Abstract

Keterbukaan informasi dalam perjanjian perdata memainkan peran krusial dalam menciptakan hubungan hukum yang adil, transparan, dan seimbang. Penelitian ini bertujuan untuk mengkaji dampak keterbukaan informasi terhadap hak dan kewajiban para pihak dalam perjanjian perdata, serta implikasi hukum yang timbul akibat kurangnya transparansi. Dalam penelitian ini ditemukan bahwa keterbukaan informasi mengurangi risiko sengketa dengan memastikan pemahaman yang jelas tentang kewajiban dan hak yang dimiliki para pihak. Selain itu, keterbukaan informasi juga meningkatkan kepercayaan antara pihak-pihak dalam perjanjian. Sebaliknya, kurangnya keterbukaan informasi berpotensi menyebabkan pelanggaran terhadap prinsip itikad baik, penipuan, eksploitasi, serta berdampak pada kewajiban ganti rugi dan pembatalan perjanjian. Tanggung jawab hukum bagi pihak yang tidak mengungkapkan informasi yang relevan sangat penting untuk menjaga integritas sistem hukum. Penegakan hak pihak yang dirugikan karena kurangnya keterbukaan informasi juga menjadi bagian dari mekanisme perlindungan hukum yang ada. Oleh karena itu, penting bagi setiap pihak dalam perjanjian untuk menyampaikan informasi dengan transparansi agar dapat tercipta keadilan dan kepercayaan dalam transaksi perdata.

Abstract

Tempeh, a traditional Indonesian fermented soybean product, is highly nutritious but under-consumed by children due to its bland appearance and unfamiliar texture. This community service program aimed to enhance elementary school students’ interest in consuming tempeh through a participatory training that introduced character molds into the tempeh-making process. Conducted with 20 students aged 9–11 years, the intervention employed a pretest-posttest design to assess changes in tempeh preferences, knowledge, and willingness to consume and prepare tempeh. Results indicated significant improvements across all indicators: students’ liking of tempeh increased from 35% to 85%, their perception of its visual appeal rose from 25% to 90%, and willingness to try character-shaped tempeh reached 95%. The program not only improved students’ understanding of tempeh’s nutritional benefits but also engaged them in creative, hands-on food preparation that enhanced motivation and enjoyment. The findings support the use of experiential learning and visual food design in child nutrition education. This initiative effectively combined cultural food preservation with innovative teaching strategies. It demonstrates that integrating fun and creativity into traditional food education can promote healthier eating habits and strengthen local food identity among young learners. Future programs should consider scaling up and incorporating family and school-level involvement to achieve a broader and more sustainable impact.

