Abstract

Pandemi Covid-19 telah mempengaruhi segala aspek kehidupan masyarakat termasuk sistem peradilan. Eksistensi E-Court sebagai sistem peradilan diharapkan dapat menjadi solusi ditengah pembatasan aktivitas oleh pemerintah. Penelitian ini adalah penelitian kualitatif deskriptif dengan menggunakan pendekatan yuridis dan normatif syar’i. Hasil penelitian ini menunjukkan bahwa Pengadilan Tata Usaha Negara Makassar telah menerapkan sistem E-Court secara efektif, meskipun mengalami beberapa kendala, seperti terbatasnya tahapan persidangan yang dapat dilakukan melalui aplikasi dan sarana dan prasarana pendukung. Dalam konsep siyasah syar’iyyah, pemanfaatan E-Court merupakan instrumen untuk memberikan kemudahan, sekaligus sebagai upaya untuk mengurangi interaksi para pencari keadilan ditengah wabah covid-19, sehingga penerapan sistem tersebut telah bersesuaian dengan prinsip maslahat.

Abstract

The main problem in this study is that there is a dispute between the land owner and the cultivator so that conflicts often occur because the agreement from the beginning was not appropriate at the time of the harvest agreement, and how is the perspective of the Hanbali School regarding profit sharing in agricultural cooperation in Bontoramba village, Pallangga District, Gowa Regency. The main problems that will be described from the sub-problems are: (1) what is the form of agricultural cooperation carried out by Bontoramba Village, Pallangga District, Gowa Regency? (2) how is the agricultural product sharing system between land owners and cultivators in Bontoramba Village, Pallangga District, Gowa Regency? (3) how is the application of profit sharing in agricultural cooperation according to the Hanbali school in Bontoramba Village, Pallangga District, Gowa Regency? The type of research used is qualitative research or method (field research), namely research that provides a qualitative picture which focuses on field research methods and connects with the Hanbali school. This research is sourced from secondary data and primary data by mananging primary data sourced from interviews with local communities in Bontoramba Village, Pallangga District, Gowa Regency. From the research conducted, the results show that: (1) the from agricultural cooperation carried out in Bontoramba Village is in the from of entering into an agreement with each other in writing or verbally with the presenee of witnesses who witnessed the agreement. (2) the agricultural product sharing system between cand voters and cultivators in accordance with the agreed rules, if the land owner finances all the planting to harvesting processes, the distribution of the results is shared by the land owner, but if the cultivator finances everything and the land owner only receives it. The it is the cultivator who divides the distribution of the harvest. (3) the application of profit sharing in agricultural cooperation, there are rules that are carried out because thare are often disputes with each other at the time of sharing the results due to the lack of trust in each other, then it is applied with a written agreement with the presence of witnesses and involves in the profit sharing of the farmer so as not to there is another disputeAdapun jenis penelitian yang digunakan adalah penelitian kualitatif atau metode (fiel receacrh) yaitu penelitian yang memberikan gambaran secara kualitatif dimana memfokuskan pada metode penelitian lapangan serta menghubungkan dengan mazhab hanbali. Penelitian ini bersumber dari data sekunder dan data primer dengan mengelola data primer yang bersumber dari wawancara masyarakat setempat di Desa Bontoramba Kecamatan Pallangga Kabupaten Gowa.Dari penelitian yang dilakukan, hasil menunjukkan bahwa: (1) Bentuk kerjasama pertanian yang dijalankan di Desa bontoramba dalam bentuk mengadakan suatu perjanjian satu sama lain dengan tertulis atau secara lisan dengan adanya saksi yang menyaksikan suatu perjanjian tersebut. (2) sistem bagi hasil pertanian antara pemilih lahan dan penggarap sesuai dengan aturan yang telah di sepakati jika pemilik lahan yang membiayai semua proses tanam sampai panen maka pembagian hasilnya di bagi oleh pemilik lahan, tetapi jika penggarap yang membiayai semuanya dan pemilik lahan hanya terima jadi maka sih penggarap lah yang membagi pembagian hasil penen. (3) Penerapan bagi hasil dalam kerjasama pertanian adanya aturan yang dilakukan karena sering terjadi perselisihan satu sama lain di saat pembagian hasil dikarenakan tidak adanya kepercayaan satu sama lain, maka di terapkannya dengan perjanjian tertulis dengan adanya saksi dan melibatkan dalam bagi hasil partanian tersebut supaya tidak adanya lagi perselisihan yang terjadi

