Abstract

Human rights are a set of rights inherent in every human being as a creature of God Almighty and are His gift which must be respected and upheld, and protected by the state, law, government and every person for the sake of honor and protection of human dignity. Protection of human rights is a very crucial and important foundation for creating a just, peaceful and civilized society. In this case, law has an important role in becoming an instrument that can become the basis for creating protection and guarantees for the rights of every human being. This research was conducted with the aim of finding out how human rights protection is carried out in the context of implementing Article 3 of Law no. 39 of 1999 concerning Human Rights. The method used in this research is the literature study research method. This research produces insight into how the state carries out and provides protection for human rights.

Abstract

This research is entitled "The Urgency of the Effectiveness of the Job Creation Law on the Scope of MSMEs in Economic Disparities" and the aim of this research is to examine improvements or obstacles in business scale, market access and competitiveness as well as finding out changes to employment regulations in the Copyright Law Work influences the protection of labor rights in MSMEs and knowing the concrete efforts in the law to improve the skills and competencies of MSMEs to be more competitive in the market, it is hoped that this research will be the basis for understanding the urgency of the effectiveness of the work copyright law on the scope of MSMEs in theoretical economic inequality.

Abstract

Tujuan dari Penulisan Artikel ini adalah untuk mengetahui dan mendeksripsikan isu tentang apa itu judi online, bentuk bentuk judi online dan resiko dalam melakukan judi online, mengetahui bagaimana masyarakat dapat dengan mudahnya mengakses judi online dari media elektronik yang di punya, mengetahui sudah sejauh mana UU ITE dalam menangani kasus judi online yang lagi marak di indonesia, sebagai berita informasi, pembaca dapat mengerti Undang-Undang ITE yang berlaku di Indonesia, kegunaan penelitian ini secara sosial di gunakan untuk pemecahan masalah yang terjadi di masyarakat dengan memahami hukuman dan sanksi yang terjadi Ketika melakukan kejahatan judi online. Adapun penelitian ini, menggunakan Metode pendekatan yuridis normatif. Pendekatan yuridis normatif, yaitu penelitian hukum melalui bahan kepustakaan (library research). Perjudian adalah sutau tindakan yang tentu melanggar hukum, yang dilakukan oleh orang dewasa maupun anak remaja. subjek perjudian tidak hanya melanggar hukum, tetapi juga melanggar tata krama, nilai dan norma yang berlaku di masyarakat. Perjudian online yang sedang marak terjadi di lingkungan masyarakat karena perkembangan IPTEK. Salah satu bentuk atau jenis judi yang akan di kaji lebih lanjut mewakili judi online adalah slot online. Penegakan hukum Tindak Pidana Perjudian Online dalam UU ITE Khusus mengenai judi online diatur dalam BAB VII Pasal 27 ayat (2) dan UU ITE dalam Pasal 303, Pasal 303 bis KUHP Pasal 2 ayat(1), (2), (3) UU No. 7 Tahun 1974 tentang Penerbitan Perjudian, serta Pasal 27 ayat 2 jo. Pasal 45 ayat 2 UU ITE.

Abstract

This research aims to determine the performance of the North Tapanuli National Land Agency in realizing the Complete Systematic Land Registration program based on the regulations of the Minister of Agaria and Spatial Planning Number 6 of 2018 and to examine the factors that influence the National Land Agency in realizing the Complete Systematic Land Registration program in North Tapanuli Regency. . This research is empirical juridical legal research. The research method used in this research is qualitative using a descriptive approach. Data collection was carried out using primary data and secondary data. Primary data was obtained through interviews, documentation and observation. The data obtained was obtained through books, journals and articles that were relevant to the topic studied. The results of this research show that the performance of the National Land Agency in realizing the Complete Systematic Land Registration program based on Minister of Agrarian and Spatial Planning Regulation Number 6 of 2018 in North Tapanuli Regency has gone well and shown satisfactory results in various performance indicators such as productivity, service quality, responsibility, responsibility, and accountability. The factors that influence the National Land Agency in realizing a complete Land System Registration are, the commitment of the central and regional governments, adequate budget allocation, policies that support legal certainty and technical support and professionalism during implementation. Inhibiting factors in realizing the Complete Systematic Land Registration program are less than optimal community participation, differences and incomplete documents, complexity of customary land ownership, geographical constraints and limited human resources.

Abstract

This study aims to find out the application of the principle of diversion in the cases of children of criminal offenders in the Medan District Court, as well as to find out the obstacles and obstacles faced in its application. This study uses a normative-empirical legal approach with qualitative methods and case studies. The results of the study show that the principle of diversion is applied to provide optimal legal protection for children involved in criminal acts. Diversion is implemented from the investigation stage to the court, with a focus on shifting case resolution from the formal path to a more humane and rehabilitation-based restorative approach. Factors that contribute to the application of diversion include the type of crime, the involvement of the victim's family in mediation, and the willingness of all parties to reach a peace agreement. Diversion is easier to apply to misdemeanors, while more serious cases often face obstacles in reaching an agreement.

