results-based evaluation. In terms of integration, the low participation of beneficiaries in planning and evaluation, coupled with one-way communication, highlights the need for two-way communication forums, greater involvement of beneficiaries, and synergy with Islamic financial institutions to increase inclusiveness. Finally, in terms of adaptation, challenges in adjusting to local needs, ensuring transparency, and guaranteeing sustainability require solutions such as publishing open reports, developing programmes based on local needs, and involving relevant stakeholders.

Abstract

This research aims to explore the development and transformation of Muhammadiyah thought from puritanism to cosmopolitanism. This research uses a qualitative method with a library research model. The source of data for this research is by searching for books and scientific articles in online journals with the help of the Publish or Perish application and Google Scholar. After the data is found, it is filtered and classified according to the theme discussed. Furthermore, the author will present the results of the research in the form of narratives and graphs, making it easier to understand the discussion. The results of this research can be concluded, that Muhammadiyah as a modernist Islamic movement, is rooted in the spirit of puritanism which emphasises the purification of Islamic teachings based on sacred texts and practices of the salaf generation. Over time, the organisation underwent a transformation towards cosmopolitanism, which integrates inclusive, adaptive, and universal values. This shift was influenced by globalisation, the dynamics of science, and contextual needs, which encouraged Muhammadiyah to combine puritanism with tajdid (renewal). Through the concept of Islam Berkemajuan, Muhammadiyah carries the vision of universal humanitarian solidarity, dialogue between civilizations, and active participation in global issues. This transformation reflects a shift from a doctrine-based movement to one that contributes significantly to the welfare of humanity, maintaining relevance at the national level, while expanding its influence on the global stage.