Abstract

The purpose of this research is to find out the views of Islamic law on the behavior of endorsement service providers. This research uses a qualitative research type, with data collection using the library research method, the approach used is normative by studying the Qur'an and hadith as the basis of Islamic law while the data source Primary data are in the form of the Koran and Hadith, while secondary data are journal books, with deductive conclusions drawn. The results of the study show that the deviant behaviors carried out have different laws according to Islamic provisions. As for behavior such as excessive promotion and using language that is impolite and harsh, the law was originally clearly not allowed (haram), but if it is brought into the context of muamalah, the law on it may be permissible (permissible) as long as the behavior has a clear reason, such as because of elements of a promotional strategy, and as long as no one is harmed by the behavior. As for behavior such as lying, committing elements of fraud, tabarruj, and dropping other products, in the view of Islam the law is certainly not permissible (haram) because it has deviated from the provisions of Islamic sharia.

Abstract

Pokok masalah penelitian ini adalah bagaimana tinjauan Maqashid al-Syariah terhadap perceraian karena faktor ekonomi serta bagaimana pandangan seorang majelis hakim dalam memutuskan perkara perceraian yang dipicu oleh faktor ekonomi selama Pandemi ini. Penelitian ini menggunakan metode penelitian kualitatif (lapangan) dan jenis penelitiannya menggunakan metode library research (kepustakaan). Teknik pengumpulan data yang digunakan menggunakan teknik dokumentasi seperti observasi, wawancara, berkas-berkas serta dokumen yang diperlukan yang berkaitan dengan data perkara perceraian yang diperoleh dari web Pengadilan Agama Jeneponto. Selain itu buku, jurnal, skripsi dan sebagainya juga menjadi metode pengumpulan data yang digunakan. Hasil penelitian ini menunjukkan bahwa menurut Maqashid Syariah dalam perlindungan al-daruriyat terbagi menjadi lima bagian yakni: Hifz al-Din, Hifz al-Nafz, Hifz al-Aql’, Hifz al-Nasl dan Hifz al-Mal. Maka Hifz al-Nasl, Hifz al-Din dan Hif al-Aql dalam konsep Maqashid al-Syariah dapat dijadikan sebagai alasan perceraian karena telah mencederai ketiga perlindungan itu. Selanjutnya pertimbangan majelis hakim dalam memutuskan perkara perceraian karena faktor ekonomi itu tidak memutuskan perkara cerai dengan murtadnya tetapi memutuskan perkara cerai berdasarkan pada Undang-undang yakni pasal 39 UU No.1/1974 jo. Pasal 19 Peraturan Pemerintah Nomor 9 tahun 1975 tentang alasan-alasan perceraian dan Pasal 116 Kompilasi Hukum Islam.

