Abstract

Pendekatan restorative justice dalam sistem peradilan pidana anak di Indonesia merupakan respon terhadap kebutuhan akan sistem hukum yang lebih humanis dan berorientasi pada pemulihan, bukan sekadar penghukuman. Penelitian ini bertujuan untuk mengkaji peran lembaga hukum dalam mengimplementasikan prinsip keadilan restoratif, khususnya melalui mekanisme diversi dan restitusi sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA) dan Peraturan Pemerintah Nomor 43 Tahun 2017. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan analisis terhadap norma hukum positif dan literatur relevan. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum telah tersedia, implementasinya masih terkendala oleh kurangnya koordinasi antar-lembaga, minimnya pelatihan aparat, keterbatasan infrastruktur, serta resistensi sosial dari masyarakat. Penelitian ini merekomendasikan penguatan kapasitas lembaga hukum, peningkatan koordinasi, dan sosialisasi publik sebagai langkah strategis untuk mewujudkan sistem peradilan anak yang lebih adil dan inklusif.

Abstract

The phenomenon of migrant workers in Indonesia is one of the issues that often cause public unrest. Migrant workers are considered foreign exchange heroes for the country. However, often the problems that afflict these migrant workers are unknown and even untouched while still working or after working as a migrant workers. The purpose of the activity is to provide legal assistance (social advocacy) to the village government and migrant workers to ensure the fulfillment of the rights of migrant workers and increase the capacity of both knowledge and legal information for migrant workers and former migrant workers once a month, provide legal protection information and improve the competence of PMI families and increase the ability and competence of PMI candidates in Sumber Gede Village community every three months. The method used is the Participatory Rural Appraisal (PRA) method. It is carried out in Sumber Gede Village, East Lampung Regency, through the stages of problem identification, activity planning, coordination with partners, implementation of activities, and supervision and evaluation. The exercises are strengthening legal literacy through the socialization of the law. No. 18 of 2017 on the protection of Indonesian migrants and Sumber Gede Village Regulation No. 4 of 2021 on the protection of Indonesian migrants, Gender-responsive Case Management Training and Paralegal Training in case handling for women migrant workers. The result of this activity is to increase competence and knowledge for migrant workers, former migrant workers and migrant workers' families both in terms of regulatory knowledge, legal assistance, and improving entrepreneurial skills.

Abstract

Violations in the electoral process in Indonesia are an issue that often occurs during the electoral process, where the Election Supervisory Body (Bawaslu) is tasked with preventing and taking action related to alleged election violations, not only during the election but also when the vote results have been determined nationally, with the hope of realizing a fair and integrity election. This study aims to describe the limitations of Bawaslu in carrying out its duties fully to oversee the entire series of elections following statutory regulations. This research uses a normative juridical research method through a statutory approach. The results of this study reveal that Bawaslu is unable to fully carry out its duties in taking action against alleged election violations after the determination of the vote until the stage of taking the oath or pledge because there is a legal vacuum in Article 93 letter d of Law Number 7 of 2017 concerning General Elections which outlines that Bawaslu is only tasked with overseeing the implementation of the election until the stage of determining the election results. Law Number 7/2017 on General Elections must be reviewed to provide legal certainty to Bawaslu in carrying out its duties under statutory regulations.

Abstract

Kegiatan ini dilatarbelakangi oleh semakin pentingnya pemahaman mengenai hak kebebasan berpendapat di media sosial sebagai salah satu hak asasi warga negara, khususnya bagi mahasiswa. Mahasiswa, sebagai generasi muda dan pengguna aktif media sosial, perlu dibekali dengan pengetahuan hukum yang memadai agar dapat memanfaatkan kebebasan berpendapat secara bertanggung jawab. Penyuluhan ini bertujuan untuk meningkatkan kesadaran dan pemahaman mahasiswa Universitas PGRI Palangka Raya mengenai batasan dan implikasi hukum dari kebebasan berpendapat di media sosial. Metode yang digunakan dalam kegiatan penyuluhan ini adalah ceramah interaktif yang melibatkan diskusi dan tanya jawab, serta penyebaran materi edukatif melalui media cetak dan digital. Metode yang digunakan adalah penyuluhan melalui pendekatan Service Learning. Hasil dari kegiatan ini menunjukkan bahwa terdapat peningkatan signifikan dalam pemahaman mahasiswa terhadap hak kebebasan berpendapat dan batasan hukumnya di media sosial. Mahasiswa juga menunjukkan kesiapan untuk mengaplikasikan pengetahuan tersebut dalam aktivitas sehari-hari di media sosial. Dengan demikian, penyuluhan hukum ini berhasil menciptakan lingkungan akademik yang lebih sadar hukum dan bertanggung jawab dalam menggunakan media sosial.

