Abstract

Meaningful participation in law formation is a crucial aspect of a democratic country. The existence of this participation not only reflects the voice of the people but also increases the legitimacy of the resulting law. A legislative process that involves the community can create rules that are more responsive and in line with community needs. In this context, this research discusses meaningful participation practices in Indonesia, South Africa, and the United States. Each country has different approaches and mechanisms for involving the public in the legislative process. The research method used is normative legal research with a statutory approach and a comparative legal approach. Through this approach, the study analyzes the laws and regulations governing public participation and identifies best practices from each country. The research results show that South Africa implements an effective public consultation system, where the public can provide direct input in the discussion of draft laws. Meanwhile, the United States has a structured participation mechanism, including public hearings and gathering input from various stakeholders, thereby creating a space for constructive dialogue between policymakers and the public. On the other hand, Indonesia still faces challenges in ensuring meaningful participation, despite efforts through public discussion mechanisms. These findings suggest the need to improve participation mechanisms in Indonesia to optimize the quality of democracy and legal legitimacy. Apart from that, support from the government and society is needed to create a stronger culture of participation, so that every individual feels they have a role in the legislative process. In this way, it is hoped that the resulting law will not be just a formality, but wil.Keywords:Meaningfull Participation; Legislation; Law Making; Democratic.

Abstract

In the Employment Law is not found that the Government may appoint civil servants Candidate (employess) derived from Honorary Workers but then with Government Regulation No. 48 Year 2005 About Appointment of Honorary Workers Being employess has set a policy that the Government may appoint honorary be employess and then amended by Government Regulation No. 43 of 2007 On Amendment of Government Regulation No. 48 Year 2005 concerning the appointment of Honorary Workers Being employess. This study aims to assess the presence of Honorary Workers in the perspective of Employment Law and Legal Implications Power Honorary appointment into employess. This type of research is normative and descriptive analytical study the rules or norms of positive law, relating to the Government's policy to raise the Honorary Workers be employess. The results of this study found that the appointment of Honorary Workers become employess more viscous aspects of public policy rather than juridical aspects. But public policy is then given a legal basis in the form of Government Regulation. Legal implications of the appointment of Honorary be employess conflict between Employment Law with Government Regulations governing, so that under the principles of law should be a higher Regulations beat / disregard the underlying Regulation and this may mean that the implications of the appointment of Honorary Workers into the civil servant is not valid in terms of Legal Aspects

Abstract

Motivation is crucial in education, driving the learning process. Cooperative Problem-Based Learning (CPBL), an extension of Problem-Based Learning (PBL), enhances critical thinking and student motivation, especially in mechanical engineering education. However, research on CPBL’s motivational impact is limited. The MUSIC Model—comprising Empowerment, Usefulness, Success, Interest, and Caring—provides a framework to boost motivation. This study examines the synergy between CPBL and the MUSIC Model in mechanical engineering education. A mixed-method approach with a Sequential Explanatory design was used, involving students from a public university in Surakarta, Indonesia, enrolled in a sustainability-related course. Quantitative data were collected through MUSIC-based questionnaires, and qualitative data were obtained from semi-structured interviews. Descriptive statistics (SPSS) and the Miles & Huberman method analyzed the data. Results show that 60-90% of students report very high motivation across all components. The study suggests CPBL fosters motivation and develops essential 21st-century skills, preparing students for future challenges.

Abstract

Pharmaceutical Chemical Substances (BKO) are chemicals added to traditional medicines to enhance their efficacy and accelerate healing. A 2015 BPOM (Indonesian Food and Drug Authority) report found 54 traditional medicine products containing BKO circulating in digital markets, posing potential risks such as liver and kidney damage. This study examines the legal protection of consumers against traditional medicines with BKO in digital markets and evaluates BPOM's role in prevention. The research uses a normative juridical method with a statute approach, analyzing secondary data qualitatively. Findings show that consumer protection for traditional medicines with BKO in digital markets is regulated under Law No. 8 of 1999 concerning Consumer Protection (UUPK), particularly Article 19, which prohibits businesses from making false or misleading claims. The Electronic Information and Transactions Law (UU ITE) also applies, particularly Article 9, requiring full disclosure to consumers regarding the substances, approval, form, efficacy, and side effects of the medicine. Sanctions for businesses selling traditional medicines with BKO in online markets can be imposed to protect consumer rights. Consumers are entitled to legal protection for purchasing traditional medicines not registered with BPOM. Articles 60 to 63 of the UUPK specify administrative and criminal sanctions, with Article 60 outlining administrative sanctions and Articles 61 and 62 detailing criminal penalties. BPOM issued Regulation No. 8 of 2020 to supervise online food and drug distribution, aiming to prevent the circulation of traditional medicines with BKO. BPOM Regulation No. 14 of 2024 revokes the previous regulation, expands commodity coverage, and clarifies procedures for monitoring and withdrawing illegal products based on online verification