Abstract

Lingkungan hidup adalah suatu sistem yang saling terikat dan harus dijaga keseimbangannya, baik dari perspektif ekologi maupun ajaran Islam. Dalam pandangan Islamic Environmental Justice, keseimbangan (mizan) menjadi prinsip utama dalam pemanfaatan sumber daya alam untuk menghindari eksploitasi berlebihan yang dapat merusak ekosistem. Penelitian ini menyoroti pengelolaan sampah di Kota Palangka Raya, khususnya pelaksanaan kebijakan bank sampah dan efektivitas platform digital Info Bang Apul dalam meningkatkan kesadaran masyarakat terhadap pengelolaan sampah. Metode yang digunakan adalah pendekatan empiris dengan data kuantitatif, didukung oleh data kuesioner yang diperoleh dari 136 responden. Hasil penelitian mengungkapkan bahwa meskipun telah terdapat aturan seperti Undang-Undang Nomor 18 Tahun 2008 tentang Pengelolaan Sampah dan Peraturan Walikota (Perwali) Kota Palangka Raya Nomor 20 Tahun 2019 tentang Kebijakan Pengelolaan Sampah, pelaksanaannya masih menghadapi berbagai kendala. Kendala utama adalah rendahnya pemahaman dan keterlibatan masyarakat dalam pengelolaan sampah. Jika ditinjau dari perspektif hukum lingkungan dan keadilan ekologis dalam Islam, kondisi tersebut mencerminkan bentuk ketidakadilan ekologis, di mana masyarakat belum mendapatkan akses yang merata terhadap solusi pengelolaan sampah yang berkelanjutan. Teknologi bank sampah digital seperti Info Bang Apul memiliki potensi dalam meningkatkan efektivitas pengelolaan sampah tetapi masih memerlukan sosialisasi lebih lanjut agar lebih dikenal dan digunakan secara luas oleh masyarakat. Selain itu, perlu adanya peningkatan fitur pada Info Bang Apul guna memberikan informasi lengkap dan menyediakan berbagai layanan untuk meningkatkan partisipasi masyarakat. Penelitian ini merekomendasikan strategi peningkatan pengetahuan masyarakat melalui edukasi serta optimalisasi peran pemerintah dengan sosialisasi. Dengan penerapan prinsip keadilan lingkungan Islam dan penggunaan teknologi digital, diharapkan pengelolaan sampah yang lebih berkelanjutan dapat tercapat di Kota Palangka Raya.   The environment is an interrelated system whose balance must be preserved both from the ecological and Islamic perspectives. From the perspective of Islamic Environmental Justice, balance (mizan) becomes the main principle in the usage of natural resources to prevent excessive exploitation that may damage the ecosystem. This research focuses on analyzing the waste management in Palangka Raya City, Central Kalimantan Province, Indonesia, especially in the implementation of the waste bank policy and the effectiveness of the Info Bang Apul digital platform in increasing society’s awareness of waste management. The method used in this research was the empirical approach with quantitative data, supported by data from questionnaires which were spread to 136 respondents. Results of this research showed that even though there are already regulations such as Law No. 18 of 2008 on Waste Management and the Regulation of the Palangka Raya City Mayor No. 20 of 2019 on the Waste Management Policy, their implementation still faces various obstacles. The main obstacle was society’s lack of understanding and involvement in waste management. If analyzed from the perspectives of environmental law and ecological justice in Islam, such a condition reflects a form of ecological injustice, where society still has not obtained equal access to the solution of sustainable waste management. Digital waste bank technologies such as Info Bang Apul have the potential to increase the effectiveness of waste management. However, there is still a need for further introduction so that society may know and widely use them. Apart from that, there needs to be an increase in Info Bang Apul’s features to provide more comprehensive information and add various services to increase community participation. This research recommends strategies to increase society’s knowledge through education as well as the optimization of the government’s role through program introduction. It is hoped that the application of the Islamic environmental justice principles and the usage of digital technologies may lead to the achievement of more sustainable waste management in Palangka Raya City, Indonesia.

Abstract

This article examines the implementation of inheritance distribution based on the Dayak Ngaju customary law through a case study of Decision Number 056/DKA-KJR/V/2022 by the Customary Court of Kedamangan Jekan Raya, Palangka Raya City. The study adopts a juridical-empirical approach by combining normative legal analysis with field observations on how inheritance disputes are resolved within the community. The findings reveal that inheritance settlement among the Dayak Ngaju people is carried out through a customary court forum known as the Kerapatan Mantir Adat, led by Damang and Mantir (customary judges). The dispute in this case arose when the father (Respondent) sold inherited land without sharing the proceeds with his children (Petitioners) as rightful heirs. The resolution process involved stages from pre-conflict negotiation to formal adjudication, emphasizing the principles of deliberation, consensus, harmony, and justice in accordance with Dayak Ngaju customary values. The final decision of the customary court affirmed gender equality in inheritance rights and mandated a fair and equal distribution of the estate. This study underscores the vital role of customary institutions not only in conflict resolution but also in preserving social harmony and sustaining local wisdom within Indonesia’s pluralistic legal system.

Abstract

Perampasan aset merupakan instrumen penting dalam sistem hukum pidana untuk memastikan bahwa kejahatan tidak memberikan keuntungan kepada pelakunya serta memulihkan kerugian negara dan korban. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta menganalisis regulasi yang berlaku seperti KUHP, KUHAP, dan Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Hasil penelitian menunjukkan bahwa meskipun pengaturan hukum mengenai perampasan aset telah tersedia, implementasinya masih menghadapi sejumlah kendala, seperti celah hukum yang dapat dimanfaatkan oleh pelaku, inkonsistensi putusan pengadilan, lemahnya koordinasi antar lembaga penegak hukum, dan keterbatasan kemampuan aparat dalam menelusuri transaksi keuangan yang kompleks. Selain itu, aspek perlindungan terhadap korban belum mendapat perhatian yang memadai. Oleh karena itu, dibutuhkan penguatan regulasi melalui pengesahan Rancangan Undang-Undang Perampasan Aset, peningkatan kapasitas aparat penegak hukum, serta penguatan kerja sama nasional dan internasional agar perampasan aset dapat lebih efektif menekan ruang gerak tindak pidana pencucian uang sekaligus mewujudkan keadilan substantif.