Abstract

Penerapan hukum adat dalam pengelolaan sumber daya alam telah menjadi subjek penting dalam upaya pembangunan berkelanjutan. Peluang yang kiranya sangat berkaitan dengan penerapan hukum adat mencakup peningkatan pelestarian lingkungan, pemeliharaan keanekaragaman hayati, dan pemberdayaan masyarakat lokal. Hukum adat juga memberikan landasan bagi praktik-praktik pengelolaan yang berkelanjutan, memungkinkan adaptasi terhadap perubahan lingkungan, dan mempromosikan ketahanan lokal. Namun, penerapan hukum adat juga dihadapkan pada sejumlah tantangan. Sehingga penelitian ini bertujuan untuk mengetahui bagaimana seharusnya masyarakat adat mendapatkan perlindungan hak terhadap tantangan utama sulitnya mendapatkan pengakuan dan perlindungan hukum terhadap Hutan Adat sebagai sumber daya alam di Kalimantan Tengah menurut perspektif hukum adat. Menurut hasil penelitian, konflik kepentingan antara masyarakat adat dan pihak-pihak lainnya seperti pemerintah, serta ketidaksesuaian dengan kerangka hukum nasional menjadi pemicu permasalahan antara Masyarakat adat dan pemerintah. Dalam konteks pembangunan berkelanjutan, pemerintah seharusnya memegang kepentingan untuk memperkuat pengakuan dan perlindungan hukum terhadap hukum adat, serta memperkuat keterkaitan antara hukum adat dan hukum formal. Langkah-langkah tersebut dapat menciptakan kerangka kerja yang inklusif dan berkelanjutan bagi pengelolaan sumber daya alam, yang menghargai pengetahuan lokal, mendorong partisipasi masyarakat, dan memperkuat resiliensi ekosistem dalam rangka pengelolaan dan pemanfaatn hutan adat sebagai Upaya Pembangunan Berkelanjutan.

Abstract

Ketentuan Pasal 4 UU No. 39 Tahun 1999 tentang HAM yang di dalamnya menyebutkan bahwa hak hidup merupakan non derogable rights secara horizontal bertentangan dengan KUHP dan sejumlah UU di luar KUHP yang mencantumkan ancaman pidana mati. Konflik norma ini mencerminkan tidak adanya relevansi di antara aturan yang memberlakukan pidana mati dengan aturan yang menyebutkan bahwa hak hidup adalah non derogable rights. Menanggapi adanya konflik norma tersebut, perlu dikaji pengaturan pidana mati dan hak hidup sebagai non derogable rights dalam perspektif ius constituendum. Jenis penelitian ini yakni penelitian Hukum normatif dengan metode pendekatan statute approach, historical approach, dan conceptual approach. Hasil dan pembahasan bahwa kedepan tentang pidana mati masih dipertahankan, sehingga perlu melakukan perubahan UUDN RI Tahun 1945 dengan menambahkan ketentuan pasal yang menyatakan bahwa pidana mati tidak bertentangan dengan hak hidup sebagai non derogable rights. Selain itu, dalam KUHP baru eksistensi pidana mati tetap dipertahankan, tetapi pengaturannya dilakukan secara khusus (eksepsional).