Abstract

Penelitian ini menguraikan tentang Konsep Ihtikar Terhadap Minyak Goreng (Studi Komparatif Empat Mazhab)” dengan tujuan penelitian ini adalah untuk mengetahui faktor yang menyebabkan sehingga terjadinya penimbunan minyak goreng, untuk mengetahui pandangan empat imam mazhab tentang konsep Ihtikar minyak goreng. Untuk mengetahui kasus penimbunan minyak goreng. Dalam menjawab permasalahan tersebut, penulis menggunakan teologi normatif (syar’i) dan yuridis. Penelitian ini tergolong library research (penelitian pustaka), data yang dikumpulkan dengan menggunakan data pustaka berupa buku, jurnal, artikel-artikel baik dalam media elektronik maupun media cetak sebagai datanya, kemudian menganalisa isi terhadap literatur yang menyangkut dengan masalah yang dibahas, kemudian mengulas dan menyimpulkannya. Hasil penelitian ini menunjukkan bahwa para ulama empat mazhab, baik Syafi’iyah, Hanabilah, dan Malikiyah melarang kecuali Hanafiah yang memakruhkan penimbunan barang dagangan, terutama yang berhubungan dengan bahan-bahan makanan dan bahan pokok masyarakat umum, yang dapat menimbulkan madharat atau kerugian bagi ekonomi masyarakat.

Abstract

The dismantling and removal of the skeleton raises new questions about its capabilities. The main problem in this study is how the law of Transfer of Corpses with a comparative approach between the views of the Al-Shafi'i and Hanbali Schools. The purpose of this study was to find out the Law of Transfer of Corpses with a comparative approach between the views of the Al-Shafi'i and Hanbali Schools. This research uses a type of qualitative research (Library Research), with primary and secondary data sources where primary data uses literature such as books, journals of scientific papers in the form of theses, theses, data information and websites and uses a comparative normative approach in analyzing data and using content analysis and conclusion making and using deductive conclusion drawing methods. The results showed that Imam Shafi'iyah argued that moving a dead body before burial from the place of death to another place was haram, even though the smell of the corpse was guaranteed not to change, unless they used to bury the bodies outside their area. Imam Hambali argued that even moving a body from the place of death to a distant place was okay on the condition that the transfer was done for the right purpose.

Abstract

Association is the need of every living being, especially humans as social beings who need each other, so that association will occur every day between fellow living beings. Association is a process of interaction carried out by individuals with other individuals, it can also be by individuals with groups. Because human beings are naturally social beings who cannot live alone without other beings, so to meet the needs of life and their interests, humans always live in society. Shari‟at Islam has set good sociability procedures and boundaries in association, both between individuals and groups, both same-sex and opposite-sex. There are strong boundaries in Islamic shari'a. . The purpose of this study is to explore and refer to the law of ikhtilat the perspective of classical and contemporary scholars. The research method used is field research which is qualitative. The data sources used are sourced from primary and secondary data. The result of this study is that Ikhtilat at its origin is allowed by syara', but with some conditions. If not, then it is difficult for human life all day long. However, we need to distinguish between justified and forbidden ikhtilats. Ikhtilat, as we mentioned earlier, the law of origin is mubah (must) to facilitate human life. There is no obstruction to him unless he leads to an illegitimate matter.

Abstract

Child marriage is always motivated by various things or commonly referred to as factors, this factor is what encourages a child to marry or want to marry under the age of the provisions that already exist in legislation Number 16 of 2019 concerning marriage, namely in article 7 paragraph 1 which states that those who are allowed to marry when they reach the age of 19 years. Low marriage education is one of the factors for child marriage, which increases every year. In terms of child marriage, one of the factors that influence the occurrence of child marriage is not in accordance with the provisions of Law Number 16 of 2019 concerning marriage, namely the age of 19 years namely due to a lack of knowledge about child marriage, such as a lack of understanding of the impacts that will result from a marriage, both good and bad impacts. This research uses a field methodology (Field Research), namely research that has been carried out by being directly on the object, especially in an effort to collect data and information. And the type of research used is qualitative research. The implication of this research is that underage marriages that occur in Sungguminasa Regency, they are forced to marry due to several factors such as pregnancy outside of marriage, promiscuity, economy, education, custom, arranged marriage and their own desires this is due to lack of supervision and lack of interest in education so that quarrels and violence occur.