Abstract

Philanthropy which is a voluntary action aimed at enhancing social welfare, faces significant challenges related to the misuse of funds that can undermine public trust. Regulatory weaknesses, particularly Law No. 9 of 1961, demonstrate inadequacies in accommodating the developments of modern philanthropy, such as digital fundraising. Consumer protection in the context of Civil Law must encompass clear regulations regarding the rights and responsibilities between donors, managers, and beneficiaries, while Constitutional Law emphasizes the need for a robust constitutional framework to oversee philanthropic activities. Collaboration between the state, regulatory bodies, and civil society is crucial for creating a transparent and accountable system. The utilization of Indonesia's demographic and cultural potential, with the value of mutual assistance as a foundation, can support income redistribution and sustainable community empowerment, thereby ensuring that philanthropy effectively contributes to enhancing social welfare.

Abstract

The rapid development of generative Artificial Intelligence (AI) technologies such as OpenAI and Stable Diffusion has created a complex dilemma in copyright protection in Indonesia. Generative AI, which is capable of producing works of art, music, and writing by imitating human artistic styles through the use of training data from various sources without permission, poses a serious threat to the originality of works and the economic well-being of original artists. This study identifies significant legal gaps in Indonesia's legal system, where AI is not recognized as a legal entity under Article 1367 of the Civil Code, the Information and Transactions Law (ITE Law), the Patent Law, the Copyright Law, and Government Regulation No. 71 of 2019, making it difficult to hold AI accountable for copyright infringements it causes. Using a normative legal research method with a legislative and comparative approach, the study identified three main issues: the absence of specific AI regulations, the use of copyrighted data without permission, and productivity disparities that harm original creators. Comprehensive solutions include the creation of specific AI regulations, the implementation of blockchain technology, and the adoption of international best practices to create a sustainable creative ecosystem.

Abstract

The spread of hoaxes through voice manipulation technology, such as voice changers, has become a significant issue in Indonesia in recent years. This technology allows perpetrators to manipulate someone's voice, which is then used to spread false information that can damage an individual's reputation, influence public opinion, and create social unrest. This study aims to analyze the legal aspects related to the misuse of voice changers in the spread of hoaxes, identify the challenges faced in law enforcement, and provide policy recommendations to improve legal protection for hoax victims. The methodology used in this research is normative legal research, with a normative approach focusing on the analysis of the Electronic Information and Transactions Law (UU ITE) and the Personal Data Protection Law (UU PDP), as well as other relevant regulations. The results show that although Indonesia has a sufficient legal framework to address hoax cases involving voice changers, law enforcement still faces challenges in terms of identifying perpetrators, proving voice manipulation, and the lack of more specific regulations. Additionally, victims have the right to legal protection, including compensation and clarification of false information. This study recommends enhancing the capacity of law enforcement, strengthening regulations, and improving digital literacy among the public to address the challenges posed by this technology.

Abstract

Tujuan dari pengabdian kepada masyarakat dengan diadakannya kegiatan sekolah pasar modal bagi mahasiswa Universitas PGRI palangak Raya untuk memberikan pemahaman kepada mahasiswa terkait investasi, sehingga mahasiswa terhindar dari investasi bodong dan judi online. Dalam kegiatan ini juga diinformasikan tentang investasi yang resmi diawasi OJK. Mahasiswa diberi pemahaman tentang jenis pasar modal, cara membeli saham, cara menjual saham yang sudah dibeli, dan cara berinvestasi yang baik dan benar. Analisis deskriptif diketahui pengetahuan responden tentang pasar modal dan instrument investasimasih tergolong rendah, sedangkan pengetahuan responden tentang tingkat keuntungan investasi sudah baik dan pengetahuan responden tentang tingkat resiko investasi sudah bisa dikatakan cukup. Antusias Mahasiswa Universitas PGRI palangka Raya mengikuti kegiatan ini terlihat dari hampir semua peserta membuat akun saham di RHB Tradesmart, dan mulai melirik membeli saham milik BUMN maupun milik swasta.