Abstract

This community service activity was carried out by the Faculty of Law, University of Palangka Raya, at SMK Negeri 2 Palangka Raya as an effort to enhance legal awareness among students. The background of this program lies in the increasing legal issues related to digital crimes and the urgent need for students to understand their legal rights and obligations in everyday life. The rapid growth of digital technology has led to an increased risk of cybercrimes, such as online fraud, cyberbullying, and data privacy violations, which have significant implications for individuals, particularly students. The main objective of this activity is to provide students with a comprehensive understanding of cybercrime, misuse of information technology, and the importance of responsible behavior in using social media. The methods applied in this program include interactive lectures, group discussions, case studies, and role-playing simulations, which encouraged students to actively participate in the learning process. The results indicated that students were able to grasp the fundamentals of laws related to cybercrime, recognize the potential dangers of irresponsible technology use, and demonstrate improved critical attitudes in responding to possible legal issues in daily activities. Furthermore, the program strengthened collaboration between the academic environment and vocational schools in building a young generation with strong legal awareness. In conclusion, interactive-based legal counseling proved effective in fostering legal awareness values among students, helping them make informed decisions in their digital interactions

Abstract

Climate change is an urgent global challenge requiring innovative approaches to environmental management. One such approach that is gaining traction is the green economy, which integrates economic growth with ecological sustainability. This research aims to analyze the legal construction of the green economy in the context of environmental management in Indonesia, particularly in addressing the impacts of climate change. This study employs a normative legal research method with legislative and conceptual approaches, exploring national regulations such as Law No. 32 of 2009 on Environmental Protection and Management, as well as policies related to a low-carbon economy, including carbon taxes and renewable energy incentives. The findings indicate that although relevant regulations exist, their implementation still needs to be improved, such as the lack of economic incentives for businesses to transition to environmentally friendly practices and weak law enforcement. Within the framework of the green economy, there is a need to strengthen legal instruments that promote innovation, investment, and cross-sector cooperation. This study recommends further integration of environmental and economic policies through a progressive legal approach, which emphasizes not only the mitigation of climate change impacts but also the protection of the rights of vulnerable communities and ecological justice. Thus, the legal construction of the green economy can become a key pillar in building sustainable environmental management in the era of climate change.

Abstract

Meaningful participation in law formation is a crucial aspect of a democratic country. The existence of this participation not only reflects the voice of the people but also increases the legitimacy of the resulting law. A legislative process that involves the community can create rules that are more responsive and in line with community needs. In this context, this research discusses meaningful participation practices in Indonesia, South Africa, and the United States. Each country has different approaches and mechanisms for involving the public in the legislative process. The research method used is normative legal research with a statutory approach and a comparative legal approach. Through this approach, the study analyzes the laws and regulations governing public participation and identifies best practices from each country. The research results show that South Africa implements an effective public consultation system, where the public can provide direct input in the discussion of draft laws. Meanwhile, the United States has a structured participation mechanism, including public hearings and gathering input from various stakeholders, thereby creating a space for constructive dialogue between policymakers and the public. On the other hand, Indonesia still faces challenges in ensuring meaningful participation, despite efforts through public discussion mechanisms. These findings suggest the need to improve participation mechanisms in Indonesia to optimize the quality of democracy and legal legitimacy. Apart from that, support from the government and society is needed to create a stronger culture of participation, so that every individual feels they have a role in the legislative process. Abstract

A clear national insight can guarantee the achievement of national interests, both internally and externally. This means that national insight provides a clear picture and direction for the nation's survival, as well as the future development of the nation and state. The organization of national and state life must proceed on the basis of mutual agreement, namely Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia (NKRI), and Bhinneka Tunggal Ika (Unity in Diversity). Indonesia's existence as a state based on the rule of law (rechtstaat) based on Pancasila and the 1945 Constitution requires the development of Pancasila ideology and national insight as instruments that serve as catalysts or drivers in strengthening national insight and spirit, love of the homeland, democracy, legal awareness, respect for diversity, and participation in building a Pancasila-based nation in Wonogiri, especially among intellectuals. In accordance with its function, the Pancasila Ideology and National Insight Development organizes national, democratic, legal, multicultural and citizenship education to support the realization of citizens who are aware of their rights and obligations, as well as intelligent, skilled and have character so that they can be relied upon to build the nation and the Unitary State of the Republic of Indonesia.