Abstract

ABSTRACT The  research was  conducted at  the  Sugar Mill  Plantation PTPN Camming, District Libureng, Bone, and continued at the Laboratory of Plant Pests and Diseases. The purpose of this study was to determine the fitofag insects associated with sugarcane (S. officinarum L.) plants at several age levels. Research method was made using several kinds of traps namely Pitfall traps, nets, traps and direct observation of yellow adhesive. Observations were made as many as 8 times, with an interval of 3 days. The research results showed that fitofag insects that were found in sugar cane plantation were dominated by Bactrocera spp (Tepritidae; Diptera), and  the  lowest insect was Family Pyralidae (Lepidoptera). Insects which were categorized as pest in sugarcane crop were Locusta sp. (Orthoptera), Wereng (Cicadellidae; Homoptera), C. lanigera (Pseudococcidae; Homoptera), Pyralidae (Lepidoptera), Gryllidae (Orthoptera), and Curculionidae (Coleoptera). Keywords: Sacharum officinarum L., phytofag insects, diversity of population

Abstract

The implementation of Zuhur prayer after Jumat prayer is not a common thing in all the mosques. Generally, Muslims would not perform the Zuhur prayer after Jumat prayer if the series of both pillar and term of the prayer as well as the Khutbah has been completed (perfect). However, in several mosques located in Kasuarrang area would perform the Zuhur prayer after the Jumat prayer. Thus, this case has inspired the researchers to deepen the understanding towards the case in the mentioned area. This research aims to find out the reasons of people to perform Zuhur prayer after Jumat prayer in the Kasuarrang Neighbourhood, Allepolea village, Lau district, Maros regency, Indonesia and also to find out the views of the Khalwatiyah Samman order regarding this matter. This research is a field research that implements in descriptive-qualitative method. Furthermore, this research applies observation, interview and documentation methods with a historical approach in understanding hadist. The result of this research found that the reason on the why people in Kasuarrang neighbourhood perform Zuhur prayer after Jumat prayer is because they follow the example of their parents who always perform it. Their parents used to be followers of the Tarekat Khalwatiyah Samman that has been becoming an internal recommendation for its followers. This tarekat believes that the Zuhur prayer and the Jumat prayer are obligatory prayers that are independent of each other and therefore, the Jumat prayer does not replace the Zuhur prayer, so both must still be performed on Friday. It differs from the view of the four madhhabs. They agreed that the Jumat prayer is a substitute for the Zuhur prayer on Friday. Hence, the Zuhur prayer should not be conducted after the Jumat prayer. However, the Imams allow Zuhur prayer on Friday if some of the requirements and pillars of the Jumat prayer are missing. ملخّص أداء صلاة الظهر بعد صلاة الجمعة ليس أمرا شائعا في المساجد. بشكل عام ، لم يعد المسلمون يؤدون صلاة الظهر بعد صلاة الجمعة عندما تكون سلسلة صلاة الجمعة وخطبتها قد أكملت أركانها وشروطها. ومع ذلك ، تمارس صلاة الظهر بعد صلاة الجمعة في عدة المساجد التي تقع في بيئة كاسوارانج، حي ألبوليا، ناحية لاو، منطقة ماروس، ماروس ريجنسي. لذلك ، فإنه يشجع الباحثين على