Abstract

This study aims to analyze the implementation of accessibility rights fulfillment for inmates with disabilities at the Class IIA Correctional Institution in Parepare City. Persons with disabilities are a vulnerable group requiring special treatment in accordance with human rights principles and national regulations, such as Law Number 8 of 2016 concerning Persons with Disabilities and Law Number 22 of 2022 concerning Corrections. This research employs a normative-empirical method with a statutory and social approach through literature study, observation, and direct interviews with prison officials and inmates with disabilities. The results show that the Class IIA Correctional Institution in Parepare has taken significant steps to fulfill accessibility rights, such as providing special shuttle services, rooms with sitting toilets, separation of inmates with disabilities, intensive care, and wheelchair facilities. In addition, there is collaboration with the Health Office, Ministry of Social Affairs, and other agencies to support optimal services. However, there are still shortcomings, such as the unavailability of hearing aids for inmates with hearing impairments. In general, the Class IIA Correctional Institution in Parepare demonstrates a commitment to providing inclusive and non-discriminatory services, including the right to interact with other inmates. These findings highlight the importance of continuous improvement to create a disability-friendly correctional environment.

Abstract

This study investigates the public understanding and practical realization of post-divorce rights for ex-wives and children in Bantaeng Regency, where 379 divorce cases were recorded in 2022. Despite clear legal provisions, many of these rights remain unfulfilled, reflecting a gap between legal rulings and social implementation. The purpose of this research is to examine how the local community perceives and practices the fulfillment of these rights in light of Maqāṣid al-Sharī‘ah, the higher objectives of Islamic law. The findings reveal a significant disconnect between legal provisions and societal behavior. Although the Bantaeng Religious Court implements Supreme Court Circular (SEMA) No. 1 of 2017, which mandates the inclusion of post-divorce obligations (e.g., maintenance of iddah, mut'ah, and child support) in court verdicts, enforcement remains weak. When fathers neglect their responsibilities, mothers are often unaware of their right to request legal execution of these obligations. This research contributes original insights into the socio-legal dynamics of post-divorce justice in rural Indonesia. It highlights the need for broader legal literacy and institutional support. The study recommends that legal authorities and local governments actively disseminate information about SEMA No. 1 of 2017 to ensure post-divorce rights are properly understood and enforced.

The primary issue in this study pertains to the ineffectiveness of administrative sanctions as stipulated in Law Number 8 of 1999 regarding Consumer Protection (UUPK), which remains anchored in the conventional transaction paradigm and has not adequately addressed cross-border and anonymous e-commerce practices. The objective of this research is to conduct a legal analysis of the efficacy of examine administrative punishments within the digital consumer protection framework, highlight normative and institutional obstacles to its execution, and propose alternative legislative changes for responsiveness. The methodology used is normative legal research using a regulatory and conceptual framework, supplemented by a study of secondary literature. Abstract

This research aimed to analyze the realities of sexual harassment survivors in Makassar City, its impact on their lives, and examine the concept of Hifzul ‘Irḍi within the maqāṣid al-syaria as a framework for protecting survivors' honor. This research approach was qualitative, with data collected through in-depth interviews with survivors, legal counselors, and complaint service providers, as well as a review of relevant documents and literature as secondary data. The data was analyzed thematically to identify patterns in survivors' experiences and their relevance to the principles of protection in Islamic law. The results showed that survivors were often reluctant to report due to confusion in determining legal action, concerns about the perpetrator's position of power, and psychological burdens such as anxiety, stress, and deep trauma. Victims also faced a moral dilemma between maintaining the institution's reputation and pursuing justice. Sexual harassment had a significant impact on survivors' lives, not only causing deep emotional wounds but also creating social stigma, discrimination, and isolation that damage their interpersonal relationships. Hifzul ‘Irḍi's analysis emphasized that maintaining honor was an essential right that must be upheld, while the existence of complaint services was a crucial instrument in restoring the dignity of survivors and preventing similar cases in the future. This research recommends strengthening human rights-based policies and the maqāṣid al-syaria to create a safe, responsive, and victim-friendly social ecosystem.