Abstract

The enactment of Law Number 13 of 2022, concerning the Second Amendment to Law Number 12 of 2011 on the Establishment of Legislation, is a follow-up to Constitutional Court Decision No. 91/PUU-XVIII/2020 regarding the formal review of Law Number 11 of 2020 on Job Creation. However, during its formation process, Law Number 13 of 2022 can be considered as not meeting the criteria of an open cumulative law due to the Constitutional Court's decision. It is viewed as a tool to legitimize the flawed legislative process that followed the Court's ruling on Law Number 11 of 2020. The method used in this analysis is normative juridical, applying a statutory approach. The results of this research indicate that the reconstruction of substantive content using the omnibus law method in Law Number 13 of 2022 does not align with regulatory governance in Indonesia, which remains characterized by overlapping regulations—both horizontally and vertically—and is irrelevant to the existing decentralization system. The establishment of a National Regulatory Agency (BRN) is proposed as a constructive solution to ensure that the quality of academic drafts, methods, and regulatory content is thoroughly examined for feasibility, thereby creating a national regulatory system that is high quality, orderly, and optimal.

Abstract

Restorative Justice, sebagai landasan utama penanganan kejahatan, mementingkan pemulihan korban melalui kompensasi, perdamaian, dan tindakan sosial antara pelaku dan korban. Dalam era globalisasi ekonomi dan teknologi, produksi massal meningkat, menuntut penanganan multilateral atas Hak Kekayaan Intelektual (HKI). Tulisan ini mengeksplorasi penerapan konsep Restorative Justice dalam konteks tindak pidana HKI, mengamati pertimbangan filosofis, definisi, dan derivasi konsep tersebut. Penelitian ini menggunakan pendekatan perundang-undangan dan konseptual untuk menganalisis isu-isu yang muncul, khususnya dalam kaitannya dengan Tindak Pidana HKI. Konsep Restorative Justice mungkin memiliki keterbatasan dalam menangani tindak pidana HKI yang didorong oleh motif keuntungan ekonomi. Oleh karena itu, diperlukan pendekatan hukum yang holistik, menggabungkan restorasi, sanksi hukum efektif, dan penegakan hukum untuk mencapai tujuan perlindungan dan pencegahan yang seimbang. Pencegahan dan penegakan hukum menjadi krusial dalam tindak pidana HKI, di mana Restorative Justice mungkin tidak memberikan insentif cukup untuk mencegah pelanggaran efektif, mengingat motif finansial pelaku. Selain itu, perlindungan HKI melibatkan tidak hanya kepentingan individu tetapi juga kepentingan publik, seperti mendorong inovasi. Oleh karena itu, sanksi yang diterapkan harus tidak hanya memulihkan hubungan pelaku dan korban tetapi juga memperkuat perlindungan kepentingan publik dalam konteks inovasi dan kreativitas

Abstract

Dewasa ini pertanggungjawaban pidana korporasi dalam tindak pidana ekonomi sudah semakin rumit dikarenakan perkembangan hukum dan ekonomi. Korporasi sebagai entitas hukum tidak hanya berperan dalam pembangunan ekonomi, tetapi juga dapat menjadi subjek tindak pidana yang merugikan negara dan masyarakat. Meskipun regulasi mengenai pertanggungjawaban pidana korporasi telah berkembang di Indonesia, masih terdapat berbagai hambatan dalam penerapannya, terutama terkait dengan konsep mens rea dan actus reus dalam pemidanaan terhadap korporasi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan konseptual dan Undang-Undang. Pendekatan konseptual digunakan untuk mengkaji teori-teori hukum mengenai pertanggungjawaban pidana korporasi, termasuk doktrin vicarious liability dan identification doctrine, yang menjadi dasar penjatuhan sanksi terhadap korporasi. Sementara itu, pendekatan Undang-Undang digunakan untuk menganalisis kebijakan hukum yang diterapkan dalam sistem peradilan pidana ekonomi di Indonesia. Hasil penelitian menunjukkan bahwa masih terdapat ketidakkonsistenan dalam regulasi pertanggungjawaban pidana korporasi, terutama dalam menentukan subjek yang bertanggung jawab serta mekanisme penegakan hukumnya. Selain itu, penelitian ini mengidentifikasi tiga model pertanggungjawaban pidana korporasi yang diterapkan dalam berbagai undang-undang di Indonesia, yang mencerminkan pergeseran dari strict vicarious liability menuju pendekatan identifikasi yang lebih mempertimbangkan peran individu dalam korporasi. Kesimpulan dari penelitian ini menekankan perlunya harmonisasi regulasi mengenai pertanggungjawaban pidana korporasi dalam tindak pidana ekonomi. Diperlukan penyempurnaan dalam sistem hukum pidana untuk memastikan bahwa korporasi sebagai entitas hukum tidak dapat menghindari tanggung jawab atas tindak pidana yang dilakukan oleh pengurusnya. Reformasi hukum yang lebih jelas dan terstruktur diharapkan dapat meningkatkan efektivitas penegakan hukum serta memberikan kepastian hukum dalam kasus tindak pidana ekonomi yang melibatkan korporasi