معرفة المزيد عن أداء صلاة الظهر بعد صلاة الجمعة في المكان. يهدف هذا البحث إلى معرفة أسباب المجتمع في المكان لأداء صلاة الظهر بعد صلاة الجمعة في بيئة كاسوارانج، حي ألبوليا، ناحية لاو، منطقة ماروس، ويهدف أيضًا إلى معرفة آراء جماعة طريقة خلواتية السمان في هذا الشأن . هذا البحث هو بحث ميداني. البحث المستخدم في هذه المشكلة هو بحث وصفي نوعي. يستخدم هذا البحث أساليب الملاحظة والمقابلات والتوثيق. بمقاربة تاريخية في فهم الحديث توصلت نتائج هذا البحث إلى أن سبب قيام الناس في حي كاسوارانج بأداء صلاة الظهر بعد صلاة الجمعة هو أنهم يتبعون آبائهم الذين يقومون بها دائمًا. وكان آباؤهم في السابق من أتباع طريقة خلواتية السمان. وهذه توصية داخلية لأتباعها. وذهبت هذه الجماعة إلى أن صلاة الظهر وصلاة الجمعة صلاة فرضية مستقلة. وهذا يعني أن صلاة الجمعة لا تغني عن صلاة الظهر، فيجب الاستمرار في أداءهما يوم الجمعة. وهذا بخلاف آراء أئمة المذهب الأربعة. ويزعمون أن صلاة الجمعة هي بدل صلاة الظهر يوم الجمعة. ولذلك لم تعد صلاة الظهر تُقام بعد صلاة الجمعة. ومع ذلك، فإن هؤلاء الأئمة يسمحون بصلاة الظهر في أيام الجمعة إذا كانت هناك عدة متطلبات شرعية ومتناغمة لصلاة الجمعة التي تم تركها. الكلمات المفتاحية: طريقة خلواتية السمان، صلاة الظهر، صلاة الجمعة، بيئة كاسوارانغ، منطقة ماروس Abstrak Pelaksanaan salat zuhur setelah salat jumat bukan merupakan hal yang umum terjadi di masjid-masjid. Pada umumnya, umat Islam tidak lagi melaksanakan salat zuhur setelah salat jumat ketika rangkaian pelaksanaan salat dan khutbah jumat telah sempurna rukun dan syaratnya. Namun, salat zuhur setelah salat jumat dipraktikkan di beberapa masjid yang ada di Lingkungan Kasuarrang, Kelurahan Allepolea, Kecamatan Lau, Kabupaten Maros, Indonesia. Maka dari itu mendorong peneliti untuk mengetahui lebih jauh tentang pelaksanaan salat zuhur setelah salat jumat di tempat tersebut. Peneitian ini bertujuan untuk mengetahui alasan masyarakat di daerah tersebut melaksanakan salat zuhur setelah salat jumat di Lingkungan Kasuarrang, kelurahan Allepolea, kecamatan Lau, kabupaten Maros, Indonesia dan juga untuk mengetahui pandangan Tarekat Khalwatiyah Samman terkait hal tersebut. Penelitian ini merupakan penelitian lapangan. Metode yang digunakan dalam penelitian ini adalah metode kualitatif deskriptif. Penelitian ini menggunakan metode observasi, wawancara dan dokumentasi, dengan pendekatan historis dalam memahami hadis. Hasil penelitian menemukan bahwa alasan masyarakat di Lingkungan Kasuarrang melaksanakan salat zuhur setelah salat jumat karena mereka mencontoh orang tua mereka yang selalu melaksanakannya. Adapun dahulu orang tua mereka merupakan pengikut Tarekat Khalwatiyah Samman. Hal ini merupakan anjuran internal bagi para pengikutnya. Tarekat ini berpandangan bahwa salat zuhur dan salat jumat merupakan salat fardhu yang mustaqillah (berdiri sendiri). Hal ini berarti bahwa salat jumat tidak menggantikan salat zuhur, maka keduanya harus tetap dilaksanakan pada hari jumat. Hal ini berbeda dengan pandangan para imam empat madzhab. Mereka berpendapat bahwa salat jumat merupakan pengganti dari salat zuhur pada hari jumat. Oleh karena itu, salat zuhur tidak dilaksanakan lagi setelah melaksanakan salat jumat. Namun, Para imam tersebut membolehkan salat zuhur pada hari jumat jika ada beberapa syarat sah dan rukun salat jumat yang tertinggal. Kata Kunci: Tarekat Khalwatiyah Samman; Salat Jumat; Lingkungan Kasuarrang; Kabupaten Maros.