Abstract

AbstractThe teacher is the most important factor in the field of education, because the teacher is the driving force of education for students in achieving educational goals. If there is a managerial role from the leader, the teacher will be able to teach the school the best. Therefore, the principal must be able to motivate teachers to improve teacher performance. This article aims to determine the performance of OCB (Organizational Citizenship Behavior) in teacher leadership and integrity. This article uses the literature study method. Therefore, the principal must be able to stimulate teachers to improve their performance. The method used is descriptive analysis. __________ AbstrakGuru adalah faktor yang terpenting dalam bidang pendidikan, karena guru adalah penggerak pendidikan bagi siswa mencapai tujuan pendidikan. Dalam hal peran manajerial dari pemimpin maka guru akan mampu melakukan pengajaran yang terbaik sekolah. Oleh karena itu, kepala sekolah harus mampu memotivasi guru dalam meningkatkan kinerja guru. Artikel ini bertujuan untuk mengetahui kinerja perilaku kewargaan organisasi dalam kepemimpinan dan integritas guru. Artikel ini menggunakan metode studi kepustakaan. Karena itu, kepala sekolah harus bisa merangsang guru untuk meningkatkan kinerjanya.

Abstract

Hoaxes about chemicals in food have spread in society and have caused misinformation that has a negative impact on food safety. Many natural and added chemicals in food are considered dangerous without strong scientific evidence. This community service aims to educate students at SMA Negeri 1 Percut Sei Tuan about the safety and dangers of chemicals in food using the educational application "Chemical Quest". This application integrates an interactive game approach that makes it easier for students to understand facts and myths related to chemicals in food. Service methods include initial presentations, application use, and evaluation through pre-tests and post-tests. The results show an increase in students' understanding in detecting hoaxes and their ability to think critically regarding food safety issues. This article also discusses the effectiveness of gamification in increasing scientific literacy among students.

Abstract

A diploma is a letter of completion of study given to students who have successfully completed and taken a certain level of education. The levels of education are Elementary School (SD), Middle School (SMP), High School (SMA), and College. This diploma is used for various needs, one of which is to find work. However, along with the development of technology, many frauds have arisen such as forgery and the use of fake diplomas. Using a fake diploma is clearly a criminal offense because it is regulated in law. There are many types of misuse of fake diplomas in Indonesia that have been revealed and those that have not yet been revealed. This research aims to find out how the case sat and the basis for the judge's considerations in decision Number 1583/Pid.Sus/2021/PT. MDN. This research uses a type of normative juridical research using secondary data sources. Data collection techniques in research use library research. In normative juridical research, library research is used to collect legal materials or secondary data. The results of the research show that the judge in handing down a criminal decision against the defendant Suhardi, whose decision strengthened the Sei Rempah District Court Decision No. 328/Pid.Sus/2021/PN Srh because it has fulfilled the elements in article 69 of Law no. 20 of 2003 concerning the National Education System. The considerations in handing down this decision are correct, which can be seen from the public prosecutor's demands, the indictment, the public prosecutor's demands, the evidence at trial based on evidence, and the appeal file.

Abstract

Penelitian ini bertujuan untuk memahami bagaimana masyarakat pinggiran Sungai Deli memandang kewarganegaraan ekologis berdasarkan Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup. Metode yang digunakan adalah deskriptif kualitatif dengan pendekatan studi kasus. Data dikumpulkan melalui sumber primer dan sekunder. Data primer diperoleh dari wawancara, dokumentasi, dan observasi, sedangkan data sekunder berasal dari buku, jurnal, dan artikel yang relevan dengan topik penelitian. Penelitian ini menggunakan teknik purposive sampling untuk memilih sampel. Informan penelitian adalah masyarakat pinggiran Sungai Deli berjumlah 10 orang. Hasil penelitian menunjukkan bahwa Tingkat kewarganegaraan ekologis masih rendah di kalangan masyarakat pinggiran Sungai Deli. Kewarganegaraan ekologis belum sepenuhnya dipahami dan diterapkan oleh masyarakat setempat, Mayoritas masyarakat beranggapan bahwa tindakan membuang sampah pada tempatnya sudah cukup sebagai bentuk partisipasi dalam pengelolaan lingkungan hidup. Kesenjangan antara masyarakat yang peduli terhadap lingkungan dan yang tidak peduli masih terlihat jelas. Dilihat dari masih banyak masyarakat yang tidak terlibat dalam kegiatan pengelolaan lingkungan hidup di sekitar Sungai Deli. Hambatan dan kendala partisipasi masyarakat dalam perlindungan dan pengelolaan lingkungan hidup di wilayah pinggiran Sungai Deli mencakup berbagai faktor, termasuk keterbatasan fasilitas, keterbatasan waktu, serta kurangnya informasi dan edukasi mengenai lingkungan hidup.

Abstract

This study aims to examine the juridical review of hospital accountability in providing healthcare services to general patients and BPJS users, focusing on RSUD H. Abdul Manan Simatupang Kisaran. The research employs a qualitative descriptive method with an empirical juridical approach. Data collection involves primary data obtained through observations, interviews, and documentation, as well as secondary data sourced from relevant books, journals, and articles. The research subjects include the Public Relations department of RSUD, medical staff, general patients, and BPJS users, selected through purposive sampling. Data analysis techniques include data reduction, data presentation, and conclusion drawing. The findings indicate that the hospital's accountability in delivering healthcare services to both general patients and BPJS users encompasses the responsibility to provide quality, safe, comprehensive, non-discriminatory services, and to protect all patients. As a legal entity, the hospital must bear legal consequences for actions or negligence by itself or its healthcare personnel. The differences in treatment between general patients and BPJS users are primarily related to administrative procedures rather than the quality of medical services. These differences are influenced by factors such as inadequate communication from medical staff to BPJS patients, limited understanding of BPJS participants regarding required procedures, and insufficient dissemination of information about BPJS service procedures.