Abstract

The ultra petitum partiumis a principle that doesn’t allow judge to make verdicts on unrequested or over-demanding cases. In divorcement cases, ithas limited the authority of the judge in giving verdicts to grant women's rights. The existence of a Supreme Court Circular Letter (SEMA) on number 3 of 2018 strengthened by PERMA on number 3 of 2017 concerning The Guidelines for Prosecuting Women Facing the Law opens a gap for judges to consider this principle. The type of this research is empirical legal research. The data obtained through field research and qualitative descriptive. The primary data sources in this study were collected through observations, and judges interview in the Metro Religious Courts. The secondary data sources are acquired from library (legislation and certain related books). The data analysis method conducted in 3 stages, 1. Collecting the data, 2.Restating the statement, and 3. Connecting the datawith existed theories. The results shows that the Metro Religious Court Judges still override the existence of a Supreme Court Circular (SEMA) number 3 of 2018 because it is only limited to the formulation of rooms that are not binding as legislations. It is may also be applied or ignored.

Abstract

Artikel ini membahas problematika kriminalisasi aborsi dalam KUHP Nasional dari perspektif hak asasi perempuan. Meskipun KUHP 2023 telah memberikan ruang pengecualian terbatas terhadap tindakan aborsi, seperti dalam kasus kedaruratan medis dan kehamilan akibat perkosaan, ketentuan tersebut belum cukup menjamin perlindungan terhadap hak atas kesehatan dan otonomi tubuh perempuan. Dengan menggunakan pendekatan yuridis normatif, artikel ini mengkaji ketidaksesuaian antara ketentuan hukum pidana tentang aborsi dan prinsip-prinsip hak asasi manusia, terutama prinsip non-diskriminasi dan keadilan substantif. Penelitian ini menunjukkan bahwa kriminalisasi aborsi menciptakan hambatan struktural dan psikologis bagi perempuan dalam mengakses layanan kesehatan reproduksi yang aman dan legal. Artikel ini merekomendasikan perlunya evaluasi dan reformasi hukum pidana yang lebih responsif terhadap kebutuhan dan kerentanan perempuan, sejalan dengan komitmen konstitusional dan instrumen HAM internasional

Abstract

Kekerasan psikis digital seperti cyberbullying dan persekusi digital telah menjadi ancaman serius dalam kehidupan masyarakat modern. Meskipun Indonesia telah memiliki kerangka hukum melalui KUHP Nasional dan UU ITE, perlindungan terhadap korban kekerasan psikis di dunia maya masih bersifat terbatas dan belum menyentuh akar persoalan. Tulisan ini bertujuan untuk menganalisis ketimpangan perlindungan hukum terhadap korban kekerasan digital, hambatan dalam pembuktian unsur pidana, dan dampak psikologis yang dialami korban. Melalui pendekatan yuridis normatif dan studi perbandingan terhadap sistem hukum di Korea Selatan, Inggris, dan Australia, ditemukan bahwa Indonesia memerlukan regulasi yang lebih eksplisit dan sistem pendukung yang lebih responsif terhadap kebutuhan korban. Penelitian ini merekomendasikan pendekatan hukum yang berbasis korban, pembentukan lembaga pelaporan independen, serta peningkatan kapasitas aparat penegak hukum dalam menangani kekerasan psikis digital secara profesional dan empatik.
